राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 23 सितम्बर, 2022 /2672-2680.—इस सरकार की दिनांक 01.10.2018 की अधिसूचना संख्या फा. .9/87/2018/गृ.सा./5980 के आंशिक आशोधन में तथा दिल्ली कारागार अधिनियम (2002 का दिल्ली अधिनियम संख्या 2) की धारा 71 की उप-धारा (2) के खंड (xx) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, एतद्‌द्वारा दिल्ली कारागार नियम 2018 में आगे संशोधन करते हैं, अर्थातः- शीर्षक (1) इन नियमों को दिल्ली कारागार (संशोधन) नियम, 2022 कहा जाये।

(2) प्रस्तावित संशोधन संभावित होगा और इस अधिसूचना के शासकीय राजपत्र में प्रकाशन की तिथि से प्रभावी होगा।

2. दिल्ली कारागार नियम, 2018 के नियम 1178 के पष्चात्‌ निम्नलिखित नियम 1178क जोड़ा जाएगाः

कोई भी दोषी, जो सामान्य छूट के लिए पात्र है, अपनी वार्षिक सदाचरण रिपोर्ट के आधार पर, विचाराधीन कैदी

(यूटीपी) के रूप में अपनी कैद की अवधि के दौरान सदाचरण के लिए छूट के अवार्ड के लिए पात्र होगा, जिस मामले में

उसे दोषी ठहराया गया है। विचाराधीन अवधि के दौरान एक वर्ष के लिए वार्षिक सदाचरण रिपोर्ट संबंधित विचाराधीन

कैदी के दोषी ठहराए जाने के बाद एक महीने की छूट अर्जित करेगा।

उन विचाराधीन कैदियों के लिए एक वार्षिक सदाचरण रिपोर्ट दर्ज की जाएगी, जिन्होंने अपनी कैद के पूरे वर्ष में सदाचरण

बनाए रखा है। यह प्रयोग प्रत्येक वर्ष विचाराधीन कैदी की कैद की अवधि के दौरान दोहराया जाएगा। एक वर्ष की गणना

के प्रयोजन के लिए, यह विचाराधीन कैदी के प्रवेश की तारीख से गिना जाएगा, जिसने कोई जेल अपराध नहीं किया है या

जिस तारीख को उसे जेल अपराध के लिए अंतिम बार दंडित किया गया था (चेतावनी के अलावा)। वार्षिक सदाचरण रिपोर्ट

के प्रयोजनार्थ सजा की तारीख से पहले के वर्ष के अंश की गणना नहीं की जाएगी। वार्षिक सदाचरण रिपोर्ट पर जेल

अधीक्षक द्वारा हस्ताक्षर किए जाएंगे।

IX IX- एक विचाराधीन कैदी की वार्षिक सदाचरण रिपोर्ट का रिकॉर्ड सहायक अधीक्षक, विचाराधीन कार्यालय द्वारा रखा जाएगा। संबंधित विचाराधीन कैदी द्वारा अर्जित वार्षिक सदाचरण रिपोर्ट के प्रभाव में अंडरट्रायल रजिस्टर में प्रविष्टियां सहायक अधीक्षक (यूटी कार्यालय) द्वारा विधिवत की जाएंगी, जिस पर संबंधित उप अधीक्षक (जेल) द्वारा विधिवत हस्ताक्षर किए गए हैं। अधीक्षक जेल त्रैमासिक आधार पर विचाराधीन रजिस्टर का निरीक्षण करेगा ताकि यह सुनिश्चित हो सके कि वार्षिक सदाचरण रिपोर्ट के संबंध में आवश्यक प्रविष्टियां विधिवत की जा रही हैं।

4. दिल्ली कारागार नियम, 2018 के नियम 1190 के उप नियम V का विलोपन किया जाएगा।

निम्नानुसार संशोधित की गईः-

NOTIFICATION

Delhi, the 23rd September, 2022

F. No. 18/26/2022-Home(G)/2672-2680.—In partial modification of this Government Notification No. F. 9/87/2018/HG/5980 dated 01.10.2018 and in exercise of the powers conferred by clause (xx) of sub section (2) of the Section 71 of Delhi Prisons Act (Delhi Act No.2 of 2002), the Lt. Governor of National Capital Territory of Delhi is pleased to further amend the Delhi Prison Rules 2018, namely:—

1. Short title and commencement: - (1) These rules may be called the Delhi Prisons (Amendment) Rules, 2022.

(2) The proposed amendment will be prospective and will be effective from the date of publication of this notification in the Official Gazette.

2. The following Rule 1178A shall be added after Rule 1178 of Delhi Prison Rules, 2018:

1178A: Any convict, eligible for ordinary remission, will be eligible for award of remission for the good conduct during his period of incarceration as undertrial prisoner (UTP) also, in the case in which he is convicted, based on his Annual Good Conduct Reports for that period. The Annual Good Conduct Report for a year during the undertrial period will earn one month remission, once the concerned UTP is convicted.

An Annual Good Conduct Report will be recorded for those undertrial prisoners, who have maintained good conduct throughout the year of their incarceration. This exercise will be repeated every year throughout the UTP's period of incarceration. For computation purpose of one year, it will be reckoned from the date of admission of the undertrial prisoner, who has not committed any prison offence or the date on which he was last[PART IV DELHI GAZETTE : EXTRAORDINARY 3 punished (except by way of warning) for a prison offence. The fraction of year preceding the date of punishment will not be reckoned for the purpose of Annual Good Conduct Report. The Annual Good Conduct Report shall be signed by the Jail Superintendent.

3. After sub-rule VIII, the following sub rule IX shall be added in the existing Rule 1194 of Delhi Prison Rules,

2018:

IX. The record of Annual Good Conduct Report of an undertrial prisoner shall be maintained by Assistant Superintendent, Undertrial Office. Entries in the Undertrial Register to the effect of Annual Good Conduct Report earned by the concerned UTP shall be duly made by the Assistant Superintendent (UT office) which is also to be duly signed by the concerned Deputy Superintendent (Jail). The Superintendent Jail shall inspect the undertrial register on quarterly basis to ensure that necessary entries with respect to Annual Good Conduct Report are being duly made.

4. Sub rule V of Rule 1190 of Delhi Prison Rules, 2018 shall be deleted.
