राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 19 अक्तूबर, 2022 .—जबकि, समय-समय पर संशोधित दिल्ली नगर निगम अधिनियम, 1957 तथा उसके अधीन बनाई गई, नियमावली के प्रावधानों के अनुसार दिल्ली की एकीकृत एक नगर निगम की स्थापना के लिए पार्षदों के आम चुनाव द्वारा नगर निगम का गठन करना है।और जबकि, राज्य चुनाव आयोग, राष्ट्रीय राजधानी क्षेत्र दिल्ली, इस बात से संतुष्ट है कि उपरोक्त आम चुनावों में उपयोग हेतु नगर निगम के 250 वार्डों के लिए नई मतदाता सूचियाँ तैयार करने की एवज में राष्ट्रीय राजधानी क्षेत्र, दिल्ली के संबंधित विधान सभा निर्वाचन क्षेत्रों की वर्तमान मतदाता सूचियों को अंगीकार करना उचित होगा, जो उक्त नगर निगम के सभी वार्डों के अंतर्गत आते हैं, और उपरोक्त चुनावों के प्रयोजन के लिए सभी वार्डों से संबंधित हैं तथा ऐसे विधान सभा निर्वाचन क्षेत्रों की मतदाता सूचियाँ जो 01.01.2022 से अर्हक तिथि के रूप में मुख्य चुनाव अधिकारी, दिल्ली सरकार, दिल्ली, द्वारा पुनरीक्षित की जा चुकी हैं तथा तत्समय के लिए लागू हैं। अतः 7050 DG/2022 (1) 2 DELHI GAZETTE : EXTRAORDINARY PART IV] इस आयोग द्वारा उक्त वर्णित वार्डों की नई मतदाता सूचियों को तैयार करने में काफी समय लग सकता है तथा इस संबंध में अतिरिक्त व्यय भी होगा, जिसे आसानी से बचाया जा सकता है। अब इसलिए, दिल्ली नगर निगम (मतदाता सूची की तैयारी) नियमावली, 1975 के नियम 27 के उपबंधों के साथ पठित दिल्ली नगर निगम अधिनियम, 2011 (समय-समय पर संशोधित) दिल्ली नगर निगम अधिनियम, 1957 की धारा-7 ड़ के परन्तुक के अंतर्गत चुनाव आयोग को प्रदा शक्तियों का प्रयोग करते हुए मैं, डॉ. विजय देव, राज्य चुनाव आयुक्त, राष्ट्रीय राजधानी क्षेत्र, दिल्ली, एतद्‌द्वारा निर्देश देता हूँ कि उन विधानसभा क्षेत्रों की मतदाता सूचियाँ, जो वर्तमान में प्रचलित हैं तथा ये दिल्ली नगर निगम के 250 वार्डों से संबंधित हैं, ये दिल्ली नगर निगम के उपरोक्त 250 वार्डों के होने वाले चुनावों के लिए मतदाता सूचियाँ होगीं।

विधानसभा के निर्वाचन क्षेत्रों की उपर्युक्त मतदाता सूचियाँ जिनको "01.01.2022" की अर्हक तिथि के अनुसार पुनरीक्षित किया गया है तथा जो अन्तिम रूप से प्रकाशित कर दी गई हैं, तत्पश्चात्‌ जनप्रतिनिधित्व अधिनियम, 1950 की धारा 22 तथा 23 के अधीन बनाई गई/बनाई जाने वाली परिशिाष्ठ सूचियाँ उक्त आम चुनाव के लिए नामांकन भरने की अंतिम तिथि तक, उक्त संबंधित वार्डों की मतदाता सूचियों का भी हिस्सा बनेंगी, जिन्हें नगर निगम के आम चुनाव के लिए अंगीकार किया गया है।

NOTIFICATION

Delhi, the 19th October, 2022

In supersession of this Commission's notification of even number dated the 31st January 2022,

regarding adoption of electoral rolls of Assembly Constituencies of Delhi for use in general election to the three

Municipal Corporations of Delhi, the following notification is issued by the Commission:-

F. No. 4(2)/SEC/LAW/2022/7240.—WHEREAS general election to the unified single Municipal Corporation of Delhi, is scheduled to be held shortly under the provisions of the Delhi Municipal Corporation Act, 1957 as amended from time to time and the Rules made there- under, to elect councilors to constitute the Municipal Corporation of Delhi,

AND WHEREAS the State Election Commissioner of the National Capital Territory of Delhi is satisfied that instead of preparing fresh electoral rolls for the election of Coucillors of the Municipal Corporation of Delhi as detailed above, it would be sufficient to adopt the electoral rolls of the respective Assembly Constituencies of the National Capital Territory of Delhi, as are comprised within the 250 wards of the Municipal Corporation of Delhi and as have been updated with reference to "1st January, 2022" as the "qualifying date" by the Chief Electoral Officer, Government of NCT of Delhi and are in force for the time being. Thus, preparation of fresh electoral rolls for the above-said wards by this Commission would entail considerable time besides incurring additional expenditure in this respect which can be avoided.

NOW, THEREFORE, in exercise of the powers conferred upon the Election Commission under the proviso to Section 7E of the Delhi Municipal Corporation Act, 1957 as amended from time to time read with Rule 27 of the Delhi Municipal Corporation (Preparation of Electoral Rolls) Rules, 1975, I, Dr. Vijay Dev, State Election Commissioner of the National Capital Territory of Delhi, hereby direct that the electoral rolls of such Assembly Constituencies, for the time being in force and as these relate to the above-mentioned 250 wards of the Municipal Corporation of Delhi, shall be the electoral rolls for the said Municipal Wards, for the purpose of the ensuing general election to the Municipal Corporation of Delhi.

The amendments made/to be made in the above-mentioned electoral rolls of Assembly Constituencies subsequent to the final publication of electoral rolls prepared for the year 2022, under Section 22 and 23 of the Representation of the People Act, 1950, till the last date for filing nominations for the aforesaid general election and as these are being adopted for general election to the Municipal Corporation of Delhi shall also form part of the Electoral Rolls of respective Wards of the said Corporation as have been adopted for use in the above-mentioned general election to the Municipal Corporation of Delhi.
