राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 2 नवम्बर, 2022 I 7492.—जबकि दिल्ली नगर निगम अधिनियम, 1957, जैसा आज तक संशोधित है, की धारा-7 के अंतर्गत दिल्ली नगर निगम के चुनावों का अधीक्षण, निर्देशन एवं नियंत्रण, राष्ट्रीय राजधानी क्षेत्र दिल्ली के राज्य चुनाव आयुक्त में निहित है। राष्ट्रीय राजधानी क्षेत्र, दिल्ली नगर निगम के चुनाव के लिए राजनैतिक दलों (राष्ट्रीय एवं राज्यों) द्वारा प्रायोजित चुनाव लड़ने वाले उम्मीदवारों और निर्दलीय उम्मीदवारों को चुनाव चिन्हों के चुनाव और आवंटन का प्रावधान करना आवश्यक है। दिल्ली नगर निगम अधिनियम, 1957, की धारा-7 (इसके आगे 'अधिनियम' के रूप में संदर्भित) के अधीन प्रदा शक्तियों का प्रयोग करते हुए, दिल्ली नगर निगम (नगर पार्षदों का चुनाव) नियम 2012 के नियम 15 के साथ पठित (इसके आगे 'नियमों' के रूप में संदर्भित) और इस संबंध में इसे सक्षम करने वाले अन्य सभी प्रावधान और इस विषय पर सभी पूर्व अधिसूचनाओं के अधिक्रमण में, राष्ट्रीय राजधानी क्षेत्र, दिल्ली राज्य का चुनाव आयोग एतद्‌द्वारा निम्नलिखित आदेश जारी करता हैः-

(क) इस आदेश को ''दिल्ली नगर निगम चुनाव चिन्ह (आरक्षण एवं आवंटन) आदेश, 2022'' कहा जाएगा। यह दिल्ली नगर निगम के वार्डों के चुनाव के सम्बन्ध में पूरे क्षेत्रों में विस्तारित दिल्ली के उपरोक्त नगर निगम के वार्डों के चुनावों के सम्बन्ध में लागू होता है।

(ख) यह राष्ट्रीय राजधानी क्षेत्र, दिल्ली के राजपत्र में प्रकाशन की तिथि से लागू होगा।

(क) इस आदेश में, जब तक संदर्भ से अन्यथा अपेक्षित न हो, 'आयोग' शब्द का अर्थ राष्ट्रीय राजधानी क्षेत्र, दिल्ली का राज्य चुनाव आयोग है।

(ख) 'नगर निगम'' का अर्थ दिल्ली नगर निगम है। (ग) 'वार्ड' का अर्थ दिल्ली नगर निगम का वार्ड है। (घ) 'राष्ट्रीय दल' का अर्थ है, वह दल जो भारत निर्वाचन आयोग के चुनाव चिन्ह (आरक्षण एवं आवंटन) आदेश 1968 के साथ पठित जन प्रतिनिधित्व अधिनियम 1951 की धरा 29-ए के अधीन भारत निर्वाचन आयोग द्वारा पंजीकृत तथा मान्यता प्राप्त ऐसा दल है, जिसे राष्ट्रीय राजधानी क्षेत्र, दिल्ली में लोकसभा/विधानसभा के निर्वाचन क्षेत्र के चुनाव के लिए राष्ट्रीय राजधानी क्षेत्र, दिल्ली में भारत निर्वाचन आयोग द्वारा आरक्षित चुनाव चिन्ह आवंटित किया गया है।

(ड़) 'दिल्ली राज्य दल' का अर्थ है वह दल जो भारत निर्वाचन आयोग के चुनाव चिन्ह (आरक्षण एवं आवंटन) ओदश 1968 के साथ पठित जन प्रतिनिधित्व अधिनियम 1951 की धरा 29-ए के अधीन भारत निर्वाचन आयोग द्वारा पंजीकृत तथा मान्यता प्राप्त एक ऐसा राज्य दल जिसे लोकसभा/विधानसभा निर्वाचन क्षेत्र के चुनाव के लिए एक आरक्षित चुनाव चिन्ह आवंटित किया गया है।

(च) अन्य 'राज्य पार्टी' का अर्थ है, वह दल जो भारत निर्वाचन आयोग के चुनाव चिन्ह (आरक्षण एवं आवंटन) ओदश 1968 के साथ पठित जन प्रतिनिधित्व अधिनियम 1951 की धरा 29-ए के अधीन भारत निर्वाचन आयोग द्वारा किसी राज्य या राज्यों (दिल्ली के राष्ट्रीय राजधानी क्षेत्र, के अतिरिक्त) उस राज्य में, जिसमें लोकसभा/विधानसभा निर्वाचन क्षेत्र के चुनाव के लिए एक आरक्षित प्रतीक आवंटित किया गया है। (छ) 'अधिनियम' का अर्थ दिल्ली नगर निगम अधिनियम, 1957 जो समय-समय पर संशोधित किया गया है। (ज) 'नियमों' का अर्थ ''दिल्ली नगर निगम (पार्षदों के चुनाव) नियम, 2012'' है। (क) भारत निर्वाचन आयोग राष्ट्रीय राजधानी क्षेत्र, दिल्ली से लोकसभा तथा विधानसभा के चुनावों हेतु, जो राष्ट्रीय दलों को मान्यता प्रदान की गई है तथा भारत निर्वाचन आयोग द्वारा जारी चुनाव चिन्ह III ै, के अनुसार आयोग एतद्‌द्वारा इसके पश्चात्‌ होने वाले राष्ट्रीय राजधानी क्षेत्र, दिल्ली के नगर निगम के चुनावों हेतु उक्त नियम के नियम 15 के प्रावधानों के अंतर्गत उसी रूप में उन्हें मान्यता प्रदान करता है। (ख) इस आयोग ने भी राष्ट्रीय दलों व राज्य दलों के लिए उन्हीं चुनाव चिन्हों को अपनाया है, जिन्हें भारत निर्वाचन आयोग ने राष्ट्रीय दलों के लिए आरक्षित किया है और न कि किसी अन्य चिन्ह को।

(ग) लोकसभा व विधानसभा के चुनावों के लिए भारत निर्वाचन आयोग ने राष्ट्रीय दलों व अन्य प्रत्याशियों (स्वतंत्र) सहित के लिए चिन्हों का जो प्रतिरूप (आकार और रूप) निर्धारित किया है, उन्हें यह आयोग भी दिल्ली के उपरोक्त दिल्ली नगर निगम के आगामी व उससे आगे होने वाले चुनावों के लिए उसी रूप और आकार में अपनाता है और निर्धारित करता है।(ऐसे राष्ट्रीय दलों के नाम व निर्धारित चिन्हों की सूची का विवरण क्रमशः अनुसूची-I और II में संलग्न सारणी I में दर्शाया गया है)।

(घ) भारत निर्वाचन आयोग द्वारा राष्ट्रीय राजधानी क्षेत्र, दिल्ली के लिए आम आदमी पार्टी को दिल्ली राज्य दल की मान्यता प्रदान की है तथा ''झाड़ू'' चुनाव चिन्ह का आवंटन किया है। जिसे इस आयोग द्वारा भी उक्त नियम 15 के अंतर्गत उल्लेखित चुनाव के लिए अपनाया गया है।

(ड़) अन्य प्रत्याशियों (स्वतंत्र) द्वारा चयन करने के लिए स्वतंत्र चिन्हों की सूची भी उपरोक्त अनुसूची I की सारणी III में दर्शायी गई है। जिसे इस आयोग द्वारा भी उक्त नियम 15 के अंतर्गत उल्लेखित चुनाव के लिए अपनाया गया है।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 (क) दिल्ली नगर निगम के चुनाव लड़ रहे प्रत्येक प्रत्याशी का नियमावली में दिए गए प्रावधानों तथा उपरोक्त आदेश तथा इस संबंध में आयोग द्वारा समय-समय पर जारी निर्देशों के अनुसार चुनाव चिन्ह आवंटित किया जाएगा।

(ख) राष्ट्रीय दल द्वारा दिल्ली नगर निगम के वार्ड के चुनाव के लिए नामित किया गया प्रत्याशी उसी चुनाव चिन्ह का चयन करेगा और वही चिन्ह उसे आवंटित किया जाएगा, जो उस दल के लिए भारत निर्वाचन आयोग द्वारा आरक्षित है, न कि कोई अन्य चिन्ह।

(ग) यदि दिल्ली नगर निगम के किसी वार्ड के चुनाव के लिए कोई प्रत्याशी ऐसे राज्य दल द्वारा नामित किया जाता है, जो राष्ट्रीय राजधानी क्षेत्र, दिल्ली में भारत निर्वाचन आयोग द्वारा मान्यता प्राप्त नहीं है और वह ऐसे चुनाव चिन्ह का इच्छुक है अथवा चयन करना चाहता है जो उस दल के लिए उस राज्य या राज्यों में आरक्षित है, जहां वह दल मान्यता प्राप्त राज्य दल है (अनुसूची I में सारणी II देखें) तो अन्य प्रत्याशियों को छोड़कर वह चिन्ह केवल उस प्रत्याशी को निम्न शर्तों को पूरा करने पर आवंटित कर दिया जाएगा। (i) दिल्ली नगर निगम के चुनावों के लिए ऐसे राज्य दल द्वारा उनके नामित अभ्यर्थी को उसी दल के लिए आरक्षित चुनाव चिन्ह को आवंटन करने के लिए उस दल द्वारा आयोग को चुनाव का आह्‌वान करने हेतु राजपत्र में प्रकाशित अधिसूचना की तिथि के तीन दिन के अन्दर आयोग में आवेदन करना होगा।

(ii) उक्त अभ्यर्थी ने अपने नामांकन पत्र में यह घोषणा की है कि वह दिल्ली नगर निगम के वार्ड के चुनाव हेतु उस दल द्वारा खड़ा किया गया है तथा दल ने इस आदेश के पैरा 5 के खंड (ख) (ग) (घ) तथा (ड़) की अपेक्षाओं को भी पूरा कर लिया है।

(iii) आयोग की राय में ऐसे आवंटन के आवेदन को अस्वीकार करने के लिए उचित आधार नहीं है। (iv) यदि भारत निर्वाचन आयोग के आदेशानुसार एक ही समान 'आरक्षित' चिन्ह को एक से अधिक राज्य दलों के प्रत्याशी उसी 'आरक्षित' चिन्ह का चुनाव करते हैं, उस स्थिति में लॉटरी द्वारा राज्य दल के उम्मीदवार को आरक्षित चिन्ह आवंटित किया जाएगा तथा किसी अन्य पद्धति द्वारा नहीं। शेष समस्त या कोई भी राज्य दल जिसका उम्मीदवार उपरोक्तानुसार स्पष्ट की गई पद्धति के अनुरूप 'आरक्षित चिन्ह' प्राप्त नहीं करता तो उसे निर्दलीय उम्मीदवारों से ऊपर प्राथमिकता देकर निर्वाचन अधिकारी उसकी पसंद का 'स्वतंत्र चुनाव चिन्ह' आवंटित करेगा।

(v) राष्ट्रीय पार्टी तथा दिल्ली राज्य की मान्यता प्राप्त पार्टी के प्रत्याशियों को नामांकन पत्र में एक प्रस्तावक से फाईल करना होगा तथा उनके लिए चुनाव चिन्ह की पसंद जो उनके नामांकन पत्र में भरी गई है, वह भारत निर्वाचन आयोग द्वारा उस दल के लिए किए गए आरक्षण तक ही प्रतिबन्धित होगी।

(vi) राज्य दलों (दिल्ली राज्य दल को छोड़ कर) द्वारा नामित प्रत्याशियों को अपने नामांकन पत्रों में दस (10) प्रस्तावक लेने होंगे और उनकी चुनाव चिन्ह की पसंद जो उनके नामांकन पत्र में दर्शाई गई हो, भारत निर्वाचन आयोग द्वारा उस राज्य या राज्यों में मान्यताप्राप्त उस दल के लिए आरक्षित चुनाव चिन्ह तक सीमित होगी।

(घ) भारत निर्वाचन आयोग द्वारा पंजीकृत अमान्य राजनैतिक दलों के उम्मीदवारों को सभी प्रयोजनों के लिए वांछित प्रस्तावकों की संख्या जोकि 10 है तथा चुनाव चिन्हों के आवंटन हेतु स्वतंत्र उम्मीदवार ही समझा जाएगा। चुनाव चिन्हों के आवंटन हेतु ऐसे उम्मीदवारों को अन्य स्वतंत्र उम्मीदवारों के ऊपर कोई प्राथमिकता नहीं दी जाएगी अथवा दिल्ली के किसी भी नगर निगम में उपरोक्त दल के सभी प्रत्याशियों को केवल एक ही चुनाव चिन्ह आवंटन हेतु कोई प्राथमिकता प्रदान नहीं की जाएगी।

(ड़) (i) दिल्ली नगर निगम के वार्ड के चुनाव हेतु राष्ट्रीय व दिल्ली राज्य दल अथवा अन्य राज्यों के राजनैतिक दल के प्रत्याशियों को छोड़कर अन्य प्रत्याशी उस संदर्भ में बनाए गए इस अनुच्छेद के प्रावधानों के अनुसार इनमें से एक स्वतंत्र चिन्ह को चुनेगा व वह चिन्ह इसी आदेश में दिए प्रावधानों के अनुसार 'स्वतंत्र' चिन्हों में से एक चिन्ह उसे आवंटित कर दिया जाएगा।

(ii) प्रत्येक प्रत्याशी को एक पृथक चुनाव चिन्ह, जैसा कि प्राथमिकता के आधार पर उसके नामांकन पत्र में उल्लेखित होगा, जहां तक संभव हो उसके नामांकन पत्र में दी गई प्राथमिकताओं के आधार पर प्रदान कर दिया जाएगा;

(iii) यदि एक से अधिक ऐसे प्रत्याशियों ने उसी चुनाव चिन्ह को प्राथमिकता दी है, तो रिटर्निंग अधिकारी लॉटरी द्वारा निर्णय लेगा कि वह चुनाव चिन्ह किस प्रत्याशी को दिया जाए;

(iv) दूसरे प्रत्याशी जो ऊपर (ii) या (iii) में निहित प्रावधानों में नहीं आते उनको बचे हुए स्वतंत्र चुनाव चिन्हों में से जहां तक संभव हो सके, उसकी इच्छानुसार एक चुनाव चिन्ह प्रदान कर दिया जाएगा :

यदि फिर भी कोई प्रत्याशी अपने प्रथम नामांकन पत्र में दी गई चुनाव चिन्हों की तीन प्राथमिकताओं के आधार पर ही चिन्ह लेने का हठ करता है तथा वह इस वार्ड में बचे चिन्हों में से कोई और चिन्ह लेने की कोई इच्छा व्यक्त करने के लिए मना करता है, तो रिटर्निंग अधिकारी शेष बचे ''स्वतंत्र चुनाव चिन्हों'' में से एक चिन्ह उसे आवंटित कर देगा तथा उसका इस संदर्भ में यह निर्णय अन्तिम निर्णय होगा जब तक कि रिटर्निंग अधिकारी का यह कार्य उपरोक्त निर्देशों के प्रतिकूल न हो। (क) इस आदेश के उद्‌देश्य हेतु एक प्रत्याशी को मान्यताप्राप्त राजनैतिक दल द्वारा तभी नामित करना माना जाएगा जबकि उस प्रत्याशी द्वारा भरे गए नामांकन पत्र में इस निमिा घोषणा कर दी गई है। (ख) प्रत्याशी अथवा एवजी प्रत्याशी द्वारा भरे गए नामांकन पत्र में उसने दल के लिए 'आरक्षित' चुनाव चिन्ह का ही चयन किया है और किसी अन्य चुनाव चिन्ह का नहीं।

(ग) नामांकन भरने की अन्तिम तिथि को सायं 03.00 बजे तक उस वार्ड के रिटर्निंग अधिकारी को जहां से प्रत्याशी चुनाव लड़ रहा है तथा राष्ट्रीय राजधानी क्षेत्र, दिल्ली के चुनाव आयोग को भी संबंधित दल द्वारा फार्म 'बी' में लिखित नोटिस प्राप्त करवा दिया जाएगा।

(घ) उपरोक्त नोटिस फार्म 'ए' में प्राधिकृत व्यक्ति, दल के अध्यक्ष अथवा सचिव द्वारा स्याही से हस्ताक्षरित हो, मोहर या छाप द्वारा किए गए हस्ताक्षर स्वीकार्य नहीं होंगे। इन प्रपत्रों, प्रपत्र 'ए' तथा प्रपत्र 'बी' की फैक्स, फोटो स्टेट, साइक्लोस्टाइल प्रति भी स्वीकार होगी यदि वह राष्ट्रीय/राज्य राजनैतिक दल के प्राधिकृत व्यक्ति द्वारा स्याही से/बाल पेन से हस्ताक्षरित होगी।

(ड़) ऐसे प्राधिकृत व्यक्ति का नाम व हस्ताक्षर का नमूना फार्म 'बी' में भरकर नामांकन देने की अन्तिम तिथि को सायं 03.00 बजे तक वार्ड के रिटर्निंग अधिकारी व राष्ट्रीय राजधानी क्षेत्र, दिल्ली के चुनाव आयोग को सूचित कर दिया गया हो।

(च) प्रपत्र 'बी' में की गई प्रथम प्राधिकृतता के पश्चात्‌ राष्ट्रीय अथवा राज्य राजनैतिक दल की ऐसी सूचना जिसमें प्रथम प्राधिकृतता को निरस्त अथवा परिवर्तित कर दिया गया हो, संबंधित रिटर्निंग अधिकारी व राज्य चुनाव आयोग को भेज देनी चाहिए जो कि आयोग/संबंधित रिटर्निंग अधिकारी को नामांकन भरने की अन्तिम तिथि को सायं 03.00 बजे तक प्राप्त हो जाए। प्रपत्र 'बी' में ऐसी बाद में की गई प्राधिकृतता, प्राधिकृत कार्यालय-अधिकारी जिसका नाम प्रपत्र 'ए' में पहले भेजा जा चुका है, द्वारा ही हस्ताक्षर की गई हो, तथा इसमें कोई संशय न हो और यह पूर्णतया स्पष्ट हो, कि या तो वह पूर्व प्राधिकृतता को निरस्त करता है या परिवर्तित करता है जैसा भी मामला हो।

(छ) यदि उसी राजनैतिक दल से एक ही वार्ड में या दो से अधिक प्रत्याशियों के लिए प्रपत्र 'बी' में सूचना रिटर्निंग अधिकारी व आयोग को प्राप्त होती है तथा वह राजनैतिक दल प्रपत्र 'बी' में यह बताने/दर्शाने में असफल हो जाता है कि इन सूचनाओं में से पूर्व भेजी गई सूचनाओं को निरस्त अथवा अतिक्रमण कर दिया है, तो रिटर्निंग अधिकारी केवल उस प्रत्याशी के प्रपत्र 'बी' को स्वीकार करेगा जिसका नामांकन पत्र उसे पहले प्राप्त हुआ हो तथा शेष प्रत्याशियों, जिनके लिए भी प्रपत्र 'बी' उसे प्राप्त हो गए हों, को ऐसे राजनैतिक दल के प्रस्ताविक प्रत्याशी नहीं माना जाएगा तथा उनके नामांकन पत्र भी अस्वीकार कर दिए जाएंगे।

(ज) फार्म 'ए' व 'बी', जैसा उपयुक्त हो इस आदेश की अनुसूची- II में निर्धारित है। आयोग अनुदेश व निर्देश जारी कर सकता है :-

(क) इस आदेश के किसी भी प्रावधान के संबंध में स्पष्टीकरण हेतु।

(ख) इस प्रकार के प्रावधानों को लागू करने के सम्बंध में उत्पन्न होने वाली किसी समस्या व संशय के समाधान हेतु।[PART IV DELHI GAZETTE : EXTRAORDINARY 5 (ग) चुनाव चिन्हों के आरक्षण एवं आवंटन हेतु तथा राजनैतिक दलों की मान्यता से सम्बन्धित किसी मामले के सम्बन्ध में जिसके लिए इस आदेश में कोई प्रावधान नहीं है अथवा अपर्याप्त प्रावधान है तथा आयोग के मतानुसार सुचारू रूप से चुनाव कराए जाने के लिए प्रावधान किया जाना आवश्यक है।

STATE ELECTION COMMISSION

Delhi, the 2nd November, 2022

No. F. 4(1)/OSDI/Legal/SEC/2022/7492.—WHEREAS the superintendence, direction and control of elections to the Municipal Corporation of Delhi are vested in the State Election Commissioner of NCT of Delhi vide Section 7 of the Delhi Municipal Corporation Act, 1957 as amended till date.

AND WHAREAS it is necessary to provide for the choice and allotment of symbols to the contesting candidates sponsored by political parties (National and State) and to the independent candidates for election to the Municipal Corporation of National Capital Territory of Delhi.

Now, therefore in exercise of the powers conferred under Section 7 of the Delhi Municipal Corporation Act 1957, (hereinafter referred to as the 'ACT') read with Rule 15 of the Delhi Municipal Corporation (Election of16 DELHI GAZETTE : EXTRAORDINARY PART IV] Councillors) Rules, 2012 (hereinafter referred to as 'Rules') and all other provisions enabling it in this behalf and in supercession of all earlier Notifications on the subject, the State Election Commission of the National Capital Territory of Delhi hereby makes the following order:-

1. Short Title, Application and Commencement:

(a) This order will be called the "Municipal Corporation of Delhi Election Symbols (Reservation and Allotment) Order, 2022". It extends to the whole areas of the Municipal Corporation of Delhi and applies in relation to elections to the wards of the said Municipal Corporation of Delhi to be held hereafter.

(b) It shall come into force on the date of its publication in the Gazette of NCT of Delhi.

2. Definitions, Interpretation:

(a) In this order, unless the context otherwise requires, the words 'the Commission' means the State Election Commission of the National Capital Territory of Delhi.

(b) "The Municipal Corporation" means the Municipal Corporation of Delhi.

(d) '"National Party' means a party registered and recognized by the Election Commission of India as such under section 29A of the Representation of the People Act, 1951 read with provision of "The Election Symbols (Reservation and Allotment) Order, 1968.", to which a reserved symbol has been allotted for election to Lok Sabha/ Assembly Constituency in the NCT of Delhi by the Election Commission of India.

(e) Delhi State Party means a State Party registered and recognized by the Election Commission of India under section 29A of the Representation of the People Act, 1951 read with provisions of "The Election Symbols (Reservation and Allotment ) Order, 1968" to which a reserved symbol is allotted for election to Lok Sabha/Assembly Constituency in the NCT of Delhi.

(f) Other 'State Party' means a party registered and recognized by the Election Commission of India in a State or States (Other than N.C.T. of Delhi) by the Election Commission of India as such under section 29A of the Representation of the People Act, 1951 read with provision of "The Election Symbols (Reservation and Allotment) Order, 1968." to which a reserved symbol is allotted for election to Lok Sabha/Assembly Constituency in that State or States.

(g) 'Act' means The Delhi Municipal Corporation Act, 1957 as amended till date.

(h) 'Rules means Delhi Municipal Corporation (Election of Councillors) Rules, 2012;

3. Recognition of National and State parties:

(a) The National Parties recognized as such for the time being by the Election Commission of India in respect of election to Lok Sabha and State Legislative Assemblies in India, and as per Symbol Orders of Election Commission of India vide Notification No. 56/2021/PPS-III dated the 23.09.2021 as amended from time to time thereafter by the Election Commission of India, are hereby recognized as such by this Commission for purposes of elections to the above said Municipal Corporation of the National Capital Territory of Delhi to be held hereafter under the provisions of Rule 15 of the aforesaid Rules.

(b) The Commission hereby also adopts for the National Parties and Sate Parties those very symbols which are reserved for these parties by the Election Commission of India and not any other symbol.

(c) The facsimiles of the symbols reserved for the National Parties and State Parties (in size and shape) as prescribed for elections to Lok Sabha and State Assemblies by the Election Commission of India as well as those prescribed for other candidates (independents) in the list of Free Election Symbols are adopted and prescribed as such by this Commission for purposes of the elections to the Municipal Corporation of Delhi, to be held hereafter. The names of such National Parties and State Parties and symbols prescribed for them are mentioned in Table-I & Table II of Schedule-I annexed.

(d) "Aam Aadmi Party" is recognized for N.C.T. of Delhi by the Election Commission of India as 'Delhi State Party' and Symbol allotted to this party is "Broom" which is also adopted by this Commission under rule 15 of the said "Rules" for purpose of aforesaid elections

(e) A list of 'free symbols' to be chosen by other candidates (independents) etc. as prescribed by Election commission of India is contained in Table-III in the Schedule-I and these are also adopted by this Commission for purpose of aforesaid election under Rule 15 of the said "Rules"[PART IV DELHI GAZETTE : EXTRAORDINARY 17

4. Choice of Symbol by candidates of National and State Parties and allotment thereof:

(a) For every contested election of the Municipal Corporation of Delhi, a symbol shall be allotted to each contesting candidate in accordance with the provisions of the said Rules, this Order and the instructions issued by the Commission from time to time in this regard.

(b) A candidate set up by a National Party and Delhi State Party at an election to a ward of the Municipal Corporation of Delhi shall choose, and shall be allotted, ONLY the symbol reserved for that party by Election Commission of India and no other symbol.

(c) If a candidate set up by a State Party other than Delhi State Party (N.C.T. of Delhi) contests election to a ward of a Municipal Corporation of Delhi which party is not recognized in the National Capital Territory of Delhi by Election Commission of India, intends to choose or chooses a symbol reserved for it in the State or States in which it is recognized as 'State Party' (see schedule-I table-II) then such candidate shall be allotted that symbol to the exclusion of any other candidate and no other symbol on fulfillment of each of the following conditions, namely:

(i) that an application is made to the Commission by the State Party for exclusive allotment of that symbol to the candidate set up by it at an election to the Municipal Corporation of Delhi not later than the third day after publication in the official gazette of the Notification calling the election to the Municipal Corporation of Delhi;

(ii) that the said candidate has made a declaration in his nomination paper that he has been set up by that party at the election to a ward of the Municipal Corporation of Delhi and that the party has also fulfilled the requirements of clauses (b),(c),(d), & (e) of paragraph 5 of this Order;

(iii) that, in the opinion of the Commission, there is no reasonable ground for refusing the application for such allotment.

(iv) In case more than one State Parties having the same 'reserve' symbol as per Election Commission of India's order, choose the 'reserve' symbol it shall be allotted to a candidate of a State Party by draw of lot and in no other manner. All or any other State Party whose candidate does not get the 'reserve' symbol as explained above shall be allotted a 'free symbol' of his choice by the Returning Officer in preference to the independent candidates.

(v) Candidates sponsored by recognized National Parties & Delhi State Party will have to file nomination paper with one proposer and their choice of symbol to be indicated in the nomination paper(s) shall be restricted to the Symbol reserved for it by the Election Commission of India.

(vi) Candidates sponsored by such State Parties (other than Delhi State Party) will have to file nomination papers with ten proposers and their choice of symbol to be indicated in the nomination paper(s) shall be restricted to the symbol reserved for it in the State or States in which it is so recognized by the Election Commission of India.

(d) The candidates belonging to unrecognized parties registered by Election Commission of India shall be treated as independent candidates for all purposes including number of proposers required i.e. 10 proposers of the ward to which the nomination is filed and for allotment of symbols. They shall not be given any preference over other independent candidates in allotment of free symbols or allotment of only one free symbol to all its candidates in any ward of the Municipal Corporation of Delhi.

(e) (i) Any candidate at an election to a ward of the Municipal Corporation of Delhi other than a candidate set up by a National Party, Delhi State Party or State party (other than "Delhi State Party") i.e. Independent Candidates etc. shall choose and shall be allotted in accordance with the provisions hereafter set out in this paragraph, one of the symbols specified as 'free symbols' as per this Order.

(ii) A different symbol to each contesting candidate will be allotted in conformity as far as practicable, with his choice as per three preferences mentioned in his/her nomination paper.

(iii) If more contesting candidates than one have indicated their preference for same symbol, the Returning Officer shall decide by lot to which of such candidates the symbol will be allotted.

(iv) Other contesting candidates not covered in (ii) or (iii) above, can be allotted a symbol out of list of left out symbols as per their choice as far as practicable.

If a candidate still insists to have a symbol out of his three preferences only, as given by him in his first nomination paper, allotted and he refuses to give his choice for any other symbol left out in that ward, the18 DELHI GAZETTE : EXTRAORDINARY PART IV] Returning Officer shall allot him a 'free symbol' out of the remaining symbols and his decision in this context shall be final unless action of the Returning Officer is contrary to the foregoing direction.

5. Authorization by National and State Parties for allotment of Symbols:

(a) For the purpose of this Order, a candidate shall be deemed to have been set up by a recognized political party if and only if the candidate has made a declaration to that effect in the nomination paper filed by him/her.

(b) The candidate or substitute candidate has chosen only the 'reserved' symbol of his party in his/her nomination paper filed and no 'other symbol'.

(c) A notice in Form 'B' of setting up the candidate has been delivered not later than 3.00 P.M. on the last day of filing nomination, in writing, to the Returning Officer of the ward to which the candidate is contesting and State Election Commission of NCT Delhi by the party concerned.

(d) The above said notice is signed by a person authorized in Form 'A' by the President or the Secretary of the party, in ink. Facsimile signatures shall not be accepted. Similarly fax, Photostat, cyclostyled copy of such forms i.e. (form A & B) are also acceptable if the same is signed by the authorized person of the National/State Political Party in ink/ball pen.

(e) The name and specimen signature of such authorized person in Form A are communicated to the Returning Officer concerned and the State Election Commission of the NCT Delhi not later than 3.00 P.M. on the last date fixed for filing nominations.

(f) Any subsequent authorization by a National or State Party cancelling or substituting the earlier authorization in Form 'B' shall be sent to the Returning Officer concerned and the State Election Commission of NCT of Delhi also so as to be received by the Commission and the concerned Returning Officer not later than 3.00 P.M. on the last date for making nomination. Such subsequent authorization in Form 'B' is to be signed by the authorized Office bearer whose name has been duly intimated in Form 'A' and is to be unambiguous and clearly showing that it either cancels or substitutes the earlier authorization, as the case may be.

(g) If more than one notice in Form 'B' are received from a National or State Party by the Returning Officer/Commission in respect of two or more candidates in a ward from the same political party and that political party fails to indicate in such notices in Form 'B' that one of these notices is cancelled or supersedes all other previous notices, the Returning Officer shall accept the notice in Form 'B' in respect of that candidate whose Nomination Paper was first delivered to him, and the remaining candidates in respect of whom also notices in Form 'B' have been received by him, shall not be treated as candidates set up by such political party and their nomination(s) shall also be rejected

(h) Form 'A' and 'B', as applicable, are prescribed as in Schedule II with this order

6. Power of Commission to issue instructions and directions:

The Commission may issue instructions and directions –

(a) for clarification of any of the provisions of this order.

(b) for the removal of any difficulty or doubt which may arise in relation to the implementation of any such provisions, and

(c) in relation to any matter with respect to the reservation and allotment of symbols and recognition of political parties, for which this order makes no provision or makes insufficient provision, and provision is, in the opinion of the Commission, necessary for the smooth and orderly conduct of elections.
