राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 7 नवम्बर, 2022 1052-1062.—उपभोक्ता संरक्षण अधिनियम, 2019 (केंद्रीय अधिनियम 2019 का 35) की धारा 102 की उप-धारा (1) तथा खंड (ज) तथा (ड) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल एतद्द्वारा दिल्ली उपभोक्ता संरक्षण (राज्य आयोग एवं जिला आयोग के अध्यक्ष तथा सदस्यों के वेतन, भत्ते तथा सेवा की शर्तें) नियमावली, 2022 में निम्नलिखित नियम बनाते हैं, अर्थात-
1. संक्षिप्त शीर्शक एवं प्रारंभ :- (1) इन नियमों को दिल्ली उपभोक्ता संरक्षण (राज्य आयोग तथा जिला आयोग के अध्यक्ष तथा सदस्यों के वेतन, भत्ते एवं सेवा की शर्तें) नियमावली, 2022 कहा जाए।
(2) ये शासकीय राजपत्र में अपनी अधिसूचना की तिथि से प्रभावी होंगे।
2. परिभाक्षाएं - (1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हों -
(क) 'अधिनियम' का अभिप्राय उपभोक्ता संरक्षण अधिनियम, 2019 (2019 का 35) से है।
(ख) 'सदस्य' का अभिप्राय यथास्थिति जिला आयोग अथवा राज्य आयोग के एक सदस्य से है। 7419 DG/2022
(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] (ग) 'अध्यक्ष' का अभिप्राय यथास्थिति जिला आयोग अथवा राज्य आयोग के अध्यक्ष से है।
(घ) 'राज्य सरकार' में नियम 13 के अतिरिक्त संविधान के अनुच्छेद 239 के अंतर्गत नियुक्त केंन्द्र शासित प्रदेश का एक प्रशासक शामिल है।
(2) अधिनियम में परिभाशित तथा अपरिभाशित एवं इसमें प्रयुक्त शब्दों एवं अभिव्यक्तियों का क्रमशः वही अर्थ होगा जो अधिनियम में दिया गया है।
(1) अध्यक्ष उन वेतन तथा भत्तों के लिए पात्र होंगे जो जिला न्यायाधी ा को वेतन के सुपर टाइम स्केल में स्वीकार्य है। (2) किसी सदस्य को राज्य सरकार के उप-सचिव के न्यूनतम वेतनमान एवं ऐसे अधिकारी को स्वीकार्य अन्य भत्तों के समान वेतन प्राप्त होगा। (4) अध्यक्ष और सदस्य के वेतन में 3 प्रतिशत की दर से वार्शिक उध्र्वगामी सं ाोधन किया जाएगा। (1) राज्य आयोग के अध्यक्ष उन वेतन तथा अन्य भत्तों को प्राप्त करेगा जो राज्य के उच्च न्यायालय के पदासीन न्यायाधी ा को स्वीकार्य है।
(2) राज्य आयोग के किसी सदस्य को राज्य सरकार के अपर-सचिव के न्यूनतम वेतनमान एवं ऐसे अधिकारी को स्वीकार्य अन्य भत्तों के समकक्ष वेतन प्राप्त होगा। (4) किसी सदस्य के वेतन में 3 प्रतिशत की दर से वार्शिक उध्र्वगामी सं ाोधन किया जाएगा। किसी भी व्यक्ति को अध्यक्ष या सदस्य के रूप में तब तक नियुक्त नही किया जाएगा जब तक कि उसे इस संबंध में राज्य सरकार द्वारा निदिष्ट प्राधिकारी द्वारा चिकित्सकीय रूप में स्वस्थ घोशित नहीं किया जाता है। ी राज्य आयोग या जिला आयोग के अध्यक्ष कार्यालय में आकस्मिक रिक्ती के मामले में जैसी भी स्थिति हो, राज्य सरकार को अध्यक्ष के रूप में कार्य निर्वहन हेतु सबसे वरिष्ठ सदस्य को नियुक्त करने की षक्ति होगी।
- अध्यक्ष अथवा सदस्य समान दर पर मकान किराया भत्ता के लिए पात्र होंगे जो तदनुरूप स्थिति में राज्य सरकार के ग्रुप 'अ' अधिकारी को स्वीकार्य है।
- अध्यक्ष अथवा सदस्य समान दर पर परिवहन भत्ता के लिए पात्र होंगे जो तदनुरूप स्थिति में राज्य सरकार के ग्रुप 'अ' अधिकारी को स्वीकार्य है। राज्य आयोग एवं जिला आयोग के अध्यक्ष एवं सदस्य अवकाश, अवकाश यात्रा रियायत, चिकित्सा उपचार एंव अस्पताल की सुविधाएँ, राज्य सरकार में समूह 'अ' के सरकारी कर्मचारियों पर लागू प्रावधानों के अनुसार लेने के पात्र होंगे।
अध्यक्ष या सदस्य, अपना पद ग्रहण करने से पूर्व अपनी परिसंपत्तियों, देनदारियों और वित्तीय तथा अन्य हितों की घोषणा करेंगे। (1) अध्यक्ष अथवा सदस्य की सेवा के निबंधन एवं शर्ते जिनके संबंध में इन नियमों में कोई स्पष्ट प्रावधान नहीं किया गया है, वे इस प्रकार होंगे, जो तदनुरूप स्थिति में राज्य सरकार के समूह 'अ' अधिकारी को स्वीकार्य है।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 (2) अध्यक्ष या सदस्य राज्य आयोग या जिला आयोग की सेवा से सेवानिवृत्ति के पश्चात, जैसा भी मामला हो, राष्ट्रीय आयोग, राज्य आयोग या जिला आयोग के समक्ष कार्य नहीं करेंगे।
(3) अध्यक्ष या सदस्य राज्य आयोग या जिला आयोग में अपनी क्षमताओं पर कार्य करते हुए, जैसा भी मामला हो, कोई मध्यस्थता का कार्य नहीं करेंगे।
(4) राज्य आयोग या जिला आयोग के अध्यक्ष या सदस्य, जैसा भी मामला हो, पदधारण की समाप्ति की तिथि से दो वषो की अवधि के लिए, कोई व्यक्ति जो राज्य आयोग या जिला आयोग के समक्ष कार्रवाई का पक्षकार हो, में अथवा प्रबंधन या प्रशासन से जुड़ा हो किसी रोजगार को स्वीकार नहीं करेगा। बशर्तें कि इस नियम में निहित कंपनी अधिनियम 2013 (2013 का 18) की धारा 2 का खंड (45) में यथापरिभाशित किसी भी केन्द्रीय, राज्य, प्रांतीय अधिनियम या एक सरकारी कंपनी के अंतर्गत अथवा उसके द्वारा स्थापित किसी भी निगम या वैधानिक प्राधिकरण में केन्द्रीय सरकार या राज्य सरकार या स्थानीय प्राधिकरण के अन्तर्गत किसी भी रोजगार पर कुछ भी लागू नहीं होगा। अध्यक्ष या सदस्य के रूप में नियुक्त होने वाला प्रत्येक व्यक्ति अपने पदग्रहण करने से पूर्व इन नियमों के साथ संलग्न प्रपत्र I में पद की शपथ तथा प्रपत्र II में गोपनीयता की शपथ लेकर सदस्यता ग्रहण करेंगे।
13. अध्यक्ष अथवा सदस्यों के वेतन, पारिश्रमिक तथा अन्य भत्ते राज्य सरकार की समेकित निधि से तथा केन्द्रशासित प्रदेशों के मामले में भारत की समेकित निधि से अदा किए जाएंगे।
14. जिला आयोग तथा राज्य आयोग के अध्यक्ष एवं सदस्यों की सेवा की निबंधन एवं शर्तें उनके कार्यकाल के दौरान उन्हें असुविधा होने पर परिवर्तित नहीं होगी।

NOTIFICATION
Delhi, the 7th November, 2022
F. No. 50/222(1)/F&S/CA/2020/1052-1062.—In exercise of the powers conferred by sub-section (1) and Clauses (h) and (m) of Section 102 of the Consumer Protection Act, 2019 (35 of Central Act 2019), the Lt. Governor of the National Capital Territory of Delhi hereby makes the following rules, namely Delhi Consumer Protection (Salary, allowances and conditions of service of President and Members of the State Commission and District Commission) Rules, 2022.
1. Short title and commencement. — (1) These rules may be called the Delhi Consumer Protection (Salary, allowances and conditions of service of President and Members of the State Commission and District Commission) Rules, 2022.
(2) They shall come into force from the date of their notification in the official Gazette.
2. Definitions. - (1) In these rules, unless the context otherwise requires, —
(a) 'Act' means the Consumer Protection Act, 2019 (35 of 2019);
(b) 'Member' means a Member of the District Commission or the State Commission, as the case may be;
(c) 'President' means the President of the District Commission or the State Commission, as the case may be;
(d) 'State Government' includes an administrator of a Union territory appointed under article 239 of the Constitution except in rule 13.
(2) The words and expressions used herein and not defined and defined in the Act shall have the same meaning respectively assigned to them in the Act.
3. Salaries and allowances payable to President and members of District Commission. – (1) The President shall be entitled to the salary and allowances as are admissible to a District Judge in the super time scale of pay.
(2) A Member shall receive a pay equal to the pay at the minimum of the scale of pay of a Deputy Secretary of the State Government and other allowances as admissible to such officer.
(3) The pay of a person appointed as President or member, who is in receipt of any pension, shall receive amount equivalent to last pay drawn by him minus pension and other allowances applicable to him.
(4) There shall be an annual upward revision of the pay of the President and member at the rate of 3%.
4. Salaries and allowances payable to President and members of the State Commission.- (1) President of the State Commission shall receive the salary and other allowances as are admissible to a sitting judge of the High Court of the State.
(2) A Member of the State Commission shall receive a pay equivalent to the pay at minimum of the scale of pay of an Additional Secretary of the State Government and other allowances as are admissible to such officer.
(3) The pay of a person appointed as President or member, who is in receipt of any pension, shall receive amount equivalent to last pay drawn by him minus pension and all other allowances applicable to him.
(4) There shall be an annual upward revision of the pay of a member at the rate of 3%.
5. Medical fitness.—No person shall be appointed as President or Member unless he is declared medically fit by an authority specified by the State Government in this behalf.
[PART IV DELHI GAZETTE : EXTRAORDINARY 56. Casual vacancy.— In case of a casual vacancy in the office of President in the State Commission or District Commission, as the case may be, the State Government shall have the power to appoint the senior most Member to officiate as President.
7. House rent allowance.— The President or member shall be entitled to House Rent Allowance at the same rate as are admissible to Group 'A' Officer of the State Government of a corresponding status.
8. Transport allowance.— The President or member shall be entitled to transport allowance at the same rate as are admissible to Group 'A' Officer of the State Government of a corresponding status.
9. Leave and medical treatment and hospital facilities.— The President and members of the State Commission and the District Commission shall be entitled to leave, Leave Travel Concession, medical treatment and hospital facilities as per the provisions applicable to Group A Government servants in the State Government.
10. Declaration of Financial and other Interests.— The President or member shall, before entering upon his office, declare his assets, and his liabilities and financial and other interests.
11. Other conditions of service.— (1) The terms and conditions of service of the President or member with respect to which no express provision has been made in these rules, shall be such as are admissible to a Group 'A' Officer of the State Government of a corresponding status.
(2) The President or member shall not practice before the National Commission, the State Commission or the District Commission after retirement from the service of the State Commission or the District Commission, as the case may be.
3) The President or member shall not undertake any arbitration work while functioning in these capacities in the State Commission or the District Commission, as the case may be.
(4) The President or member of the State Commission or the District Commission, as the case may be, shall not, for a period of two years from the date on which they cease to hold office, accept any employment in, or connected with the management or administration of, any person who has been a party to a proceeding before the State Commission or the District Commission:
Provided that nothing contained in this rule shall apply to any employment under the Central Government or a State Government or a local authority or in any statutory authority or any corporation established by or under any Central, State or Provincial Act or a Government company as defined in clause (45) of section 2 of the Companies Act, 2013 (18 of 2013).
12. Oaths of office and secrecy.—Every person appointed to be the President or member shall, before entering upon his office, make and subscribe an oath of office in Form I and oath of secrecy in Form II annexed to these rules.
13. The salary, remuneration and other allowances shall be defrayed out of the Consolidated Fund of the State Government and in the case of the Union Territories, from the Consolidated Fund of India.
14. The terms and conditions of the service of the President and the members of the District Commission and the State Commission shall not be varied to their disadvantage during their tenure of office.
