III .—गृह मंत्रालय, भारत सरकार की दिनांक 24/09/1968 की अधिसूचना फा. सं. 24/78/68-डीएच(एस) के साथ पठित भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए तथा अपर लोक अभियोजक के पद से संबंधित भर्ती नियमावली, फा. सं. 11/18/2020/एच-डीओपी/आर.आर.-III/756-764 दिनांक 17.02.2022 के अधिक्रमण में, ऐसे अधिक्रमण से पूर्व कुछ भी की गई या किये जाने के लिए हटाई गई बातों को छोड़कर, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल संघ लोक सेवा आयोग के पूर्व परामर्श के पश्चात् एतद्द्वारा अभियोजन निदेशालय, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में अपर लोक अभियोजक के पद की भर्ती पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैंं, अर्थात्ः

(क) इन नियमों को अभियोजन निदेशालय, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, अपर लोक अभियोजक भर्ती नियमावली, 2022 कहा जायेगा।
(ख) ये शासकीय राजपत्र में अपने प्रकाशन की तिथि से लागू होंगे।
ये नियम इन नियमों के साथ संलग्न अनुसूची के कॉलम 1 में निर्दिष्ट पदों के लिए लागू होंगे। 7810 DG/2022
(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] उक्त पदों की संख्या, इनका वर्गीकरण तथा इसके साथ संलग्न वेतनमान इन नियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथाविनिर्दिष्ट होंगे।
उक्त पदों की भर्ती पद्धति, आयु सीमा, योग्यता एवं इनसे संबंधित अन्य मामलें उक्त अनुसूची के कॉलम (5) से (13) में यथाविनिर्दिष्ट होंगे।
ऐसा कोई भी व्यक्ति :
(क) जो किसी व्यक्ति के जीवित पति/पत्नी के होते हुए विवाह करता है या विवाह का अनुबंध करता है; या (ख) जो एक जीवित पति/पत्नी के होते हुए किसी व्यक्ति से विवाह कर चुका है या विवाह अनुबंध कर चुका है, वह उक्त पद पर नियुक्ति का पात्र नहीं होगा;
षर्त यह है कि यदि राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति एवं विवाह के अन्य पक्षकार पर लागू व्यक्तिगत कानून के अंतर्गत अनुमत है और इस बात से संतुष्ट हो जाने पर कि ऐसा करने के लिये विशेष आधार हो तो ऐसे किसी भी उम्मीदवार को इस नियम के प्रवर्तन की छूट दी जा सकती है। 6. जहां सरकार का यह मत हो कि ऐसा करना आवश्यक अथवा समीचीन है, तो वह कारणों को लिखित में अभिलेखबद्ध करते हुए संघ लोक सेवा आयोग के परामर्श से आदेश द्वारा व्यक्तियों की किसी श्रेणी के सम्बंध में इन नियमों के उपबंध में से किसी भी उपबंध को शिथिल कर सकती है। 7. इन नियमों की किसी भी बात का सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिक, अन्य पिछड़ा वर्गों तथा अन्य विशेष वर्गों के व्यक्तियों के लिये उपबन्धित किये जाने के लिये आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा। अभियोजन निदेशालय, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में अपर लोक अभियोजक के पद की भर्ती नियम।

| 11. | ः | सहायक लोक अभियोजक के रूप में 6 वर्ष की नियमित सेवा सहित वेतन मैट्रिक्स के स्तर -8 (47600 - 1,51,100/- रूपये) में तथा विभाग द्वारा यथानिर्धारित प्रासंगिक क्षेत्र मे ं दो से चार सप्ताह का अनिवार्य प्रशिक्षण सफलतापूर्वक पूर्ण करने वाले सहायक लोक अभियोजक । जिन कनिष्ठ अधिकारियों ने अपनी अर्हक/पात्रता सेवा पूरी कर ली है वे पदोन्नति के लिए विचारणीय है। उनके वरिष्ठ अधिकारी भी पदोन्नति के लिए विचारणीय होंगे; बशर्तें कि उनके लिए अपेक्षित अर्हक/पात्रता सेवा ऐसी अपेक्षित अर्हक/पात्रता सेवा की अवधि के आधे से अधिक या दो वर्ष, इसमें जो भी कम हो, और उन्होंने आगामी उच्च ग्रेड पर पदोन्नति के लिए अपनी परिवीक्षा अवधि अपने कनिष्ठ अधिकारियों के साथ सफलतापूर्वक पूरी कर ली होे, जिन्होंने (कनिष्ठ अधिकारी) उतनी अर्हक/पात्रता पहले ही पूरी कर ली है। प्रतिनियुक्ति (अल्पकालिक संविदा सहित) : केन्द्रीय/राज्य सरकार/संघ राज्य क्षेत्र/स्वायत्त या सांवधिक संगठन/ सार्वजनिक क्षेत्र के उपक्रम/मान्यता प्राप्त अनुसंधान संस्थान/मान्यता प्राप्त विश्वविद्यालय के निम्नलिखित अधिकारीः- क. (i) मूल संवर्ग या विभाग मे नियमित आधार पर समरूप पदधारण करने वाले; अथवा (ii) वेतन मैट्रिक्स के स्तर 10 (56100 - 177500/-रूपये) के पदों मेेंं नियमित आधार पर नियुक्ति के उपरांत ग्रेेड में पाँच वर्षों की सेवा सहित अथवा मूल संवर्ग/विभाग में समकक्ष। (ख) निम्नलिखित शैक्षिक योग्यताएँ एवं अनुभव रखने वाले :- अनिवार्य : (i) मान्यता प्राप्त विश्वविद्यालय/संस्थान से विधि में उपाधि (ii) विधिज्ञ में सात वर्ष का अनुभव । वांछनीय : सरकारी अधिवक्ता के रूप में एक वर्ष का अनुभव । ः भरक श्रेणी के विभागीय अधिकारी जो कि पदोन्नति की सीधी श्रृंखला में हैं, वे प्रतिनियुक्ति/समावेशन पर नियुक्ति हेतु विचारणीय नहीं होंगे। ठीक इसी प्रकार प्रतिनियुक्ति वाले भी पदोन्नति द्वारा नियुक्ति हेतु विचारणीय नहीं होंगे। केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में |
| इस नियुक्ति से तुरन्त पूर्वधारित किसी अन्य गैर संवर्ग पद में प्रतिनियुक्ति (अल्पकालिक संविदा सहित) की अवधि भी सम्मिलित है, यह सामान्यतः चार वर्षों से अधिक नहीं होगी। प्रतिनियुक्ति (अल्पकालिक संविदा सहित) द्वारा नियुक्ति हेतु अधिकतम आयु सीमा आवेदन प्राप्ति की अन्तिम तारीख को छप्पन (56) वर्षों से अधिक नहीं होंगी। लागू नहीं । | |||

No. F. 11/18/2020/H-DOP/RR-III/560 to 568.—In exercise of the powers conferred by proviso to article 309 of the Constitution of India, read with the Government of India, Ministry of Home Affairs, Notification No. F.24/78/68-DH(S) dated the 24/09/1968, and in supersession of this Government's Notification No. F.11/18/2020/H-DOP/RR-III/756-764 dated the 17th February, 2022, the Recruitment Rules for the post of Additional Public Prosecutor, and anything done or omitted to be done before such supersession, the Lieutenant Governor of the National Capital Territory of Delhi, after prior consultation with Union Public Service Commission, hereby makes the rules regulating the method of recruitment to the post of the Additional Public Prosecutor in the Directorate of Prosecution, Government of National Capital Territory of Delhi as following, namely:—
1. Short title and commencement –
(a) These rules may be called the Directorate of Prosecution, Government of National Capital Territory of Delhi, Additional Public Prosecutor Recruitment Rules -2022.
[PART IV DELHI GAZETTE : EXTRAORDINARY 5(b) They shall come into force on the date of their publication in the official Gazette.
2. Application:- These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules.
3. Number of posts, its classification and Pay level in the pay matrix:- The number of said posts, its classification and pay scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
4. Method of recruitment, age limit, other qualification, etc- The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.
5. Disqualification:- No person,
(a) Who has entered into or contracted a marriage with a person having a spouse living; or
(b) Who, having a spouse living, has entered into or contracted a marriage with any person;
shall be eligible for appointment to the said post;
Provided that the Government of National Capital Territory of Delhi, may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of these rules.
6. Power to Relax:- Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, may relax any of the provisions of these rules with respect to any class or category of persons.
7. Saving:- Nothing in these rules shall affect reservations, relaxations of age limit and other concessions, required to be provided for the Schedule Castes, the Schedule Tribes, ex-servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.
