फा. सं. 20/23/2000/गृह पुलिस-II/2859-2874.—दिल्ली नगर निगम अधिनियम, 1957(1957 का 66) की धारा 469 तथा नई दिल्ली नगर पालिका परिषद् अधिनियम, 1994 (1994 का 44) की धारा 375 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल एतद् द्वारा निम्नलिखित व्यक्तियों को जिन्हें विशेष कार्याधिकारी (राजपत्र-II दिल्ली उच्च न्यायालय की दिनांक 10 अक्टूबर, 2022 की अधिसूचना सं. 52/डीएचसी/राजपत्र-II बी/विशेष एमएम/2022 के द्वारा दण्ड प्रक्रिया संहिता 1973 (1974 का 2) की धारा 18 की उपधारा (1) के प्रावधानों के अनुसरण में विशेष महानगर दण्डाधिकारी की समस्त शक्तियां प्रदत्त की गई हैं, को राष्ट्रीय राजधानी क्षेत्र दिल्ली में दिल्ली नगर निगम अधिनियम, 1957 और नई दिल्ली नगर पालिका परिषद् अधिनियम, 1994 के अन्तर्गत अपराधों की विवेचना हेतु उन्हें विशेष महानगर दण्डाधिकारी की शक्तियां प्रदान करते हैं। यह शक्तियां उस अवधि तक जारी रहेंगी, जब तक दिल्ली उच्च न्यायालय द्वारा उन्हें विशेष महानगर दण्डाधिकारी की शक्तियां प्राप्त हैं, अर्थात्:-

नगर दण्डाधिकारी के रूप में नियुक्त उक्त अधिकारी, अन्य विशेष महानगर दण्डाधिकारियों की तरह सप्ताह में छः दिन कार्य करेंगे और दूसरे शनिवार को अवकाश रहेगा और दिल्ली लघु अपराध (विशेष महानगर दण्डाधिकारी द्वारा विचारण) नियमावली, 1998 में निहित प्रावधानों के अनुसार अवकाश के पात्र होंगें।

F. No. 20/23/2000/HP-II/2859-2874.—In exercise of the powers conferred by section 469 of the Delhi Municipal Corporation Act, 1957 (66 of 1957) and section 375 of the New Delhi Municipal Council Act, 1994, (44 of 1994), the Lt Governor of the National Capital Territory of Delhi, is pleased to confer upon the following persons, who have been conferred with all power of Special Metropolitan Magistrate in accordance with the provisions of sub- section (1) of section 18 of the Code of Criminal Procedure,1973 (2 of 1974), vide Notification No.52/DHC/GAZ.- IIB/SPL.MM/2022 dated 10th October 2022 of Officer on Special Duty (Gazette-II), High Court of Delhi, the powers of Municipal Magistrate for the trial of offences under the Delhi Municipal Corporation Act, 1957 and New Delhi Municipal Council Act, 1994, within the National Capital Territory of Delhi for such period till the powers of Special Metropolitan Magistrate conferred upon them by the High Court of Delhi, exist, namely:-

The above said officers, appointed as Municipal Magistrates, like other Special Metropolitan Magistrates, would work for six days a week with Second Saturday off and would be entitled to leave as per the provisions contained in Delhi Petty Offences (Trial by Special Metropolitan Magistrate) Rules, 1998.
