II/ 02-10.—जबकि गृह विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार की दिनांक 01.7.2022 की अधिसूचना सं. 3/03/एचईएसएमए/2017/गृ. पु. - II/1400- 1409 के अनुसार राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल ने बीएसईएस राजधानी पावर लिमिटेड (बीआरपीएल), बीएसईएस यमुना पावर लिमिटेड (बीवाईपीएल) टाटा पावर दिल्ली डिस्ट्रीब्यूशन लिमिटेड (टीपीडीडीएल) एवं डीटीएल, आईपीजीसीएल, पीपीसीएल (सरकारी उर्जा निगम) में बिजली की आपूर्ति और वितरण में लगे बिजली कर्मचारियों और अभियन्ताओं की सेवाओं को आवश्यक सेवाओं के रूप में घोषित किया था और राष्ट्रीय राजधानी क्षेत्र दिल्ली में लोगों के लिए आवश्यक सेवाओं को बनाये रखने के लिए ऐसे कर्मचारियों और अभियन्ताओं के हड़ताल को प्रतिबन्धित किया गया था। उक्त अधिसूचना दिनांक 03.01.2023 तक वैध है।और जबकि राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल आगे इस बात से संतुष्ट हैं, कि बीएसईएस राजधानी पावर लिमिटेड (बीआरपीएल), बीएसईएस यमुना पावर लिमिटेड (बीवाईपीएल), टाटा पावर दिल्ली डिस्ट्रीब्यूशन लिमिटेड (टीपीडीडीएल) एवं डीटीएल, आईपीजीसीएल, पीपीसीएल (सरकारी उर्जा निगम) के बिजली कर्मचारयों एवं अभियन्ताओं द्वारा की जाने वाली हड़ताल/आन्दोलन पर प्रतिबंध लगाना जनहित में आवश्यक और समीचीन है। 19 DG/2023 (1) 2 DELHI GAZETTE : EXTRAORDINARY PART IV] अब, इसलिए राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, गृह मंत्रालय, भारत सरकार की दिनांक 30.07.93 की अधिसूचना सं0 जी एस आर 526(ई) के अनुसार राष्ट्रीय राजधानी क्षेत्र दिल्ली में यथाविस्तारित हरियाणा अनिवार्य सेवाएं रखरखाव अधिनियम, 1974 (1974 का हरियाणा अधिनियम सं0 40) की धारा 4क के साथ पठित धारा 3 के अधीन उन्हें प्रदत्त शक्तियों का प्रयोग करते हुए एतद्‌ द्वारा उपर्युक्त सेवाओं को अनिवार्य सेवाएं घोषित करते हैं और दिल्ली में बिजली सेवा प्रदान करने वाली बीएसईएस राजधानी पावर लिमिटेड (बीआरपीएल), बीएसईएस यमुना पावर लिमिटेड (बीवाईपीएल), टाटा पावर दिल्ली डिस्ट्रीब्यूशन लिमिटेड (टीपीडीडीएल) एवं डीटीएल, आईपीजीसीएल, पीपीसीएल (सरकारी उर्जा निगम) के बिजली कर्मचारियों एवं अभियन्ताओं द्वारा की जाने वाली हड़ताल पर दिनांक 04.01.2023 से 03.07.2023 तक और छः माह की अवधि के लिए प्रतिबंध लगाते हैं।

NOTIFICATION

Delhi, the 2nd January, 2023

F. No. 3/03/HESMA/2017/HP-II/02-10.—Whereas vide Home Department, Govt. of NCT of Delhi notification No. F.3/03/HESMA/2017/HP-II/1400-1409 dated 01.7.2022, the Lt. Governor of the National Capital Territory of Delhi declared the services of Electricity Employees and Engineers of BSES Rajdhani Power Limited (BRPL), BSES Yamuna Power Limited (BYPL), Tata Power Delhi Distribution Limited (TPDDL) & DTL, IPGCL, PPCL (Govt. Power Corporation), engaged in the supply and distribution of Power, as essential Services and prohibited the strike of such Employees and Engineers for maintaining Services necessary for the people in the National Capital Territory of Delhi. The said notification is valid up to 03.01.2023.

And whereas, the Lt. Governor of the National Capital Territory of Delhi is further satisfied that in the public interest, it is necessary and expedient to prohibit the strike/agitation by Electricity Employees & Engineers of BSES Rajdhani Power Limited (BRPL), BSES Yamuna Power Limited (BYPL), Tata Power Delhi Distribution Limited (TPDDL) & DTL, IPGCL, PPCL (Govt. Power Corporation).

Now, therefore, the Lt. Governor of the National Capital Territory of Delhi, in exercise of Powers conferred upon him under section 3 read with section 4A of the Haryana Essential Services Maintenance Act, 1974 (Haryana Act No. 40 of 1974) as extended to the National Capital Territory of Delhi, vide Govt. of India, Ministry of Home Affairs Notification No. GSR 526 (E) dated 30.7.93, hereby declares the above said services as essential services and prohibits the strike by Electricity Employees & Engineers of BSES Rajdhani Power Limited (BRPL), BSES Yamuna Power Limited (BYPL), Tata Power Delhi Distribution Limited (TPDDL) & DTL, IPGCL, PPCL (Govt. Power Corporation), the power service providers in Delhi for another period of six months w.e.f. 04.01.2023 upto 03.07.2023.
