126-132.—अद्यतन यथासंशोधित दिल्ली न्यायिक सेवा नियमावली, 1970 के नियम 18 क उपबंधों एवं सिविल अपील संख्या 6113/2021 शीर्षक अकांकक्षा सिंह बनाम दिल्ली उच्च न्यायालय एवं अन्य अर सिविल अपील संख्या 6114/2021 में माननीय भारत के सर्वच्च न्यायालय द्वारा पारित आदेश दिनांक 09.12.2021 एव रिट पैटिशन (सिविल) संख्या 5948/2019 शीर्षक भव्या नैन बनाम माननीय दिल्ली उच्च न्यायालय में माननीय दिल्ली उच्च न्यायालय द्वारा पारित निर्णय दिनांक 08.05.2020 क अनुसरण में राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, दिल्ली उच्च न्यायालय के परामर्श से, श्री भव्या नैन को दिल्ली उच्च न्यायालय, नई दिल्ली द्वारा नियुक्त किए जाने पर अपने कार्यालयं में कार्यभार सम्भालने की तिथि से द वर्ष की अवधि के लिए परिवीक्षा आधार पर दिल्ली न्यायिक सेवा के सदस्य के रूप में नियुक्त करते हैं।
2. ये नियुक्ति पूर्णतया अस्थायी आधार पर हैं तथा अभ्यर्थी के चरित्र पूर्ववृत्तों के सत्यापन तथा जाति/दिव्यांग प्रमाण पत्र जहां लागू हो, के अनुसार होगी । यदि सत्यापन से यह पता चलता है कि अनुसूचित जाति तथा अनुसूचित जनजाति या दिव्यांग श्रेणी, जैसी भी स्थिति हो, से संबंधित दावा गलत है तो बिना किसी आगामी कारणों तथा असत्य प्रमाण पत्र प्रस्तुत करने पर भारतीय दंड संहिता के उपबंधों के अधीन की जाने वाली आगामी कार्यवाही पर प्रतिकूल प्रभाव डाले बिना सेवा तुरन्त समाप्त कर दी जाएगी। 376 DG/2023
(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 3. उपर्युक्त नियुक्ति अद्यतन तिथि तक तथा समय-समय पर दिल्ली न्यायिक सेवा के अधिकारियों पर यथा लागू अन्य आदेशों/निर्देशों क अनुसार दिल्ली न्यायिक सेवा नियमावली, 1970 के उपबंधों के अनुसार होगी ।
4. रिट पैटिशन (सिविल) संख्या 5948/2019 शीर्षक भव्या नैन बनाम माननीय दिल्ली उच्च न्यायालय में माननीय दिल्ली उच्च न्यायालय क निर्णय दिनांक 08.05.2020 क अनुसार, श्री भव्या नैन अपने अन्य समुहसाथियं क साथ अपनी नशनल वरिष्ठता बरकरार रखेंगे। उन्हें अपने अन्य समुहसाथियं क साथ पद ग्रहण किया समझ्ाा जाएगा, हालांकि वे किसी भी बैक वेजस क हकदार नहीं हंगे।
5. पद का वेतनमान 7 वां सीपीसी संशधित कॉरेस्पॉन्डिंग पे मैट्रिक्स अर पे लेवल के 10 वें स्तर में 56100-177500 रूपये सामान्य भत्ते जैसा समय-समय पर इस संबंध में लागू हो के अनुसार है।

NOTIFICATION
Delhi, the 16th January, 2023
No. F. 6/43/2018-Judl./Suptlaw/126-132.—In pursuance of the provisions of rule 18 of the Delhi Judicial Service Rules, 1970 as amended up to date and order dated 09.12.2021 passed by the Hon'ble Supreme Court of India in Civil Appeal No. 6113/2021 titled as Akanksha Singh vs. High Court Of Delhi & Ors and Civil Appeal No. 6114/2021 and the Judgment dated 08.05.2020 passed in W.P. (C) No. 5948/2019 by the Hon'ble High Court titled as "Bhavya Nain Vs. High Court of Delhi", the Lt. Governor of the National Capital Territory of Delhi, in consultation with the High Court of Delhi, is pleased to appoint Sh. Bhavya Nain as member of the Delhi Judicial Service on probation for a period of two years with effect from the date he assumes charge of his office on being posted by the Delhi High Court, New Delhi.
2. The above appointment is on purely provisional basis, and subject to the verification of character and antecedents of the candidate from the concerned authorities and verification of their caste certificate/PH category certificate, where ever applicable. If the verification reveals that the claim to belong to Scheduled Caste and Scheduled Tribe or Physically Handicapped category, as the case may be, is false, the services will be terminated forthwith without assigning any further reasons and without prejudice to such further action as may be taken under the provisions of the Indian Penal Code for production of false certificate.
3. The above appointment shall be subject to the provisions of Delhi Judicial Service Rules, 1970 as amended up to date and other orders/instructions as may be applicable to the officers of the Delhi Judicial Service from time to time.
4. As per the judgment dated 08.05.2020 of Hon'ble High Court of Delhi in WP(C) 5948/2019 titled as "Bhavya Nain Vs. High Court of Delhi", Sh. Bhavya Nain would retain his notional seniority along with his other batchmates and he would be deemed to have joined his post along with his other batchmates, though he would not be entitled to any back wages.
[PART IV DELHI GAZETTE : EXTRAORDINARY 35. The post carries the scale of pay of Rs. 56100-177500 in the 10th level of matrix of 7th CPC Revised Corresponding Pay Matrix and Pay Level plus usual allowances as may be applicable in this behalf from time to time.
