भूमि अधिग्रहण कलेक्टर (पश्चिम) ने भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन मे उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 की धारा 11 की उप धारा 1 द्वारा प्रदत्त शक्तियों का प्रयोग अधिसूचना संख्या का.आ. 2740 (अ) दिनांक 21 अक्टूबर 2014 के साथ पठित, का.आ. 2014(अ) दिनांक 21.07.2015 के साथ पठित धारा 11(1) के तहत अधिसूचना संख्या एडीएम /पश्चिम/एलएसी/2022/655 दिनांक 05/08/2022 के तहत उपयुक्त सरकार यानी उपराज्यपाल, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के अनुमोदन पर ग्राम बक्करवाला की खसरा संख्या 741 DG/2023
(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 5//11मिन, 12मिन, 13मिन, 17मिन (कु ल क्षेत्रफल 0.1853 हेक्टेयर) मे इंफ्रास्ट्रक्चर प्रोजेक्ट यानी श्मशान घाट तक मार्ग/पथ प्रदान कराने हेतु के संबंध में अधिसूचना जारी की है।
अतिरिक् जिलाधिकारी (पश्चिम) को उक्त अधिनियम की धारा 43 की उप धारा (1) के तहत उपरोक्त अधिसूचना के अनुसार उक्त भूमि के अधिग्रहण के कारण प्रभावित परिवारों के पुनर्वासन और पुनव्र्यवस्थापन के लिए प्रशासक के रूप में नियुक्त किया गया है।
भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन मे उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 की धारा 16 के अनुसार, प्रशासक द्वारा पुनर्वासन और पुनव्र्यवस्थापन योजना की तैयारी की जानी चाहिए और इसे निम्नानुसार पुन: प्रस्तुत किया जाता है:-
"...16 प्रशासक द्वारा पुनर्वास एवं पुनस्र्थापन योजना तैयार करना
1. कलेक्टर द्वारा धारा 11 की उप-धारा (1) के तहत प्रारंभिक अधिसूचना के प्रकाशन पर, पुनर्वासन और पुनव्र्यवस्थापन के लिए प्रशासक एक सर्वेक्षण करेगा और प्रभावित परिवारों की जनगणना करेगा, इस तरह से और ऐसे समय के भीतर जो हो सकता है तैयार किया गया है, जिसमें शामिल होंगे।
a. प्रत्येक प्रभावित परिवार की अर्जित की जा रही भूमि एवं अचल सम्पत्ति का विवरण।
b. जिन भूमिहीनों और भूमिहीनों की आजीविका अधिग्रहित की जा रही भूमि पर मुख्य रूप से निर्भर है, जिनकी आजीविका समाप्त हो गई है।
c. सार्वजनिक उपयोगिताओं और सरकार की एक सूची भवन जो प्रभावित हैं या प्रभावित होने की संभावना है, जहां प्रभावित परिवारों का पुनर्वास शामिल है।
d. प्रभावित या प्रभावित होने की संभावना वाली सुविधाओं और बुनियादी सुविधाओं का विवरण, जहां प्रभावित परिवारों का पुनर्वास शामिल है।
e. अधिग्रहीत की जा रही किसी भी सामान्य संपत्ति संसाधनों का विवरण।
2. प्रशासक, उप-धारा (1) के तहत सर्वेक्षण और जनगणना के आधार पर, पुनर्वास और पुनस्र्थापन योजना का एक प्रारूप तैयार करेगा, जैसा कि वर्णित है, जिसमें प्रत्येक भूमि मालिक और भूमि के पुनर्वास और पुनस्र्थापन अधिकारों का विवरण शामिल होगा, जिनकी आजीविका प्राथमिक रूप से निर्भर है भूमि का अधिग्रहण किया जा रहा है और जहां प्रभावित परिवारों का पुनर्वास शामिल है।
i. पुनर्वास क्षेत्र में उपलब्ध कराए जाने वाले सरकारी भवनों की सूची ।
ii. पुनर्वास क्षेत्र में प्रदान की जाने वाली जन सुविधाओं एवं अधोसंरचनात्मक सुविधाओं का विवरण। 3. प्रारूप पुनर्वास और पुनस्र्थापन योजना उप खंड (2) के रूप में संदर्भित है जिसमें पुनर्वास और पुनस्र्थापन योजना को लागू करने की समय सीमा शामिल होगी।
कलेक्टर द्वारा धारा 11 की उप-धारा 1 के तहत प्रारंभिक अधिसूचना के प्रकाशन पर, पुनर्वासन और पुनव्र्यवस्थापन प्रशासक प्रभावित परिवारों का सर्वेक्षण करेगा और जनगणना करेगा। इस संबंध में, भूमि अर्जन, पुनर्वासन और पुनव्र्यवस्थापन मे उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 में उचित मुआवजे और पारदर्शिता के अधिकार की धारा 16 (1) के संबंध में तहसीलदार पंजाबी बाग की रिपोर्ट इस प्रकार है:
(a) ग्राम बक्करवाला खतौनी वर्ष (2013-2014) के राजस्व अभिलेख के अनुसार खाता संख्या 75 में दर्ज भूमि खसरा नं. 5//11 (6-12), 5//12 (4-10) जिसमें से खसरा नं. 5//11 0.0456 हेक्टेयर (लगभग 11 बिस्वा) और 5//12 0.042655 हेक्टेयर (लगभग 10 बिस्वा) का अधिग्रहण किया जा रहा है जो जय सिंह के सभी पुत्रों श्री अमरजीत, श्री राके श, श्री रविंदर, श्रीमती नीलम पुत्री जय सिंह और प्रकाशो पत्नी जय सिंह बराबर शेयर 1/3 के नाम पर है। श्रीमती रामप्यारी पत्नी राजेंद्र सिंह 1/3 शेयर और श्री बिजेंद्र सिंह के सभी बेटे श्री सुनील कु मार, श्री.
विनोद कु मार, श्री. प्रमोद कु मार में बराबर हिस्सेदारी यानी 1/3 गांव बक्करवाला के राजस्व रिकॉर्ड में दर्ज है। उक्त भू-स्वामियों की भूमि के अधिग्रहण के बाद उक्त खाते में 84 बीघा 8 बिस्वा भूमि बच जाएगी। खाता संख्या 171 में दर्ज भूमि खसरा नं. 5//13 (2-12) और 5//17 (5-5) जिनमें से खसरा नं. 5//13 (0.042655 हेक्टेयर) (लगभग 10.5 बिस्वा) और खासा नं. 5//17 (0.054312 हेक्टेयर) (लगभग 13 बिस्वा) भूमि अधिग्रहण की जा[PART IV DELHI GAZETTE : EXTRAORDINARY 3 रही है और खसरा नं. 5//13 और 17 श्री देविंदरसिंह पुत्र रणबीर सिंह निवासी गांव बक्करवाला के नाम पर दर्ज है। उक्त भूस्वामियों की भूमि अधिग्रहण के बाद इस खाते में 9 बीघा 14 बिस्वा बच जाएगी ।
(b) भूमिदार से भूमि के अधिग्रहण के बाद, उक्त भूमिदार पर कोई प्रभाव नहीं पड़ता है क्योंकि उनके पास पर्याप्त भूमि रहती है और भूमिहीन व्यक्तियों पर कोई प्रभाव नहीं पड़ता है क्योंकि वे अधिग्रहीत भूमि पर निर्भर नहीं हैं। (c) अधिग्रहित की जा रही भूमि पर कोई सार्वजनिक उपयोगिता या सरकारी भवन मौजूद नहीं है।
(d) जो भूमि अधिग्रहित की जा रही है वह वतर्मान में खाली पड़ी है।
(e) जिन भूमिदारों की भूमि अधिग्रहित की जा रही है उनका विवरण उपरोक्त क्र.सं. (ए) पर है।
इसलिए, धारा 16(1) के तहत तहसीलदार (पंजाबी बाग) द्वारा दिनांक 01/11/2022 के तहत सर्वेक्षण और जनगणना रिपोर्ट के आधार पर और सामाजिक प्रभाव आकलन रिपोर्ट धारा 16 के तहत प्रारूप पुनर्वासन और पुनव्र्यवस्थापन योजना (2) इस प्रकार है:-

(DRAFT REHABILITATION AND RESETTLEMENT SCHEME)
F. No. ADM/WEST/LAC/2023/191-200.—Draft Rehabilitation and Resettlement Scheme U/s 16 (2) of the Right to Fair Compensation and Transparency in Land Acquisition Act, 2013 for families affected with the proposed acquisition of land bearing Khasra no. 5//11min, 12min, 13min, 17min (total area 0.1853 Hectare) of Village Bakkarwala for providing approach road/path to cremation ground of Village Bakkarwala, New Delhi.
Land Acquisition Collector (West) in the exercise of the power conferred by Sub Section 1 of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation & Resettlement Act, 2013 read with notification No. S.O. 2740(E) dated 21st October 2014 and S.O. 2014(E) dated 21.07.2015 has issued Preliminary Notification under section 11(1) Vide notification No. ADM/WEST/LAC/2022/655 dated 05/08/2022 on the approval of Appropriate Government i.e. Lieutenant Governor, GNCT of Delhi in respect of acquisition of land bearing Khasra No. 5//11min, 12min, 13min, 17min (total area 0.1853 Hectare) land of village Bakkarwala for public purpose for infrastructure project i.e. providing approach road/path to cremation ground at Bakkarwala village, New Delhi.
The Addl. District Magistrate (West) was appointed as the Administrator under sub section (1) of Section 43 of the said Act for Rehabilitation & Resettlement of affected families due to acquisition of the said land as per above mentioned notification.
As per section 16 of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation & Resettlement Act, 2013, preparation of Rehabilitation & Resettlement Scheme by the Administrator should be done and the same is reproduced as below:-
"…16. Preparation of Rehabilitation and Resettlement Scheme by the Administrator
1. Upon the publication of the preliminary notification under sub – section(1) of section 11 by the Collector, the
Administrator for Rehabilitation and Resettlement shall conduct a survey and undertake a census of the
affected families, in such manner and within such time as may be prescribed, which shall include-
a. Particulars of lands and immovable properties being acquired of each affected family;
b. Livelihoods lost in respect of land losers and landless whose livelihoods are primarily dependent on the
lands being acquired;
c. A list of public utilities and Govt. buildings which are affected or likely to be affected, where resettlement
of affected families is involved;
d. Details of the amenities and infrastructural facilities which are affected or likely to be affected, where
resettlement of affected families is involved; and
e. Details of any common property resources being acquired.
2. The Administrator shall, based on the survey and census under sub section (1), prepare a draft Rehabilitation
& Resettlement Scheme, as described which shall include particular of the Rehabilitation & Resettlement
entitlements of each land owner and landless whose livelihoods are primarily dependent on the lands being
acquired and where resettlement of affected families is involved.
i. A list of Govt. building to be provided in the Resettlement area,
ii. Details of the public amenities and infrastructural facilities which are to be provided in the resettlement
area.
3. The draft Rehabilitation & Resettlement Scheme referred to in sub section (2) shall include time limit for
implementing Rehabilitation & Resettlement Scheme………."
Upon the publication of the preliminary notification under sub – section 1 of section 11 by the Collector, the Administrator for Rehabilitation and Resettlement shall conduct a survey and undertake a census of the affected families. In this regard, the report of Tehsildar Punjabi Bagh in respect of section 16 (1) of the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation & Resettlement Act, 2013 is as under:
(a) That as per revenue record of Village Bakkarwala khatoni year (2013-2014) the land recorded in khata no. 75 bearing khasra no. 5//11 (6-12), 5//12 (4-10) out of which from khasra no. 5//11 0.0456 hectare (approx 11 biswa) and from 5//12 0.042655 hectare (approx 10 biswa) are being acquired is in the name of Shri Amarjeet, Shri Rakesh, Shri Ravinder all sons of Sh. Jai Singh, Smt. Neelam D/o Sh. Jai Singh and Smt. Praksho Wd/o Sh. Jai Singh equal share 1/3 and Smt. Rampyari W/o Rajender Singh 1 /3 share and Sh. Sunil Kumar, Sh. Vinod Kumar, Sh. Pramod Kumar all sons of Sh. Bijender Singh equal share i.e. 1/3 Village6 DELHI GAZETTE : EXTRAORDINARY PART IV] Bakkarwala is recorded in revenue record. After acquisition of land of aforesaid land owners have also left with 84 bigha 8 biswa land in the aforesaid khata. That the land recorded in khata no. 171, khasra no. 5//13 (2-12) and 5//17 (5-5) out of which from khasra no. 5//13 0.042655 hectare (approx 10.5 biswa) and from khasra no. 5//17 (5-5) 0.054312 hectare (approx 13 biswa ) is being acquired. The ownership of khasra no. 5//13 and 17 is recorded in the name of Sh. Davinder Singh S/o Sh. Ranvir Singh r/o Village Bakkarwala. After acquisition of land of aforesaid land owners have also left with 9 bigha 14 biswa in this khata.
(b) That after acquisition of the land from Bhumidar, no effect falls on the said Bhumidar as enough land remains with them and no effect falls on landless persons as they are not dependent on the acquired land.
(c) That no public utility or government building exists on the land being acquired.
(d) That land which is being acquired is presently lying vacant.
(e) That the details of the Bhumidars whose land is being acquired has been given at above Sl. No. (a). Hence, Based on the Survey & Census report dated 01/11/2022 submitted by Tehsildar (Punjabi Bagh) under Section 16(1) & Social Impact Assessment Report the Draft Rehabilitation & Resettlement Scheme under section 16(2) is as under:-
