दिल्ली विद्युत विनियामक आयोग (टैरिफ के निर्धारण के लिए नियम और शतें) (प्रथम संशोधन) विनियम, 2023 F.3(679)/Tariff/DERC/2022-23/7460/27 —विद्युत अधिनियम, 2003 (2003 का अधिनियम 36) की धारा 61 और धारा 86(1)(बी) के साथ पठित, धारा 181 के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए और इस संबंध में इसे सक्षम करने वाली अन्य सभी शक्तियों और पिछले प्रकाशन के बाद, दिल्ली विद्युत विनियामक आयोग एतद् द्वारा,दिल्ली विद्युत विनियामक आयोग(टैरिफ के निर्धारण के लिए नियम और शतें)विनियम, 2017 (इसके बाद "प्रमुख विनियम" के रूप में संर्दर्भत) में संशोधन करने के लिए निम्नलिखित विनियम निर्माण करता है:

(1)2 DELHI GAZETTE : EXTRAORDINARY PART III] 1.0 संक्षिप्त शीर्षक और प्रारंभ:
(1) इन विनियमों को दिल्ली विद्युत विनियामक आयोग(टैरिफ के निर्धारण के लिए नियम और शतें) ( प्रथम संशोधन)विनियम, 2023कहा जा सकता है और ये 1/04/2023 से लागू होंगे।
2.0 प्रमुख विनियमों के विनियम 72 में नया प्रावधान:
"बशते कि संबंधित वित्तीय वर्ष की प्रभावी कर दर आयकर रिटर्न से प्राप्त की जाएगी।"
3.0 प्रमुख विनियमों के विनियम 77 में जोड़ा गया नया प्रावधान:
" बशते कि किसी वित्तीय वर्ष के लिए ब्याज की भारित औसत दर भुगतान किए गए ब्याज, सभी बैंक शुल्कों, सिंडिके शन शुल्क और संबंधित ऋणों को बढ़ाने और बनाए रखने के लिए उस वर्ष के दौरान भुगतान किए गए अन्य शुल्कों को शामिल करके निकाली जाएगी।"
4.0 प्रमुख विनियमों के विनियम 124 में संशोधन:
"(124) वितरण लाइसेंसधारी के नवीकरणीय खरीद दायित्व(आरपीओ) की लागत की गणना दिल्ली विद्युत नियामक आयोग (नवीकरणीय खरीद दायित्वऔर नवीकरणीय ऊर्जा प्रमाणपत्र फ्रेमवर्क कार्यान्वयन) विनियम, 2021 में यथा विर्निर्दष्ट नवीकरणीय ऊर्जा स्रोतों से विद्युत अधिप्राप्ति की अनुमोदित लागत और उसके बाद के संशोधनों के आधार पर की जाएगी:
बशते कि आरपीओ में कमी की मात्रा के लिए जुर्माना ट्रू-अप वर्ष के लिए पावर एक्सचेंज (आईईएक्स) में खोजे गए भारित औसत आरईसी मूल्य का 10% होगा।
आगे बशते कि नवीकरणीय ऊर्जा स्रोतों से विद्युत अधिप्राप्ति और नवीकरणीय ऊर्जा प्रमाणपत्रों की खरीद के लिए वास्तविक खर्च आयोग द्वारा ट्रू-अप किया जाएगा:
बशते यह भी कि यह आयोग विशिष्ट नियंत्रण अवधि के लिए व्यवसाय योजना विनियमों में पवन आरपीओ, अन्य आरपीओ और एचपीओ के लिए लक्ष्य र्निर्दष्ट करेगा:
बशते यह भी कि आरपीओ लक्ष्यों को पूरा न करने के लिए जुर्माना, जैसाकि इस आयोग द्वारा अपने टैरिफ आदेश में र्निर्दष्ट किया गया है, संबंधित वित्तीय वर्ष के टू-अप के दौरान एआरआर में समायोजित किया जाएगा।"

Delhi Electricity Regulatory Commission (Terms and Conditions for Determination of Tariff)
(First Amendment) Regulations, 2023
F.3(679)/Tariff/DERC/2022-23/7460/27.—In exercise of powers conferred under Section 181 read with Section 61 and Section 86(1)(b) of the Electricity Act, 2003 (Act 36 of 2003) and all other powers enabling it in this behalf, the Delhi Electricity Regulatory Commission hereby makes the following Regulations to amend the Delhi Electricity Regulatory Commission (Terms and Conditions for Determination of Tariff) Regulations, 2017(hereinafter referred to as "the Principal Regulations"):
1.0 Short Title and Commencement:
(1) These Regulations may be called the Delhi Electricity Regulatory Commission (Terms and Conditions for Determination of Tariff) (First Amendment) Regulations, 2023and shall be applicable from 1/04/2023 onwards.
[PART III DELHI GAZETTE : EXTRAORDINARY 32.0 New Proviso in Regulation 72 of Principal Regulations:
"Provided that Effective Tax Rate of the respective Financial Year shall be derived from the Income Tax returns."
3.0 New Proviso added in Regulation 77 of Principal Regulations:
"Provided that Weighted Average Rate of Interest for any Financial Year shall be arrived by including the Interest Paid, all Bank Charges, Syndication Fee and other Charges paid during that year for Raising and Maintaining of the respective loans."
4.0 Amendment in Regulation 124 of Principal Regulations:
"(124) The cost of Renewable Purchase Obligation (RPO) of the Distribution Licensee shall be computed on the basis of approved cost of power procurement from Renewable Energy Sources as specified in the Delhi Electricity Regulatory Commission (Renewable Purchase Obligation and Renewable Energy CertificateFramework Implementation) Regulations, 2021 and subsequent amendments thereof:
Provided that penalty for quantum of shortfall in RPO shall be 10% of weighted average REC price discovered at Power Exchange (IEX) for the Trued-up Year.
Provided further that the actual expenses for procurement of power from Renewable Energy Sources and purchase of Renewable Energy Certificates shall be trued up by the Commission:
Provided also that the Commission will specify the targets for Wind RPO,Other RPO and HPO in the Business Plan Regulations for a specific Control Period:
Provided also that the penalty for non fulfilment of RPO targets, as specified by the Commission in its Tariff Order, shall be adjusted in the ARR during True up of the relevant Financial Year."
