I दिल्ली, 25 मई, 2023 I I ः दिल्ली माल एवं सेवा कर अधिनियम, 2017 (2017 का 03) की धारा 9 की उपधारा (3) और उपधारा (4), धारा 11 की उपधारा (1), धारा 15 की उपधारा (5), और धारा 148 तहत प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, इस बात से संतुष्ट होते हुए कि ऐसा करना जनहित में आवश्यक है और जीएसटी परिषद की सिफारिशों के आधार पर, एतदद्वारा, इस सरकार की अधिसूचना संख्या 12/2017-राज्य कर (दर), जिसे सं.फा.03(15)/वित्त (राजस्व-I)/2017-18/डीएस-I/380, दिनांक 30 जून, 2017, के तहत दिल्ली के राजपत्र, असाधारण के भाग-IV में प्रकाशित किया गया था, में और आगे भी निम्नलिखित संशोधन करते हैं, यथाः-
उक्त अधिसूचना में, पैराग्राफ 3 में, स्पष्टीकरण में, खंड (IV) के बाद, निम्नलिखित खंड को अंतःस्थापित किया जाएगा,
अर्थात् :-

आयोजित करने के लिएनेशनल टेस्टिंग एजेंसी सहित केंद्र सरकार या राज्य सरकार द्वारा स्थापित किसी भी
प्राधिकरण, बोर्ड या निकाय को शिक्षण संस्थानों में प्रवेश के लिए प्रवेश परीक्षा के संचालन के माध्यम से
सेवाएं प्रदान करने के सीमित उद्देश्य के लिए शैक्षिक संस्थान माना जाएगा।''
2. यह अधिसूचना दिनांक 01 मार्च, 2023 से लागू होगी।
प्रधान अधिसूचना संख्या 12/2017-राज्य कर (दर), को सं.फा.03(15)/वित्त (राजस्व-I)/2017-18/डीएस-I/380,
दिनांक 30 जून, 2017, के तहत दिल्ली के राजपत्र, असाधारण के भाग-IV में प्रकाशित किया गया था, और इसमें अंतिम बार
अधिसूचना संख्या 15/2022-राज्य कर (दर), जिसे सं.फा.03(40)/वित्त(व्यय-I)/2022-23/डीएस-I/255, दिनांक 27 मार्च
2023, के तहत दिल्ली के राजपत्र, असाधारण के भाग-IV में प्रकाशित किया गया था, के द्वारा संशोधन किया गया था।

NOTIFICATION
Delhi, the 25th May, 2023
No. 01/2023-State Tax (Rate)
F. No. 3(42)/Fin. (Exp-I)/2022-23/DS-I/446.—In exercise of the powers conferred by sub-sections (3) and (4) of section 9, sub-section (1) of section 11, sub-section (5) of section 15 and section 148 of the Delhi Goods and Services Tax Act, 2017 (3 of 2017), the Lieutenant Governor of National Capital Territory of Delhi, on being satisfied that it is necessary in the public interest so to do, on the recommendations of the Council, hereby makes the following further amendmentin this Government's Notification, No.12/2017-State Tax (Rate), published in the Gazette of Delhi, Extraordinary, Part IV, vide number F.3 (15)/Fin (Rev-I)/2017-18/DS-VI/380, dated the 30th June, 2017, namely:—
In the said notification, in paragraph 3, in the Explanation, after clause (iv), the following clause shall be inserted, namely: -
"(iva) For removal of doubts, it is clarified that any authority, board or body set up by the Central Government or State Government including National Testing Agencyfor conduct of entrance examination for admission to educational institutionsshall be treated as educational institution for the limited purpose of providing services by way of conduct of entrance examination for admission to educational institutions.".
2. This notification shall come into force with effect from the01stMarch, 2023.
Note: The principal notification was published in the Gazette of Delhi, Extraordinary, vide notification No. 12/2017 - State Tax (Rate), published in the Gazette of Delhi, Extraordinary, Part IV, vide number F.3 (15)/Fin(Rev-I)/2017- 18/DS-VI/380, dated the 30th June, 2017 and last amended vide notification No. 15/2022 - State Tax (Rate), vide numberF. 3(40)/Fin.(Exp-I)/2022-23/DS-I/255 dated the 27th March, 2023.
