राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 13 जून, 2023 .—जबकि, गृह मंत्रालय, भारत सरकार द्वारा जारी दिनांक 21 अक्टूबर, 2014 की राजपत्र अधिसूचना सं0 2740 (ई) के साथ पठित दिनांक 21 जुलाई, 2015 की अधिसूचना सं0 एस.ओ. 2004 (ई) द्वारा भारत के माननीय राष्ट्रपति ने भूमि अधिग्रहण, पुनर्वास तथा पुनःस्थापन में उचित प्रतिपूर्ति एवं पारदर्शिता का अधिकार अधिनियम, 2013 (2013 का 30) के अंतर्गत उपयुक्त सरकार की शक्तियों को प्रत्यायोजित किया है तथा इसके अंतर्गत दिल्ली के उपराज्यपाल ने राष्ट्रीय राजधानी क्षेत्र दिल्ली के लिए नियम बनाए हैं।और जबकि, दिनांक 01.08.2017 की राजपत्र अधिसूचना अंकित फा0सं0/05/29/16/भू0 एवं भ0/प्रशा0/4216 द्वारा भूमि अधिग्रहण, पुनर्वास तथा पुनःस्थापन में उचित प्रतिपूर्ति एवं पारदर्शिता का अधिकार अधिनियम, 2013 (2013 का 30) की धारा 64 की उपधारा (1) के अंतर्गत भूमि अधिग्रहण के कारण प्रभावित व्यक्तियों के भूमि अधिग्रहण क्षतिपूर्ति, पुनर्वास तथा पुनःस्थापन से संबंधित विवादों का त्वरित निपटान करने के प्रयोजनार्थ राष्ट्रीय राजधानी क्षेत्र दिल्ली के माननीय उपराज्यपाल ने ''भूमि अधिग्रहण, पुनर्वास तथा पुनःस्थापन प्राधिकरण'' (एलएआरआर प्राधिकरण) का गठन किया है जिसमें पीठासीन अधिकारी भी शामिल है। इसके अतिरिक्त, भूमि 3770 DG/2023 (1) 2 DELHI GAZETTE : EXTRAORDINARY PART IV] अधिग्रहण, पुनर्वास तथा पुनःस्थापन प्राधिकारण के पास राष्ट्रीय राजधानी क्षेत्र दिल्ली के लिए 2013 के अधिनियम की धारा 64 के अंतर्गत बनाए गए संदर्भों पर विचार करने और निर्णय लेने का क्षेत्राधिकार होगा।

और जबकि, दिल्ली उच्च न्यायालय के माननीय मुख्य न्यायाधीश तथा माननीय न्यायधीश एतद्‌ द्वारा

अनुशंसित करते हैं कि एडीजे-2, पश्चिम, तीस हजारी न्यायालयों को भूमि अधिग्रहण, पुनर्वास तथा पुनःस्थापन में

उचित प्रतिपूर्ति एवं पारदर्शिता का अधिकार अधिनियम, 2013 के अंतर्गत भूमि अधिग्रहण, पुनर्वास तथा पुनःस्थापन

प्राधिकरण के पीठासीन अधिकारी के रूप में नामित किया जाए।

अब, इसलिए गृह मंत्रालय, भारत सरकार द्वारा जारी दिनांक 21 अक्टूबर, 2014 की अधिसूचना सं0 एस.ओ.

2740 (ई) तथा दिनांक 21 जुलाई, 2015 की अधिसूचना सं0 एस.ओ. 2004 (ई) के साथ पठित भूमि अधिग्रहण,

पुनर्वास तथा पुनःस्थापन में उचित प्रतिपूर्ति एवं पारदर्शिता का अधिकार अधिनियम, 2013 (2013 का 30) की धारा 51

की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उपयुक्त सरकार होने के नाते दिल्ली के उपराज्यपाल एतद्‌

द्वारा एडीजे-2, पश्चिम, तीस हजारी न्यायालयों को भूमि अधिग्रहण, पुनर्वास तथा पुनःस्थापन में उचित प्रतिपूर्ति एवं

पारदर्शिता का अधिकार अधिनियम, 2013 के अंतर्गत भूमि अधिग्रहण, पुनर्वास तथा पुनःस्थापन प्राधिकरण के पीठासीन

अधिकारी के रूप में नामित करते हैं।

Delhi, the 13th June, 2023

F. No. /05/29/2016/L&B/Admn./1691.—Whereas, vide Gazette notifications No. 2740 (E) dt. 21st October, 2014, read with No. S.O. 2004 (E) dated 21st July, 2015, issued by the Ministry of Home Affairs, Government of India, the Hon'ble President of India has delegated the powers of the appropriate Government under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) and the Rules made there under, within the National Capital Territory of Delhi to the Lieutenant Governor of Delhi.

And whereas, vide Gazette notification bearing No. F/05/29/16/L&B/Admn./4216 dated 01-08-2017, the Hon'ble Lieutenant Governor of National Capital Territory of Delhi constituted "Land Acquisition Rehabilitation and Resettlement Authority" (LARR Authority) consisting of Presiding Officer, for the purpose of providing speedy disposal of disputes relating to Land Acquisition, Compensation, Rehabilitation and Resettlement of the affected persons due to the acquisition of land under Sub-section (1) of section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013). Further, the Land Acquisition Rehabilitation and Resettlement Authority shall have the jurisdiction within the National Capital Territory of Delhi for entertaining and deciding the references made to it under section 64 of the Act of 2013.

And whereas Hon'ble Chief Justice and Hon'ble Judges of High Court of Delhi have pleased to recommend that the ADJ-2, West, Tis Hazari Courts may be designated as the Presiding Officer, Land Acquisition Rehabilitation and Resettlement Authority under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

Now, therefore in exercise of powers conferred by sub-section (1) of section 51 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013), read with notifications no. S.O. 2004 (E) dated 21st July 2015 and S.O. 2740 (E) dated 21st October, 2014, issued by Ministry of Home Affairs, Government of India, the Lieutenant Governor of Delhi being appropriate Government is pleased to designate ADJ-2, West, Tis Hazari Courts as Presiding Officer, Land Acquisition Rehabilitation and Resettlement Authority under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
