राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 3 जुलाई, 2023 21(15)/DSACS/FAS/DBT-C88C5/2020-21/1095.—जबकि, सेवाओं या लाभों या सब्सिडी के वितरण के लिए एक पहचान दस्तावेज के रूप में आधार का उपयोग सरकारी वितरण प्रक्रियाओं को सरल बनाता है, पारदर्शिता और दक्षता लाता है, तथा लाभार्थियों को अपनी पहचान साबित करने के लिए कई दस्तावेजों को प्रस्तुत करने की आवश्यकता को समाप्त करके एक सुविधाजनक और निर्बाध तरीके से सीधे अपनी पात्रता प्राप्त करने में सक्षम बनाता है;
और जबकि, स्वास्थ्य एवं परिवार कल्याण विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार (तत्पश्चात् विभाग के रूप में संदर्भित) मानव इम्यूनो डेफिसिएंसी वायरस/मानव इम्यूनो डेफिसिएंशी सिंड्रोम (एचआईवी/एड्स) के साथ जी रहे लोगों (पीएलएचए)/ एचआईवी/एड्स से संक्रमित बच्चों, (सीएलएचए), एचआईवी/एड्स से संक्रमित अनाथ/निराश्रित बच्चों (ओसीआई) तथा एचआईवी/एड्स से प्रभावित अनाथ बच्चों (ओसीए) (तत्पश्चात योजना के रूप में संदर्भित) के लिए वित्तीय सहायता योजना का संचालन कर रहा है; जिसे दिल्ली राज्य एड्स नियंत्रण सोसाइटी (तत्पश्चात् कार्यान्वयन एजेसी के रूप में संदर्भित) के माध्यम से लागू किया जा रहा है;
और जबकि, योजना के अंतर्गत, वित्तीय सहायता (तत्पश्चात् लाभ के रूप में संदर्भित) मौजूदा योजना दिशा-निर्देशों के अनुसार कार्यान्वयन एजेसी द्वारा एचआईवी/एड्स (तत्पश्चात् लाभार्थियों के रूप में संदर्भित) द्वारा संक्रमित/प्रभावित अनाथ बच्चों सहित एचआईवी/एड्स से पीड़ित लोगों तथा बच्चों को दी जाएगी;

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] और जबकि, पूर्वोक्त योजना में राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार की संचित निधि से किया गया आवर्ती व्यय शामिल है;
अब, इसलिए, आधार (वित्तीय और अन्य सब्सिडी, लाभों और सेवाओं का लक्षित वितरण) अधिनियम, 2016 (2016 का 18) (तत्पश्चात् उक्त अधिनियम के रूप में संदर्भित) की धारा 7 के अनुसरण में, सरकार एतद् द्वारा निम्नलिखित को अधिसूचित करती है, अर्थात :-
1. (1) योजना के अन्तर्गत लाभों को प्राप्त करने के लिए पात्र व्यक्ति को एतद् द्वारा आधार संख्या के सत्र का प्रमाण प्रस्तुत करना या आधार प्रमाणीकरण से गुजरना अपेक्षित होगा।
(2) योजना के अन्तर्गत लाभों को प्राप्त करने के इच्छुक कोई भी व्यक्ति जिसके पास आधार संख्या नहीं है या, जिसने अभी तक आधार के लिए नामांकन नहीं कराया है, को योजना हेतु पंजीकरण करने से पूर्व आधार नामांकन कराने के लिए आवेदन करना अपेक्षित होगा; बशर्ते कि वह उक्त अधिनियम की धारा 3 के अनुसार आधार प्राप्त करने का हकदार हो, तथा ऐसे व्यक्तियों को आधार हेतु नामांकन कराने के लिए किसी भी आधार नामांकन केन्द्र (भारतीय विशिष्ट पहचान प्राधिकरण (यूआईडीएआई) की वेबसाइट www.uidai.gov.in पर उपलब्ध सूची) पर जाना होगा।
(3) आधार (नामांकन और अद्यतन) विनियमन, 2016 के विनियमन 12 के अनुसार, विभाग को अपनी कार्यान्वयन एजेंसी के माध्यम से उन लाभार्थियों के लिए आधार नामांकन सुविधाएं प्रदान करना आवश्यक है जो अभी तक आधार के लिए नामांकित नहीं हैं और संबंधित ब्लॉक या तालुका अथवा तहसील में कोई भी आधार नामांकन केंद्र स्थित न होने के मामले में, विभाग अपनी कार्यान्वयन एजेंसी के माध्यम से यूआईडीएआई के मौजूदा रजिस्ट्रार के समन्वय में या स्वयं यूआईडीएआई रजिस्ट्रार बनकर सुविधाजनक स्थानों पर आधार नामांकन सुविधाएं प्रदान करेगाः
बच्चों के मामलों के अलावा, किसी व्यक्ति को जब तक आधार नहीं मिल जाता है, तब तक ऐसे व्यक्ति को योजना के अन्तर्गत लाभ दिया जाएगा, बशर्ते कि वो निम्नलिखित दस्तावेजों को प्रस्तुत करने में समर्थ हो, अर्थात :-
(क) यदि उसने नामांकन किया है, तो उसकी आधार नामांकन पहचान पर्ची; तथा
(ख) निम्नलिखित दस्तावेजों में से कोई एक दस्तावेज, अर्थात :-
(i) फोटो सहित बैंक या पोस्ट आफिस पासबुक; या
(ii) स्थायी खाता संख्या (पैन) कार्ड; या
(iii) पासपोर्ट; या
(v) मतदाता पहचान कार्ड; या
(vi) महात्मा गांधी राष्ट्रीय ग्रामीण रोजगार गारंटी अधिनियम (मनरेगा) कार्ड; या
(vii) किसान फोटो पासबुक; या
(viii) मोटर वाहन अधिनियम, 1988 (1988 का 59) के अन्तर्गत लाइसेंसिंग प्राधिकरण द्वारा जारी ड्राइविंग लाइसेंस; या (ix) आधिकारिक लेटरहैड पर राजपत्रित अधिकारी अथवा तहसीलदार द्वारा जारी किसी भी व्यक्ति का फोटो वाला पहचान पत्र; या
(x) विभाग द्वारा यथानिर्दिष्ट कोई अन्य दस्तावेजः
आगे यह भी उपबंधित है कि बच्चों के मामले में, जब तक बच्चे को आधार नहीं दिया जाता है, तब तक योजना के अन्तर्गत लाभ ऐसे बच्चों को दिया जाएगा, जो निम्नलिखित दस्तावेजों को प्रस्तुत करने मेें समर्थ होंगे, अर्थात :-
(क) यदि बच्चे को पांच वर्ष की आयु प्राप्त करने के पश्चात नामांकित किया गया है (बॉयोमेट्रिक्स संग्रह के साथ) तो उसकी आधार नामांकन पहचान पर्ची, या बायो-मेट्रिक अद्यतन पहचान पर्ची; तथा
(ख) निम्नलिखित दस्तावेजों में से कोई एक, अर्थातः -
(i) जन्म प्रमाण-पत्र; या उपयुक्त प्राधिकारी द्वारा जारी जन्म का रिकॉर्ड; या
(ii) स्कूल पहचान पत्र, स्कूल के प्रधानाचार्य द्वारा विधिवत हस्ताक्षरित, माता-पिता के नाम सहित; तथा
(ग) मौजूदा योजना के दिशानिर्देशों के अनुसार माता-पिता या कानूनी अभिभावक के साथ लाभार्थी के संबंध के साक्ष्य के रूप में
निम्नलिखित दस्तावेजों में से कोई एक, अर्थातः -
(i) जन्म प्रमाण-पत्र; या उपयुक्त प्राधिकारी द्वारा जारी जन्म का रिकॉर्ड; या[PART IV DELHI GAZETTE : EXTRAORDINARY 3 (ii) राशन कार्ड; या
(iii) भूतपूर्व सैनिक अंशदायी स्वास्थ्य योजना (ईसीएचएस) कार्ड; या कर्मचारी राज्य बीमा निगम (ईएसआईसी) कार्ड या केन्द्रीय सरकार स्वास्थ्य योजना (सीजीएचएस) कार्ड; या
(iv) पेंशन कार्ड; या
(v) सेना कैंटीन कार्ड; या
(vi) कोई भी सरकारी परिवार पात्रता कार्ड; या़
(vii) विभाग द्वारा यथानिर्दिष्ट कोई अन्य दस्तावेज;
आगे यह भी उपबंधित है कि इस प्रयोजनार्थ विभाग द्वारा विशेष रूप से नामित अधिकारी द्वारा उपरोक्त दस्तावेजों की जांच की जाएगी।
2. योजना के अन्तर्गत लाभार्थियों को सुविधानुसार लाभ उपलब्ध कराने हेतु विभाग अपनी कार्यान्वयन एजेंसी के माध्यम से उक्त आवश्यकता से अवगत कराने के लिए मीडिया के माध्यम से लाभार्थियों को व्यापक प्रचार-प्रसार सुनिश्चित करने के लिए समस्त आवश्यक व्यवस्थाएँ करेगा।
3. सभी मामलों में, जहां लाभार्थियों की खराब बायोमेट्रिक्स के कारण या किसी अन्य कारण से आधार प्रमाणीकरण विफल हो जाता है, तो निम्नलिखित उपचारात्मक तंत्र को अपनाया जाएगा : -
(क) खराब फिंगरप्रिंट गुणवत्ता के मामले में, प्रमाणीकरण के लिए आईरिस स्कैन या फेस ऑथेंटिकेशन सुविधा को अपनाया जाएगा। एतद् द्वारा विभाग अपनी कार्यान्वयन एजेंसी के माध्यम से आईरिस स्कैनर या फेस ऑथेंटिकेशन के साथ-साथ फिंगरप्रिंट प्रमाणीकरण के लिए प्रावधान करेगा ताकि निर्बाध रूप से लाभ प्रदान किया जा सके;
(ख) फिंगरप्रिंट या आईरिस स्कैन या फेस ऑथेंटिकेशन के माध्यम से बायोमेट्रिक प्रमाणीकरण सफल नहीं होने की स्थिति में, जहां भी संभव तथा स्वीकार्य हो, आधार वन टाइम पासवर्ड या सीमित समय वैधता के साथ टाइम-आधारित वन-टाइम पासवर्ड, जैसा भी मामला हो, द्वारा प्रमाणीकरण प्रस्तुत किया जाएगाः
(ग) अन्य सभी मामलों में, जहां बायोमेट्रिक या आधार वन टाइम पासवर्ड या टाइम-आधारित वन-टाइम पासवर्ड प्रमाणीकरण संभव नहीं है, तो योजना के अंतर्गत भौतिक आधार पत्र के आधार पर लाभ दिया जा सकता है, जिसकी प्रामाणिकता आधार पत्र पर मुद्रित त्वरित प्रतिक्रिया (क्यूआर) कोड के माध्यम से सत्यापित की जा सकती है और त्वरित प्रतिक्रिया (क्यूआर) कोड रीडर की आवश्यक व्यवस्था विभाग द्वारा अपनी कार्यान्वयन एजेंसी के माध्यम से सुविधाजनक स्थानों पर उपलब्ध कराई जाएगी।
4. (1) उपरोक्त के अतिरिक्त, यह सुनिश्चित करने के लिए कि योजना के अंतर्गत कोई भी वास्तविक लाभार्थी अपने देय लाभों से वंचित नहीं है, विभाग अपनी कार्यान्वयन एजेंसी के माध्यम से डीबीटी मिशन, कैबिनेट सचिवालय, भारत सरकार दिनांक 19 दिसम्बर 2017 के कार्यालय ज्ञापन में निर्दिष्ट अपवाद प्रबंधन तंत्र का पालन करेगा।
(2) यहां उपरोक्त में कुछ भी अन्तर्निहित होते हुए भी, किसी भी बच्चे को प्रमाणीकरण के माध्यम से अपनी पहचान स्थापित करने में विफल रहने, या आधार संख्या होने का प्रमाण प्रस्तुत करने में विफल होने पर, अथवा ऐसे बच्चे के मामले में, जिसे आधार संख्या नहीं दी गई है, किन्तु नामांकन के लिए आवेदन किया है, को योजना के अन्तर्गत लाभ से वंचित नहीं किया जाएगा। पैरा 1 के उप-पैराग्राफ (3) के परंतुक के खंड (ख) और (ग) में यथा उल्लिखित अन्य दस्तावेजों के आधार पर उसकी पहचान की पुष्टि करके उसे लाभ दिया जाएगा और जहां लाभ ऐसे अन्य दस्तावेजों के आधार पर दिए गए, वहाँ उसका रिकॉर्ड अनुरक्षित करने के लिए एक अलग रजिस्टर रखा जाएगा, जिसकी विभाग द्वारा अपनी कार्यान्वयन एजेंसी के माध्यम से समीक्षा और लेखा परीक्षा की जाएगी।
5. यह अधिसूचना शासकीय राजपत्र में अपने प्रकाशन की तिथि से प्रभावी होगी।

NOTIFICATION
Delhi, the 3rd July, 2023
F. No. 21(15)/DSACS/FAS/DBT-C88C5/2020-21/1095.—Whereas, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;
And whereas the Department of Health & Family Welfare, Govt. of NCT of Delhi (here in after referred to as the Department), is administering the Financial Assistance Scheme for People Living with Human Immuno Deficiency Virus / Human Immuno Deficiency Syndrome (HIV/AIDS) (PLHAs)/ Children Living With HIV/AIDS (CLHA), Orphan/Destitute Children infected with HIV/AIDS (OCI) and Orphan Children affected by HIV/AIDS(OCA) (hereinafter referred to as the Scheme), which is being implemented through the Delhi State AIDS Control Society, (hereinafter referred to as the Implementing Agency);
And whereas, under the Scheme, Financial Assistance (hereinafter referred to as the benefit) will be given to People & Children living with HIV/AIDS including Orphan children infected/ affected by HIV/AIDS (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the extant Scheme guidelines;
And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of National Capital Territory of Delhi;
Now, therefore, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Government of National Capital Territory of Delhi; hereby notifies the following, namely:-
1 (1) An individual eligible for receiving the benefits under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.
(2) Any individual desirous of availing benefits under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment before registering for the Scheme provided that he is entitled to obtain Aadhaar as per section 3 of the said Act, and such individuals shall visit any Aadhaar enrolment centre (list avai- lable at the Unique Identification Authority of India (UIDAI) website (www.uidai.gov.in) to get enrolled for Aadhaar.
(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:
Provided that till the time Aadhaar is assigned to the individual other than a child, benefits under the Scheme shall be given to such individual, subject to the production of the following documents, namely:-
(a) if he has enrolled. his Aadhaar Enrolment Identification slip; and
(b) any one of the following documents, namely :-
(i) Bank or Post office Passbook with Photo; or
(ii) Passport; or
(iii) Ration Card; or
(iv) Voter Identity Card; or
(v) Mahatma Gandhi National Rural Employment Guarantee
[PART IV DELHI GAZETTE : EXTRAORDINARY 5Act (MGNREGA) card; or
(vi) Kisan Photo passbook; or
(vii) Driving license issued by the Licensing Authority under the Motor Vehicles Act. 1988 (59 of 1988); or
(viii) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or
(ix) any other document as specified by the Department:
Provided further that in case of children till the time Aadhaar is assigned to the Child, benefits under the Scheme shall be given to such children Subject to the production of the following documents, namely:-
(a) if the child has been enrolled after attaining the age of five years (with biometrics collection), his Aadhaar Enrolment Identification slip, or of bio-metric update identification slip; and
(b) any one of the following documents, namely :-
(i) Birth Certificate; or Record of birth issued by the appropriate authority; or (ii) School identity card, duly signed by the Principal of the school, containing parents' names; and
(c) any one of the following documents as proof of relationship of the beneficiary with the parent or legal guardian as per the extant Scheme guidelines, namely:-
(i) Birth Certificate; or Record of birth issued by the appropriate authority; or (ii) Ration Card; or
(iii) Ex-Servicemen Contributory Health Scheme (ECHS) Card; or Employees'State Insurance Corporation (ESIC) Card; or Central Government Health Scheme (CGHS) Card; or
(iv) Pension Card; or
(v) Army Canteen Card; or
(vi) Any Government Family Entitlement Card; or
(vii) Any other document as specified by the Department;
Provided further that the above documents may be checked by an officer specifically designated by the Department for that purpose.
2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through the media shall be given to the beneficiaries to make them aware of the said requirement of Aadhaar under the scheme.
3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely: -
(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication. Hereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger-print authentication for delivery of benefits in seamless manner;
(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;
(c) in all other cases where biometric or Aadhaar One Time Password or Time-based One- Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response (QR) code printed on the Aadhaar letter and the6 DELHI GAZETTE : EXTRAORDINARY PART IV] necessary arrangement of QR code reader shall be provided at the convenient locations by the Department through its Implementing Agency.
4. (1) In addition to the above, in order to ensure that no bonafide beneficiary under the Scheme is deprived of his due benefits, the Department through its Implementing Agency shall follow the exception handling mechanism as outlined in the Office Memorandum of DBT Mission, Cabinet Secretariat, Government of India dated 19th December 2017.
(2) Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or furnishing proof of possession of Aadhaar number, or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment. The benefit shall be given to him by verifying his identity on the basis of other documents as mentioned in clauses (b) and (c) of the proviso of sub-paragraph (3) of paragraph 1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Department through its Implementing Agency.
5. This notification shall come into effect from the date of its publication in the Official Gazette.
