फा. सं. 11(35)/प्रषा./वि.न्याय एवं वि. कार्य/18/8178.-गृह मंत्रालय, भारत सरकार की दिनांक 13 जुलाई, 1959 की अधिसूचना जीएसआर 840 के साथ पठित संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, एतद्द्वारा विधि, न्याय एवं विधायी कार्य विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में ''स्टाफ कार चालक (सामान्य ग्रेड)''केपद की भर्ती पद्वति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. संक्षिप्त शीर्षक एवं प्रारंभ :- (i) इन नियमों को '' स्टाफ कार चालक (सामान्य ग्रेड)'' भर्ती नियम, 2023 कहा जाए। (ii) ये दिल्ली राजपत्र में अपने प्रकाशन की तिथि से लागू होंगे।
2. पदों की संख्या, वर्गीकरण तथा वेतन मैट्रिक्स में स्तर :-उक्त पदों की संख्या, उनका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर इन नियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथाविनिर्दिष्ट होंगे। 5072DG/2023
(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 3. भर्ती पद्धति, आयु सीमा, अन्य योग्यता इत्यादि :-उक्त पदों की भर्ती पद्धति, आयु सीमा, योग्यता एवं इससे संबंधित अन्य मामलें उक्त अनुसूची के कॉलम (5) से (13) में यथाविनिर्दिष्ट होंगे।
4. अयोग्यता :-वह व्यक्ति
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या विवाह की संविदा की है
या
(ख) जो एक जीवित पति/पत्नी के होते हुए किसी व्यक्ति से विवाह कर चुका है या विवाह अनुबंध कर चुका है,
वह उक्त पद पर नियुक्ति का पात्र नहीं होगा।
शर्त यह है कि यदि सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति एवं विवाह के अन्य पक्ष पर लागू व्यक्तिगत कानून के अंतर्गत अनुमत है और ऐसा करने के लिये अन्य आधार हैं किसी ऐसे व्यक्ति को इस नियम के प्रवर्तन की छूट दे सकती है।
5. षिथिल करने की शक्ति :-जहां सरकार का यह मत हो कि ऐसा करना आवश्यक अथवा समीचीन है, तो वह कारणों को लिखित में अभिलेखबद्ध करते हुए आदेश द्वारा व्यक्तियों की किसी श्रेणी या वर्ग के इन नियमों के किसी उपबंध को छूट दे सकती है।
6. बचावः-इन नियमों में किसी उल्लेख से सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिक अथवा अन्य विशेष वर्गों के व्यक्तियों के लिये अपेक्षित आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा।

| 7. | सीधी भर्ती वाले उम्मीदवारों से अपेक्षित शैक्षिक तथा अन्य योग्यताएं | ः अनिवार्यः- | दसवीं कक्षा उत्तीर्ण । (i) (ii) मोटर कार हेतु वैध ड्राइविंग लाइसेंस का होना । (iii) मोटर तंत्र की जानकारी (उम्मीदवार को वाहन में छोटी विकृतिओं को दूर करने मे ं सक्षम होना चाहिए)। (iv) मोटर कार चलाने का कम से कम तीन वर्ष का अनुभव। वांछनीयः- होम गार्ड/नागरिक स्वयं सेवकों के रूप में 3 वर्ष की सेवा। टीप : अन्यथा सुयोग्य उम्मीदवारों के मामले में योग्यताएं सक्षम प्राधिकारी के विवेक पर शिथिलनीय हैं । ट ीपः यदि चयन की किसी अवस्था में सक्षम प्राधिकारी के अभिमत से |
| अनुसूचित जातियों अथवा अनुसूचित जनजातियों के लिए आरक्षित रिक्तियों को भरने हेतु अपेक्षित अनुभव रखने वाले इन जातियों के उम्मीदवारों के पर्याप्त संख्या में मिलने की संभावना नहीं है तो अनुभव संबंधी योग्यता सक्षम प्राधिकारी के विवेक पर शिथिलनीय है। | |||

| 11. | यदि पदोन्नति/प्रतिनियुक्ति/समावेशन द्वारा भर्ती होनी हो तो ग ्रेड जिनसे पदोन्नति /प्रतिनियुक्ति /समावेशन किया जाना है | ः | प्रतिनियुक्ति/समावेशन :- केन्द्र सरकार /राज्य सरकार या केन्द्र शासित प्रदेशों के अधिकारी : (क) (i) मूल संवर्ग या विभाग में नियमित आधार पर समरूप पदधारी, अथवा ( ii) जिस कार्यालय में रिक्तियां हैं उसमें तीन वर्ष की नियमित सेवा सहित वेतन मैट्रिक्स के स्तर-1 (18000-56900 रूपये) में समूह-ग के कर्मचारियों में से, जिसके न होने पर केन्द्र सरकार/राज्य सरकार/संघ शासित क्षेत्रों में तीन वर्ष की नियमित सेवा सहित वेतन मैट्रिक्स के स्तर-1 (18000-56900 रूपये) में समूह-ग के कर्मचारियों में से तथा ड्राईविंग परीक्षा के आधार पर मोटर कार चलाने की क्षमता का आकलन करना । तथा ख् ा) कॉलम 7 में यथानिर्धारित निम्नलिखित योग्यता एवं अनुभव रखने वाले । ट ीप 1ः- प्रतिनियुक्ति की अवधि म ें केन्द्र सरकार/राज्य सरकार/संघ शासित क्षेत्र के उसी या कोई अन्य संगठन / विभाग ने इस नियुक्ति से तुरन्त पूर्वधारित अन्य गैर संवर्ग पद में प्रतिनियुक्ति की अवधि भी सम्मिलित है, यह सामान्यतः तीन वर्ष से अधिक नहीं होगी। टीप-2ः- प्रतिनियुक्ति/समावेशन द्वारा नियुक्ति हेतु अधिकतम आयु सीमा आवेदन प्राप्ति की अन्तिम तारीख को '56 वर्षों से अधिक नहीं होगी'। |

NOTIFICATION
Delhi, the 7th August, 2023
F. No. 11(35)/Admn/LJ&LA/18/8178.—In exercise of the powers conferred by the proviso to article 309 of the Constitution read with Government of India, Ministry of Home Affair's Notification GSR 840 dated 13th July, 1959, the Lieutenant Governor, National Capital Territory of Delhi is pleased to make the following rules regulating the method of recruitment to the post of "STAFF CAR DRIVER (ORDINARY GRADE)" in the Law, Justice and Legislative Affairs Department, Government of National Capital Territory of Delhi, namely:-
1. Short title and commencement – (i) These rules may be called "Staff Car Driver (Ordinary Grade)" Recruitment Rules, 2023.
(ii) They shall come into force on the date of their publication in the Delhi Gazette.
2. Number of Posts, classification and Level in the Pay Matrix – The number of post, its classification and Level in the Pay Matrix shall be specified in columns (2) to (4) of the Schedule attached with these rules.
3. Method of recruitment, age limit and other qualification, etc.. – The method of recruitment to the said post, age limit, qualification and other matter relating thereto shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualifications – No person, -
(a) Who has entered into or contracted a marriage with a person having a spouse living, or (b) Who having a spouse living, has entered into or contracted a marriage with any person;
shall be eligible for appointment to the said post;
Provided that the Government may, if satisfied, that such marriage is permissible under the personnel law applicable to such person and the other party to the marriage and that there are other ground for doing so, exempt any person from the operation of this regulation.
5. Power to relax – Where the Government is of the opinion that if necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, may relax any of the provisions of this rule with respect of any class or category of persons.
6. Saving – Nothing in these rules shall affect reservations, relaxation of age limit and other concession required to be provided for the Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-servicemen or any other special category of persons in accordance with the orders issued by the Government from time to time in this regard.

Note 1: The qualifications are relaxable at the discretion of the competent authority in the case of candidates otherwise well qualified. Note 2: The qualification(s) regarding experience is relaxable at the discretion of the competent authority in the case of candidates belonging to the Scheduled Castes or Scheduled Tribes if at any stage of selection, the competent authority is of the opinion that the sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancy reserved for them. |
