फा. सं.-19(7)/2021/वि.स.स./स्था.शाखा/3467-73.—गृह मंत्रालय, भारत सरकार की दिनांक 13 जुलाई, 1959 की अधिसूचना संख्या-एफ 27/59-हिम (1) के साथ पठित भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा इस सरकार के दिनांक 20 मई, 1999 की अधिसूचना के अधिक्रमण में ऐसे अधिक्रमण से पूर्व की जाने वाली या लोप किये जाने वाली बातों को छोड़कर, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, विधान सभा सचिवालय, राष्ट्रीय राजधानी क्षेत्र, दिल्ली सरकार में ''स्टाफ कार चालक (श्रेणी-II)'' के पद हेतु भर्ती पद्धति को विनियमित करने के लिये निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. संक्षिप्त शीर्षक एवं प्रारंभ : (i) इन नियमों को ''स्टाफ कार चालक (श्रेणी-II)'' भर्ती नियमावली, 2023 कहा जायेगा।
(ii) ये दिल्ली राजपत्र में अपनेे प्रकाशन की तारीख से लागू होंगे।
2. पदोें की संख्या, वर्गीकरण तथा वेतन मैट्रिक्स में स्तर :- पद की संख्या, इनका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर इन नियमों के साथ संलग्न अनुसूची के कॉलम 2 से 4 में यथाविनिर्दिष्ट होंगे।

5492 DG/20232 DELHI GAZETTE : EXTRAORDINARY PART IV] 3. भर्ती पद्धति, आयु सीमा तथा अन्य योग्यताएं इत्यादि :- उक्त पद की भर्ती पद्धति, आयु सीमा, योग्यताएं एवं इससे संबंधित अन्य मामलेें उक्त अनुसूची के कॉलम 5 से 13 में यथाविनिर्दिष्ट होंगे।
4. निरर्हता :- वह व्यक्ति,
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; या
(ख) जो अपने जीवित पति/पत्नी के होते हुए किसी व्यक्ति से विवाह कर चुका है या विवाह अनुबंध कर चुका है,
वह उक्त पद पर नियुक्ति का पात्र नहीं होगा।
शर्त यह है कि यदि सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति एवं विवाह के अन्य पक्ष पर लागू व्यक्तिगत कानून के अन्तर्गत अनुमत है और ऐसा करने के लिए अन्य आधार है किसी ऐसे व्यक्ति को इस नियम के प्रवर्तन की छूट दे सकती हैै।
5. शिथिल करने की शक्ति :- जहां सरकार का यह मत हो कि ऐसा करना आवश्यक समीचीन है, तो वह कारणों को लिखित में अभिलेखबद्ध करते हुए आदेश द्वारा व्यक्तियों की किसी श्रेणी या वर्ग के इन नियमों के किसी उपबंध को छूट दे सकती है।
6. बचाव :- इन नियमों में किसी उल्लेख से सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडा वर्ग, भूतपूर्व सैनिक या अन्य विशेष वर्गों के व्यक्तियों के लिए अपेक्षित आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा।

| प्रतिनियुक्ति/समावेशन द्वारा भर्ती होनीे हो तो श्रेणी जिनसे पदोन्नति/प्रतिनियुक्ति/ समावेशन किया जाना है। | वेतन मेट्रिक्स के स्तर-2 में रूपये 19,900-63,200/- में स्टाफ कार चालक (सामान्य श्रेणी) जिन्हो ंने उस श्रेणी में 8 वर्ष की नियमित सेवा की हो और परिवहन विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली के द्वारा निर्दिष्ट व्यावसायिक परीक्षा उत्तीर्ण की हो। टीप-जिन कनिष्ठ अधिकारियों ने अपनी अर्हक/पात्रता सेवा पूरी कर ली है। वे पदोन्नति के लिए विचारणीय हैं। उनके वरिष्ठ अधिकारी भी पदोन्नति के लिए विचारणीय होंगे। बशर्ते कि उनके लिए अपेक्षित अर्हक/पात्रता सेवा ऐसी अपेक्षित अर्हक/पात्रता सेवा की अवधि के आधे से न्यून या दो वर्ष से कम न हो और उन्होंने आगामी उच्च ग्रेड पर पदोन्नति के लिए अपनी परिविक्षा अवधि अपने कनिष्ठ अधिकारियों के साथ सफलतापूर्वक पूरी कर ली हो, जिन्होंने (कनिष्ठ अधिकारी) उतनी अर्हक/पात्रता पहले ही पूरी कर ली है। | |

NOTIFICATION
Delhi, the 25th August, 2023
F. No. 19(07)/2021/LAS/Estt./3467-73.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, read with the Government of India, Ministry of Home Affairs Notification No.F.27/59- Him(i) dated the 13th July, 1959 and in supersession of this Government's notification dated 20th May, 1999 except as respects things done or omitted to be done before such supersession, the Lt. Governor, National Capital Territory of Delhi is pleased to make the following rules regulating the method of recruitment to the post of "Staff Car Driver (Grade-II)" in the Legislative Assembly Secretariat of the Government of National Capital Territory of Delhi, namely:-
1. Short title and commencement:- (i) These rules may be called "Staff Car Driver (Grade-II)" Recruitment Rules, 2023.
(ii) They shall come into force on the date of their publication in the Delhi Gazette.
2. Number of posts, classification and level in the pay matrix:- The number of post, its classification and level in the Pay Matrix shall be as specified in columns 2 to 4 of the Schedule attached with these rules.
3. Method of recruitment, age limit and other qualifications, etc:- The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in the columns 5 to 13 of the said Schedule.
4. Disqualifications:- No person;

Provided that the Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other ground for so doing, exempt any person from the operation of this rule.
5. Power to relax:- Where the Government is of the opinion that it is necessary expedient so to do, it may by order, and for reasons to be recorded in writing, relax any of the provisions of this rules with respect of any class or category of persons.
6. Saving:- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Schedule Tribes, Other Backward Classes, Ex-servicemen or any special categories of persons in accordance with orders issued by the Government from time to time in this regard.
