फा. सं. ए/डी/एम/एल.ए.सी/द० पू०/2023/5.-860.—भारत सरकार गृह मंत्रालय की अधिसूचना संख्या का.आ. 2740 (अ) दिनांक 21 अक्तूबर, 2014 को एस.ओ. 2014 (अ) दिनांक 21.07.2015 के साथ पठित उचित मुआवजा और भूमि अधिग्रहण में पारदर्शिता, पुनर्वास और पुनःस्थापन अधिकार अधिनियम 2013 की धारा 11 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र के उपराज्यपाल को प्रतीत होता है, उपयुक्त सरकार होने के नाते सराय काले खां से मयूर विहार नई दिल्ली तक बारापुल्ला नाला के ऊपर एलिवेटेड रोड के निर्माण हेतु परियोजना के तीसरे चरण के लिए सार्वजनिक प्रयोजन के लिए जिला दक्षिण पूर्व में सब डिवीजन डिफें स कॉलोनी के नगली रजापुर गांव में कु ल 1169.093वगर्मीटर (0.1169093 हेक्टेयर) भूमि की आवश्यकता है । सामाजिक प्रभाव आकलन यूनिट स्कू ल ऑफ ह्यूमन इकोलॉजी, अंबेडकर विश्वविद्यालय, दिल्ली द्वाराएक सामाजिक प्रभाव आकलन अध्ययन किया गया था और सामाजिक प्रभाव आकलन रिपोर्ट 21 अगस्त, 2023 को प्रस्तुत की थी। सामाजिक प्रभाव आकलन रिपोर्ट प्रारंभिक जांच का सारांश निम्रानुसार है।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] सामाजिक प्रभाव आकलन रिपोर्ट के अनुसार, अपेक्षित पार्सल भूमि वैध और वास्तविक सार्वजनिक उद्देश्य को पूरा करती है और न्यूनतम मात्रा में भूमि है। प्रस्तावित भूमि अधिग्रहण के कारण किसी भी परिवार के विस्थापित होने की संभावना नहीं है।
प्रस्तावित भूमि अधिग्रहण के कारण किसी भी परिवार के विस्थापित होने की संभावना नहीं है।
अतिरिक्त जिला मजिस्ट्रेट, दक्षिण पूर्व, राजस्व विभाग राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार को प्रभावित परिवारों के पुनर्वास और पुनः स्थापन के उद्देश्य के लिए प्रशासक के रूप में नियुक्त किया गया है। इसलिए अधिग्रहण के अधीन मापन 1169.093वगर्मीटर (0.1169093 हेक्टेयर) भूमि का हिस्सा जिला दक्षिण पूर्व में सब डिवीजन डिफें स कॉलोनी के नगली रजापुर गांव में उपरोक्त परियोजना के लिए अधिसूचित किया जाता है. अधिग्रहण की जाने वाली भूमि का विस्तृत विवरण निम्नलिखित है।

यह अधिसूचना सभी संबंधित के लिए उचित मुआवजा और भूमि अधिग्रहण में पारदर्शिता, पुनर्वास और पुनःस्थापन अधिकार अधिनियम, 2013 के अन्तर्गत बनाई गई है।
अधिग्रहित की जाने वाली भूमि योजना तथा अन्य विवरण हितधारी व्यक्तियों द्वारा कार्यालय, जिला क्लेक्टर, जिला (दक्षिण पूर्व), राजस्व विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार और मुख्य परियोजना प्रबन्धक (फलाई ओवर), लोक निर्माण विभाग, दिल्ली, में किसी भी कार्य दिवस परकार्य समय के दौरान निरीक्षण किया जा सकता है। सरकार ने उक्त अधिनियम की धारा 12 में दिए गए और निर्दिष्ट अनुसार अतिरिक्त जिला मजिस्ट्रेट (दक्षिण-पूर्व) और उनके कर्मचारियों को भूमि में प्रवेश करने और सर्वेक्षण करने, किसी भी भूमि का स्तर लेने, उप-मिट्टी में खुदाई करने या बोर करने और उनके उचित निष्पादन के लिए आवश्यक अन्य सभी कार्य करने के लिए अधिकृ त किया है। अधिनियम की धारा 11 (4) के तहत, कोई भी व्यक्ति कलेक्टर की पूर्व अनुमति के बिना इस अधिसूचना के प्रकाशन की तारीख से कोई लेनदेन नहीं करेगा या इसभूमि का कोई लेनदेन यानी बिक्री/खरीद आदि नहीं करेगा, या ऐसी भूमि पर कोई अतिक्रमण नहीं करेगा।
अधिग्रहण पर आपत्ति, यदि कोई हो, इस अधिसूचना के प्रकाशन की तारीख से 60 (साठ) दिनों के भीतर अधिनियम की धारा 15 के तहत कलेक्टर (दक्षिण-पूर्व), ओल्ड गार्गी कॉलेज बिल्डिंग, एलएसआर बिल्डिंग, लाजपत नगर IV, नई दिल्ली। के समक्ष इच्छु क व्यक्ति द्वारा दायर की जा सकती है।

PRELIMINARY NOTIFICATION
Delhi, the 21st December, 2023
F. No. ADM/LAC/SE/2023/05/860.—In the exercise of the power conferred by sub-section (1) of section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 rend with Government of India, Ministry of Home Affairs Notification No S.0. 2740 (e) dated 21 October, 2014, read with S.0 2014(E) dated 21.07.2015, it appears to Lieutenant Governor of National Capital Territory of Delhi, being the appropriate Government that in total 1169.093 Sq. Mtrs. (0.1169093 hectares) land is required in the Khasra No.221/2/1 and 221/2/3 of NangliRazapur Village of Sub-Division Defence Colony in District South East for public purpose, namely for the 3rd phase of the project, for construction of Elevated Road over the BarapullahaNallah starting from Sarai Kale Khan to MayurVihar, New Delhi. The Social Impact Assessment Study was carried out by Social Impact Assessment Unit, the School of Human Ecology, Ambedkar University, Delhi and Social Impact Assessment report was submitted on 21/08/2023. The summary of the Social Impact Assessmentreport/preliminary investigation is as follows:-
As per recommendation of the Social Impact Assessment report, the requisition parcel land serves
legitimate and bonafidepublic purpose and is bare minimum amount of land.There is no family likely to be
displaced due to the proposed acquisition of land.

The Additional District Magistrate, South East Revenue District, Government of National Capital Territory of Delhi is appointed as administrator for purpose of rehabilitation and resettlement of the affected families. Therefore, it is notified that for the above said project in the NangliRazapur Village of Sub-Division Defence Colony in District South-East, the piece of land under acquisition measuring 1169.093 Sq. Mtrs. (0.1169093 hectares), whose detailed description is as following, is under acquisition.

This notification is made under the provisions of section 11(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) to all whom it may concern.
The land Plan and other details of the land to be acquired can be inspected by the interested person in the office of the District Collector, District (South East), Revenue Department, Government of NCT of Delhi and Chief Project Manager (Flyover) Public Works Department, Delhi on any working day during the working hours.
The government is pleased to authorised Additional District Magistrate (South-East) and his staff to enter upon and survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in section 12 of the said act.
[PART IV DELHI GAZETTE : EXTRAORDINARY 5Under section 11 (4) of the Act, no person shall make any transaction or cause any transaction of land i.e. sale/purchase etc, or create any encumbrances on such land from the date of publication of such notification without prior approval of the collector.
Objection to the acquisition, if any, may be filed by the person interested within 60 (Sixty) days from the date of publication of this notification as provided under section 15 of the Act before the Collector (South-East), Old Gargi College Building, LSR Building, Lajpat Nagar IV, New Delhi.
