राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 10 जनवरी, 2024 गृह मंत्रालय, भारत सरकार की दिनांक 13 जुलाई, 1959 की अधिसूचना सं. फा. 27/59-एचआईएम (i) के साथ पठित संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों तथा इस संबंध में उन्हें सक्षम बनाने वाली अन्य समस्त शक्तियों का प्रयोग करते हुए एवं इस सरकार की दिनांक 08.02.1988 की अधिसूचना सं. फा. 10(83)/87-श्रम/स्था./1745-49 के अधिक्रमण में, ऐसे अधिक्रमण से पूर्व की गई या विलोप की जाने वाली बातों को छोड़कर, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, एतद् द्वारा श्रम विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में के पद की भर्ती पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
(i) इन नियमों को ''प्रयोगशाला सहायक (वरिष्ठ) तथा प्रयोगशाला सहायक (कनिष्ठ)'' भर्ती नियमावली, 2023 कहा जाए।

उक्त पदों की संख्या, उनका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर इन नियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथाविनिर्दिष्ट होंगे।
उक्त पदों की भर्ती पद्धति, आयु सीमा, योग्यताएं एवं इससे संबंधित अन्य मामले उक्त अनुसूची के कॉलम (5) से (13) में यथाविनिर्दिष्ट होंगे।
वह व्यक्ति, (क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; अथवा
(ख) जो एक जीवित पति/पत्नी के होते हुए किसी व्यक्ति से विवाह कर चुका है या विवाह की संविदा कर चुका है, वह उक्त पद पर नियुक्ति के लिए पात्र नहीं होगा।
शर्त यह है कि यदि सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति एवं विवाह के अन्य पक्ष पर लागू व्यक्तिगत कानून के अंतर्गत अनुमत है और ऐसा करने के लिये अन्य आधार हैं, तो वह किसी ऐसे व्यक्ति को इस नियम के प्रवर्तन की छूट दे सकती है।
जहां सरकार का यह मत हो कि ऐसा करना आवश्यक एवं समीचीन है, तो वह कारणों को लिखित में अभिलेखबद्ध करते हुए, आदेश द्वारा, व्यक्तियों के किसी वर्ग या श्रेणी के संबंध में इन नियमों के किसी उपबंध को छूट दे सकती है।
इन नियमों में सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्गों, भूतपूर्व सैनिक या किसी अन्य विशेष वर्गों के व्यक्तियों के लिये उपबंधित किए जाने वाले अपेक्षित आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा।

| 11. | ः | 1. केन्द्र सरकार/राज्य सरकार, केंद शासित प्रदेशों के अधिकारी :- (क) (i) मूल संवर्ग या विभाग में नियमित आधार पर समरूप पदधारण करने वाले; अथवा (ii) मूल संवर्ग या विभाग में वेतन मैट्रिक्स के स्तर-04 में नियमित आधार पर पद की नियुक्ति के उपरांत प्रदान की गई 5 वर्षों की सेवा सहित; तथा ( ख) निम्नलिखित योग्यताएं एवं अनुभव रखने वाले - (i) किसी मान्यता प्राप्त विश्वविद्यालय अथवा संस्थान से एम. एससी (रसायन विज्ञान/जैव-रसायन विज्ञान)। अथवा (ii) किसी सरकारी प्रयोगशाला अथवा किसी अन्य मान्यता प्राप्त प्रयोगशाला में कार्य करने के दो वर्ष के अनुभव सहित किसी एक विषय के रूप में रसायन विज्ञान या जैव-रसायन विज्ञान के साथ बी0एससी। 2. ग्रेड में 05 वर्षों की नियमित सेवा सहित वेतन मैट्रिक्स के स्तर-04 मे ं विभागीय प्रयोगशाला सहायक (कनिष्ठ) भी बाहरी उम्मीदवारों के साथ विचारणीय होंगे तथा यदि पद पर नियुक्ति हेतु उसका चयन हो जाता है, तो उसे पदोन्नति द्वारा भरा गया समझा जाएगा। (प्रतिनियुक्ति की अवधि में केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से तुरन्त पूर्वधारित किसी अन्य गैर संवर्ग पद में प्रतिनियुक्ति (अल्पकालिक संविदा सहित) की अवधि भी सम्मिलित है। यह सामान्यतः तीन वर्षों (03) से अधिक नहीं होगी। प्रतिनियुक्ति (अल्पकालिक संविदा सहित) द्वारा नियुक्ति हेतु अधिकतम आयु सीमा आवेदन प्राप्ति की अन्तिम तिथि को छप्पन (56) वर्षों से अधिक नहीं होंगी।) | |

F. No. 1/31/1138/LC/Estt./Rectt.Rules/Lab.Asstt.Sr./2023/6760.—In exercise of the powers conferred by the proviso to article 309 of theConstitution read with Government of India, Ministry of Home Affairs, Notification No. F.27/59-Him (i) dated 13thJuly, 1959 and all other powers enabling him in this behalf and in supersession of this Government's Notification No. 10(83)/87-Labour/Estt./1745-49 dated 08.02.1988 except as respects things done or omitted to be done before suchsupersession, the Lt. Governor of the National Capital Territory of Delhi is pleased to make the following rules regulating the method of recruitment to the post of Laboratory Assistant (Senior) and Laboratory Assistant (Junior) in the Labour Department, Government of National Capital Territory of Delhi, namely:
1. Short title and commencement:
i) These rules may be called "Laboratory Assistant (Senior) and Laboratory Assistant (Junior)" Recruitment Rules, 2023.
ii) They shall come into force on the date of their publication in the Delhi Gazette.
2. Number of Posts, Classification and Scale of Pay: The number of the said posts, their classification and the scale of pay attached thereto shall be as specified in column (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, qualifications etc.: The method of recruitment to the said posts, age-limit, qualifications and other matters connected therewith, shall be as specified in column (5) to (13) of the said schedule.
4. Disqualifications: No person,
a) Who has entered into or contracted a marriage with a person having a spouse living, or
b) Who having a spouse living, has entered into or contracted a marriage with a person,
Shall be eligible for appointment to the said post:
Provided that the Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this rule.
5. Power to relax: Where the Government is of the opinion that it is necessary expedient so to do, it may by order, and for reasons to be recorded in writing, relax anyof the provisions of this rule with respect of any class or category of persons.
6. Saving: Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen or any other special category of persons in accordance with the orders issued by the Government from time to time in this regard.

The Departmental Laboratory Assistant (Junior) in Level-04 of Pay Matrix with 5 years of regular service in the grade will also be considered along with outsiders and in case he is selected for appointment to the post, the same shall be deemed to have been filled up by promotion. ( Period of Deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or another organization/department of the Central Govt. shall ordinarily not exceed three years. The maximum age limit for appointment by deputation (ISTC) shall not be exceeding 56 years as on the closing date of receipt of application.) |
