राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI दिल्ली, 1 फरवरी, 2024 गृह मंत्रालय, भारत सरकार की दिनांक 24.09.1968 की अधिसूचना एसओ 3532 के साथ पठित संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए तथा दिनांक 03.02.2000 की अधिसूचना सं0 फा0 11(6)/97-पीएचसी/टीआरसी/3072-3078 के अधिक्रमण में, ऐसे अधिक्रमण से पूर्व की गई या विलोप की जाने वाली बातों को छोड़कर, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, एतद् द्वारा राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के औषधि नियंत्रण विभाग में प्रयोगशाला सहायक (सूक्ष्मजीव विज्ञान) के पद की भर्ती पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते है, अर्थात् :-
(i) इन नियमों को औषधि नियंत्रण विभाग, प्रयोगशाला सहायक (सूक्ष्मजीव विज्ञान)भर्ती नियमावली, 2024 कहा जाए।
(ii) ये शासकीय राजपत्र में अपने प्रकाशन की तिथि से लागू होंगे।
उक्त पदों की संख्या, उनका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर इन नियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में विनिर्दिष्ट होंगे।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] उक्त पदों की भर्ती पद्धति, आयु सीमा, योग्यताएं एवं इससे संबंधित अन्य मामले पूर्वोक्त अनुसूची के कॉलम (5) से (13) में यथाविनिर्दिष्ट होंगे।
वह व्यक्ति (क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; अथवा
(ख) जो एक जीवित पति/पत्नी के होते हुए किसी व्यक्ति से विवाह कर चुका है या विवाह की संविदा कर चुका है, वह उक्त पद पर नियुक्ति के लिए पात्र नहीं होगा।
शर्त यह है कि यदि सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति एवं विवाह के अन्य पक्ष पर लागू व्यक्तिगत कानून के अंतर्गत अनुमत है और ऐसा करने के लिये अन्य आधार हैं, तो वह किसी ऐसे व्यक्ति को इस नियम के प्रवर्तन की छूट दे सकती है। जहां सरकार का यह मत हो कि ऐसा करना आवश्यक या समीचीन है, तो वह कारणों को लिखित में अभिलेखबद्ध करते हुए, आदेश द्वारा व्यक्तियों के किसी वर्ग या श्रेणी के संबंध में इन नियमों के किसी उपबंध को छूट दे सकती है। इन नियमों में केन्द्र सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्गों, भूतपूर्व सैनिक तथा अन्य विशेष वर्गों के व्यक्तियों के लिये उपबंधित किए जाने वाले अपेक्षित आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा।

| अन्यथा सुयोग्य उम्मीदवारों के मामले में, योग्यताएं कारणों को लिखित में अभिलेखबद्ध करते हुए सक्षम प्राधिकारी के विवेक पर शिथिलनीय हैं। यदि चयन की किसी अवस्था में सक्षम प्राधिकारी के अभिमत से अनुसूचित जाति तथा अनुसूचित जनजातियों के लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उम्मीदवारों के पर्याप्त संख्या में मिलने की संभावना नहीं है, तो अनुभव संबंधी योग्यता (योग्यताएं) सक्षम प्राधिकारी के विवेक पर शिथिलनीय है/हैं। | |||

Delhi, the 1st February, 2024
F. No. 50(13)/DC/Estt./2023/64.—In exercise of the powers conferred by the proviso to Article 309 of the constitution read with Government of India, Ministry of Home Affairs Notification No. S.O. 3532 dated 24.09.1968 and in supersession of the Notification No. F.11(6)/97-PHC/TRC/3072-3078 dated 03.02.2000, except as respects things done or omitted to be done before such supersession , the Lt. Governor of the National Capital Territory of Delhi hereby makes following rules regulating the method of recruitment to the post of Laboratory Assistant (Microbiology) in the Drugs Control Department, Government of National Capital Territory of Delhi, namely:
1. Short title and commencement-
(i) These rules may be called the Drugs Control Department, Laboratory Assistant (Microbiology) Recruitment Rules, 2024
(ii) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, Classification and Pay Level in Pay Matrix- The number of the said post, its classification and the pay level in the pay matrix attached thereto shall be specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualifications, etc.-The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule aforesaid.
4. Disqualification.-No person,
(a) Who has entered into or contracted a marriage with a person having a spouse living; or
(b) Who, having a spouse living, has entered into or contracted a marriage with any person,
Shall be eligible for appointment to the said post:
Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to Relax- Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving- Nothing in these rules, shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

| Essential: 1. Bachelor's Degree in Pharmacy/ Science (with chemistry, Botany and Zoology subjects). 2. One year's experience in the field of Microbiology testing of drugs from a recognised Institution. Note 1: Qualifications are relaxable at the discretion of the Competent Authority, for reasons to be recorded in writing, in the case of candidates otherwise well qualified.
