फा. स. ंएलएसी/सी/2020 (092623813)/440-452.-गृह मंत्रालय, भारत सरकार की दिनांक 21 अक्टूबर, 2014 की अधिसूचना सं0 एस0ओ0 2740 (ई), दिनांक 21 जुलाई, 2015 की अधिसूचना सं0 एस0ओ0 2004 (ई) के साथ पठित भूमि अर्जन और पुर्नव्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 की धारा 11 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल उपयुक्त सरकार होने के नाते ऐसा उचित समझते है ंकि सार्वजनिक उद्देश्य अर्थात्‌ एमआरटीएस (मेट्रो रेल ट्रांजिट प्रणाली) परियोजना चरण-IV जोराहत गंज/आराम गंज, रोशनारा रोड, पुल बंगश नइर् दिल्ली पर स्थित जनकपुरी पश्चिम से शुरू होकर मुकुंदपुर-आर. के. आश्रम मार्ग कॉरिडोर तक जाती है, हेतु मध्य जिला मे ंउप-प्रभाग कोतवाली की संपत्ति संख्या 8736-सी और 8736-डी, राहत गंज/आराम गंज, रोशनारा रोड, पुल बंगश के लिए कुल 62 वर्ग मीटर (0.0062 हेक्टेयर) भूमि की आवश्यकता है।

समाजिक प्रभाव आकलन का अध्ययन शहरी अध्ययन केंद्र, भारतीय लोक प्रशासन संस्थान, आई पी एस्टेट, नई दिल्ली-110002 के द्वारा किया गया था।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] समाजिक प्रभाव आकलन प्रतिवेदन का सारांश इस प्रकार है-सामाजिक प्रभाव आकलन प्रतिवेदन के अनुसार, अधिग्रहण के लिए प्रस्तावित भूखंड न्यूनतम है और यह वैध और वास्तविक सार्वजनिक उद्देश्य को पूरा करेगा।यह परियोजना सार्वजनिक उद्देश्य की पूर्ति के साथ-साथ सामाजिक रूप से भी लाभकारी होगी। इस परियोजना से आधारभूत संरचना में न्यूनतम व्यवधान होगा और व्यक्तियों पर न्यूनतम प्रतिकूल प्रभाव पड़ेगा। उक्त परियोजना से पर्यावरण पर किसी भी रूप् में कोइर् प्रतिकूल प्रभाव नही ंपड़ेगा।

अपर जिला मजिस्ट्रेट, मध्य राजस्व जिला, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार का ेप्रभावित परिवारों के पुनर्वास तथा पुनःस्थापन के प्रयोजनार्थ प्रशासक रूप मे ंनियुक्त किया गया है। इसलिए, यह अधिसूचित किया जाता है कि जिला मध्य में संपत्ति संख्या 8736-सी और 8736-डी, राहत गंज/आराम गंज, रोशनारा रोड, पुल बंगश में उपरोक्त परियोजना के लिए अधिग्रहण के अन्तर्गत भूखंड 62 वर्गमीटर (0.0062 हेक्टेयर) है, जिसका विस्तृत विवरण निम्नानुसार हैः-

यह अधिसूचना भूमि अर्जन और पुर्नव्यवस्थापन मे ंउचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 (2013 का 30) की धारा 11 (1) के प्रावधानों के अंतर्गत उन सभी के लिए बनाई गई है, जिनसे यह संबंधित हो सकती है।

इच्छुक व्यक्ति द्वारा भूमि योजना और अधिग्रहित की जाने वाली भूमि के अन्य विवरणों का निरीक्षण जिलाधिकारी जिला (मध्य) राजस्व विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार और महाप्रबंधक/भूमि डीएमआरसी लिमिटेड मेट्रो भवन, दमकल लेन, बाराखंभा रोड, नई दिल्ली-110001 के कार्यालय में किसी भी कार्य दिवस पर कार्य समय के दौरान किया जा सकता है।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 सरकार एतद्‌ द्वारा अपर जिला मजिस्ट्रेट (मध्य) और उनके कर्मचारियो ंको उक्त अधिनियम की धारा 12 में यथा उपबंधित तथा विनिर्दिष्ट अपने कार्यों के समुचित निष्पादन हेतु अपेक्षित भूमि पर अपना स्वामित्व रखने तथा उसका सर्वेक्षण करने, किसी भी स्तर पर भूमि का अधिग्रहण करने, भूमिगत खुदाई या उसमे ंछेद करने तथा समस्त अन्य कार्यों को करने के लिए प्राधिकृत करती है।

अधिनियम की धारा 11 (4) के अंतर्गत, कोई भी व्यक्ति जिलाधिकारी के पूर्व अनुमोदन के बिना ऐसी अधिसूचना के प्रकाशन की तिथि से भूमि का कोई भी लेनदेन या भूमि के किसी लेनदेन का कारण अर्थात्‌ बिक्री/खरीद आदि अथवा ऐसी भूमि पर किसी प्रकार की बाधा उत्पन्न नहीं करेगा।

अधिग्रहण पर आपत्ति, यदि कोई हो, तो अधिनियम की धारा 15 के अंतर्गत यथा उपबंधित इस अधिसूचना के प्रकाशन की तिथि से 60 (साठ) दिनों के भीतर इच्छुक व्यक्ति द्वारा जिलाधिकारी (मध्य) पुराना रोजगार कार्यालय भवन, 14 दरियागंज नई दिल्ली-110002 के समक्ष दर्ज की जा सकतीहै।

PRELIMINARY NOTIFICATION

No. LAC/C/2020/(092623813)/440-452.—In the exercise of the powers conferred by Sub-Section (1) Section 11 of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 read with Government of India, Ministry of Home Affairs Notification No. S.O 2740 (E) dated 21 st October, 2014, read with S.O. 2004 (E) dated 21st July, 2015, it appears to Lieutenant Governor of National Capital Territory of Delhi, being the appropriate Government that Total 62 Sq. Mtr. (0.0062 hectares) land is required at Property No. 8736-C & 8736-D, Rahat Ganj / Aram Ganj, Roshanara Road, Pul Bangash of Sub Division Kotwali in District Central for public purpose namely MRTS (Metro Rail Transit System) project Phase- IVstarting from Janak Puri West -Mukundpur- R.K. Ashram Marg Corridor at Rahat Ganj / Aram Ganj, Roshanara Road, Pul Bangash New Delhi.

The Social Impact Assessment Study was carried out by Centre for Urban Studies, Indian Institute of Public Administration, IP Estate, New Delhi-110002.

The summary of the Social Impact Assessment Report is as follows.As per the social Impact Assessment report, the proposed parcel of land for acquisition is bare minimum and will serve legitimate and bonafide public purpose. The project will serve public purpose and also be beneficial socially. The project shall have minimum disturbance to the infrastructure and minimum adverse impact on the individuals. There is no adverse impact on the environment from the project in question.

The Additional District Magistrate, Central Revenue District, Government of National Capital Territory of Delhi is appointed as administrator for purpose of rehabilitation and resettlement of the affected families. Therefore, it is notified that for the above said project in the Property No. 8736-C & 8736-D, Rahat Ganj / Aram Ganj, Roshanara Road, Pul Bangash in District Central the piece of land under acquisition measuring 62 Sq. Mtr. (0.0062 hectares) whose detailed description is as under.

The notification is made under the provisions of section 11 (1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (30 of 2013) to all whom it may concern.

The land Plan and other details of the land to be acquired can be inspected by the interested person in the office of the District Collector District (Central) Revenue Department, Government of NCT of Delhi and General Manager / Land DMRC Ltd. Metro Bhawan, Fire Brigade Lane, Barakhamba Road, New Delhi-110001 on any working day during the working hours.

The Government is pleased to authorize Additional District Magistrate (Central) and his staff to enter upon and survey land, take levels of any land, dig or bore into the sub-soil and do all other acts required for the proper execution of their work as provided and specified in section 12 of the said Act.

Under section 11 (4) of the Act, no person shall make any transaction or cause any transaction of land i.e., sale/purchase etc. or create any encumbrances on such land from the date of publication of such notification without prior approval of the collector.

Objection to the acquisition, if any, may be filed by the persons interested within 60 (Sixty) days from the date of publication of this notification as provided under section 15 of the Act before the Collector (Central) Old Employment Exchange Building, 14 Darya Ganj New Delhi-110002.
