राष्ट्रीय राजधानी राज्य क्षेत्र दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI -गृह मंत्रालय, भारत सरकार की दिनांक 29 मई, 1970 की अधिसूचना संख्या फाइल 1/2/70/डीएच (एस) के साथ पठित संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियाँ, दिनांक 25 जुलाई, 1970 की अधिसूचना संख्या फा0-डीएच (एस) द्वारा यथासंशोधित तथा इस संबंध में उसे समर्थ बनाने वाली समस्त अन्य शक्तियों का प्रयोग करते हुए, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल दिल्ली उच्च न्यायालय के परामर्श से, एतद्द्वारा दिल्ली उच्चतर न्यायिक सेवा नियमावली, 1970 में आगे संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. ष (1) इन नियमों को दिल्ली उच्चतर न्यायिक सेवा (संशोधन) नियमावली,
2024 कहा जाए।
(2) ये शासकीय राजपत्र में अपने प्रकाशन की तिथि सेे लागू होंगे।

''22(1) सीधी भर्ती द्वारा सेवा हेतु की गई भर्ती दिव्यांगजन अधिकार
अधिनियम, 2016 द्वारा यथा उपबंधित अनुसूचित जातियों, अनुसूचित
जनजातियों तथा दिव्यांगजनों के लिए आरक्षण एवं अन्य रियायतें
(आयु में छूट को छोड़कर) तथा इस संबंध में केन्द्र सरकार द्वारा
समय-समय पर जारी आदेशों, अधिसूचनाओं इत्यादि से संबंधित
प्रावधानों के अधीन होगी।
(2) दिव्यांगजन सीधी भर्ती के माध्यम से नियुक्ति हेतु केवल तभी
विचारणीय होंगे जब वे चिकित्सा बोर्ड की संतुष्टि के अनुसार
न्यायिक अधिकारी के रूप में कत्र्तव्यों का कुशलतापूर्वक निर्वहन
करनें में सक्षम पाए जाते हैं, जो नियुक्ति के लिए उनके नामों की
अनुशंसा से पूर्व अथवा पश्चात् में गठित की जा सकती है।
(3) पदोन्नति [नियम 7(1)(क) तथा नियम 7(1)(ख) के निबंधनों में]
के द्वारा सेवा हेतु भर्ती दिव्यांगजन अधिकार अधिनियम, 2016 द्वारा
यथा उपबंधित दिव्यांगजनों के लिए आरक्षण एवं अन्य रियायतें
(आयु में छूट को छोड़कर) तथा इस संबंध में केन्द्र सरकार द्वारा
समय-समय पर जारी आदेशों, अधिसूचनाओं इत्यादि से संबंधित
प्रावधानों के अधीन होगी।

NOTIFICATION
Delhi, the 3rd June, 2024
No. F. 1/37/2024-Judl./Supt.law/1116-1121—In exercise of the powers conferred by the proviso to article 309 of the Constitution read with Government of India, Ministry of Home Affairs Notification No.F.1/2/70/DH(S) dated the 29th May, 1970 as amended by Notification No.F.-DH(S) dated 25th July, 1970 and all other powers enabling him in this behalf, the Lieutenant Governor of National Capital Territory of Delhi in consultation with the High Court of Delhi is pleased to make the following rules further to amend the Delhi Higher Judicial Service Rules, 1970, namely: -
1. Short title and commencement. - (1)
These rules may be called the Delhi Higher Judicial Service (Amendment) Rules, 2024.
(2)
They shall come into force on the date of their publication in the Official Gazette.
2. Amendment of rule 22. - In the Delhi Higher Judicial Service Rules 1970, in place of
existing Rule 22, the following shall be substituted, namely: -
"22(1) Recruitment made to the service by direct recruitment shall be subject to provisions regarding reservation and other concessions (except age relaxation) for the Scheduled Castes, Schedules Tribes and Persons with Disability as provided by Rights of Persons with Disability Act, 2016 and the orders, notifications etc. issued in this respect by the Central Government from time to time.
[PART IV DELHI GAZETTE : EXTRAORDINARY 3(2) Persons with Disability shall be considered for appointment through direct recruitment only if they are found capable of efficiently discharging duties as Judicial Officer as per the satisfaction of the Medical Board that may be constituted before or after their names are recommended for appointment.
(3) Recruitment to service by way of promotion [in terms of Rule 7(1)(a) and Rule 7(1)(b)] shall be subject to provisions regarding reservation and other concessions (except age relaxation) for Persons with Disability as provided by Rights of Persons with Disability Act, 2016 and the orders, notifications etc. issued in this respect by the Central Government from time to time."
