F.107/WFD/COT/23-24/1618-25.—दिल्ली वृक्ष संरक्षण अधिनियम, 1994 (1994 का दिल्ली अधिनियम 11) की धारा 29 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए जनहित में उपराज्यपाल राष्ट्रीय राजधानी क्षेत्र दिल्ली, आर्मी हॉस्पिटल (आर एंड आर), दिल्ली कैं ट, नई दिल्ली में ऑन्कोलॉजी सेंटर बिल्डिंग (200 बिस्तरों वाला) के निर्माण हेतु नीचे दिए गए विवरण के अनुसार 5.6 हेक्टेयर लगभग क्षेत्रफल को उक्त अधिनियम की धारा 9 की उपधारा (3) के उपबंधों से छू ट प्रदान करते हैं ।

यह छू ट निम्नलिखित शतो के अधीन है:-

नियम एवं शतें

1. आर्मी आर एंड आर हॉस्पिटल,जो कि उपभोगी संस्था के रूप में संर्दर्भत है, को सात वषों की अवधि के लिए पौधों के सम्पूर्ण विकास एवं रखरखाव हेतु उपरोक्तानुसार 1,82,97,000/-रुपये (एक करोड़ बयासी लाख सत्तानवे हजार मात्र @ रु. 57000/- प्रति वृक्ष)(वापसी योग्य राशि- 1,59,10,365/- रुपये (एक करोड़ उनसठ लाख दस हजार तीन सौ पैंसठ मात्र) और प्रशासनिक शुल्क और आकस्मिकता- रुपये 23,86,635/- रुपये (तेईस लाख छियासी हजार छह सौ पैंतीस मात्र) की राशि अमिि रूप से जमा करवानी होगी और यदि उपभोगी संस्था द्वारा 2, 3 और 4 में उल्लिखित नियमों और शतों का पालन नहीं किया जाता है, तो इस राशि को जब्त कर लिया जाएगा और इस राशि को वन विभाग द्वारा वृक्षारोपण के लिए उपयोग किया जाएगा ।

2. उपभोगी संस्था द्वारा वृक्षों का प्रत्यारोपण / कटाई शुरू करने से पहले पूरी की जाने वाली आवश्यक शतें:-

a. दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 12 के अनुपालन में उपभोगी संस्था द्वारा संबंधित वृक्ष अधिकारी / उप- वन संरक्षक को विस्तृत वृक्षारोपण कार्यक्रम प्रस्तुत किया जाएगा ।

b. उपभोगी संस्था द्वारा साइट की तैयारी और वृक्षारोपण के लिए एक विस्तृत योजना प्रस्तुत किया जाएगा । c. उपभोगी संस्था के द्वारा यह सुनितिि किया जायेगा कि वृक्षो की कटाई / प्रत्यारोपण से पूर्व कोई लंबित मुकदमा या स्थगन आदेश किसी भी न्यायालय / अन्य प्राधिकरण द्वारा पारित न हुआ हो ।

d. उपभोगी संस्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का कार्य सभी वैधानिक मंजूरियों को लेने के बाद ही शुरू किया जाएगा।

e. उपभोगी संस्था के द्वारा वनमंजूरी में और अन्य मंजूरी में उल्लिखित सभी शतों, यदि कोई हो, का निष्ठापूर्वक पालन किया जाएगा ।

f. रिज मैनेजमेंट बोर्ड (आरएमबी) द्वारा स्वीकृ त और माननीय सवोच्च न्यायालय द्वारा अनुमोदित परियोजना के लिए निर्धारित परियोजना लागत का 5% रिज मैनेजमेंट बोर्ड में उपभोगी संस्था द्वारा जमा किया जायेगा और इसे संबंधित वृक्ष अधिकारी / उप- वन संरक्षक को अवगत कराया जायेगा ।

g. यदि परियोजना लागत संशोधित हो जाती है, तो अतिरिक्त सुरक्षा राशि जारी करने के अनुरोध से पहले उपभोगी संस्था के द्वारा आरएमबी के पास जमा कर दी जाए ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3 3. वृक्षों के प्रत्यारोपण / कटाई के दौरान पूरी की जाने वाली आवश्यक शतें:-

a. क्र.सं.2 में शतों के अनुपालन होने के तुरंत बाद उपभोगी संस्था द्वारा वृक्षो का प्रत्यारोपण शुरू किया जाएगा और इसे छ:महीने के अंतराल में पूर्ण किया जाएगा । प्रत्यारोपण प्रक्रिया के पूर्ण होने का बाद एक सम्पूर्ण रिपोर्ट सम्बंधित वृक्ष अधिकारी / उप- वन संरक्षक को प्रस्तुत की जायेगी । प्रत्यारोपण स्थल मे प्रत्यारोपित वृक्षो की दूरी 4 मीटर (बिंदु से बिंदु) से कम नहीं होनी चाहिए ।

b. उपभोगी संस्था के द्वारा वृक्ष प्रत्यारोपण नीति, 2020 में उल्लिखित सभी शतों का पालन किया जाएगा । c. उपभोगी संस्था प्रतिरोपित वृक्षों का न्यूनतम तीन वषों तक उसी प्रत्यारोपण एजेंसी के माध्यम से अनुरक्षण करेगी जिन के द्वारा प्रत्यारोपण किया गया था ।

d. उपभोगी संस्था द्वारा 210 वृक्षो को काटने से पूर्व प्रत्यारोपण किया जाएगा । 210 वृक्षो की अनुमति 111 वृक्षो के सफल प्रत्यारोपण और सम्बंधित वृक्ष अधिकारी / उप- वन संरक्षक को अनुपालन प्रमाण पत्र प्रस्तुत करने के बाद दी जायेगी ।

e. उपभोगी संस्था द्वारा प्रत्यारोपण / काटे जाने वाले वृक्षों की प्रगति रिपोर्ट संबंधित वृक्ष अधिकारी / उप- वन संरक्षक को वृक्षों के पूर्ण विवरण के साथ प्रस्तुत की जाएगी ।

f. यदि किसी वृक्ष में पक्षियों का घोंसला पाया जाता है तो उसे तब तक नहीं काटा/ प्रत्यारोपण किया जाएगा जब तक कि पक्षी उसे स्वतः छोड़ न दें ।

g. उपभोगी संस्था द्वारा 321 वृक्षो के अलावा किसी भी वृक्ष की कटाई / प्रत्यारोपण दिल्ली वृक्ष संरक्षण अधिनियम, 1994 के अन्तर्गत एक अपराध होगा ।

h. उपभोगी संस्था द्वारा वृक्षो को हटाए जाने के उपरान्त प्राप्त लकड़ियों की नीलामी की जाएगी और उससे प्राप्त धनराशि को सरकार के खाते मे राजस्व के रूप में जमा की जाएगी ।

i. उपभोगी संस्था द्वारा वृक्षों के ऊपरी शाखाओं को काटे जाने के उपरान्त प्राप्त लकड़ियों को मुफ्त में निकटतम सार्वजनिक शवदाहों में प्रयोग हेतु सौपी जाएगी और इसकी सूचना सम्बंधित वृक्ष अधिकारी / उप- वन संरक्षक को भी दी जाएगी ।

j. उपभोगी संस्था द्वारा वृक्षो को हटाए जाने के स्थल से लकड़ियों को को ले जाने से पूर्व सम्बंधित वृक्ष अधिकारी / उप- वन संरक्षक से ढुलाई अनुमति प्राप्त करनी होगी ।

k. उपभोगी संस्था द्वारा वृक्षो की प्रत्यारोपण / कटाई और उसमें पैदा होने वाली वन उपज को सार्वजनिक श्मशान मे 90 दिनों के अंदर पूरा किया जाएगा ।

l. उपभोगी संस्था के द्वारा यह सुनितिि किया जायेगा कि इस प्रस्ताव की योजना को परिर्वर्तत नहीं किया जाएगा ।

m. उपभोगी संस्था के द्वारा वन मंजूरी में और अन्य मंजूरी में उल्लिखित सभी शतों, यदि कोई हो, का निष्ठापूर्वक पालन किया जाएगा ।

n. उपभोगी संस्था के द्वारा अनुमोदित वृक्ष संरक्षण योजना के अंतर्गत प्रस्तुत सभी गतिविधियों का निष्ठापूर्वक पालन किया जाएगा ।

o. उपभोगी संस्था के द्वारा यह सुनितिि किया जाएगा कि वृक्ष प्रत्यारोपण नीति 2020 की धारा 4 (6-बी) के अंतर्गत सभी प्रावधानों का निष्ठापूर्वक पालन किया गया है और इसका सम्बंधित वृक्ष अधिकारी / उप- वन संरक्षक को प्रस्तुत किया जाएगा ।

p. उपभोगी संस्था के द्वारा यह सुनितिि किया जाएगा कि सभी प्रतिरोपित वृक्षों के लिए जो 15 फीट ऊं चाई और कम से कम 6 इंच व्यास वाले स्वदेशी वृक्ष प्रजातियों में जीवित नहीं रह पाते हैं, तो उन्हें 1:5 के अनुपात में लगाया जाएगा । आवश्यक अतिरिक्त भूमि उपभोगी संस्था द्वारा प्रदान की जाएगी और वृक्षारोपण स्वयं की लागत पर किया जाएगा ।4 DELHI GAZETTE : EXTRAORDINARY PART IV] 4. वृक्ष अधिकारी / उप-वन संरक्षक द्वारा सफलतापूर्वक वृक्षारोपण और सुरक्षा जमा राशि जारी करने पर विचार करने के लिए आवश्यक शतें:-

a. उपरोक्त तालिका 1 (क) और (ख) के अनुसार, देशी प्रजातियों के 3210 पौधो का 100% प्रतिपूरक वृक्षारोपण और उनका सात वषो तक रखरखाव उपभोगी संस्था द्वारा किया जायेगा । इस वृक्षारोपण के सफलता पूर्वक स्थापना के बाद उपभोगी संस्था द्वारा निगरानी की जाएगी ।

b. 321 वृक्षो के प्रत्यारोपण / काटे जाने के बदले मे 1:10 के अनुपात मे स्वदेशी प्रजातियों के 6-8 फीट की ऊँ चाई वाले 3210 पौधो का प्रतिपूरक वृक्षारोपण गैर-वन भूमि पर किया जाएगा । वृक्षारोपण की अनुमति के जारी होने के तीन महीने के अंदर निर्धारित की गई भूमि पर अतिरिक्त उपायों के साथ वृक्षारोपण स्थल के अनुसार विशिष्ट वृक्षारोपण तकनीकों के द्वारा किया जाएगा और अमिि सात (7) वषों के लिए रखरखाव तथा उसके बाद उनका रखरखाव उपभोगी संस्था द्वाराअपनी स्वयं की लागत पर किया जाएगा । c. यदि उपभोगी संस्था सफलतापूर्वक प्रतिपूरक वृक्षारोपण करने में विफल रहती है। उपभोगी संस्थाद्वारा अतिरिक्त साइट सुधार खचों को जमा किया जाएगा जो कि सम्बंधित वृक्ष अधिकारी / उप- वन संरक्षक द्वारा गणना के अनुसार वृक्षारोपण के लिए उपयुक्त बनाने के लिए आवश्यक हो सकती है ।

d. जो भूमि प्रतिपूरक वृक्षारोपण / वृक्ष प्रत्यारोपण के लिए आवंटित है, उसका उपयोग किसी अन्य कायो के लिए सक्षम प्राधिकारी की स्वीकृ ति के बिना नहीं किया जाएगा।

e. उपभोगी संस्था द्वारा वृक्षारोपण पत्रिका को वन और वन्यजीव विभाग राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार को निर्धारित करेंगी और इसकी एक प्रति प्रत्येक वित्तीय वर्ष के अंत में सम्बंधित वृक्ष अधिकारी / उप- वन संरक्षक को प्रस्तुत की जाएगी । प्रारूप की प्रति https://dpta.eforest.delhi.gov.in पर उपलब्ध है। f. भूमि स्वामित्व एजेंसी यह सुनितिि करेगी कि प्रतिपूरक वृक्षारोपण के लिए प्रस्तावित क्षेत्र में कोई अतिक्रमण न हो।

g. उपभोगी संस्था द्वारा प्रतिपूरक वृक्षारोपण/ प्रत्यारोपण स्थल में मृदा नमी संरक्षण कार्य की गतिविधियों को किया जाएगा ।

h. उपभोगी संस्था के द्वारा यह सुनितिि किया जायेगा कि इस प्रस्ताव की योजना को परिर्वर्तत नहीं किया जाएगा ।

i. उपभोगी संस्था पांच वर्ष की अवधि के लिए वृक्षारोपण की प्रगति रिपोर्ट करते हुए हर छह महीने में सीईसी (CEC)को एक प्रस्तुत की जाएगी।

5. यदि उपरोक्त में से कोई भी शर्त उपभोगी संस्था द्वारा पूरी नहीं की जाती है, तो संबंधित वृक्ष अधिकारी / उप- वन संरक्षक द्वारा दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 12 के अनुसार कार्रवाई की जाएगी । 6. उक्त अधिनियम की धारा 9 की उपधारा (3) के प्रावधान से क्षेत्र को छू ट देने के लिए दिल्ली वृक्ष संरक्षण अधिनियम, 1994 की धारा 29 के तहत अधिसूचना जारी की जाती है। हालाँकि, 321 वृक्षो को प्रत्यारोपण / कटाई के लिए अनुमति दिल्ली वृक्ष संरक्षण अधिनियम, 1994 के प्रावधान के अंतर्गत वृक्ष अधिकारी द्वारा अलग से उपभोगी संस्था को उनके स्वयं के जोखिम पर और किसी भी अन्य व्यक्ति के दावे के पक्षपात के बिना, जो वृक्षो और भूमि पर सही हो सकती है, दी जाएगी ।

NOTIFICATION

Delhi, the 10th June, 2024

F.107/WFD/COT/23-24/1618-25.—In exercise of the powers conferred by section 29 of the Delhi reservation of Trees Act (DPTA), 1994 (Delhi Act 11 of 1994), the Lt. Governor of National Capital Territory of Delhi, hereby, in public interest exempts an area of 5.6 ha for construction of Oncology Centre Building (200 Bedded) at Army Hospital (R&R), Delhi Cantt., New Delhi, from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-

TERMS & CONDITIONS

1. Army R&R Hospital herein referred to as User Agency, shall make an advance deposit of an amount of Rs 1,82,97,000/- (Rs. One Crore Eighty Two Lakh Ninety Seven Thousand Only) (Refundable amount- Rs. 1,59,10,365/- Rupees (One Crore Fifty Nine Lakh Ten Thousand Three Hundred Sixty Five Only) and Administrative charges and contingencies- Rs. 23,86,635/-Rupees (Twenty Three Lakh Eighty Six Thousand Six Hundred Thirty Five Only) towards security deposit for creation and maintenance of compensatory plantation for a period of Seven (7) years and the same shall be forfeited and utilized for plantation by the Forest Department if terms and conditions mentioned at 2, 3 & 4 are not followed by User Agency.

2. The conditions required to be fulfilled before starting transplantation / felling of trees by User

Agency:-

a. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer / Deputy Conservator of Forests in compliance with Section-12 of DPTA, 1994.

b. User Agency shall submit a detailed plan for site preparation and plantation.

c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/ other authority before undertaking felling/ transplantation of trees.

d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall necessarily be obtained by the User Agency.

e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other clearances, if any obtained, shall be followed scrupulously.

f. 5% of the project cost as prescribed for project cleared by Ridge Management Board (RMB) and approved by Hon'ble Supreme Court of India should be deposited with Ridge management Board and the same is conveyed to Tree Officer / Deputy Conservator of Forests (West).

g. If project costs get revised, the additional amount should be deposited with Ridge Management Board before requesting for release of security deposit.

3. The conditions required to be fulfilled during the transplantation / felling of trees:-

a. Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and should be completed not later than six (06) months of such date, after which a completion report has to be submitted to the concerned Tree Officer / Deputy Conservator of Forests. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.

b. All the conditions mentioned in Tree Transplantation Policy, 2020 shall be followed scrupulously by User Agency.

c. User Agency shall maintain the transplanted trees for minimum three years by engaging the same transplantation agency which has carried out the transplantation.

d. The transplantation shall be carried out prior to felling of 210 number of trees permitted herein. The 210 trees shall be removed / felled after successful transplantation of 111 trees and submission of compliance certificate to concerned Tree Officer / Deputy Conservator of Forests

e. The progress report of transplantation / felling shall be submitted to concerned Tree Officer / Deputy Conservator of Forests along with complete details of trees by the User Agency.

f. If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned by the birds.

g. Transplantation / felling of any tree apart from 321 trees by User Agency shall constitute an offence under Delhi Preservation of Trees Act (DPTA), 1994.

h. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to the Government account by the User Agency.

i. The lops & tops of the trees shall be sent / supplied to the nearest crematorium free of cost and the same should be reported to concerned Tree Officer / Deputy Conservator of Forests by User Agency.

j. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood shall be obtained from the concerned Tree Officer / Deputy Conservator of Forests by User Agency.

k. Transplantation / felling of trees and transportation of forest produce arising there from to the public crematorium shall be completed within 90 days.

l. The User Agency shall ensure that the plan of this proposal shall not be changed.

m. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other clearances, if any obtained, shall be followed scrupulously.

n. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.

o. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy, 2020 have been followed and details of the same should be submitted to the Tree Officer / Deputy Conservator of Forests concerned.

p. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with 15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be provided by User Agency & plantation has to be done at own cost.

4. The conditions required to be fulfilled for considering successful plantation & release of Security

Deposit by the Tree Officer / Deputy Conservator of Forests :-

a. 100% Compensatory Plantation of 3210 saplings of native species shall be raised and maintained by User Agency for Seven years and monitored till its successful establishment as mentioned on table above.

b. 3210 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on non-forest land in lieu of transplantation / felling 321 no. of trees. The plantation shall be done by following site specific plantation techniques with additional measures on identified land within three months of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after by User Agency with their own funds.

c. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit extra site improvement expenses which may be required to make the site suitable for plantation as calculated by Tree Officer / Deputy Conservator of Forests concerned (as deposits).

d. The land over which compensatory plantation / Tree transplantation raised shall not be utilized for other purpose without the approval of the Competent Authority.

e. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife, Government of NCT of Delhi and a copy of the same shall be submitted to the concerned Tree Officer / Deputy Conservator of Forests at the end of every financial year. f. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory plantation/ transplantation.

g. The User Agency shall implement the improved soil moisture conservation activities on compensatory plantation/ transplantation site.

h. The User Agency shall ensure that the plan of this proposal shall not be changed.

i. The User Agency file a report to CEC every six months reporting progress of plantation for a period of five years.

5. If any of the above condition is not fulfilled by the User Agency, concerned Tree Officer/ / Deputy Conservator of Forests shall initiate action as per Section 12 of Delhi Preservation of Trees Act, 1994.

6. The notification is issued under section 29 of DPTA, 1994 to exempt the area from the provision of sub- section (3) of section 9 of the said act. However, permission for transplantation / felling of 321 numbers of tress shall be granted separately by the Tree Officer under the provision of DPTA, 1994 to the User Agency at their own risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the land or the trees.
