II —भारतीय तार अधिनियम, 1885 की
धारा 10, 11 तथा 16 तथा ऊर्जा मंत्रालय, भारत सरकार की दिनांक 24.12.2003 की एस0ओ0 संख्या 1463(ई) के द्वारा जारी
अधिसूचना के साथ पठित विद्युत अधिनियम, 2003 की धारा 67, 68 और 164 के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए,
राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल एतद् द्वारा संचरण लाइन बिछाने के प्रयोजनार्थ मुआवजे के निर्धारण हेतु नीति
निर्धारित करते हैं, जो निम्नानुसार है :
(क)
लाइसेंसधारी कृषि भूमि के लिए सर्किल रेट की दुगनी दर से
अथवा डीएम द्वारा मुआवजे को अंतिम रूप दिए जाने वाले वर्ष से ठीक पहले विगत 03 वर्षों में बिक्री/खरीद में —षि भूमि की
औसत दर, जो भी अधिक हो, मुआवजे का भुगतान करेगा,
(ख)
लाइसेंसधारी
सर्किल रेट के आधार पर भूमि मूल्य का 15 प्रतिशत या डीएम द्वारा मुआवजे को अंतिम रूप दिए जाने वाले वर्ष से ठीक पहले
विगत 03 वर्षों में बिक्री/खरीद में —षि भूमि की औसत दर का 15 प्रतिशत, जो भी अधिक हो, इसके अलावा हाई टेंशन लाइन

के कॉरिडोर के नीचे के क्षेत्र के लिए 15 प्रतिशत "नो यूज अलाउंस" (कुल 30 प्रतिशत) के रूप में मुआवजे का भी भुगतान
करेगा।
2.
लाइसेंसधारी पंजी—त भूमि स्वामी या उसके
उत्तराधिकारी को उनकी फसलों/वृक्षों/भवनों एवं संरचनाओं आदि की हुई क्षति के लिए मुआवजे का भुगतान करेगा। एडीएम,
जिला वन अधिकारी और ईई (पीडब्ल्यूडी) वाली समिति इस संबंध में आकलन करेगी और कलेक्टर से मांग की तिथि से 15
दिनों के भीतर डीएम को रिपोर्ट प्रस्तुत करेगी। एडीएम उक्त समिति के संयोजक होंगे।
3. लाइसेंसधारी को प्रभावित भूमि/क्षेत्र का विवरण उपलब्ध कराना होगा, जिसके माध्यम से संचरण लाइन
गुजरती है। संबंधित डीएम अंतिम रूप से मुआवज़ा और उसके प्राप्तकर्ताओं का निर्धारण करेगा तथा लाइसेंसधारी से हाल ही में
की गई मांग की तिथि से 30 दिनों की अवधि के भीतर लाइसेंसधारी को विवरण प्रेषित करेगा।
4. उसके बाद लाइसेंसधारी पंजी—त भूमि स्वामी या उसके उत्तराधिकारी को अधिमानतः 10 दिनों के भीतर
एनईएफटी/आरटीजीएस द्वारा मुआवजे का भुगतान करेगा।
5. मुआवजे की राशि से संबंधित किसी भी विवाद के मामले में, तार अधिनियम, 1885 की धारा 16 के प्रावधान
लागू होंगे।
उपरोक्त मुआवजा राशि 66 केवी से कम की उप-संचरण और वितरण लाइनों के लिए न होकर केवल 66 केवी
और उससे अधिक के टावर बेस द्वारा समर्थित संचरण लाइनों के लिए देय होगी।

NOTIFICATION
Delhi, the 29th July, 2024
No. F. 202/SDM-II (HQ)/Land/2024/087759789/237– In exercise of the powers conferred under section 67, 68 and 164 of the Electricity Act, 2003, read with section 10, 11 and 16 of Indian Telegraph Act, 1885 and notification issued by Ministry of Power, Government of India, S.O. No 1463(E) dated 24.12.2003, the Lt. Governor of National Capital Territory of Delhi hereby lays down the policy for determination of the compensation for the purpose of laying transmission lines, which is as under:
1. (a) Compensation for Area under tower : Licensee shall pay compensation at the double rate of the circle rate for agricultural land or the average rate of agricultural land in the sale/ purchase in last 03 years immediately preceding the year in which compensation is finalized by the DM, whichever is more.
(b) Compensation for the area under corridor i.e area between the towers : The Licensee shall also pay compensation at the rate of 15% of the land value at circle rate for agricultural land or the average rate of agricultural land in the sale/ purchase in last 03 years immediately preceding the year in which compensation is finalized by the DM, whichever is more, for diminution of land and also 15% for "No Use Allowance" (total 30%) for the area occupied by the line corridor of high tension line (i.e. total 30%).
2. Compensation towards Crop/Tree/building and structure etc.:- Licensee shall pay compensation to the recorded land owner or his/her successor in interest for damage caused to their crops/trees/buildings and structures etc. The committee comprising of ADM, District Forest Officer and EE (PWD)[PART IV DELHI GAZETTE : EXTRAORDINARY 3 shall make an assessment in this regard and furnish the report to DM within 15 days from the date of requisition from the collector. ADM will be the convener of the said committee.
3. The licensee shall provide details of affected land/area through which transmission line passes. The DM concerned shall finally determine the compensation and its recipients and forward the statement to the licensee within a period of 30 days from the date of the recent requisition from the licensee.
4. The licensee shall then pay the compensation to the recorded land owner or his/her successor in interest preferably by NEFT/RTGS within 10 days.
5. In case of any dispute with respect to the amount of compensation, the provisions of section 16 of the Telegraph Act, 1885 shall apply.
Note: The above compensation amount will be payable only for transmission lines supported by a tower base of 66 KV and above, and not for sub-transmission and distribution lines below 66 KV.
