फा.सं.13(244)/ ाह.वि./एमबी/एसवीएस-18/2018/पार्ट फाइल-2 (सीडी सं.-021582304)1328- 1337.—जबकि केंद्रीय आधार (वित्तीय और अन्य सब्सिडी, लाभ और सेवाओं का लक्षित वितरण) अधिनियम, 2016 (तत्पश्चात्‌ उक्त अधिनियम के रूप में संदर्भित) की धारा 4(4)(ख)(ii) केन्द्र सरकार प्राधिकरण के परामर्श से तथा राज्य के हित में, जैसा वह निर्धारित कर सकती है, ऐसे प्रयोजन के लिए स्वैच्छिक आधार पर प्रमाणीकरण का निष्पादन करने की अनुमति प्रदान करती है;

और जबकि, भारत सरकार ने सुशासन (सामाजिक कल्याण, नवाचार, ज्ञान) नियमावली, 2020 हेतु आधार प्रमाणीकरण की रूपरेखा तैयार की है जिसके अंतर्गत राज्य सरकार स्वैच्छिक आधार पर आधार प्रमाणीकरण का उपयोग करने की अनुमति मांग सकती है;

और जबकि, भारत सरकार ने आधिकारिक ज्ञापन संख्या 13(4)/2020-ईजी-II(खंड-IV-9), दिनांक 14 मई, 2024 को सक्षम प्राधिकारी के अनुमोदन से संप्रेषित किया है कि राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार का शहरी विकास विभाग अपने क्षेत्र में नई दिल्ली नगर पालिका परिषद्‌ द्वारा पटरी विक्रेताओं के हाँ/नहीं या/और ई-केवाईसी प्रमाणीकरण सुविधा का उपयोग करते हुए सर्वेक्षण करने हेतु स्वैच्छिक आधार पर आधार प्रमाणीकरण का निष्पादन करने के लिए आधार (वित्तीय और अन्य सब्सिडी, लाभ और सेवाओं का लक्षित वितरण) अधिनियम, 2016 ("अधिनियम") की धारा 4 की उप-धारा (4) के खंड (ख) के उप-खंड (ii) के साथ पठित सुशासन (सामाजिक कल्याण, नवाचार, ज्ञान) नियमावली, 2020 हेतु आधार प्रमाणीकरण के निमय-5 के अंतर्गत अधिसूचित करने के लिए अनुमति प्रदान करता है।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] उक्त प्राधिकार इस शर्त के अधीन है कि शहरी विकास विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार/नई दिल्ली नगर पालिका परिषद्‌ यह सुनिश्चित करेगा कि आधार प्रमाणीकरण सेवाओं का उपयोग केवल उन सेवाओं/उद्देश्यों के लिए किया जाए जो आधार अधिनियम की धारा 4(4)(ख)(i) अथवा 4(4)(ख)(ii) या 7 के प्रावधानों के सख्ती से अनुपालन में हैं तथा वे संबंधित केंद्र/राज्य मंत्रालय/विभाग द्वारा विधिवत अधिसूचित की गई हैं।

अब, इसलिए, सुशासन (सामाजिक कल्याण, नवाचार ज्ञान) नियमावली, 2020 हेतु आधार प्रमाणीकरण के नियम-5 के अंतर्गत शक्तियों का प्रयोग करते हुए, दिल्ली के उपराज्यपाल एतद्‌द्वारा शहरी विकास विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार/नई दिल्ली नगर पालिका परिषद्‌ अपने क्षेत्र में नई दिल्ली नगर पालिका परिषद द्वारा पटरी विक्रेताओं के हाँ/नहीं या/और ई-केवाईसी प्रमाणीकरण सुविधा का उपयोग करते हुए सर्वेक्षण करने के लिए तथा पहले से बनाई गई विभिन्न योजनाओं के अंतर्गत लाभार्थियों को मौद्रिक लाभ प्रदान करने के लिए पंजीकरण हेतु स्वैच्छिक आधार प्रमाणीकरण के निष्पादन को अधिसूचित करती है।

यदि दावेदार अपने आधार का उपयोग करके प्रमाणित करने का इरादा नहीं रखता है, तो नई दिल्ली नगर पालिका परिषद्‌ के अध्यक्ष अलग से पहचान के तरीकों को अधिसूचित करेंगे।

दावेदारों से एकत्र किया जाने वाला सहमति प्रपत्र इस अधिसूचना के साथ संलग्न अनुसूची "क" में विनिर्दिष्ट है।

मैं.......................................................आधार संख्या.....................................................................धारक यूआईडीएआई के साथ आधार ओटीपी अथवा बायोमेट्रिक प्रमाणीकरण का उपयोग करते हुए यूआईडीएआई के माध्यम से ई-केवाईसी तथा इसे शहरी विकास विभाग, राष्ट्रीय राजधानी क्षेत्रदिल्ली सरकार के डेटा बेस के साथ जोड़ने के उद्देश्य से मेरी पहचान और अन्य जानकारी प्राप्त करने के लिए शहरी विकास विभाग, राष्ट्रीय राजधानी क्षेत्रदिल्ली सरकार को अपनी सहमति देता हूं/देती हूं। मैं आधार (वित्तीय और अन्य सब्सिडी, लाभ और सेवाओं का लक्षित वितरण) अधिनियम, 2016 की धारा -7 के अंतर्गत अधिसूचित सरकारी कल्याण योजना हेतु डीबीटी के माध्यम से लाभों के वितरण के लिए अपने आधार नंबर का उपयोग करने के लिए भी अपनी सहमति देता हूं।

आधार की जानकारी एकत्र करने की सहमति और उद्देश्य मुझे स्थानीय भाषा में समझाया गया है। विभाग ने मुझे सूचित किया है कि मेरे आधार का उपयोग ऊपर उल्लिखित उद्देश्य के अलावा किसी अन्य उद्देश्य के लिए नहीं किया जाएगा। मुझे केवाईसी उद्देश्यों के लिए विभाग द्वारा आधिकारिक तौर पर वैध दस्तावेज जमा करके भौतिक केवाईसी सहित अन्य वैकल्पिक साधनों (मतदाता पहचान पत्र/ड्राइविंग लाइसेंस/राशन कार्ड आदि) के बारे में सूचित किया गया है तथा मैंने स्वेच्छा से आधार आधारित केवाईसी को चुना है।

मैं समझता हूं कि मैंने प्रमाणीकरण के लिए जो बायोमेट्रिक्स और/या ओटीपी उपलब्ध कराया है, उसका उपयोग केवल उस विशिष्ट लेनदेन के लिए आधार प्रमाणीकरण प्रणाली के माध्यम से मेरी पहचान प्रमाणित करने के लिए किया जाएगा और किसी अन्य उद्देश्य के लिए नहीं किया जाएगा।

व्यक्तिगत डेटा का उपयोग करने हेतु सहमति

NOTIFICATION

Delhi, the 21st August, 2024

F. No. 13(244)/UD/MB/SVS-18/2018/Pt-2(CD NO.-021582304)1328-1337.—Whereas Section 4(4)(b)(ii) of the Central Aadhaar (Targeted Delivery of Financial and other Subsidies, Benefits and Services) Act, 2016 (hereinafter referred to as "the said act), allows performing authentication on voluntary basis for such purpose as the Central Government in consultation with the Authority, and in the interest of the State, may prescribe;

AND WHEREASthe Government of India has framed the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020 under which the State Government can seek permission to use Aadhaar authentication on voluntary basis;

AND WHEREAS the Government of India vide Official Memorandum No. 13(4)/2020-EG-II(Vol-IV-9) dated 14th May, 2024 has conveyed the approval of the Competent Authority to allow the Govt. of NCT of Delhi, Urban Development Department, to notify under rule-5 of the Aadhaar Authentication for Good Governance (Social Welfare, Innovation, Knowledge) Rules, 2020 read with sub-clause (ii)of clause (b) of sub-section (4) of section 4 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 ("Act") performance of Aadhaar authentication, on a voluntary basis, for carrying out the survey of street vendors by the NDMC in their area, using Yes/No or/and e-KYC authentication facility.

The said authorization is subject to the condition that Urban Development Department, Government of NCT of Delhi/NDMC shall ensure that Aadhar Authentication services are used only for those services/purposes which are strictly in compliance with provisions of section 4(4)(b)(i) or4(4)(b)(ii) or 7 of the Aadhaar Act and have been duly notified by the concerned Central/State Ministry/Department.

Now, THEREFORE, in exercise of the powers under rule-5of the Aadhaar Authentication for Good Governance (Social Welfare, Innovation Knowledge) Rules, 2020, the Lt. Governor of Delhi is pleased to notify the Urban Development, Govt. of NCT of Delhi/NDMC to perform voluntary Aadhaar authentication for registration for carrying out the survey of street vendors by the NDMC in their area, using Yes/No or/and e-KYC authentication facility and providing monetary benefits to the beneficiaries under various schemes formulated.

The Chairman, New Delhi Municipal Council shall separately notify the methods of identification in case the claimant does not intend to authenticate using his Aadhaar.

The consent form to be collected from the claimants is specified in Schedule "A" appended to this notification.

I _____________________________ holder of Aadhaar No. _________________________ give my consent to the Govt. of NCT of Delhi, Urban Development Department for fetching my identity and other information for the purpose of e-KYC through UIDAI, using the Aadhaar OTP or Biometric authentication with UIDAI and seeding it with data base of Govt. of NCT of Delhi, Urban Development. I also give my consent for using my Aadhaar Number for disbursement of benefits through DBT for the Government Welfare Scheme notified under Section-7of the Aadhaar (Targeted Delivery of Financial and other subsidies, Benefits and Services) Act, 2016.

The consent and purpose of collecting Aadhaar has been explained to me in local language. The department has informed me that my Aaadhaar shall not be used for any purpose other than that mentioned above.

I have been informed of other alternative means (Voter ID/Driving License/Ration Card etc.), by the department for KYC purposes including physical KYC by submitting officially valid documents and I have voluntarily chosen Aadhaar based KYC.

I understand that the Biometrics and/or OTP I provide for authentication shall be used only for authenticating my identity through the Aadhaar Authentication system for that specific transaction and for no other purposes.

Consent For Using Personal Data

I ___________________________ holder of Govt. of NCT of Delhi ID __________________ hereby give consent to use my personal data available for creating database of Govt. of NCT of Delhi, Urban Development. I am aware that this database shall be used for deciding my eligibility for various schemes, services and projects of the Govt. of NCT of Delhi, Urban Development Department.
