फा0 सं0 11/17/2024/गृ0पु0-II/2204 से 2239.—गृह मंत्रालय, भारत सरकार की दिनांक 28 जून, 2024 की अधिसूचना सं0 एस0ओ0 2506 (ई) (फा0 सं0 यू-11030/3/2024-यूटीएल) के साथ पठित भारतीय नागरिक सुरक्षा संहिता, 2023 की धारा 176 की उपधारा (1) के अन्तर्गत प्रदत्त शक्तियों का प्रयोग करते हुए माननीय उपराज्यपाल, दिल्ली एतद् द्वारा निर्देश देते है कि किन्हीं भी नियमों या अनुदेशों में कुछ भी निहित होते हुए भी भारतीय नागरिक सुरक्षा संिहता, 2023 के उक्त प्रावधान के अन्तर्गत पुलिस स्टेशन के प्रभारी अधिकारी को निम्न यथाउल्लिखित मामलों में जांच के लिए किसी भी अधीनस्थ अधिकारी को प्रतिनियुक्त करने का अधिकार है :-
1. निरीक्षक :- भारतीय न्याय संहिता, 2023 तथा स्थानीय एवं विशेष कानून के अधीन सभी मामलों की जांच करेगा, जब तक कि ऐसे स्थानीय या विशेष कानून में कुछ भी असंगत निर्दिष्ट न हो अथवा ऐसे स्थानीय या विशेष कानून में जांच की शक्ति निर्दिष्ट रैंक के किसी भी पुलिस अधिकारी को प्रदान न की गई हो।
2. उप-निरीक्षक/सहायक उप-निरीक्षक ः- भारतीय न्याय संहिता, 2023 तथा स्थानीय एवं विशेष कानून के अधीन बीएनएस की धारा 103 (1) के अधीन हत्या के मामले को छोड़कर सभी मामलों की जाँच करेगा, जब तक कि ऐसे 5683 DG/2024
(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] स्थानीय या विशेष कानून में कुछ भी असंगत निर्दिष्ट न हो अथवा ऐसे स्थानीय या विशेष कानून में जांच की शक्ति निर्दिष्ट रैंक के किसी भी पुलिस अधिकारी को प्रदान न की गई हो।
3. प्रधान सिपाही ः- भारतीय न्याय संहिता, 2023 तथा स्थानीय एवं विशेष कानून के अधीन सभी मामलों की जाँच करेगा, जिसमें अधिकतम निर्धारित सजा सात (07) वर्ष तक है, जब तक कि ऐसे स्थानीय या विशेष कानून में कुछ भी असंगत निर्दिष्ट न हो अथवा ऐसे स्थानीय या विशेष कानून में जांच की शक्ति निर्दिष्ट रैंक के किसी भी पुलिस अधिकारी को प्रदान न की गई हो।
4. सिपाही, स्नातक उपाधि तथा 10 वर्षों की नियमित सेवा सहित और आयुक्त पुलिस, दिल्ली द्वारा यथानिर्धारित जांच प्रशिक्षण उत्तीर्ण ः- भारतीय न्याय संहिता, 2023 तथा स्थानीय एवं विशेष कानून के अधीन सभी मामलों की जाँच करेगा, जिसमें अधिकतम निर्धारित सजा तीन (03) वर्ष तक है, जब तक कि ऐसे स्थानीय या विशेष कानून में कुछ भी असंगत निर्दिष्ट न हो अथवा ऐसे स्थानीय या विशेष कानून में जांच की शक्ति निर्दिष्ट रैंक के किसी भी पुलिस अधिकारी को प्रदान न की गई हो।
उपरोक्त अधिकारियों को दैनिक डायरी में प्रविष्टियां करने, केस डायरी तथा केस फाइल लिखने, अंतिम रिर्पोट तैयार करने, गिरफ्तारी, जब्ती, प्रगति की रिपोर्ट प्रस्तुत करने के साथ-साथ न्यायालयों में उपस्थित होने तथा भारतीय नागरिक सुरक्षा संहिता, 2023 के अधीन मामलों की जांच एवं सुनवाई हेतु यथावश्यक सभी अन्य कार्यों को करने सहित जांच करने की शक्ति होगी।

F. No. 11/17/2024/HP-II/2204 to 2239.—In exercise of powers conferred under sub-section (1) of section 176 of Bharatiya Nagarik Suraksha Sanhita, 2023, read with the Ministry of Home Affairs, Govt. of India's Notification No. S.O. 2506(E), dated 28th June, 2024 (F. No. U-11030/3/2024-UTL), Hon'ble Lt. Governor, Delhi is pleased to direct that notwithstanding anything contained in any Rules or Instructions, the Officer-in-Charge of a Police Station under the said provision of the Bharatiya Nagarik Suraksha Sanhita, 2023 is empowered to depute any subordinate officer to investigate cases as mentioned below:
1. Inspectors: To investigate all cases under Bharatiya Nyaya Sanhita, 2023 and Local & Special Law unless anything contrary is specified in such local or special laws or the power of investigation in such local or special laws is conferred upon any police officer of specified rank.
2. Sub-Inspectors/Assistant Sub-Inspectors: To investigate all cases under Bharatiya Nyaya Sanhita, 2023 and Local & Special Laws except Murder under section 103(1) BNS, unless anything contrary is specified in such local or special laws or the power of investigation in such local or special laws is conferred upon any police officer of specified rank.
3. Head Constables: To investigate all cases under Bharatiya Nyaya Sanhita, 2023 and Local & Special Laws which have the maximum prescribed punishment of upto seven (7) years, unless anything contrary is specified in such local or special laws or the power of investigation in such local or special laws is conferred upon any police officer of specified rank.
4. Constable with Graduate degree and 10 years of regular service and having passed a training in
investigation as prescribed by the Commissioner of Police, Delhi: To investigate all cases under Bharatiya Nyaya Sanhita, 2023 and Local & Special Laws which have the maximum prescribed punishment of upto[PART IV DELHI GAZETTE : EXTRAORDINARY 3 three (3) years, unless anything contrary is specified in such local or special laws or the power of investigation in such local or special laws is conferred upon any police officer of specified rank.
The afore-mentioned officers shall have the power to carry out investigation, including making entries in the Daily Diary, writing case diaries and case files, drafting final reports, effecting arrests, seizures, submit progress as well as appearance in Courts and carrying out all other functions as required for investigation and trial of cases under the Bharatiya Nagarik Suraksha Sanhita, 2023.
