सं. 576/3/ईवीएम/2025/एसडीआर/खण्ड-I.––यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61क में यह उपबंध किया गया है कि ऐसे निर्वाचन क्षेत्र या निर्वाचन क्षेत्रों में वोटटंग मशीनों द्वारा मतदान करने और मतों के अभिलेखन का यथाविहित ऐसा तरीका अपनाया जाए, जैसा कि भारत निर्वाचन आयोग द्वारा प्रत्येक मामले की परिस्थितियों को ध्यान में रखते हुए, विर्निर्दष्ट किया जाए;

(1)2 DELHI GAZETTE : EXTRAORDINARY PART II—I] 2. यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 49क के परन्तुक के अनुसार भारत निर्वाचन आयोग द्वारा यथा-अनुमोदित ऐसे डिजाइन वाला ड्रॉप बॉक्स युक्त एक प्रिंटर भी, ऐसे निर्वाचन क्षेत्र या निर्वाचन क्षेत्रों या उसके भागों में मत के पेपर ट्रेल के मुद्रण के लिए मतदान मशीन के साथ जोड़ा जाए जैसा कि भारत निर्वाचन आयोग द्वारा निदेश दिया जाए;
3. यतः, निर्वाचन आयोग ने अपने प्रेस नोट सं. ईसीआई/पीएन/169/2025 और प्रेस नोट सं.
ईसीआई/पीएन/170/2025 दोनों दिनांक 07 जनवरी, 2025 के जरिए घोषित राष्ट्रीय राजधानी क्षेत्र दिल्ली विधानसभा के वतर्मान साधारण निर्वाचन एवं उत्तर प्रदेश में 273-मिल्कीपुर (अ.जा.) विधानसभा क्षेत्र और तमिलनाडु में 98- इरोड (पूर्व) विधानसभा क्षेत्र के उपचुनावों में सभी परिस्थितियों पर विचार किया है, और निर्वाचन आयोग संतुष्ट है कि उपयु र्क्त विधान सभा निर्वाचन क्षेत्रों में मतदान कराने के लिए पर्याप्त संख्या में इलेक्ट्रॉनिक वोटटंग मशीनें (ईवीएम) और पेपर ट्रेल [मतदाता सत्यापनीय पेपर ऑडिट ट्रेल मशीन (वीवीपैट)] मुद्रित करने के लिए प्रिंटर उपलब्ध हैं। मतदान कार्र्मक ईवीएम और 'वीवीपैट प्रिंटरों' को कु शलतापूर्वक संभालने में अच्छी तरह से प्रशिक्षित हैं और मतदाता भी ईवीएम और वीवीपैट प्रिंटरों के प्रचालन से पूर्ण रूप से अवगत हैं ।
4. अब, इसलिए, भारत निर्वाचन आयोग, लोक प्रतिनिधित्व अधिनियम, 1951 की उक्त धारा 61क तथा निर्वाचनों का संचालन नियम, 1961 के नियम 49क के तहत अपनी शक्तियों का प्रयोग करते हुए, एतद्द्वारा, 10 जनवरी, 2025 को अधिसूचित किये जाने वाले, राष्ट्रीय राजधानी क्षेत्र दिल्ली के सभी विधानसभा निर्वाचन क्षेत्रों, उत्तर प्रदेश में 273-मिल्कीपुर (अ.जा.) विधानसभा निर्वाचन क्षेत्र और तमिलनाडु में 98-इरोड (पूर्व) विधानसभा निर्वाचन क्षेत्र को ऐसे निर्वाचन क्षेत्रों के रूप में विर्निर्दष्ट करता है, जिनमें निर्वाचनों का संचालन नियम, 1961 और इस विषय पर निर्वाचन आयोग द्वारा समय-समय पर जारी किए गए अनुपूरक अनुदेशों के अंतर्गत विहित तरीके से इलेक्ट्रॉनिक वोटटंग मशीनों तथा वीवीपैट प्रिंटरों के माध्यम से मत डाले और अभिलिखित किए जाएंगे। 5. निर्वाचन आयोग, एतद्द्वारा भारत इलेक्ट्रॉनिक्स लिमिटेड, बंगलोर तथा इलेक्ट्रॉनिक्स कापोरेशन ऑफ इण्डिया लिमिटेड, हैदराबाद द्वारा यथा-विकसित इलेक्ट्रॉनिक वोटटंग मशीनों और वीवीपैट प्रिंटरों, जिन्हें सभी निर्वाचन क्षेत्रों में मत डालने और अभिलिखित करने के लिए उक्त मशीनों से जोड़ा जाएगा, के डिजाइन को भी अनुमोदित करता है।

No.576/3/EVM/2025/SDR-Vol.-I.—Whereas, Section 61A of the Representation of the People Act, 1951, provides that the giving and recording of votes by voting machines in such manner as may be prescribed, may[PART II—I DELHI GAZETTE : EXTRAORDINARY 3 be adopted in such constituency or constituencies as the Election Commission of India may, having regard to the circumstances of each case, specify; and
2. Whereas, as per the proviso to Rule 49A of the Conduct of Elections Rules, 1961, a printer with a drop box of such design, as may be approved by the Election Commission of India, may also be attached to voting machine for printing a paper trail of the vote, in such constituency or constituencies or parts thereof as the Election Commission of India may direct; and
3. Whereas, the Election Commission has considered the circumstances in current general election to the Legislative Assembly of NCT of Delhi bye elections to 273-Milkipur (SC) Assembly Constituency in Uttar Pradesh & 98-Erode (East) Assembly Constituency in Tamil Nadu announced vide the Election Commission's Press Notes No. ECI/PN/169/2025 and No. ECI/PN/170/2025 both dated 07th January, 2025, and is satisfied that sufficient number of Electronic Voting Machines (EVMs) and Printers for printing Paper Trail [Voter Verifiable Paper Audit Trail(VVPAT)] are available for taking the poll in the above said Assembly Constituencies. The polling personnel are well trained in efficient handling of EVMs and 'VVPAT Printers' and the electors are also fully conversant with the operation of the EVMs and the VVPAT Printers;
4. Now, therefore, the Election Commission of India, in exercise of its powers under the said Section 61A of the Representation of the People Act, 1951, and Rule 49A of the Conduct of Elections Rules, 1961, hereby specifies all the Assembly Constituencies in NCT of Delhi, 273-Milkipur (SC) Assembly Constituency in Uttar Pradesh and 98-Erode (East) Assembly Constituency in Tamil Nadu, to be notified on 10th January, 2025, as the constituencies in which the votes, shall be given and recorded by means of EVMs and VVPAT printers in the manner prescribed, under the Conduct of Elections Rules, 1961, and the supplementary instructions issued by the Election Commission from time to time on the subject.
5. The Election Commission also hereby approves the design of EVMs and VVPAT Printers as developed by the Bharat Electronics Ltd., Bangalore and Electronics Corporation of India Ltd., Hyderabad, which shall be attached to the said machines, to be used for the giving and recording of votes in all the Constituencies.
