फा.सं. 5(118)/23/भूमि एवं भवन/प्रशा0/भर्ती नियम/7454.-गृह मंत्रालय, भारत सरकार की दिनांक 13 जुलाई, 1959 की अधिसूचना संख्या फा0 27/59-एचआईएम (i) के साथ पठित संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा इस सरकार की दिनांक 31 जुलाई, 1971 की अधिसूचना संख्या फा0 2(25)/69-एस (II) के अधिक्रमण में, ऐसे अधिक्रमण से पूर्व की गई या विलोप की जाने वाली बातों को छोड़कर, राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल एतद् द्वारा भूमि एवं भवन विभाग, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार में ''विधि अधिकारी'' के पद की भर्ती पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. संक्षिप्त शीर्षक एवं प्रारंभ :- (i) इन नियमों को भूमि एवं भवन विभाग, विधि अधिकारी भर्ती नियमावली, 2024 कहा जाए।
(ii) ये दिल्ली राजपत्र में अपने प्रकाशन की तिथि से लागू होंगे।
2. पदों की संख्या, वर्गीकरण तथा वेतन मैट्रिक्स में स्तर :- उक्त पदों की संख्या, उनका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर इन नियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथाविनिर्दिष्ट होंगे।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 3. भर्ती पद्धति, आयु-सीमा, योग्यताएं इत्यादि :- उक्त पदों की भर्ती पद्धति, आयु-सीमा, योग्यता एवं इससे संबंधित अन्य मामले उक्त अनुसूची के कॉलम (5) से (13) में यथाविनिर्दिष्ट होंगे।
4. अयोग्यता :-वह व्यक्ति,
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; अथवा
(ख) जो एक जीवित पति/पत्नी के होते हुए किसी व्यक्ति से विवाह कर चुका है या विवाह की संविदा कर चुका है, वह उक्त पद पर नियुक्ति के लिए पात्र नहीं होगा।
शर्त यह है कि यदि सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति एवं विवाह के अन्य पक्ष पर लागू व्यक्तिगत कानून के अंतर्गत अनुमत है और ऐसा करने के लिये अन्य आधार हैं, तो वह किसी ऐसे व्यक्ति को इस नियम के प्रवर्तन की छूट दे सकती है।
5. शिथिल करने की शक्ति ः- जहां सरकार का यह मत हो कि ऐसा करना आवश्यक अथवा समीचीन है, तो वह कारणों को लिखित में अभिलेखबद्ध करते हुए तथा आदेश द्वारा व्यक्तियों के किसी वर्ग या श्रेणी के संबंध में इन नियमों के किसी भी उपबंध को छूट दे सकती है।
6. बचाव :- इन नियमों में सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्गों, भूतपूर्व सैनिक तथा अन्य विशेष वर्गों के व्यक्तियों के लिये उपबंधित किए जाने वाले अपेक्षित आरक्षण, आयुु-सीमा में छूट और अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा।

| 7. | सीधी भर्ती वाले उम्मीदवारों से अपेक्षित शैक्षिक तथा अन्य योग्यता | ः अनिवार्य : | i) किसी मान्यता प्राप्त संस्थान/विश्वविद्यालय से विधि में उपाधि तथा विधि कार्य में विधि व्यवसायी के रूप में 02 वर्षों का अनुभव अथवा सरकारी कार्यालय में विधि कार्य में 02 वर्षों का अनुभव |
| ट ीप 1ः अन्यथा सुयोग्य उम्मीदवारों के मामले में, योग्यता कारणों को लिखित में अभिलेखबद्ध करते हुए, संघ लोक सेवा आयोग के विवेक पर शिथिलनीय हैं। ट ीप 2ः यदि चयन की किसी अवस्था में संघ लोक सेवा आयोग के अभिमत से अनुसूचित जातियों अथवा अनुसूचित जनजातियों से संबंधित उम्मीदवारों के मामले में, उनके लिए आरक्षित रिक्तियों को भरने हेतु अपेक्षित अनुभव रखने वाले इन समुदायों से उम्मीदवारों के पर्याप्त संख्या में मिलने की संभावना नहीं है, तो अनुभव संबंधी योग्यता (योग्यताएँ) कारणों को लिखित में अभिलेखबद्ध करते हुए संघ लोक सेवा आयोग के विवेक पर शिथिलनीय है। | |||

NOTIFICATION
Delhi, the 8th January, 2025
F. No. 5(118)/23/L&B/ADMN/RRs/7454.—In exercise of the powers conferred by the proviso to article 309 of the Constitution read with the Government of India, Ministry of Home Affairs, notification number F-27/59- Him (i) dated the 13th July, 1959, and in supersession of this Government's Notification No.F.2(25)/69-S(II) dated 31ST July, 1971, except as respects things done or omitted to be done before such supersession, the Lt. Governor of the National Capital Territory of Delhi, is hereby pleased to make the following rules regulating the method of recruitment to the post of "LAW OFFICER" in the Department of Land & Building Department, Govt. of NCT of Delhi, namely:-
1. Short title and commencement – (i) These rules may be called the 'Land & Building Department, Law Officer, Recruitment Rules-2024.
(ii) They shall come into force from the date of their publication in the Delhi Gazette.
2. Number of Posts, Classification and level in the Pay Matrix - The number of post, its classification and level in the Pay Matrix shall be as specified in columns (2) to (4) of the Schedule annexed with these rules.
3. Method of recruitment, age limit, Qualifications, etc. –The method of recruitment to the said posts, age limit, qualification and other matters connected therewith, shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification - No person –
(a) who has entered into or contracted a marriage with a person having a spouse living, or
(b) who having a spouse living, has entered into or contracted a marriage with any person shall be eligible for appointment to the said post:
Provided that the Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other ground for so doing exempt any person from the operation of this rule.
5. Power to relax – Where the Government is of the opinion that it is necessary expedient so to do, it may be order and for reasons to be recorded in writing, relax any of the provisions of this rule with respect of any class or category of persons.
6. Saving – Nothing in these rules shall affect reservations, relaxation of age limit and other concession required to be provided for the Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-servicemen or any other special category of persons in accordance with the orders issued by the Government from time to time in this regard.
