I दिल्ली, 28 फरवरी, 2025 II .—गृह मंत्रालय, भारत सरकार, नई दिल्ली की दिनांक 28.06.2024 की अधिसूचना एसओ संख्या 2506 (ङ) के साथ पठित भारतीय नागरिक सुरक्षा संहिता, 2023 की धारा 64 की उपधारा (1) तथा (2) के अन्तर्गत प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल, एतद्द्वारा निम्नलिखित नियम बनाते हैं, अर्थात्ः-
1.
(i) इन नियमों को 'दिल्ली बीएनएसएस (सम्मन सेवा) नियमावली, 2025' कहा जाए।
(ii) इनका विस्तार सम्पूर्ण राष्ट्रीय राजधानी क्षेत्र दिल्ली तक होगा।
(iii) ये दिल्ली राजपत्र में अपने प्रकाशन की तिथि से लागू होंगे।
2. - भारतीय नागरिक सुरक्षा संहिता, 2023 के अन्तर्गत जारी किए गए प्रत्येक सम्मन की सेवा एक पुलिस अधिकारी द्वारा की जाएगी :

बशर्ते कि जहां कोई न्यायालय उचित समझे, वह आदेश दे सकता है कि ऐसे सम्मन की सेवा किसी
अन्य जांच एजेंसी के कर्मचारी/अधिकारी या दिल्ली जिला न्यायालयों के न्यायालय प्रशासन के कर्मचारी या
राजस्व विभाग या राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के किसी अन्य विभाग के कर्मचारी द्वारा की जा
सकती है या उनके द्वारा अतिरिक्त रूप से भी की जा सकती है, जैसा कि न्यायालय अपने आदेश में निर्दिष्ट
कर सकता है।
(1) प्रत्येक पुलिस स्टेशन का प्रभारी अधिकारी प्रत्येक व्यक्ति के संबंध में अपेक्षित विवरणों को दर्ज करने
हेतु इलेक्ट्रॉनिक रूप में या अन्यथा रूप में एक रजिस्टर अनुरक्षित करेगा जिसके विरुद्ध भारतीय नागरिक
सुरक्षा संहिता, 2023 के अध्याय-VI के अन्तर्गत सम्मन को इन नियमों के साथ संलग्न अनुसूची-I में
यथाविनिर्दिष्ट ऐसे प्रपत्र के रूप में जारी किया जाना अपेक्षित हो सकता है।
(2) जहां किसी जांच, अन्वेषण या परीक्षण के दौरान किसी पुलिस अधिकारी या न्यायालय को यह प्रतीत
होता है कि ऐसी स्थिति उत्पन्न हो सकती है जहां किसी व्यक्ति को भारतीय नागरिक सुरक्षा संहिता, 2023
के अंतर्गत उस चरण पर या बाद के चरण पर सम्मन (सम्मनों) की सेवा करनी पड़ सकती है, चाहे वह
अभियुक्त या साक्षी के रूप में हो या अन्यथा रूप में, ऐसा पुलिस अधिकारी या न्यायालय ऐसे व्यक्ति से
संबंधित पुलिस स्टेशन के प्रभारी अधिकारी को संबोधित करते हुए घोषणा प्रस्तुत करने के लिए कह सकता
है जिसमें ऐसे व्यक्ति के संबंध में I में विनिर्दिष्ट अपेक्षित विवरण दिए गए हों, साथ ही यह वचन भी
दिया गया हो कि ऐसा व्यक्ति I में विनिर्दिष्ट किसी भी विवरण में परिवर्तन होने की स्थिति में
संबंधित पुलिस स्टेशन के प्रभारी अधिकारी को तुरंत सूचित करेगा।
(1) भारतीय नागरिक सुरक्षा संहिता, 2023 के अंतर्गत इलेक्ट्रॉनिक संचार के माध्यम से सम्मन की सेवा
हेतु दिल्ली पुलिस अपेक्षित आधारभूत संरचना के साथ प्रत्येक पुलिस स्टेशन में एक इलेक्ट्रॉनिक सम्मन
वितरण केंद्र स्थापित करेगी।
(2) राष्ट्रीय राजधानी क्षेत्र दिल्ली में प्रत्येक अन्य जांच एजेंसी भी भारतीय नागरिक सुरक्षा संहिता, 2023
के अध्याय-VI के अंतर्गत जारी किये गये इलेक्ट्रॉनिक संचार के माध्यम से सम्मन की सेवा हेतु अपने
कार्यालय में ऐसा ही इलेक्ट्रॉनिक सम्मन वितरण केंद्र स्थापित भी करेगी।
(1) न्यायालय किसी मामले में आदेश द्वारा दिशा-निर्देश दे सकता है कि किसी व्यक्ति पर सम्मन की
सेवा भौतिक रूप से की जाने वाली साधारण सम्मन सेवा के अतिरिक्त इलेक्ट्रानिक संचार के माध्यम से भी
की जाए।
स्पष्टीकरण 1ः जहां कहीं भी इलेक्ट्रॉनिक संचार के माध्यम से सेवा करने का दिशा-निर्देश दिया जाता है,
वहां सम्मन की सेवा ई-मेल, व्हाट्सएप या किसी अन्य त्वरित संदेश सेवा के माध्यम से की जा सकती है,
जैसा कि न्यायालय आदेश द्वारा निर्दिष्ट करें, जिससे प्राप्तकर्ता के ई-मेल आईडी या व्हाट्सएप नंबर या
अन्य त्वरित संदेश सेवा आईडी पर डिजिटल रूप में सम्मन की डिलीवरी संभव हो सके, जैसा कि नियम 3
के अनुसार बनाए गए रजिस्टर में उपलब्ध है।
स्पष्टीकरण 2ः इन नियामों में ''इलेक्ट्रानिक संचार'' शब्द का वही अर्थ होगा जो भारतीय नागरिक सुरक्षा
संहिता, 2023 के नियम 2 (i) के अन्तर्गत दिया गया है।
(2) जहां कहीं सम्मन की सेवा इलेक्ट्रानिक संचार द्वारा करने का दिशा-निर्देश दिया गया है, वहां
डिजिटल रूप से सृजित सम्मन, जिस पर न्यायालय की मुहर की छवि होगी तथा जो न्यायालय के पीठासीन
अधिकारी या उसके द्वारा इस संदर्भ में प्राधि—त किसी अन्य अधिकारी द्वारा डिजिटल रूप में हस्ताक्षरित
होगा, किसी व्यक्ति को दिया जायेगा।
(3) जहां भी आवश्यक हो, इलेक्ट्रॉनिक संचार के माध्यम से भेजे जाने वाले सम्मन के साथ शिकायत,
दस्तावेजों आदि की सॉफ्ट प्रतियां या स्कैन की गई प्रतियां भी संलग्न की जा सकती हैं।
(4) इलेक्ट्रॉनिक संचार के माध्यम से प्रेषित किए जाने वाले अपेक्षित सम्मन को सेवा हेतु संबंधित पुलिस
स्टेशन के इलेक्ट्रॉनिक सम्मन वितरण केंद्र को प्रेषित किया जाएगा और ऐसे सम्मन को भारतीय नागरिक
[PART IV DELHI GAZETTE : EXTRAORDINARY 3सुरक्षा संहिता, 2023 की धारा 2 (i) में यथा परिभाषित "इलेक्ट्रॉनिक संचार" के माध्यम से प्रेषित किया
जाएगा और उपयोग में आने वाले ऐसे इलेक्ट्रॉनिक संचार के विवरणों को दिल्ली पुलिस/जांच एजेंसी की
वेबसाइट पर भी प्रदर्शित किया जाएगा।
बशर्ते कि जहां किसी मामले में कोई न्यायालय ऐसा निर्देश देता है कि संबंधित न्यायालय द्वारा
सम्मन को इलेक्ट्रॉनिक संचार के माध्यम से भी प्रेषित किया जा सकता है। न्यायालय में उपयोग किए गये
संचार के इलेक्ट्रॉनिक माध्यम के विवरणों को संबंधित जिला न्यायालय परिसर की वेबसाइट पर प्रदर्शित
किया जाएगा।
(5) न्यायालय, अपनाई गई सेवा की पद्धति, मानवीय आचरण के सामान्य क्रम तथा लोक और निजी कार्य
को ध्यान में रखते हुए, संतुष्ट होकर, आदेश द्वारा घोषित कर सकेगा कि सम्मन सेवा इलेक्ट्रॉनिक संचार के
माध्यम से विधिवत् रूप से की गई है।
बशर्ते कि इलेक्ट्रॉनिक संचार के माध्यम से सम्मन सेवा को केवल तभी सम्यक सेवा माना जाएगा,
जब साधारण तरीके से जारी सम्मन वापस नहीं किया गया हो या सेवा किए बिना वापस कर दिया गया हो
या जिस व्यक्ति को सेवा किया जाना अपेक्षित हो, वह राष्ट्रीय राजधानी क्षेत्र दिल्ली की प्रादेशिक सीमाओं से
बाहर निवास कर रहा हो।
इन नियमों की कोई भी बात भारतीय नागरिक सुरक्षा संहिता, 2023 या तत्समय प्रवृत्त किसी अन्य
कानून में दिए गए सम्मन या नोटिस या अन्य संचार की सेवा से संबंधित न्यायालय की शक्ति को सीमित या
अन्यथा प्रभावित करने वाली नहीं समझी जाएगी।

NOTIFICATION
Delhi, the 28th February, 2025
F. No. 11/08/2024/HP-II/Part File/445 to 453.—In exercise of the powers conferred under sub sections (1) and (2) of section 64 of The Bharatiya Nagarik Suraksha Sanhita, 2023, read with Notification bearing S.O. No. 2506(E), dated 28.06.2024 of the Ministry of Home Affairs, Government of India, New Delhi, the Lieutenant Governor of NCT of Delhi hereby makes following rules, namely:-
1. Short title and commencement—
(i) These rules may be called the 'Delhi BNSS (Service of Summons) Rules, 2025'.
(ii) They shall extend to whole of National Capital Territory of Delhi.
(iii) They shall come into force on the date of their publication in the Delhi Gazette.
2. Persons authorised to effect service of summons-
Every summons issued under the Bharatiya Nagarik Suraksha Sanhita, 2023 shall be served by a police officer:
Provided that, where any Court deems fit, it may order that such summons may be served or be additionally served by an official/officer of any other investigation agency or an official of the Court administration of Delhi District Courts or by an official of the Revenue department or any other department of the Government of NCT of Delhi as the Court may specify in its order.
3. Register of details:
(1) The Officer In-charge of every Police Station shall cause to be maintained a register, in electronic form or otherwise, for entering the requisite particulars in respect of every person against whom summons have been issued under Chapter VI of the Bharatiya Nagarik Suraksha Sanhita, 2023, in such form as specified in Schedule-I appended to these Rules.
(2) Where during the course of any inquiry, investigation or trial it appears to a police officer or to a Court that there may arise a situation where any person may have to be served with summons under the Bharatiya Nagarik Suraksha Sanhita, 2023 at that stage or at a later stage, whether as an accused or witness or otherwise, such police officer or Court may ask such person to furnish a declaration addressed to the Officer In-charge of the concerned Police Station stating the requisite particulars specified in Schedule-I with respect to such person along with an undertaking that such person shall immediately inform the Officer In-charge of the concerned Police Station in case of change in any of the particulars specified in Schedule-I.
4. Electronic Summons Delivery Centre:
(1) The Delhi Police shall establish an Electronic Summons Delivery Centre in each Police Station along with requisite infrastructure, for service of summons through electronic communication under the Bharatiya Nagarik Suraksha Sanhita, 2023.
(2) Every other investigation agency in National Capital Territory of Delhi shall also establish such Electronic Summons Delivery Centre in its office for service of summons through electronic communication issued under Chapter VI Bharatiya Nagarik Suraksha Sanhita, 2023.
5. Service of Summons through Electronic Communication:
(1) The Court may by order in a given case direct that summons be served upon any person through electronic communication in addition to ordinary service of summons through physical mode.
Explanation 1 : Wherever service is directed to be effected through electronic communication the summons may be served through e-mail, WhatsApp or any other instant messaging service as the Court may specify by order, enabling delivery of the summons in digital form on the email ID or WhatsApp number or other instant messaging service ID of the recipient, as are available in the Register maintained in accordance with Rule 3.
Explanation 2 : The term "Electronic Communication" in these rules shall have the same meaning as given under section 2 (i) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
(2) Wherever service of summons has been directed to be effected by electronic communication, digitally generated summons, bearing the image of seal of the Court and digitally signed by the Presiding Officer of the Court or any other officer authorised by him in this shall be served upon any person.
[PART IV DELHI GAZETTE : EXTRAORDINARY 5(3) The summons required to be served through electronic communication, wherever required, may be accompanied by soft copies or scanned copies of the complaint, documents, etc.
(4) The summons required to be served through electronic communication shall be transmitted for service to the Electronic Summons Delivery Centre of the concerned Police Station for service and such summons shall be served through the "Electronic Communication" as defined in section 2 (i) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and the details of such Electronic Communications which are in use shall also be displayed on the website of Delhi Police/Investigation Agency.
Provided that where in a given case any Court so directs, summons may also be served through electronic communication by the concerned Court. The details of electronic modes of communication used in the court shall be displayed on the website of the concerned District Court Complex.
(5) The Court may, on being satisfied, regard being had to the mode of service adopted, the common course of human conduct and public and private business, by order declare the summons to be duly served through electronic communication.
Provided that service of summons through electronic communication shall be considered as due service only where the summons issued through ordinary mode have not been returned back or have been returned back unserved or where the person required to be served resides beyond the territorial limits of the National Capital Territory of Delhi.
6. Saving of powers of the Court:
Nothing in these rules shall be deemed to limit or otherwise affect the power of the Court relating to service of summons or notices or other communications as given in the Bharatiya Nagarik Suraksha Sanhita, 2023 or any other law for the time being in force.
