फा.सं. जीजीएसआईपीयू/कॉर्ड/ओआरडी.36/85वीं बीओएम/अमेन्ड/2025/417—गुरू गोबिन्द सिंह इन्द्रप्रस्थ विश्वविद्यालय अधिनियम 1998 (1998 का अधिनियम 9) की धारा 27(2) के प्रावधानों के अनुपालन में, गुरू गोबिन्द सिंह इन्द्रप्रस्थ विश्वविद्यालय के प्रबन्ध मंडल ने दिनांक 14वीं जनवरी 2025 को आयोजित अपनी 85वीं बैठक में कार्यसूची मद सं 85.23 के द्वारा, नीचे दिये गये विवरण के अनुसार वर्तमान अध्यादेश 36 'पेंशन-व-सामान्य भविष्य निधि योजना' जिसे राजपत्र अधिसूचना सं. जीजीएसआईपीयू/कॉर्ड/अध्यादेश 36-नवीन/50वां, 55वां, 59वां एवं 76वां बीओएम/2021ः75 दिनांकित 18वी फरवरी 2022 के द्वारा अधिसूचित किया गया, में निम्न संशोधनों को स्वीकृति दे दीः

| 2.9:कर्मचारी | इस अध्यादेश में जहाँ कहीं भी कर्मी (कर्मचारी) शब्द का उल्लेख हुआ है वहाँ शिक्षण और गैर-शिक्षण, दोनो ं ही ऐसे कर्मी वर्ग, इसमें सम्मिलित हैं, जो 01/01/2004 से पूर्व नियमित आधार पर नियुक्त किए गए थे तथा अधिवर्षता आयु प्राप्त नहीं कर पाये थे । इसमें ऐसे कर्मी भी सम्मिलित होंगे जिन्हें 01/01/2004 से पूर्व गुरू गोविन्द सिंह इन्द्रप्रस्थ विश्वविद्यालय के नियमित संख्याबल में सम्मिलित कर लिया गया था और वे अपनी विगत सेवा में पेंशनी पद धारक थे तथा उन्होंने इस अध्यादेश के प्रावधानों द्वारा संचालित होने का विकल्प दिया था। के.सि. से. | खण्ड 28: सेवा की अवशिष्ट शर्तें एवं संदेह निवारण | खण्ड 28 के उपखण्ड (i) और (ii) में कई परिवर्तन नही है। | खण्ड 28 में निम्न उपखण्ड (iii) को सम्मिलित किया गया: (iii) यदि किसी कर्मचारी की मृत्यु हो जाती है, जो राष्ट्रीय पेंशन प्रणाली (NPS) के लिए विकल्प नहीं चुन सका था चाहे विश्वविद्यालय में राष्ट्रीय पे ंशन प्रणाली की अधिसूचना में देरी की वजह से या एन.पी.एस. की अधिसूचना के पश्चात, विकल्प की अंतिम तिथि से पूर्व निधन हो गया हो, और इस प्रकार वह योजनाओं का सदस्य बनने में असमर्थ रह गया। ऐसे मामलों को 'पेंशन-व सामान्य भविष्य निधि योजना' के अन्र्तगत परिवार पे ंशन के रूप में एक विशेष परिस्थिति के रूप मे ं विचार किया जा सकता है, बशर्ते कि कर्मचारी की मृत्यु सी.सी.एस (राष्ट्रीय पेंशन प्रणाली के कार्यान्वयन) नियम 2021 की अधिसूचना की तिथि यानी 30. 03.2021 से तीन साल के भीतर हो गई हो। हालांकि, ऐसे मामलों के | |
| लिए निम्नलिखित शर्तें लागू होंगेः (a) परिवार को अध्यादेश मे ं संशोधन की अधिसूचना की तिथि से तीन महीने के भीतर 'पेंशन-व सामान्य भविष्य निधि योजना' के तहत परिवार पे ंशन के लिए विकल्प च ुनना होगा। (b) आवेदनकर्ता परिवार को विश्वविद्यालय को सी.पी.एफ के नियोक्ता योगदान उसके ब्याज के साथ वापस करना होगा। (c) परिवार पेंशन का अनुमोदन सभी अन्य कागजी औपचारिकताओं/ प्रक्रियाओं की पूर्ति पर निर्भर होगा, जैसा कि अध्यादेश 36 के साथ पठित सी.सी.एस. (पेंशन) नियम 2021 में निर्धारित है। |

F.No. GGSIPU/Coord/Ord.36/85thBOM/Amend/2025/417— In pursuance of the provisions of Section 27 (2) of the Guru Gobind Singh Indraprastha University Act 1998 (Act 9 of 1998), the Board of Management of the Guru Gobind Singh Indraprastha University in its 85th meeting held on 14.01.2025 vide resolution to agenda item no. 85.23 approved the following amendments in the existing Ordinance 36 related to Pension-Cum-General Provident Fund Scheme of the University notified vide Gazette Notification No. GGSIPU/ Coord/ Ord.36/ 50th, 55th, 59th & 76th BOM/ 2021:75 dated 18th February 2022:

| 2. | 28.0 : RESIDUARY CONDITIONS OF SERVICE & REMOVAL OF DOUBTS | No change in Sub-clause (i) and (ii) of Clause 28. | To Insert sub clause (iii) as under: ( iii) In case of death of an employee, who was not able to opt for the National Pension System either due to late notification of the National Pension System in the University or died prior to the last date of the submission of option, after notification of the NPS and thus was not able to become subscriber of the Schemes. Such cases may be considered for Family Pension as a peculiar circumstance case, under– Pension-cum-General Provident Fund Scheme provided the employee has died within three years from the date of notification of CCS (Implementation of National Pension System) Rules 2021 i.e. 30.03.2021. However such cases would be subject to the following stipulation: (a) The family has to opt for Family Pension under Pension-cum- General Provident Fund Scheme within three months from the date of the notification of the amendment in the Ordinance. (b) The applicant family has to return the Employer's contribution of CPF along with interest thereof to the University. ( c) The grant of family pension would be subject to completion of all other codal formalities / modalities as are prescribed in the Ordinance 36 read with provision of CCS (Pension) Rules, 2021. |
This amendment shall come into force with effect from the date of approval by the Board of Management i.e. 14.01.2025.
