डीपीसीसी/(3)(3)(8-20)/प्रशा0-14/2113—जल (प्रदूषण निवारण एवं नियंत्रण) अधिनियम, 1974 की धारा 2 के खंड (i) के साथ पठित धारा 12 की उप-धारा (3क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा दिल्ली राजपत्र में प्रकाशित दिनांक 5 सितंबर, 2016 की अधिसूचना संख्या फा0 डीपीसीसी/(3)(3)(8-20)/प्रशा0-14/2027 के अधिक्रमण में, ऐसे अधिक्रमण से पूर्व की गई या विलोप की जाने वाली बातों को छोड़कर, दिल्ली प्रदूषण नियंत्रण समिति, राष्ट्रीय राजधानी क्षेत्र दिल्ली के माननीय उपराज्यपाल के पूर्व अनुमोदन से, एतद् द्वारा दिल्ली प्रदूषण नियंत्रण समिति में वरिष्ठ सहायक (पूर्ववर्ती अपर श्रेणी लिपिक) के पद हेतु भर्ती पद्धति के संबंध में निम्नलिखित विनियम बनाते हैं, अर्थात् :-

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 1. संक्षिप्त शीर्षक एवं प्रारंभ :- (1) इन विनियमों को दिल्ली प्रदूषण नियंत्रण समिति, वरिष्ठ सहायक भर्ती विनियम, 2025 कहा जाए।
(2) ये आधिकारिक राजपत्र में अपने प्रकाशन की तिथि से लागू होंगे।
2. पदों की संख्या, वर्गीकरण तथा वेतन मैट्रिक्स में स्तर :- उक्त पदों की संख्या, उनका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर इन विनियमों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथाविनिर्दिष्ट होंगे। 3. भर्ती पद्धति, आयु सीमा, योग्यताएं इत्यादि ः- उक्त पदों की भर्ती पद्धति, आयु सीमा, योग्यता एवं इससे संबंधित अन्य मामले उक्त अनुसूची के कॉलम 5 से 13 में यथाविनिर्दिष्ट होंगे।
4. अयोग्यता :-वह व्यक्ति,
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; अथवा
(ख) जो एक जीवित पति/पत्नी के होते हुए किसी व्यक्ति से विवाह कर चुका है या विवाह की संविदा कर चुका है, वह उक्त पद पर नियुक्ति के लिए पात्र नहीं होगा।
शर्त यह है कि यदि सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति एवं विवाह के अन्य पक्ष पर लागू व्यक्तिगत कानून के अंतर्गत अनुमत है और ऐसा करने के लिये अन्य आधार हैं, तो वह किसी ऐसे व्यक्ति को इस विनियम के प्रवर्तन की छूट दे सकती है।
5. शिथिल करने की शक्ति :- जहां सरकार का यह मत हो कि ऐसा करना आवश्यक अथवा समीचीन है, तो वह कारणों को लिखित में अभिलेखबद्ध करते हुए, आदेश द्वारा व्यक्तियों के किसी वर्ग या श्रेणी के संबंध में इन विनियमों के किसी उपबंध को शिथिल कर सकती है।
6. बचाव ः- इन विनियमों में केन्द्र सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों तथा अन्य विशेष वर्गों के व्यक्तियों के लिए उपबंधित किए जाने के लिए अपेक्षित आरक्षण, आयु सीमा में छूट तथा अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा।

| 11. | यदि पदोन्नति/प्रतिनियुक्ति/ आमेलन द्वारा भर्ती होनी हो तो ग्रेड जिनसे पदोन्नति / प्रतिनियुक्ति/ आमेलन किया जाना है | ः | पदोन्नति :- वेतन मैट्रिक्स के वेतन स्तर 2 (रुपये 19900-63200/-) में नियमित आधार पर उनकी नियुक्ति के पश्चात् प्रदान की गई ग्रेड में 8 वर्षों की नियमित सेवा सहित कनिष्ठ सहायक। ट ीप :- जिन कनिष्ठ अधिकारियों ने अपनी अर्हक/पात्रता सेवा पूरी कर ली है; वे विचारणीय हैं। बशर्तें कि अपेक्षित अर्हक/पात्रता सेवा ऐसी अपेक्षित अर्हक/पात्रता सेवा से न्यून न हो, आधे से अधिक हो अथवा दो (02) वर्ष, इनमें से जो भी कम हो तथा उन्होंने आगामी उच्च ग्रेड पर पदोन्नति के लिए अपनी परिवीक्षा अवधि अपने कनिष्ठ अधिकारियों के साथ सफलतापूर्वक पूरी कर ली हो े, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है। प ्रतिनियुक्ति (अल्पकालिक संविदा सहित) :- केन्द्र/राज्य सरकार/संघ राज्य क्षेत्र/मान्यता प्राप्त अनुसंधान संस्थान/स्वायत्त निकाय/सांविधिक निकाय/सार्वजनिक क्षेत्र के उपक्रमों के अधिकारी- ( क) (i) नियमित आधार पर समरूप पदधारण करने वाले; अथवा (ii) वेतन मैट्रिक्स के वेतन स्तर 2 (रुपये 19900-63200/-) के पदों में कम-से-कम 08 वर्षों की नियमित सेवा रखने वाले या समकक्ष; टीप :- प्रतिनियुक्ति की अवधि में केन्द्र सरकार के उसी या किसी अन्य संगठन/विभाग में नियुक्ति से तुरन्त पूर्वधारित किसी अन्य गैर संवर्ग पद में प्रतिनियुक्ति की अवधि भी सम्मिलित है; यह सामान्यतः 03 (तीन) वर्षों से अधिक नहीं होगी। प ्रतिनियुक्ति हेतु अधिकतम आयु सीमा आवेदन प्राप्ति की अन्तिम तिथि को 56 ( छप्पन ) वर्षों से अधिक नहीं होगी; भ् ारक श्रेणी के विभागीय अधिकारी जो कि पदोन्नति की सीधी श्रृखंला में है, वे प्रतिनियुक्ति पर नियुक्ति हेतु विचारणीय नहीं होंगे। इसी तरह, प्रतिनियुक्ति वाले भी पदोन्नति द्वारा नियुक्ति हेतु विचारणीय नहीं होंगे। |

NOTIFICATION
Delhi, the 4th August, 2025
F. No. DPCC/(3)(3)(8-20)/Admn-14/2113—In exercise of the powers conferred by sub-section (3A) of section 12 read with clause (i) of section 2 of the Water (Prevention and Control of Pollution) Act, 1974, and in supersession of Notification No. DPCC/(3)(3)(8-20)/Admn-14/2027 dated the 5th September, 2016 published in Delhi Gazette, except as respects things done or omitted to be done before such supersession, Delhi Pollution Control Committee, with prior approval of Hon'ble Lt. Governor, National Capital Territory of Delhi, hereby makes the regulations regarding method of recruitment for the post of Senior Assistant (erstwhile Upper Division Clerk) in the Delhi Pollution Control Committee, as following namely:-
1. Short title and commencement.—(I) These regulations may be called the Delhi Pollution Control Committee, Senior Assistant Recruitment Regulations, 2025.
(II). They shall come into force on the date of their publication in Official Gazette.
2. Number of posts, classification and level in Pay Matrix. - The number of said posts, their classification and level in Pay Matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations.
3. Method of recruitment, age limit, qualifications etc. - The method of recruitment, age limit, qualification and other matters relating to the said posts shall be as specified in columns 5 to 13 of the said Schedule.
4. Disqualifications. - No person,-
(a) Who has entered into or contracted a marriage with a person having a spouse living or;
(b) Who, having a spouse living, has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said posts:
Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this regulation.
5. Power to relax. - Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these regulations with respect to any class or category of persons.
[PART IV DELHI GAZETTE : EXTRAORDINARY 56. Saving. - Nothing in these regulations shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
