सं. 77/नियम/डीएचसी.—दिल्ली उच्च न्यायालय अधिनियम, 1966 (1966 का अधिनियम 26) की धारा 7 द्वारा प्रदत्त शक्तियों तथा इस निमित्त समर्थ बनाने वाली अन्य सभी शक्तियों का प्रयोग करते हुए, दिल्ली उच्च न्यायालय, एतद् द्वारा दिल्ली उच्च न्यायालय नियम एवं आदेश के खंड V के अध्याय I के भाग क (ख) के नियम 5 में निम्नलिखित संशोधन करता है।
दिल्ली उच्च न्यायालय के नियमों एवं आदेशों के खंड V के अध्याय 1 के भाग क (ख) के मौजूदा नियम 5 के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा:-
5. ज़मानत आवेदन-उच्च न्यायालय में प्रस्तुत प्रत्येक ज़मानत आवेदन में याचिकाकर्ता को यह बताना होगा कि क्या सर्वोच्च न्यायालय में भी ऐसा ही आवेदन किया गया है या नहीं, और यदि किया गया है तो उसका परिणाम क्या था। याचिकाकर्ता/आवेदक को यह भी बताना होगा कि क्या वह किसी अन्य आपराधिक मामले में शामिल है/था या नहीं। यदि हाँ, तो उसका विवरण और निर्णय प्रस्तुत करना होगा। जिस आवेदन में यह जानकारी नहीं है, उसे आवश्यक जानकारी के साथ पीठ के समक्ष प्रस्तुत किया जाएगा।
नोट: यह संशोधन राजपत्र में इसके प्रकाशन की तिथि से लागू होगा। 2 DELHI GAZETTE : EXTRAORDINARY PART II—I] HIGH COURT OF DELHI: NEW DELHI NOTIFICATION
Delhi, the 25th September, 2025
No. 77/Rules/DHC.—In exercise of the powers conferred by Section 7 of the Delhi High Court Act, 1966 (Act 26 of 1966) and all other powers enabling it in this behalf, the High Court of Delhi, hereby makes the following amendment in Rule 5 of Part A(b), Chapter I of Volume V of the Delhi High Court Rules & Orders.
The following shall be substituted for the existing Rule 5 of Part A(b) of Chapter 1 of Volume V of the Delhi
High Court Rules & Orders:-
5. Bail Applications- In every application for bail presented to the High Court the petitioner shall state whether similar application has or has not been made to the Supreme Court, and if made shall state the result thereof. The petitioner/applicant shall also mention whether he/she is/was involved in any other criminal case or not. If yes, particulars and decisions thereof. An application which does not contain this information shall be placed before the bench with the necessary information.
NOTE : THIS AMENDMENT SHALL COME INTO FORCE FROM THE DATE OF ITS PUBLICATION IN THE GAZETTE.
