फा. सं. 4(32)/भर्ती नियम/स्टाफ कार चालक/डीएएम/स्था0/2023/3980 - गृह मंत्रालय, भारत सरकार की दिनांक 13 जुलाई, 1959 की अधिसूचना संख्या फा0 27/59-एचओएम (i) के साथ पठित संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रीय राजधानी क्षेत्र दिल्ली के उपराज्यपाल एतद् द्वारा कृषि विपणन निदेशालय, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के कार्यालय में (1) स्टाफ कार चालक-सामान्य ग्रेड और (2) स्टाफ कार चालक-ग्रेड-II के पदों पर नियुक्ति हेतु भर्ती पद्धति एवं आवश्यक शैक्षिक योग्यता के संबंध में नियमों को शामिल करते हुए, समय-समय पर यथासंशोधित अपनी दिनांक 05 मार्च, 2003 की अधिसूचना फा0सं0 2/15/2002-डीएएम/स्था0/851-854 के साथ संलग्न अनुसूची में निम्नलिखित संशोधन करते हैं, अर्थात्ः-
1. संक्षिप्त शीर्षक एवं प्रारंभ :-
(1) इन नियमों को ''कृषि विपणन निदेशालय, राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार, स्टाफ कार चालक-सामान्य ग्रेड और स्टाफ कार चालक-ग्रेड-II, अलिपिकीय, अराजपत्रित, समूह 'ग' भर्ती नियमावली, 2025'' कहा जाए।
(2) ये आधिकारिक राजपत्र में अपने प्रकाशन की तिथि से लागू होंगे।

3. भर्ती पद्धति, आयु सीमा, योग्यताएं इत्यादि :- उक्त पदों की भर्ती पद्धति, आयु सीमा, योग्यताएं एवं इससे संबंधित अन्य मामले उक्त अनुसूची के कॉलम (5) से (13) में यथाविनिर्दिष्ट होंगे।
4. अयोग्यता :-वह व्यक्ति,
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है;
अथवा
(ख) जो एक जीवित पति/पत्नी के होते हुए किसी व्यक्ति से विवाह कर चुका है या विवाह की संविदा कर चुका है, वह उक्त पद पर नियुक्ति के लिए पात्र नहीं होगा।
शर्त यह है कि यदि राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति एवं विवाह के अन्य पक्ष पर लागू व्यक्तिगत कानून के अंतर्गत अनुमत है और ऐसा करने के लिये अन्य आधार हैं, तो वह किसी ऐसे व्यक्ति को इस विनियम के प्रवर्तन की छूट दे सकती है।
5. शिथिल करने की शक्ति :- जहां सरकार का यह मत हो कि ऐसा करना आवश्यक अथवा समीचीन है, वहां वह आदेश द्वारा तथा उसके लिए जो कारण होंगे, उन्हें अभिलेखबद्ध करते हुए, व्यक्तियों के किसी वर्ग या श्रेणी के संबंध में इन नियमों के किसी उपबंध को शिथिल कर सकती है।
6. बचाव :- इन नियमों में सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों तथा अन्य विशेष वर्गों के व्यक्तियों के लिए उपबंधित किए जाने के लिए अपेक्षित आरक्षण, आयु सीमा में छूट तथा अन्य रियायतों पर कोई प्रभाव नहीं पड़ेगा

No.F.4(32)RRs/Staff Car Driver/DAM/Estt./2023/3980.— In exercise of the powers conferred by the proviso to article 309 of the constitution, read with the Government of India, Ministry of Home Affairs, Notification No.F.27/59-Hom(i) dated the 13th July 1959, the Lt. Governor of the National Capital Territory of Delhi is pleased to make the following amendments in the schedule annexed to his Notification No.F.2/15/2002-DAM/Estt./851-854, dated the 5th March, 2003, as amended from time to time, containing the rules regarding method of recruitment and educational qualification necessary for appointment to the posts of (1) Staff Car Drivers-Ordinary Grade and (2) Staff Car Drivers-Grade-II, in the office of the Directorate of Agricultural Marketing, Govt. of National Capital Territory of Delhi, Delhi, namely:-
1. Short title and commencement: -
(i) These rules may be called the "Directorate of Agricultural Marketing, Govt. of National Capital Territory of Delhi, Staff Car Driver Ordinary Grade and Staff Car Driver Grade- II Non-Ministerial, Non-Gazetted, Group 'C' Recruitment Rules, 2025."
(ii) They shall come into force on the date of their publication in the Official Gazetted.
2. Number of posts, its classification and pay level in the pay matrix: - The number of said post, its classification and level of pay in the pay matrix of pay attached thereto shall be as specified in Columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualifications etc: - The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in the Columns (5) to (13) of the said Schedule.
4. Disqualifications: - No person:
(a) Who has entered or contracted a marriage with a person having a spouse living:
Or
(b) Who having a spouse living, has entered into or contracted a marriage with any person; shall be eligible for appointment to any of the said posts:
Provided the Government of National Capital Territory of Delhi, may, if satisfied that such a marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other g rounds of doing so exempt any person from the operation of this regulation.
6 DELHI GAZETTE : EXTRAORDINARY PART IV]5. Power to relax: - Where the Government is of the opinion that if necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, may relax any of the provision of these rules with respect to any class or category of persons.
6. Saving: - Nothing in these rules shall affect reservation, relaxation of age limit and other concessions, required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex- servicemen and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.

N ote 2 : The qualification(s) regarding experience is relaxable at the discretion of the Competent Authority in the case of candidates belonging to Scheduled Castes or Scheduled Tribes if at any stage of selection, the Competent Authority is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancy reserved for them. |
