न्यायालय शुल्क अधिनियम, 1870 (1870 का 07)में राष्ट्रीय राजधानी क्षेत्र दिल्ली में प्रवर्तन के लिए आगे संशोधन करने
हेतु विधेयक।
भारत गणराज्य के छिहत्तरवें वर्ष में राष्ट्रीय राजधानी क्षेत्र दिल्ली की विधान सभा द्वारा निम्नलिखित "रूप से अधिनियमित होः
1- laf{kIr 'kh"kZd vkSj çkjaHk %& (1) इस अधिनियम को "न्यायालय शुल्क (दिल्ली संशोधन) अधिनियम, 2026" कहा जाएगा।
(2) यह अधिनियम दिल्ली राजपत्र में इसके प्रकाशन की तिथि से प्रभावी होगा।
2. धारा 16 का प्रतिस्थापनः- न्यायालय शुल्क अधिनियम, 1870 (1870 का 07) में राष्ट्रीय राजधानी क्षेत्र दिल्ली में इसके प्रवर्तन
में धारा 16 को निम्नलिखित रूप में प्रतिस्थापित किया जाएगाः
"धारा 16& शुल्क की वापसीः- यदि किसी वाद या अपील के पक्षकार किसी भी अवस्था में आपसी सहमति से अपना
विवाद सुलझा लेते हैं , चाहे न्यायालय के हस्तक्षेप से या बिना हस्तक्षेप के, तथा चाहे दीवानी प्रक्रिया संहिता, 1908
(1908 का अधिनियम सं. 5) की धारा 89 में उल्लिखित किसी भी विवाद निपटान विधि को अपनाकर या बिना अपनाए, और उक्त
वाद (जिसमें प्रत्यावेदन, यदि कोई हो, सम्मिलित है) या अपील को न्यायालय द्वारा सुलह / समझौते के रूप में निपटाया जाता है,
तो वादी/प्रत्यावेदक को न्यायालय से एक प्रमाणपत्र प्राप्त करने का अधिकार होगा, जिसके आधार पर वह कलक्टर/संबंधित
अधिकारी से उक्त वादपत्र/प्रत्यावेदन पर अदा किया गया पूरा शुल्क वापस प्राप्त कर सकेगा।"
3- /kkjk 16, dk yksi%& न्यायालय शुल्क (संशोधन) अधिनियम, 2010 द्वारा प्रविष्ट की गई धारा 16ए, जो दिल्ली राजपत्र
(असाधारण) अधिसूचना संख्या फ.14(22)एल.ए.-2008/डब्ल्यू.ए.डब्ल्यू./17, दिनांक 11 फरवरी, 2010 द्वारा अधिसूचित की गई थी,
लोप की जाएगी।

उद्देश्यों एवं कारणों का विवरण
कोर्ट-फीस अधिनियम, 1870 (1870 का 7) एक के न्रीय अधिनियम है, जो राष्ट्रीय राजधानी क्षेत्र दिल्ली में प्रर्वर्तत है। इस अधिनियम की धारा 16A, धारा 16 तथा धारा 16A के अंतर्गत न्यायालय शुल्क की वापसी चाहने वाले व्यक्तियों के बीच एक मनमाना भेद उत्पन्न करती है और इस कारण यह भारत के संविधान के प्रतिकू ल (असंवैधानिक) है। अतः धारा 16 में संशोधन करने तथा कोर्ट-फीस (दिल्ली संशोधन) अधिनियम, 2010 के माध्यम से जोड़ी गई धारा 16A को विलोपित करने का प्रस्ताव किया जाता है। यह विधेयक उपयु र्क्त उद्देश्यों की र्पूर्त हेतु प्रस्तुत किया गया है।

प्रतिनियोजित विधान संबंधी ज्ञापन
कोर्ट-फीस (दिल्ली संशोधन) अधिनियम, 2026 किसी भी पदाधिकारी को अधीनस्थ विधान बनाने की शक्ति प्रदान करने का प्रस्ताव नहीं करता है।

वित्तीय ज्ञापन
कोर्ट-फीस अधिनियम की धारा 16 में संशोधन से संबंधित प्रस्तावों के कार्यान्वयन हेतु औसतन र्वार्षक व्यय रुपये 1,64,79,035 (एक करोड़ चौंसठ लाख उन्नासी हजार पैंतीस) अनुमानित है। यह राशि माननीय उच्च न्यायालय द्वारा विगत तीन वित्तीय वषों के विवरण प्रस्तुत किए जाने के पश्चात् गणना की गई है, जिसमें कोर्ट-फीस अधिनियम, 1870 की धारा 16A के अंतर्गत समझौते के आधार पर न्यायालय शुल्क की वापसी के रूप में भुगतान की गई कु ल राशि का उल्लेख है।

further to amend the Court Fees Act 1870 (07 of 1870), in its application to the National Territory of Delhi.
BE it enacted by Legislative Assembly of Delhi Parliament in the Seventy-sixth year of the Republic of India as follows:––
1. Short title and commencement.- (1) This Act may be called the Court Fees (Delhi Amendment) Act 2026.
(2) It shall come into force from the date of its publication in the Delhi Gazette.
2. Substitution of section 16.- The section 16 of the Court Fees Act 1870 (07 of 1870), in its application to National Territory of Delhi, shall be amended as under;-
"Section 16 - Refund of Fee:- Where the parties to a suit or appeal, at any stage of such suit or appeal, settle their dispute amicably, with or without the intervention of the Court and with or without invoking any of the modes of settlement of dispute, referred to in section 89 of the Code of Civil Procedure, 1908 (5 of 1908) and the said suit including Counter-claim, if any, or appeal is disposed of as settled/compromised by the court, the plaintiff/Counter- claimant shall be entitled to a certificate from the Court authorizing him to receive back from the collector/competent officer, the full amount of fee, paid in respect of such plaint/counter claim."
3. Omission of section 16A.- Section 16A inserted vide the Court Fees (Delhi Amendment) Act 2010 notified in Delhi Gazette-Extra Ordinary, vide Notification No F.14(22)/LA-2008/WAW/17. Dated the 11th February, 2010, shall be omitted.

STATEMENT OF OBJECTS AND REASONS
The Court Fees Act, 1870 (7 of 1870) is a Central Act as in force in the National Capital Territory of Delhi. Section 16A of the Act is creating an arbitrary distinction between persons who seeks refund of court fees under Section 16 and Section 16A of the Court Fees Act, 2010, and therefore is ultra vires to the Constitution of India. Accordingly, it is proposed to amend the section 16 and omit section 16A inserted vide the Court Fees (Delhi Amendment) Act, 2010.
The Bill seeks to achieve the above objects.

The Court Fees (Delhi Amendment) Act, 2026 does not seek to confer power on any functionary to make subordinate legislation.

FINANCIAL MEMORANDUM
For the implementation of the proposals to consider amendment of section 16 of the Court Fees Act, 1870 (07 of 1870) there will be an average annual expenditure of Rupees: 16479035.
This amount has been calculated after the submission of details of last 3 financial years by Hon'ble High Court wherein total sum paid qua refund of court fees on settlement in terms of section 16 A of Court Fees Act, 1870 is provided.
