PRAVESH SAHIB SINGH, Minister (Legislative Affairs)52 DELHI GAZETTE : EXTRAORDINARY PART IV]
STATEMENT OF OBJECTS AND REASONS
The Government of National Capital Territory of Delhi is committed to promote ease of doing business and ease of living and to make the National Capital Territory of Delhi the most preferred global investment destination by eliminating unnecessary prosecution and by simplifying the regulatory procedure. Excessive regulation, offences of minor and technical nature and offences of procedural non-compliances impose a significant cost on businesses, citizens and the State. Such provisions not only deter entrepreneurship and hinder the ease of doing business and the ease of living, but also place an undue burden on the judicial system and reduce administrative efficiency.
The Government of National Capital Territory of Delhi has consistently sought to streamline and redefine the regulatory framework under the broader Ease of Living and Ease of Doing Business reforms. Towards this, easing the compliance burden and decriminalising minor contraventions of provisions of the Acts have been key policy priorities.
2. The Central Government has also enacted Jan Vishwas (Amendment of Provisions) Acts decriminalising various penal provisions of the Central Acts. The Central Government has circulated an advisory along with the Report of the Joint Parliamentary Committee on the Jan Vishwas (Amendment of Provisions) Act, 2023, to all States and Union Territories in 2023, to review their legislative landscape and to adopt and implement the decriminalization strategy at the State level.
3. The Government of National Capital Territory of Delhi has undertaken a comprehensive review of its regulatory legislative framework to identify and amend provisions that criminalise minor contraventions. The National Capital Territory of Delhi seeks to replace punishments for such minor contraventions with civil penalties for reducing burden on Courts and also for increasing administrative efficiency. Offences involving serious threats to public order, public health, life, or safety have been retained, while those relating to minor non-compliances, procedural lapses, and outdated regulatory requirements have been decriminalised. Further, punishments such as fines have been revised and rationalised.
4. It is now proposed to amend the :-
(i) The Delhi Industrial Development, Operation and Maintenance Act, 2010
(ii) The Delhi Shops and Establishments Act, 1954
(iii) The Delhi Electricity Reform Act, 2000
(iv) The National Capital Territory (Incredible India) Bed and Breakfast Establishments (Registration and Regulation) Act, 2007
(v) The Delhi Agricultural Produce Marketing (Regulation) Act, 1998
(vi) The Delhi Water Board Act, 1998
(vii) The Delhi Professional Colleges or Institutions (Prohibition of Capitation Fee Regulation of Admission Fixation of Non-Exploitative Fee and other Measures to Ensures Equity and Excellence) Act, 2007.
(viii) The Delhi Diploma Level Technical Education Institutions (Prohibition of Capitation Fee, Regulation of Admission, Fixation of Non-Exploitative Fee and other Measures to Ensure Equity and Excellence) Act, 2007
5. The Bill seeks to give effect to achieve the above objectives.
PRAVESH SAHIB SINGH, Minister (Legislative Affairs)[PART IV DELHI GAZETTE : EXTRAORDINARY 53
FINANCIAL MEMORANDUM
This Bill primarily aims at rationalising existing penalties and introducing adjudicatory mechanisms. No new office or authority is being created mandatorily under the Bill; however, existing departments may designate officers as adjudicating and appellate authorities.
The Bill does not involve recurring financial liabilities on the Consolidated Fund of the National Capital Territory of Delhi. Any incidental expenditure arising out of administrative restructuring, digital implementation, or enforcement under the adjudicatory framework shall be met from the existing budget allocations of the concerned departments.
In view of the above, no separate financial outlay is required.
PRAVESH SAHIB SINGH, Minister (Legislative Affairs) MEMORANDUM REGARDING DELEGATED LEGISLATION
The Bill empowers the Government of NCT of Delhi to frame rules to give effect to the provisions of the amended Acts, including:
(i) prescribing procedure for adjudication and authorities for implementation; (ii) specifying forms, timelines, and manner of appeal, (iii) notifying revised penalties through periodic inflation-linked revisions, (iv) issuing operational guidelines.
Such delegation is necessary since the procedural, administrative, and operational details may require future modification based on evolving regulatory needs, stakeholder feedback, and technological advancements.
The delegation of legislative power is therefore limited in scope, reasonable, and essential for effective implementation of the Bill.
