फा.सं. डीपीसीसी/(3)(3)(8-44)/प्रशा0-18/7677.—जल (प्रदूषण निवारण एवं नियंत्रण) अधिनियम, 1974 की धारा 2 के खंड (i) के साथ पठित धारा 12 की उपधारा (3क) द्वारा प्रदा शक्तियों का प्रयोग करते हुए, दिल्ली प्रदूषण नियंत्रण समिति के अध्यक्ष, राष्ट्रीय राजधानी क्षेत्र दिल्ली के माननीय उपराज्यपाल के पूर्वानुमोदन से एतद् द्वारा दिल्ली प्रदूषण नियंत्रण समिति में सदस्य सचिव के पद हेतु भर्ती पद्धति से संबंधित निम्नलिखित विनियमन बनाते हैं, अर्थात् :-
1. संक्षिप्त शीर्षक तथा प्रारंभ :- (1) इन विनियमनों को दिल्ली प्रदूषण नियंत्रण समिति, सदस्य सचिव, भर्ती विनियमन, 2026 कहा जाएगा।
(2) ये शासकीय राजपत्र में अपने प्रकाशन की तिथि से लागू होंगे।

(1)2 DELHI GAZETTE : EXTRAORDINARY PART IV] 2. पदों की संख्या, वर्गीकरण एवं वेतन मैट्रिक्स में स्तर :- उक्त पदों की संख्या, इनका वर्गीकरण तथा वेतन मैट्रिक्स में स्तर इन विनियमनों के साथ संलग्न अनुसूची के कॉलम (2) से (4) में यथाविनिर्दिष्ट होंगे।
3. भर्ती पद्धति, आयु सीमा, योग्यताएं इत्यादि :- उक्त पदों की भर्ती पद्धति, आयु सीमा, योग्यता तथा उससे संबंधित अन्य मामले उक्त अनुसूची के कॉलम (5) से (13) में यथाविनिर्दिष्ट होंगे। 4. अयोग्यता :- कोई भी व्यक्ति,
(क) जिसने किसी ऐसे व्यक्ति से विवाह किया है जिसका जीवित पति/पत्नी है; या (ख) जिसने जीवित पत्नी/पति के रहते हुए किसी अन्य व्यक्ति के साथ विवाह किया है, वह उक्त पद पर नियुक्ति के लिये अयोग्य होगा :
बशर्ते कि सरकार यदि इस बात से संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति या अन्य पक्ष पर लागू व्यक्तिगत कानून के अन्तर्गत अनुमति योग्य है तथा ऐसा करने के अन्य आधार हैं तब किसी व्यक्ति को इस विनियमन के प्रचालन से छूट प्रदान की जा सकती है।
5. शिथिल करने की शक्ति :- जहां सरकार का मत है कि ऐसा करना आवश्यक या समीचीन है तो वह आदेश द्वारा तथा कारणों को लिखित में अभिलेखबद्ध करते हुए व्यक्तियों के किसी वर्ग या श्रेणी के संबंध में इन विनियमनों के किन्हीं उपबंधों से छूट प्रदान कर सकती है।
6. बचाव :- इन विनियमनों में कोई भी बात इस संबंध में सरकार द्वारा समय-समय पर जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़ा वर्गों तथा अन्य विशेष वर्गों के व्यक्तियों के लिये अपेक्षित आरक्षण, आयु सीमा में छूट एवं अन्य रियायतों को प्रभावित नहीं करेगी।

NOTIFICATION
Delhi, the 13th March, 2026
No. DPCC/(3)(3)(8-44)/Admn-18/7677.—In exercise of the powers conferred by sub-section (3A) of section 12 read with clause (i) of section 2 of the Water (Prevention and Control of Pollution) Act, 1974, the Chairman, Delhi Pollution Control Committee, with prior approval of Hon'ble Lt. Governor, National Capital Territory of Delhi, hereby makes the following regulations regarding method of recruitment for the post of Member Secretary in the Delhi Pollution Control Committee, namely:-
1. Short title and commencement.—(I) These regulations may be called the Delhi Pollution Control Committee, Member Secretary Recruitment Regulations, 2026.
(II). They shall come into force on the date of their publication in Official Gazette.
2. Number of posts, classification and level in the pay matrix - The number of said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations.
3. Method of recruitment, age limit, qualifications etc. - The method of recruitment, age limit, qualification and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualifications. - No person,-
(a) Who has entered into or contracted a marriage with a person having a spouse living or;
(b) Who, having a spouse living, has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said posts:
Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this regulation.
5. Power to relax. - Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these regulations with respect to any class or ategory of persons.
6. Saving. - Nothing in these regulations shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-Servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.
