नई दिल्ली,17 अक्तूबर, 2018
सं. 76/दिल्ली-वि.स./14/2015.-यतः, श्री सी ए सतीश सिंघल ने 14-शालीमार बाग विधान सभा निर्वाचन क्षेत्र से राष्ट्रीय राजधानी क्षेत्र दिल्ली विधान सभा के साधारण निर्वाचन 2015 में निर्वाचन लड़ा था, जिसके परिणाम की घोषणा 10.02.2015 को की गई थी तथा लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार उन्हें निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से तीस दिन के भीतर जिला निर्वाचन अधिकारी, उत्तर के समक्ष विधि द्वारा अपेक्षित रीति से निर्वाचन व्यय लेखा दाखिल करना अपेक्षित था।
यतः, जिला निर्वाचन अधिकारी, उत्तर ने निर्वाचन संचालन नियम, 1961 के नियम, 89 के अधीन दिनांक 09-04-2015 की अपनी रिर्पार्ट में उल्लेख किया है कि श्री सी ए सतीश सिंघल लोक प्रतिनिधित्व अधिनियम, 1951 की उक्त धारा 78 के अधीन जिला निर्वाचन अधिकारी, उत्तर के समक्ष अपना निर्वाचन व्यय लेखा दािखल करने में असफल रहे हैं और,220 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT. : NOVEMBER 22, 2018/ AGRAHAYANA 1, 1940 PART II-I] यतः, श्री सी ए सतीश सिंघल को दिनांक 24-06-2015 को एक नोटिस जारी किया गया था जिसमें उनसे यह अपेक्षा की गई थी कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर अपना निर्वाचन व्यय लेखा दाखिल करें, ऐसा नहीं करने पर उन्हें तीन वर्ष की अवधि के लिए निर्वाचन लड़ने से निरर्हित घोषित कर दिया जाएगा। उन्हें यह नोटिस दिनांक 13-08-2015 को डेलीवर कर दिया गया था, और
यतः, जिला निर्वाचन अधिकारी, उत्तर ने दिनांक 17-02-2017 के अपने पत्र द्वारा सूचित किया था कि श्री सी ए सतीश सिंघल ने अपना निर्वाचन व्यय लेखा प्रस्तुत नहीं किया था। अतः, भारत निर्वाचन आयोग ने दिनांक 7 जून, 2016 के अपने आदेश सं. 76/दिल्ली-वि.स./2015(1) के द्वारा उक्त अधिनियम द्वारा यथा अपेक्षित अपना निर्वाचन व्यय लेखा दाखिल नहीं करने के लिए लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अधीन संसद के दोनों सदनों/राज्य विधान सभा या राज्य की विधान परिषद के लिए निर्वाचन लड़ने से निरर्हित घोषित कर दिया था, और
यतः, श्री सी ए सतीश सिंघल ने एक शपथ-पत्र तथा अपने निर्वाचन व्यय लेखे से संबंधित अन्य दस्तावेजों को संलग्न करते हुए दिनांक 23-02-2017 को एक अभ्यावेदन दाखिल किया है। जिला निर्वाचन अधिकारी, उत्तर जिन्हें उनका अभ्यावेदन संदर्भित किया गया था, ने दिनांक 27-10-2017 की अपनी रिपोर्ट द्वारा आयोग को सूचित किया कि उक्त अभ्यर्थी ने विधि द्वारा अपेक्षित रीति से 25-08-2016 को अपना निर्वाचन व्यय लेखा प्रस्तुत कर दिया था।
अतः, अब मामले के सभी तथ्यों एवं परिस्थितियों एवं श्री सी ए सतीश सिंघल द्वारा किए गए निवेदन पर विचार करने के पश्चात, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 द्वारा प्रदत्त शक्ति का प्रयोग करते हुए, आयोग ने उनके /ऊपर 07.06.2016 को अधिरोपित निरर्हता को हटाने का निर्णय लिया है। परिणामस्वरूप, आयोग के दिनांक 07 जून, 2016 के आदेश सं. 76/दिल्ली-वि.स./2015(1) में क्रम सं. 04 में प्रदर्शित श्री सी ए सतीश सिंघल के नाम को उक्त आदेश से 17-10-2018 से हटा दिया जाएगा।

No.76/DL-LA/14/2015.—Whereas, . Sh. CA Satish Singal contested the General Election to the Legislative Assembly of NCT of Delhi, 2015 from 14-Shalimar Bagh Assembly Constituency, result thereof was declared on 10-02-2015 and as per Section 78 of the Representation of People Act, 1951, he was required to file his account of election expenses in the manner required by law before the District Election Officer, North within thirty days from the date of election of the return candidate.
Whereas, the District Election Officer, North vide his report dated 09-04-2015 under Rule 89 of the Conduct of Election Rules, 1961 mentioned that Sh. CA Satish Singal has failed to lodge his account of election expenses as stipulated under the said Section 78 of the Representation of the People Act, 1951 before the District Election Officer, North and;
PART II-I] DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT. : NOVEMBER 22, 2018/ AGRAHAYANA 1, 1940 221Whereas, a Notice dated 24-06-2015 was issued to Sh. CA Satish Singal requiring him to lodge his accounts of election expenses within 20 days of the receipt of notice failing which he would be disqualified from contesting elections for a period of three years. The notice was delivered to him on 13-08-2015, and
Whereas, the District Election Officer, North District had intimated vide his letter dated 17-02-2017 that Sh. CA Satish Singal had not submitted his account of election expenses. Therefore the Election Commission of India vide its order No. 76/DL-LA/2015(1) dated 7th June, 2016 disqualified Sh. CA Satish Singal from contesting election to Houses of the Parliament/ State Legislative Assembly or legislative council of state under section 10A of the Representation of the people Act, 1951 for failure to lodge his account of election expenses as required by the said Act; and
Whereas, Sh. CA Satish Singal has filed a representation dated 23-02-2017 enclosing therewith an affidavit and other related documents pertaining to his account of election expenses. The District Election Officer, North to whom his representation was referred, vide his report, dated 27-10-2017 informed the Commission that the said candidate had submitted the accounts of election expenses on 25-08-2016 in the manner required by law.
Now, therefore, after taking into consideration all facts and circumstances of the case and the submission made by , Sh. CA Satish Singal the Commission, in exercise of the power conferred by Section 11 of the Representation of the People Act, 1951, has decided to remove the disqualification imposed upon him on 07.06.2016. Consequently, the name of the Sh. CA Satish Singal appearing at SL No. 04 in the Commission's Order No. 76/DL-LA/2015(1) dated 7th June, 2016 shall be omitted from the said order with effect from 17-10-2018.
