सं.170/स्थापना/ईसं.170/स्थापना/ईसं.170/स्थापना/ईसं.170/स्थापना/ई----1/डीएचसी.1/डीएचसी.1/डीएचसी.1/डीएचसी.———— भारतीय संविधान के अनु(cid:23)छेद 229 के अंतर्गत निहित शक्तियों का प्रयोग करते #ए इस न्यायालय के माननीय मुख्य न्यायाधीश दिल्ली उ* न्यायालय स्थापना (नियुक्ति एवं सेवा शत/) नियम, 1972 के नियम 11 को सहर्ष संशोधित करते हैं ताकि उसे निम्न प्रकार पढ़ा जाए:

11	क ें 9ीय सरकारी कर्मचारी सेवा नियमों की प्रयोज्यता	कोर्ट स्टाफ की सेवा की शत? से सम्बंधित ऐसे सभी मामलों में जहाँ इन नियमों में कोई प्रावधान नहE हैं अथवा इन नियमों में अपर्याप्त प्रावधान हैं तो तत्समय प्रवृत्त तथा कें 9ीय सरकारी कर्मचारियों पर लागू नियम एवं आदेश उक्त नियमों में ऐसे स ंशोधन, परिवर्तन अथवा अपवाद, यदि कोई हों, के अध्यधीन जो मुख्य न्यायाधीश समय-समय पर निNर्दष्ट करें कोर्ट स्टाफ की सेवा शत? को नियमित करेंगे । परन्तु दिल्ली उ*तर न्यायिक सेवा एवं दिल्ली न्यायिक सेवा के निबंधक एवं स ंयुक्त/उप-निबंधक उक्त सेवा पर Rमशः लागू नियमों के अधीन होंगे ।

कोर्ट स्टाफ की सेवा की शत? से सम्बंधित ऐसे सभी मामलों में जहाँ इन नियमों में कोई प्रावधान नहE हैं अथवा इन नियमों में अपर्याप्त प्रावधान हैं तो तत्समय प्रवृत्त तथा कें 9ीय सरकारी कर्मचारियों पर लागू नियम एवं आदेश उक्त नियमों में ऐसे स ंशोधन, परिवर्तन अथवा अपवाद, यदि कोई हों, के अध्यधीन जो मुख्य न्यायाधीश समय-समय पर निNर्दष्ट करें कोर्ट स्टाफ की सेवा शत? को नियमित करेंगे । परन्तु दिल्ली उ*तर न्यायिक सेवा एवं दिल्ली न्यायिक सेवा के निबंधक एवं स ंयुक्त/उप-निबंधक उक्त सेवा पर Rमशः लागू नियमों के अधीन होंगे ।

Delhi, the 22nd January, 2019

No.170/Estt./E1/DHC.—In exercise of the powers vested under Article 229 of the Constitution of India, Hon'ble the Chief Justice of this Court has been pleased to amend Rule 11 in "Delhi High Court Establishment (Appointment and Conditions of Service) Rules, 1972, so as to read as under :—

11	Application of Central Government Servants Service Rules	In respect of all such matters regarding the conditions of service of Court Staff for which no provision or insufficient provision has been made in these rules, the rules and orders for the time being in force and applicable to Central Governments Servants shall regulate the conditions of service of the Court Staff subject to such modifications, variations or exception, if any, in the said rules, as the Chief Justice may, from time to time, specify. Provided that the Registrar and Joint/Deputy Registrar belonging to Delhi Higher Judicial Service and Delhi Judicial Service respectively, shall be governed by the rules applicable to the said service.

Application of Central Government Servants Service Rules

In respect of all such matters regarding the conditions of service of Court Staff for which no provision or insufficient provision has been made in these rules, the rules and orders for the time being in force and applicable to Central Governments Servants shall regulate the conditions of service of the Court Staff subject to such modifications, variations or exception, if any, in the said rules, as the Chief Justice may, from time to time, specify. Provided that the Registrar and Joint/Deputy Registrar belonging to Delhi Higher Judicial Service and Delhi Judicial Service respectively, shall be governed by the rules applicable to the said service.

Note: The above amendments come into force with immediate effect.
