यह सूचना सब की सम्बंधित के लिए दी जाती है कि कोपी राईट एक्ट, 1957 की धारा 31 डी सह पठित नियम 31 कोपी राईट नियम, 2013 को मध्य नज़र रखते हुए और एक दरख्वास्त जो कि इस सम्बन्ध में म्यूजिक ब्रॉड कास्ट लिमिटेड और अन्य रेडियो प्रसारकों के द्वारा दाखिल की गयी है, IPAB से गुजारिश की जाती है कि साउं ड रिकॉर्डिंग का संचार जनता को रेडियो ब्राडकास्टिंग के माध्यम से करने के लिए, धारा 31 डी के तहत, रॉयल्टी निर्धारित की जाए।

यह जन साधारण सूचना सब ही रूचि रखने वाले व्यक्तियों को IPAB के रॉयल्टी तय करने के इरादे के बारे में सूचितकरने के लिए जारी की जाती है,जैसा कि कोपी राईट एक्ट, 1957 की धारा 31 डी सह पठित कोपी राईट नियम, 2013 के नियम 31 में दिया गया है, सब ही रूचि रखने वाले व्यक्तियों के सुझाव इस संबंध में आमंत्रित हैं। 5106 DG/2020 (7) 8 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: OCTOBER 22, 2020/ASVINA 30, 1942 PART II- II] नियम 31 कोपी राईट नियम, 2013 के उप नियम (३) के मुताबकि, यह भी सूचित किया जाता है कि कोई भी कॉपीराइट का मालिक या ब्रोडकास्टिंग संगठ नया कोई रेडियो प्रसारक या कोई अन्य व्यक्ति, इस सार्वजनिक सूचना कि तारीख से 30 दिन के अन्दर अपने सुझाव, लिखित में, अपने सबूत के साथ रॉयल्टी के रेट को निर्धारित करने के लिए दे सकता है। सार्वजनिक सूचना के 30 दिनों की समाप्ति के बाद सुझावों के प्रयोजनों के लिए आगे कोई समय नहीं दिया जाएगा । हस्ता / - हस्ता / - हस्ता / -

PUBLIC NOTICE

Delhi, the 18th September, 2020

This is for information of all concerned that in view of Section 31D of the Copyright Act, 1957, read with Rule 31 of the Copyright Rules, 2013 and upon an application in this regard filed by Music Broadcast Ltd. and other radio broadcasters, the Intellectual Property Appellate Board (IPAB) is required to fix royalties for communication of Sound Recordings to the public by way of broadcast through Radio under section 31D of the Copyright Act, 1957 and the rules thereto.

This Public Notice is issued to inform all those interested persons of the IPAB's intention to fix royalties for broadcast of sound recordings through radio, as mandated under Section 31D of the Copyright Act, 1957, read with Rule 31 of the Copyright Rules, 2013 and the suggestions of all the interested persons are invited in this regard.

In accordance with sub rule (3) of Rule 31, it is stated that any owner of copyright or any broadcasting organization or any radio broadcaster or any other interested person may, within thirty days from the date of this publication, give its suggestions, in writing, with adequate evidence as to the rate of royalties to be fixed for broadcast of sound recordings and musical work through radio. No further time will be granted for the purposes of suggestions after the expiry of 30 days of Public Notice.
