सं. 76/भा.नि.आ./आदे./प्रा./एनएस-II/डीएल-लोकसभा/03/2019.—यतः, आयोग ने रा.रा.क्षे. दिल्ली के 03-पूर्व दिल्ली संसदीय निर्वाचन क्षेत्र के लिए दिनांक 16.04.2019 की अपनी अधिसूचना के द्वारा लोकसभा के साधारण निर्वाचन आयोजित करने की घोषणा की थी और श्री शिव कु मार ने पूर्वोक्त निर्वाचन लड़ा था;

(5)6 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: JANUARY 14, 2021/PAUSHA 24, 1942 PART II - Sec. 1] और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 77 (1) के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, वह तिथि जब उसे नाम-निर्देशित किया गया है और उसके परिणाम की घोषणा की तिथि, दोनों तारीखें सम्मिलित, के बीच अपने द्वारा या अपने निर्वाचन एजेंट द्वारा उपगत या अधिकृ त निर्वाचन संबंधी सभी खर्चों का, या तो स्वयं या अपने निर्वाचन एजेंट द्वारा, एक पृथक और सही लेखा रखेगा और लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से तीस दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी को दर्ज करेगा जो धारा 77 के अंतर्गत उसके द्वारा अथवा उसके निर्वाचन एजेंट द्वारा रखे गए लेखे की सत्य प्रतिलिपि होगी।

और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89(2) के अधीन मुख्य निर्वाचन अधिकारी के पत्र सं.

सीईओ/ईईएम(102)/(49)जीई-2019/49970 दिनांक 09.07.2019 के जरिए जिला निर्वाचन अधिकारी, पूर्व दिल्ली जिला, रा.रा.क्षेत्र, दिल्ली द्वारा प्रस्तुत रिपोर्ट के अनुसार, राष्ट्रीय राजधानी क्षेत्र, दिल्ली के 03-पूर्व दिल्ली संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले निर्दलीय अभ्यर्थी, श्री शिव कु मार विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई लेखा दाखिल करने में असफल रहे हैं।

और यतः, जिला निर्वाचन अधिकारी, पूर्व दिल्ली, रा.रा.क्षे. दिल्ली और मुख्य निर्वाचन अधिकारी, दिल्ली की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के तहत निर्वाचन व्यय का लेखा दाखिल न करने पर, श्री शिव कु मार को कारण बताओ नोटिस दिनांक 06.08.2019 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 06.08.2019 के उपयु र्क्त कारण बताओ नोटिस के माध्यम से, श्री शिव कु मार को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखे प्रस्तुत न कर पाने का कारण स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें/अपने लेखे में त्रुटियों को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यतः, श्री शिव कु मार द्वारा उक्त नोटिस दिनांक 19.08.2020 को प्राप्त किया गया था। अभ्यर्थी से प्राप्त पावती, एसडीएम, निर्वाचन, पूर्वी दिल्ली जिला द्वारा दिनांक 19.08.2020 के अपने पत्र सं-डीईओ/पूर्व/एसडीएम(ई)/ रिपोर्ट/3(5)/2018/14366-67 के द्वारा आयोग को प्रस्तुत कर दी गई है।

और यत:, एसडीएम (ई), पूर्व दिल्ली द्वारा दिनांक 18.11.2019 के अपने पत्र सं. डीईओ/पूर्व/एसडीएम(ई)/रिपोर्ट/ 3(5)/2018/18283 के द्वारा प्रस्तुत अनुपूरक रिपोर्ट में यह कहा गया है कि श्री शिव कु मार, निवासी-485, ज्वाला नगर, दिल्ली ने न तो कोई अभ्यावेदन दिया है और न ही मूल वाउचर्स सहित विधिवत रूप से हस्ताक्षरित निर्वाचन व्यय के सही लेखे प्रस्तुत किए हैं। इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग के सम्यक् नोटिस की प्राप्ति के बाद भी उक्त असफलता हेतु न तो कोई कारण बताया न ही स्पष्टीकरण दिया है;

और यत:, भारत निर्वाचन आयोग का यह समाधान हो गया है कि श्री शिव कु मार निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और असफलता के लिए उनके पास कोई समुचित कारण या न्यायोचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का यह समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या कानून के अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा[PART II - Sec. 1 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: JANUARY 14, 2021/PAUSHA 24, 1942 7 (ख) उसके पास उस असफलता के लिए कोई समुचित कारण या न्यायोचित्य नहीं है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा कोई भी व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित रहेगा;

अब इसीलिए, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा रा.रा.क्षेत्र दिल्ली राज्य के 03-पूर्व दिल्ली संसदीय निर्वाचन क्षेत्र से लोक सभा के साधारण निर्वाचन, 2019 में निर्वाचन लड़ने वाले अभ्यर्थी, श्री शिव कु मार, निवासी- निवासी-485, ज्वाला नगर, दिल्ली को संसद के किसी भी सदन या राज्य या संघ राज्य-क्षेत्र की विधानसभा अथवा विधान परिषद के लिए सदस्य चुने जाने या होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता है।

SECRETARIAT OF THE ELECTION COMMISSION OF INDIA

ORDER

New Delhi, the 22nd December, 2020

No.76/ECI/ORD/TERR/NS-II/DL-HP/03/2019.—WHEREAS, the Commission had declared to hold the General Election to the House of the People of NCT of Delhi to 03-East Delhi Parliamentary Constituency vide its Notification dated 16.04.2019 and Shri Shiv Kumar had contested the aforesaid election;

AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in connection with the election incurred or authorized by him or by his election agent between (the date on which he has been nominated) and (the date of declaration of the result thereof), both dates inclusive & as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses which shall be in a true copy of the account kept by him or by his election agent under Section 77.

AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer, East Delhi District, NCT of Delhi through the Chief Electoral Officer's letter No. CEO/EEM(102)/(49)GE-2019/49970 dated 09.07.2019, Shri Shiv Kumar, Independent contesting candidate from 03-East Delhi Parliamentary Constituency of NCT of Delhi has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, East Delhi, NCT of Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 06.08.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Shiv Kumar for non submission of account of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 06.08.2019, Shri Shiv Kumar was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice.

AND WHEREAS, the said notice was received by Shri Shiv Kumar on 19-08-2019,. Acknowledgment receipt obtained from the candidate have been submitted to the Commission by SDM Election East Delhi District vide his letter No. DEO (EAST) ACCTTS/3(5)/2018/14366-67 dated 19.08.2019.

AND WHEREAS, in the supplementary report submitted by SDM Election East, Delhi District vide his letter No.DEO(EAST)ACCTTS/3(5)/2018/18283 dated 18.11.2019,it has been stated that Shri Shiv Kumar, resident of 485, Jwala Nagar, Delhi has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers. Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission to satisfied that Shri Shiv Kumar has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and

(b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Shiv Kumar, resident of 485, Jwala Nagar, Delhi, the contesting candidate for the General Election to the Lok Sabha of NCT of Delhi, 2019 from 03-East Delhi Parliamentary Constituency of the state of NCT of Delhi to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

और यतः, जिला निर्वाचन अधिकारी, नई दिल्ली, रा.रा.क्षे. दिल्ली और मुख्य निर्वाचन अधिकारी, दिल्ली की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के तहत निर्वाचन व्यय का लेखा दाखिल न करने पर, श्री सुनील कु मार को कारण बताओ नोटिस दिनांक 26.07.2019 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 26.07.2019 के उपयु र्क्त कारण बताओ नोटिस के माध्यम से, श्री सुनील कु मार को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखे प्रस्तुत न कर पाने का कारण स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें/अपने लेखे में त्रुटियों को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यतः श्री सुनील कु मार द्वारा उक्त नोटिस दिनांक 10.12.2020 को प्राप्त किया गया था। अभ्यर्थी से प्राप्त पावती, एसडीएम, निर्वाचन, नई दिल्ली जिला द्वारा दिनांक 13.12.2020 के अपने पत्र सं-ओ/डीईओ(एसडीएम)/ ई/एनडीडी/2019/4696-97 के द्वारा आयोग को प्रस्तुत कर दी गई है।

और यत:, एसडीएम (ई), नई दिल्ली द्वारा दिनांक 28.02.2020 के अपने पत्र सं. ओ/डीईओ(एसडीएम)/ई/ एनडीडी/2019/1914-15 के द्वारा प्रस्तुत अनुपूरक रिपोर्ट में यह कहा गया है कि श्री सुनील कु मार, निवासी-फ्लैट नं.-248, विध्या विहार, वेस्ट एन्कलैव, पीतमपुरा, दिल्ली-110034 ने न तो कोई अभ्यावेदन दिया है और न ही मूल वाउचर्स सहित विधिवत रूप से हस्ताक्षरित निर्वाचन व्यय के सही लेखे प्रस्तुत किए हैं। इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग के सम्यक् नोटिस की प्राप्ति के बाद भी उक्त असफलता हेतु न तो कोई कारण बताया न ही स्पष्टीकरण दिया है;

AND WHEREAS, the said notice was received by Shri Sunil Kumar on 10-12-2019.Acknowledgment receipt obtained from the candidate have been submitted to the Commission by SDM(E), New Delhi vide his letter No. O/DEO/SDM (E)/NDD/2019/4696-97 dated 13.12.2019.

AND WHEREAS, in the supplementary report submitted by SDM (E), New Delhi vide his letter. No.O/ DEO/SDM(E)/NDD/2019/1914-15 dated 28-02-2020,, it has been stated that Shri Sunil Kumar, resident of Flat No. 248, Vidya Vihar, West Enclave, Pitampura Delhi-110034 has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers. और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89(2) के अधीन मुख्य निर्वाचन अधिकारी के पत्र सं. सीईओ/ईईएम(102)/(49)जीई-2019/49970 दिनांक 09.07.2019 के जरिए जिला निर्वाचन अधिकारी, उत्तर पश्चिम जिला, रा.रा.क्षेत्र, दिल्ली द्वारा प्रस्तुत रिपोर्ट के अनुसार, राष्ट्रीय राजधानी क्षेत्र, दिल्ली के 05-उत्तर पश्चिम संसदीय निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले भारतीय प्रगतिशील कांग्रेस के अभ्यर्थी, श्री राम कु मार विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई लेखा दाखिल करने में असफल रहे हैं।

और यतः, जिला निर्वाचन अधिकारी, उत्तर-पश्चिम, रा.रा.क्षे. दिल्ली और मुख्य निर्वाचन अधिकारी, दिल्ली की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के तहत निर्वाचन व्यय का लेखा दाखिल न करने पर, श्री राम कु मार को कारण बताओ नोटिस दिनांक 25.07.2019 जारी किया गया था;

और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 25.07.2019 के उपयु र्क्त कारण बताओ नोटिस के माध्यम से, श्री राम कु मार को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखे प्रस्तुत न कर पाने का कारण स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें/अपने लेखे में त्रुटियों को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;

और यतः, उक्त नोटिस श्री राम कु मार के घर के बाहर दिनांक 14-08-2019, 21-08-2019, 05-09-2019 और 23-12-2019 को 'चस्पा'दिए गए थे, क्योंकि दिए गए पते पर न तो वे स्वयं न ही उनका परिवार रहता मिला। दो भिन्न अवसरों पर दो पड़ोसियों से चस्पा रिपोर्ट की प्राप्त पावती एसडीएम(ई), उत्तर पश्चिम द्वारा दिनांक 30.12.2019 के पत्र सं.डीईओ(एनडब्ल्यु)/एसडीएम(ई)/रिपोर्ट/2019/7808-7811 द्वारा आयोग को प्रस्तुत कर दी गई थी।

और यत:, एसडीएम (ई), उत्तर पश्चिम द्वारा दिनांक 02.03.2020 के अपने पत्र सं. डीईओ(एनडब्ल्यु)/ एसडीएम(ई)/रिपोर्ट/2019/1526-1530 के द्वारा प्रस्तुत अनुपूरक रिपोर्ट में यह कहा गया है कि श्री राम कु मार, निवासी- मकान नं.-207, ब्लोक नं.-जी, पॉके ट-7, सैक्टर-16, रोहिणी, नई दिल्ली ने न तो कोई अभ्यावेदन दिया है और न ही मूल वाउचर्स सहित विधिवत रूप से हस्ताक्षरित निर्वाचन व्यय के सही लेखे प्रस्तुत किए हैं। इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग के सम्यक् नोटिस की प्राप्ति के बाद भी उक्त असफलता हेतु न तो कोई कारण बताया न ही स्पष्टीकरण दिया है;

और यत:, भारत निर्वाचन आयोग का यह समाधान हो गया है कि श्री राम कु मार निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं और असफलता के लिए उनके पास कोई समुचित कारण या न्यायोचित्य नहीं है;

और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह अनुबंधित किया गया है कि:-

"यदि निर्वाचन आयोग का यह समाधान हो जाता है कि कोई व्यक्ति-

(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या कानून के अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा

(ख) उसके पास उस असफलता के लिए कोई समुचित कारण या न्यायोचित्य नहीं है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा कोई भी व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित रहेगा;

No.76/ECI/ORD/TERR/NS-II/DL-HP/05/2019.—WHEREAS, the Commission had declared to hold the General Election to the House of the People of NCT of Delhi to 05–North West Delhi Parliamentary Constituency vide its Notification dated 16.04.2019 and Shri Ram Kumar had contested the aforesaid election;

AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in connection with the election incurred or authorized by him or by his election agent between (the date on which he has been nominated) and (the date of declaration of the result) thereof, both dates inclusive & as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses which shall be in a true copy of the account kept by him or by his election agent under Section 77.

AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, submitted by the District Election Officer, North West District, NCT of Delhi through the Chief Electoral Officer's letter No.CEO/EEM(102)/(49)GE-2019/49970 dated 09.07.2019,Shri Ram Kumar, Bhartiya Pragatisheel Congress contesting candidate from 05-North West Parliamentary Constituency of NCT of Delhi, has failed to lodge any account of his election expenses as required by law.

AND WHEREAS, on the basis of the reports of the District Election Officer, North West, NCT of Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 25.07.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Ram Kumar for non submission of account of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 25.07.2019,Shri Ram Kumar was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was made to serve to Sh. Ram Kumar on 14-08-2019,21-08-2019, 05-09- 2019 and 23-12-2019 through 'CHASPA' as he himself or his family was not found residing at the given address. The Chaspa report acknowledgment receipt obtained from the two neighbors on two different instances submitted to the Commission by SDM(E), North-West vide his letter No. DEO(NW)/SDM(E)/Reports/2019/7808-7811 dated 30.12.2019.

और यत:, एसडीएम (ई), पश्चिम दिल्ली द्वारा दिनांक 30.09.2020 के अपने पत्र सं. पीसी-06(डब्ल्युपीसी- 06)/डीईओ(डब्ल्यु)/2019/8667-69 के द्वारा प्रस्तुत अनुपूरक रिपोर्ट में यह कहा गया है कि श्री विकास कु मार मोहलनिवासी-मकान नं.-04, ब्लोक नं.-06, गांव-तोशाम, तहसील-तोशाम, जिला-भिवानी, हरियाणा ने न तो कोई अभ्यावेदन दिया है और न ही मूल वाउचर्स सहित विधिवत रूप से हस्ताक्षरित निर्वाचन व्यय के सही लेखे प्रस्तुत किए हैं। इसके अतिरिक्त, उन्होंने भारत निर्वाचन आयोग के सम्यक् नोटिस की प्राप्ति के बाद भी उक्त असफलता हेतु न तो कोई कारण बताया न ही स्पष्टीकरण दिया है;

AND WHEREAS, on the basis of the reports of the District Election Officer, West Delhi, NCT of Delhi and the Chief Electoral Officer, Delhi, a Show Cause notice dated 25.07.2019 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Shri Vikas Kumar Mohal for non submission of account of Election expenses;

AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 25.07.2019, Shri Vikas Kumar Mohal was directed to submit his representation in writing in the Commission explaining the reason for non submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts and submit the same the District Election Officer concerned within 20 days from the date of receipt of the notice;

AND WHEREAS, the said notice was received by Shri Vikas Kumar Mohal on 08-08-2019.

Acknowledgment receipt obtained from the candidate have been submitted to the Commission by SDM (E) West Delhi vide his letter No. PC-06(WDPC-06)/DEO(W)/2019/6086 dated 21.08.2019.

AND WHEREAS, in the supplementary report submitted by SDM(E), West Delhi vide his letter PC- 06(WDPC-06)DEO(W)/2019/8667-69 dated 30.09.2019, it has been stated that Shri Vikas Kumar Mohal, resident of House No. 04, Block No. 6, Village Tosham, Tehsil Tosham, Distt. Bhiwani, Haryana has not submitted any representation or a statement of correct account of his election expenses, duly signed along with original vouchers.

Further, he has neither furnished any reason nor explanation for the said failure even after receipt of the due notice to the Election Commission of India as well;

AND WHEREAS, the Commission satisfied that Shri Vikas Kumar Mohal has failed to lodge an account of election expenses and has no good reason or justification for the failure;

AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-

"If the Election Commission is satisfied that a person-

(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and

(b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the under;

NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Shri Vikas Kumar Mohal, resident of House No. 04, Block No. 6, Village Tosham, Tehsil Tosham, Distt. Bhiwani, Haryana, the contesting candidate for the General Election to the Lok Sabha of NCT of Delhi, 2019 from 06-West Delhi Parliamentary Constituency of the state of NCT of Delhi to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.

विषय: शीतकालीन अवकाश 2020 के दौरान अत्यावश्यक मामलों के मौखिक आवेदन व सुनवाई के प्रबंध के सम्बन्ध में 1. सं. 487 स्थापना/ई-I/ डी.एच.सी.—1. एतद्द्वारा यह अधिसूचित किया जाता है कि आगामी शीतकालीन अवकाश 2020 के दौरान अत्यावश्यक मामले, यदि कोई हों, की सुनवाई हेतु माननीय मुख्य न्यायाधीश निम्नलिखित माननीय न्यायाधीशगण को सहर्ष मनोनीत करते हैं:-

2. इसके अतिरिक्त माननीय मुख्य न्यायाधीश शीतकालीन अवकाश के दौरान पालन किये जाने हेतु निम्नलिखित आदेश सहर्ष पारित करते हैं :-

(i) माननीय न्यायाधीशगण, अत्यावश्यक सिविल तथा दांडिक मामले तथा ऐसे अन्य मामले जो उनके समक्ष, उपरोक्त तिथियों की अनुसूची के अनुसार प्रस्तुत हों, की सुनवाई हेतु खंडपीठों में एवं अके ले भी बैठेंगे। (ii) सामान्यतः माननीय न्यायाधीशगण सोमवार, बुधवार एवं शुक्रवार तथा ऐसे अन्य दिन जब वे उपयुक्त समझें प्रातः 10:30 बजे आभासी न्यायालय में बैठेंगे । यदि किसी दिन निर्धारित मामले उसी दिन समाप्त नहीं होते हैं तो सुनवाई अगले दिन भी जारी रहेगी।

(iii) यदि किसी आकस्मिक कारण से कोई एक माननीय न्यायाधीश किसी दिन उपस्थित नहीं होते हैं तो दूसरे माननीय न्यायाधीश, इस शर्त के अध्यधीन कि वे खंडपीठ के मामलों को ख़ारिज नहीं करेंगे, अके ले बैठेंगे । 3. निम्नलिखित नामित अधिकारियों के समक्ष उनके सामने वर्णित तिथियों पर अत्यावश्यक मामलों के मौखिक आवेदन की मौजूदा प्रक्रिया ऑनलाइन प्रणाली द्वारा जारी रहेगी:

4. किसी भी अत्यावश्यक मामले के भौतिक रूप से मौखिक आवेदन पर विचार नहीं किया जायेगा ।

5. अत्यावश्यक मामलों का मौखिक आवेदन के वल क्लिक करने योग्य लिंक https://tinyurl.com/y7se5gl2 या http://164.100.68.118:8080/DHC_FILING/ द्वारा ही किया जायेगा । उपरोक्त लिंक आगामी शीतकालीन अवकाश के दौरान, रविवार तथा छु ट्टियों के अतिरिक्त, सभी कार्य दिवसों पर प्रातः 9:00 बजे से 10:30 बजे तक उपलब्ध रहेगा । उपरोक्त लिंक में वर्णित सभी अनिवार्य स्थान भरे होने चाहिए तथा ऐसा न होने पर उपरोक्त अनुरोध प्रोसेस नहीं किया जायेगा ।

6. अत्यावश्यकता को एक पृष्ठ की पी.डी.ऍफ़ फ़ाइल (जिसका साइज़ 5 एम.बी. से अधिक न हो) अपलोड कर स्पष्ट किया जाये । अपर्याप्त विवरण की दशा में अनुरोध प्रोसेस नहीं किया जायेगा ।

7. उपरोक्त लिंक पर किसी आवेदन के सफलतापूर्वक अपलोड होने पर, अधिवक्ता को अत्यावश्यक रूप से सूचीबद्ध करने की प्रार्थना के सफल पंजीकरण की सूचना देते हुए पंजीकृ त मोबाइल नंबर पर सिस्टम द्वारा एक पुष्टिकरण एस.एम.एस. भेजा जायेगा । परन्तु इसे अत्यावश्यक रूप से सूचीबद्ध करने की प्रार्थना की स्वीकृ ति नहीं समझा जायेगा।

8. जब मौखिक आवेदन की अनुमति प्रदानित होगी, तब इसकी सूचना एस.एम.एस. द्वारा अधिवक्ता के पंजीकृ त मोबाइल नंबर पर दी जाएगी । यह सुनिश्चित करने के लिए कि मामले को दी गयी तिथि पर सूचीबद्ध किया जाये, पुष्टिकरण एस.एम.एस. के प्राप्त होने के 2 घंटे के भीतर सभी अपेक्षित दस्तावेजों को ऑनलाइन दायर किया जाये । यदि मामला सभी 'दोषों' से मुक्त होगा, तो उसे दी गयी तिथि व समय पर सुनवाई हेतु सूचीबद्ध किया जायेगा । 9. ड्यूटी पर मौजूद वरिष्ठतम संयुक्त निबंधक (न्यायिक)/संयुक्त निबंधक मामलों को चिन्हित करने तथा वाद सूची के प्रबंध व उससे सम्बंधित सभी मामलों का निरीक्षण करेंगे। वह कमरा सं. 101, प्रथम तल, 'ए' ब्लॉक, फ़ोन न. 23388470 में बैठेंगे ।

1. No.487/Estt/E-I/DHC.—1. It is hereby notified that Hon'ble the Chief Justice is pleased to nominate the following Hon'ble Judges for hearing urgent matters, if any, during ensuing Winter Vacation 2020:-

(i) The Hon'ble Judges will sit in Division Benches and also singly to hear urgent Civil and Criminal matters and such other matters as may be placed before them as per the schedule of dates given above.

(ii) Ordinarily the Hon'ble Judges will sit in Virtual Court on Monday, Wednesday and Friday and such other days as they may think fit at 10.30 A.M. The sitting may continue for the next succeeding day if matters fixed for any day are not finished on that day.

(iii) If one of the Hon'ble Judges is not available on any day for any unforeseen reason, the other Hon'ble Judge may sit alone subject to the condition that the Hon'ble Judge shall not dismiss the Division Bench matters.

5. Mentioning of the extremely urgent matters would be made only through clickable link https://tinyurl.com/y7se5gl2 OR http://164.100.68.118:8080/DHC_FILING/. The aforesaid link would be available from 09.00 A.M. to 10.30 A.M. on all the working days during the ensuing winter vacation, except Sundays and Holidays. All the mandatory fields mentioned in said link must be filled up, failing which the said request will not be processed.

6. Urgency be explained clearly by uploading a pdf file comprising of one page (not more than 5 MB in size). The request shall not be processed in case of insufficient particulars.

7. Once an application is successfully uploaded on the abovementioned link, a system generated SMS confirmation will be sent on the registered mobile number intimating the advocate of successful registration of the prayer for urgent listing. This however, shall not be construed as request for urgent listing having been allowed.

8. Once the mentioning is allowed, an SMS shall be sent to the advocate on the registered mobile number intimating the same. All requisite documents be transmitted be filed online within two hours of receiving of confirmatory SMS to ensure that the matter gets listed for the given date. If the matter is clear from all 'defects', it will be listed on the given date and time for hearing.

9. The senior most Joint Registrar(Judicial)/Joint Registrar on duty will monitor the work of marking of cases as well as preparation of cause list and all the matters related thereto. He/She will sit in Room No.l0l, 1st Floor, 'A' Block, Tel. No.23388470.
