विषय: ग्रीष्मकालीन अवकाश-2021 के दौरान अत्यावश्यक मामलों के आवेदन (मेन्शनिंग) और सुनवाई का प्रबंध 1. सं. ¹⁹⁶/स्था./ई-1/डी.एच.सी. दिनांक: ²⁸.⁰⁵.²⁰²1.— एतद्द्वारा यह अधिसूचित किया जाता है कि माननीय मुख्य न्यायाधीश निम्नलिखित माननीय न्यायाधीशगण को आगामी ग्रीष्मकालीन अवकाश 2021 के दौरान अत्यावश्यक मामले, यदि कोई हों, की सुनवाई हेतु सहर्ष नामनिर्दिष्ट करते हैं:-

2. माननीय मुख्य न्यायाधीश ग्रीष्मकालीन अवकाश के दौरान पालन करने हेतु निम्न आदेश भी सहर्ष पारित करते हैं:-

(i) माननीय न्यायाधीशगण अति -आवश्यक दीवानी एवं फौजदारी

मामलों तथा ऐसे अन्य मामले जो कि उपरोक्त तिथियों की तालिका के अनुसार उनके सम्मुख रखे जायेंगे, की सुनवाई हेतु खंडपीठ में एवं अके ले भी बैठेंगे ।

(ii) सामान्यत: माननीय न्यायाधीशगण सोमवार, बुधवार और शुक्रवार तथा ऐसे दूसरे अन्य दिवसों को, जिन्हें वह उपयुक्त समझें, प्रात: 10.30 बजे से आभासी न्यायालय में बैठेंगे । यदि किसी दिन निर्धारित मामलों की सुनवाई उसी दिन समाप्त नहीं हो पाती है तो बैठक अगले दिन भी जारी रहेगी ।

(iii) यदि दोनों में से कोई माननीय न्यायाधीश किन्हीं अनापेक्षित कारणों से किसी दिन उपलब्ध नहीं हैं, तो दूसरे माननीय न्यायाधीश इस शर्त के अध्यधीन अके ले ही बैठेंगे कि वह खंडपीठ के मामलों को ख़ारिज नहीं करेंगे ।

3. ऑनलाइन प्रणाली द्वारा अत्यावश्यक मामलों के आवेदन (मेन्शनिंग) की मौजूदा प्रक्रिया निम्न नामित अधिकारियों के समक्ष उनके सामने दी गई तिथियों पर जारी रहेगी:

IV. श्री जनार्दन त्रिपाठी, निबंधक (मो. सं. 9717394839) 26.06.2021 से 02.07.2021

4. न्यायालय में आकर किए गए अत्यावश्यक मामलों हेतु आवेदन (मेन्शनिंग)पर विचार नहीं किया जाएगा । 5. अत्यंत आवश्यक मामलों का आवेदन (मेन्शनिंग) के वल क्लिक करने योग्य लिंक https://tinyurl.com/y7se5gl2 या https://164.100.68.118:8080/DHC_FILING/ के माध्यम से किया जाएगा । उपरोक्त लिंक आगामी ग्रीष्मकालीन अवकाश में रविवार और छु ट्टी को छोड़ कर सभी कार्यदिवसों पर 09:00 बजे पूर्वाहन से 10:30 बजे पूर्वाहन तक उपलब्ध रहेगा । उक्त लिंक में दिए गए सभी अनिवार्य रिक्त स्थानों को भरा जाना चाहिए, जिसे ना करने पर उक्त अनुरोध पर कार्रवाई नहीं की जाएगी ।

6. एक पृष्ठ वाली पीडीएफ फाइल (जो कि 5 एमबी से अधिक ना हो) अपलोड कर अत्यावश्यकता को स्पष्ट रूप से समझाया जाए। अपर्याप्त विवरण की दशा में अनुरोध पर कार्रवाई नहीं की जाएगी।[PART II - Sec. 1 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: JUNE 17, 2021/JYAISTHA 27, 1943 49 7. एक बार उपरोक्त लिंक पर आवेदन सफलतापूर्वक अपलोड हो जाता है तो पंजीकृ त मोबाइल नंबर पर सिस्टम द्वारा जारी एक एसएमएस भेजा जाएगा जो अधिवक्ता को अत्यावश्यक लिस्टिंग के लिए प्रार्थना के सफल पंजीकरण के बारे में सूचित करेगा। हालांकि, इसे अत्यावश्यक लिस्टिंग के अनुरोध की स्वीकृ ति नहीं समझा जाएगा । 8. एक बार आवेदन (मेन्शनिंग)की अनुमति मिलने के बाद, अधिवक्ता को पंजीकृ त मोबाइल नंबर पर इसकी सूचना का एक एसएमएस भेजा जाएगा। यह सुनिश्चित करने के लिए कि दी गई तारीख के लिए मामला सूचीबद्ध हो, सभी आवश्यक दस्तावेज पुष्टिकरण एसएमएस प्राप्त होने के दो घंटे के भीतर ऑनलाइन दाखिल कर दिए जाएँ । यदि मामला सभी त्रुटियों से मुक्त है तो इसे सुनवाई के लिए दी गई तिथि और समय पर सूचीबद्ध किया जाएगा । 9. वरिष्ठतम संयुक्त निबंधक (न्यायिक)/ संयुक्त निबंधक, जो ड्यूटी पर हों, मामलों को चिह्नित करने के साथ-साथ वाद सूची तैयार करने और उससे संबंधित सभी मामलों की निगरानी करेंगे। वह कमरा नंबर 101, पहली मंजिल, 'ए' ब्लॉक, टेलीफ़ोन सं. 23388470, में बैठेंगे।

SUBJECT: ARRANGEMENT OF MENTIONING AND HEARING OF URGENT MATTERS DURING

SUMMER VACATION - 2021

1. No. 196/Estt/EI/DHC Date: 28.05.2021.—It is hereby notified that Hon'ble the Chief Justice is pleased to nominate the following Hon'ble Judges for hearing urgent matters, if any, during ensuing Summer Vacation 2021:-

2. Hon'ble the Chief Justice is further pleased to pass the following orders for being followed during the course of summer vacation:-

i. The Hon'ble Judges will sit in Division Benches and also singly to hear urgent Civil and Criminal matters and such other matters as may be placed before them as per the schedule of dates given above.

ii. Ordinarily the Hon'ble Judges will sit in Virtual Court on Mondays, Wednesdays and Fridays and such other days as they may think fit at 10.30 A.M. The sitting may continue for the next succeeding day if matters fixed for any day are not finished on that day.

iii. If one of the Hon'ble Judges is not available on any day for any unforeseen reason, the other Hon'ble Judge may sit alone subject to the condition that the Hon'ble Judge shall not dismiss the Division Bench matters.

3. The existing practice of mentioning of urgent matters through online system shall continue before the designated Officers mentioned below on the dates mentioned against them:

4. No physical mentioning of urgent matters shall be entertained.

5. Mentioning of the extremely urgent matters would be made only through clickable link https://tinyurl.com/y7se5gl2 OR http://164.100.68.118:8080/DHC_FILING/.The aforesaid link would be available from 09.00 A.M. to 10.30 A.M. on all the working days during the ensuing summer vacation, except Sundays and Holidays. All the mandatory fields mentioned in said link must be filled up, failing which the said request will not be processed.

6. Urgency be explained clearly by uploading a pdf file comprising of one page (not more than 5 MB in size). The request shall not be processed in case of insufficient particulars.

7. Once an application is successfully uploaded on the abovementioned link, a system generated SMS confirmation will be sent on the registered mobile number intimating the advocate of successful registration of the prayer for urgent listing. This however, shall not be construed as request for urgent listing having been allowed.

8. Once the mentioning is allowed, an SMS shall be sent to the advocate on the registered mobile number intimating the same. All requisite documents be transmitted be filed online within two hours of receiving of confirmatory SMS to ensure that the matter gets listed for the given date. If the matter is clear from all 'defects', it will be listed on the given date and time for hearing.

9. The senior most Joint Registrar(Judicial)/Joint Registrar on duty will monitor the work of marking of cases as well as preparation of cause list and all the matters related thereto. He/She will sit in Room No.l0l, 1st Floor, 'A' Block, Tel. No.23388470.
