फा. सं. ए-42015/4/2017-एच (स्था.)-II/D-213.—नई दिल्ली नगरपालिका परिषद अधिनियम, 1994 (1994 का 44) की धारा 43 की उपधारा (1) के खंड (ग) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और उक्त धारा 43 की उप-धारा (2) के अधीन यथा अपेक्षित, संघ लोक सेवा आयोग के साथ परामर्श के बाद, और उक्त अधिनियम की धारा 387 की उप-धारा (2) के अनुसार कें द्रीय सरकार के अनुमोदन से, नई दिल्ली नगरपालिका परिषद एतद्द्वारा नई दिल्ली नगरपालिका परिषद (एलोपैथी) भर्ती विनियम, 2007 में संशोधन करने के लिए निम्नलिखित विनियम बनाती है, अर्थात् 2. संक्षिप्त नाम और प्रारंभ-(1) इन विनियमों को नई दिल्ली नगरपालिका परिषद (एलोपैथी) भर्ती (संशोधन) विनियम, 2022 कहा जाएगा।

(2) वे राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे।

"(3) 31 जनवरी, 2017 को या उससे पहले अनुबंध के आधार पर या तदर्थ आधार पर नियुक्त किए गए सभी अधिकारियों को आयोग द्वारा उनकी उपयुक्तता के मूल्यांकन के आधार पर और पद के लिए विहित अपेक्षित शैक्षिक योग्यता और अनुभव रखने और उपयुक्त पाए जाने पर, संबंधित ग्रेडों में इन विनियमों के अधीन नियुक्त किया गया माना जाएगा, और वे नई दिल्ली नगरपालिका परिषद (एलोपैथी) भर्ती (संशोधन) विनियम, 2022 के प्रारंभ की तारीख से सेवा में माने जाएंगे।

NOTIFICATION

Delhi, the 20th May, 2022

F. No. A-42015/4/2017-H (Estt.)-II/D-213.—In exercise of the powers conferred by clause (c) of sub- section (1) of section 43 of the New Delhi Municipal Council Act, 1994 (44 of 1994) and after consultation with the Union Public Service Commission, as required under sub-section (2) of the said section 43, and with the approval of the Central Government in terms of sub-section (2) of section 387 of the said Act, the New Delhi Municipal Council hereby makes the following regulations to amend the New Delhi Municipal Council (Allopathy) Recruitment Regulations, 2007, namely :-

1. Short title and commencement.– (1) These regulations may be called the New Delhi Municipal Council (Allopathy) Recruitment (Amendment) Regulations, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the New Delhi Municipal Council (Allopathy) Recruitment Regulations, 2007, in regulation 5, after sub- regulation (2), the following sub-regulation shall be inserted, namely:-

"(3) All the officers appointed on contract basis or ad-hoc basis on or before the 31st January, 2017, on the basis of their suitability to be assessed by the Commission and possessing requisite educational qualifications and experience prescribed for the post and being found fit, shall be deemed to have been appointed under these regulations in the respective grades, and they shall be members of the Service from the date of commencement of the New Delhi Municipal Council (Allopathy) Recruitment (Amendment) Regulations, 2022."

फा. सं. ए-42015/4/2017-एच (स्था.)-II/D-214.—नई दिल्ली नगरपालिका परिषद अधिनियम, 1994 (1994 का 44) की धारा 43 की उपधारा (1) के खंड (ग) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और उक्त धारा 43 की उप-धारा (2) के अधीन यथा अपेक्षित, संघ लोक सेवा आयोग के साथ परामर्श के बाद, और उक्त अधिनियम की धारा 387 की उप-धारा (2) के अनुसार कें द्रीय सरकार के अनुमोदन से, नई दिल्ली नगरपालिका परिषद एतद्द्वारा दिनांक 04 सितंबर, 2002 की अधिसूचना संख्या एफ.4(22)/2001-यूडी/12810 में निम्नलिखित संशोधन करती है, अर्थात्[PART III DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MAY 26, 2022/JAISTHA 5, 1944 15 1. उक्त अधिसूचना में, प्रारंभिक पैरा के पश्चात् और 'अनुलग्नक-I' से पहले, निम्नलिखित को अंतःस्थापित किया जाएगा, अर्थात्: -

"आरंभिक संविधान.- यथास्थिति, आयुर्वेदिक चिकित्सक, वरिष्ठ आयुर्वेदिक चिकित्सक या मुख्य आयुर्वेदिक चिकित्सक के पदों पर 31 जनवरी, 2017 को या उससे पहले अनुबंध के आधार पर या तदर्थ आधार पर नियुक्त किए गए सभी अधिकारी, आयोग द्वारा उनकी उपयुक्तता के मूल्यांकन के आधार पर और पद के लिए निर्धारित अपेक्षित शैक्षिक योग्यता और अनुभव रखने और उपयुक्त पाए जाने पर, संबंधित ग्रेड में इन विनियमों के अधीन नियुक्त किया गया माना जाएगा, और वे दिनांक 20, मई 2022 की अधिसूचना सं. फा.ए-42015/4/2017-एच (स्था.)-II/D-214 में संशोधन के प्रारंभ की तारीख से सेवा के सदस्य होंगे।

(2) यह अधिसूचना राजपत्र मे इसके प्रकाशन की तारीख से प्रवृत्त होगी।

1. In the said notification, after the opening paragraph and before the 'Annexure-I', the following shall be inserted, namely:-

"Initial Constitution.- All the officers appointed on contract basis or ad-hoc basis to the posts of Ayurvedic Physician, Senior Ayurvedic Physician or Chief Ayurvedic Physician, as the case maybe, on or before the 31st January, 2017, on the basis of their suitability to be assessed by the Commission and possessing requisite educational qualifications and experience prescribed for the post and being found fit, shall be deemed to have been appointed under these regulations in the respective grades, and they shall be members of the Service from the date of commencement of the amendment notifications number F. A-42015/4/2017-H (Estt.)-II/D- 214 dated the 20th May,2022".

(2) This notification shall come into force on the date of their publication in the Official Gazette.

फा. सं. ए-42015/4/2017-एच (स्था.)-II/D-216.—नई दिल्ली नगरपालिका परिषद अधिनियम, 1994 (1994 का 44) की धारा 43 की उपधारा (1) के खंड (ग) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और उक्त धारा 43 की उप-धारा (2) के तहत यथा अपेक्षित संघ लोक सेवा आयोग के साथ परामर्श करने के बाद और उक्त अधिनियम की धारा 387 की उप-धारा (2) के अनुसार कें द्रीय सरकार के अनुमोदन से, नई दिल्ली नगरपालिका परिषद एतद्द्वारा नई दिल्ली नगरपालिका परिषद में दंत चिकित्सा संवर्ग के श्रेणी 'क' के पदों पर भर्ती की विधि को विनियमित करने के लिए निम्नलिखित विनियम बनाती है, अर्थात्

1. संक्षिप्त नाम और प्रारंभ- (1) इन विनियमों को नई दिल्ली नगरपालिका परिषद, दंत चिकित्सा संवर्ग, श्रेणी 'क' पद, भर्ती विनियम, 2022 कहा जाएगा।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. परिभाषाएं.- इन विनियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो।

(क) "आयोग" से संघ लोक सेवा आयोग अभिप्रेत है;

(ख) "परिषद" से नई दिल्ली नगरपालिका परिषद अभिप्रेत (एनडीएमसी) है;

(ग) "नियंत्रक प्राधिकारी" से परिषद के अध्यक्ष अभिप्रेत है;

(घ) "विभागीय पदोन्नति समिति" से पदोन्नति के मामलों पर विचार करने के लिए अनुसूची-III में विनिर्दिष्ट समिति अभिप्रेत है;

(ङ) "ड्यूटी पोस्ट" से कोई भी पद, चाहे वह स्थायी हो या अस्थायी, जैसा कि अनुसूची-I में निर्दिष्ट किया गया है, अभिप्रेत है;

(च) "डायनामिक एश्योर्ड कै रियर प्रोग्रेसन (डीएसीपी) स्कीम" से चिकित्सा और दंत चिकित्सकों के लिए स्वास्थ्य एवं परिवार कल्याण मंत्रालय, भारत सरकार के द्वारा आदेश संख्या ए-45024/2/2008- सीएचएस.वी, दिनांक 29 अक्तू बर, 2008 के तहत परिकल्पित डीएसीपी स्कीम अभिप्रेत है। (छ) "ग्रेड" से अनुसूची-I में निर्दिष्ट ग्रेड में से कोई भी ग्रेड अभिप्रेत है;

(ज) "उप-संवर्ग" से कोई भी उप-संवर्ग अभिप्रेत है, अर्थात्, विशेषज्ञ ग्रेड (दंत) और चिकित्सा अधिकारी (दंत), जैसा भी मामला हो;

(झ) 'अनुसूचित जातियां', 'अनुसूचित जनजातियां', 'अन्य पिछड़ा वर्ग', 'आर्थिक रूप से कमजोर वर्ग' और 'दिव्यांगजन' पदों का वही अर्थ होगा जो उनके लिए संविधान और संसद के लागू अधिनियमों में दिया गया है;

(ञ) "अनुसूची" से इन विनियमों की अनुसूची अभिप्रेत है;

(ट) "विभागीय पुष्टिकरण समिति" से पुष्टि के मामलों पर विचार करने के लिए अनुसूची-III में निर्दिष्ट समिति अभिप्रेत है।

3. संवर्ग का गठन- (1) इन विनियमों के लागू होने की तारीख से, नई दिल्ली नगरपालिका परिषद में एक दंत चिकित्सा संवर्ग का गठन किया जाएगा, जिसमें इन विनियमों की अनुसूची-I में विनिर्दिष्ट पदों की श्रेणियां शामिल होंगी।[PART III DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MAY 26, 2022/JAISTHA 5, 1944 17 (2) उक्त संवर्ग में श्रेणी, वेतन मैट्रिक्स में स्तर और पदों की संख्या अनुसूची-I में यथा-विनिर्दिष्ट के अनुसार होंगी।

(3) उक्त संवर्ग में शामिल सभी ड्यूटी पोस्टों को श्रेणी 'क' के पदों के रूप में वर्गीकृ त किया जाएगा। 4. प्राधिकृ त संख्या- (1) इन विनियमों के लागू होने की तारीख से संवर्ग के विभिन्न ग्रेडों में शामिल ड्यूटी पद की प्राधिकृ त संख्या अनुसूची-I में विनिर्दिष्ट के अनुसार होगी।

(2) विभिन्न ग्रेडों में ड्यूटी पदों की प्राधिकृ त स्थायी संख्या वह होगी जो समय-समय पर परिषद द्वारा अवधारित की जाएगी।

(3) परिषद समय-समय पर विभिन्न ग्रेडों में ड्यूटी पोस्टों की संख्या में आवश्यकता पड़ने पर अस्थायी परिवर्धन या कटौती कर सकती है।

(4) परिषद, आयोग के परामर्श से, इन विनियमों में शामिल पदों से भिन्न किसी भी अन्य पदों को शामिल कर सकती है या इन विनियमों में शामिल किसी पद को हटा सकती है।

(5) परिषद, आयोग के परामर्श से, ऐसे अधिकारी को उपयुक्त ग्रेड में अस्थायी हैसियत में या वास्तविक हैसियत में, जैसा कि उचित समझा जाए, नियुक्त कर सकती है जिसका पद इन विनियमों के उप-विनियम (4) के अधीन शामिल है, और अनुरूप ग्रेड में निरंतर नियमित सेवा को ध्यान में रखते हुए ग्रेड में उसकी वरिष्ठता निर्धारित कर सकती है। 5. प्रारंभिक संविधान- (1) इन विनियमों के लागू होने या उससे पहले परिषद में नियमित आधार पर दंत चिकित्सा संवर्ग के श्रेणी 'क' पदों को धारण करने वाले सभी मौजूदा अधिकारियों को इन विनियमों के अधीन संबंधित ग्रेडों में नियुक्त किया गया समझा जाएगा, परंतु यह कि उनके पास अपेक्षित अर्हताएं हों।

(2) इन विनियमों के लागू होने से पहले उप-विनियम (1) में निर्दिष्ट अधिकारियों की नियमित निरंतर सेवा को परिवीक्षा अवधि, पदोन्नति और पुष्टिकरण के लिए अर्हता प्राप्त सेवा, पेंशन या राष्ट्रीय पेंशन योजना के प्रयोजन के लिए गिना जाएगा।

(3) तारीख 31 जनवरी, 2017 को या उससे पहले अनुबंध या तदर्थ आधार पर नियुक्त किए गए सभी अधिकारी, जो आयोग द्वारा उनकी उपयुक्तता का मूल्यांकन किए जाने के आधार पर इन विनियमों के प्रारंभ की तारीख को परिषद में सेवा जारी रखते हैं और पद के लिए निर्धारित आवश्यक शैक्षिक योग्यता और अनुभव रखते हैं और उपयुक्त पाए जाते हैं, यह समझा जाएगा कि उन्हें इन विनियमों के अधीन संबंधित ग्रेड में नियुक्त किया गया है, और वे इन विनियमों के लागू होने की तारीख से संवर्ग के सदस्य होंगे।

6. संवर्ग का भावी अनुरक्षण- (1) अनुसूची-I में निर्दिष्ट किसी भी ग्रेड में रिक्तियों को इन विनियमों के अधीन इसके उपरांत यथा-उपबंधित रीति से भरा जाएगा।

(2) संवर्ग में शामिल पदों पर नियुक्ति या पदोन्नति के लिए ठीक नीचे के ग्रेड या ग्रेडों, जैसा भी मामला हो, में न्यूनतम अर्हक सेवा सहित भर्ती की प्रविधि, पदोन्नति के लिए चयन का क्षेत्र अनुसूची-II में यथा-विनिर्दिष्ट होगा। (3) संवर्ग में उच्च पदों पर विभागीय पदोन्नति अनुसूची-III में निर्दिष्ट विभागीय प्रोन्नति समिति की सिफारिशों पर ठीक नीचे के ग्रेड या ग्रेडों, जैसा भी मामला हो, में संवर्ग के अधिकारियों में से की जाएगी।

(4) विशेषज्ञ ग्रेड-II (कनिष्ठ स्के ल) और चिकित्सा अधिकारी (दंत) के ग्रेड में रिक्तियों को आयोग के परामर्श से अनुसूची-II में यथा-उपबंधित सीधी भर्ती द्वारा भरा जाएगा।18 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MAY 26, 2022/JYAISTHA 5, 1944 PART III] (5) संवर्ग में ड्यूटी पदों की नियुक्ति के लिए आयु-सीमा के साथ-साथ न्यूनतम शिक्षा एवं अन्य अर्हताएं अनुसूची- IV में यथा विनिर्दिष्ट होगा।

(6) विशेषज्ञ ग्रेड-II (कनिष्ठ स्के ल), विशेषज्ञ ग्रेड-II (वरिष्ठ स्के ल), विशेषज्ञ ग्रेड-I (गैर-कार्यात्मक चयन ग्रेड) और विशेषज्ञ ग्रेड-I (वरिष्ठ प्रशासनिक ग्रेड) के पद पदोन्नति के उद्देश्य से उप-संवर्ग के भीतर अंतर्विनिमेय होंगे।

(7) चिकित्सा अधिकारी, वरिष्ठ चिकित्सा अधिकारी, मुख्य चिकित्सा अधिकारी, मुख्य चिकित्सा अधिकारी (गैर- कार्यात्मक चयन ग्रेड) और मुख्य चिकित्सा अधिकारी (वरिष्ठ प्रशासनिक ग्रेड) के पद पदोन्नति के उद्देश्य से उप-संवर्ग के भीतर अंतर्विनिमेय होंगे।

(8) उप-विनियम (4) में विनिर्दिष्ट 'प्रवेश ग्रेड के भिन्न' ग्रेडों में पदोन्नति डायनेमिक एश्योर्ड सुनिश्चित करियर प्रोगेसन योजना के अनुरूप रिक्तियों से बिना किसी अंतर्संबंध के होगी।

7. अल्पकालिक संविदा सहित प्रतिनियुक्ति द्वारा ड्यूटी पदों को भरना- (1) विनियम 6 में अंतर्विष्ट किसी बात के होते हुए भी, जहां एनडीएमसी का मत है कि ऐसा करना आवश्यक या समीचीन है, वह लिखित रूप में दर्ज किए जाने वाले कारणों से और आयोग के परामर्श से कें द्रीय सरकार या राज्य सरकार या संघ राज्य क्षेत्रों के अधीन सदृश पदों पर पदस्थ उपयुक्त अधिकारियों की प्रतिनियुक्ति द्वारा और सांविधिक निकायों, स्वायत्त निकायों, सार्वजनिक क्षेत्र के उपक्रमों, विश्वविद्यालयों या मान्यता प्राप्त अनुसंधान संस्थानों के अधीन सदृश पदों पर पदस्थ उपयुक्त अधिकारी के अल्पकालिक संविदा द्वारा दंत संवर्ग में चिकित्सा अधिकारी और विशेषज्ञ ग्रेड- II (कनिष्ठ स्के ल) के ग्रेड में ड्यूटी पदों को, जो कि पांच प्रतिशत से अधिक न हो, भर सकता है।

(2) प्रतिनियुक्ति आधार पर ड्यूटी पद पर नियुक्ति के लिए, अधिकारी को, अन्य बातों के साथ, अनुसूची-IV में पदों के लिए विहित न्यूनतम शिक्षा और अन्य योग्यताओं को पूरा करना होगा।

(3) यह प्रतिनियुक्ति तीन वर्ष से अधिक की अवधि के लिए नहीं होगी, जिसे विशेष परिस्थितियों में और लिखित रूप में दर्ज किए गए कारणों से, एनडीएमसी द्वारा उचित समझे जाने पर पांच वर्ष तक बढ़ाया जा सकता है। 8. परिवीक्षा- (1) सीधी भर्ती द्वारा संवर्ग में चिकित्सा अधिकारी (दंत) और विशेषज्ञ ग्रेड-II (कनिष्ठ स्के ल) के स्तर पर नियुक्त व्यक्ति, जैसा भी मामला हो, दो वर्ष की अवधि के लिए परिवीक्षाधीन रहेगा:

परंतु यह कि एनडीएमसी इस संबंध में भारत सरकार द्वारा समय-समय पर जारी अनुदेशों के अनुसार परिवीक्षा अवधि को बढ़ा सकता है:

परंतु यह और कि, किसी अधिकारी की परिवीक्षा अवधि के विस्तार के लिए कोई भी निर्णय प्रारंभिक परिवीक्षा अवधि की समाप्ति के तुरंत बाद और आमतौर पर आठ सप्ताह के भीतर लिया जाएगा और संबंधित अधिकारी को लिखित रूप में उक्त अवधि के भीतर ऐसा करने के कारणों के साथ सूचित किया जाएगा।

(2) परिवीक्षा अवधि या उसके किसी विस्तार के पूरा होने पर, अधिकारी को, यदि स्थायी नियुक्ति के लिए उपयुक्त माना जाता है, भारत सरकार के लागू आदेशों के अनुसार स्थायी किया जाएगा।

(3) जहां, परिवीक्षा अवधि या उसके किसी विस्तार के दौरान, जैसा भी मामला हो, एनडीएमसी की राय है कि एक अधिकारी स्थायी नियुक्ति के लिए उपयुक्त नहीं है, वह ऐसे अधिकारी को यथास्थिति सेवामुक्त कर सकता है या संवर्ग में उसकी नियुक्ति से पूर्व उसके द्वारा धारित पद पर वापस भेज सकता है।

(4) परिवीक्षा अवधि या उसके किसी विस्तार के दौरान, अधिकारी को एनडीएमसी द्वारा प्रशिक्षण के ऐसे पाठ्यक्रमों से गुजरना पड़ सकता है या परिवीक्षा के संतोषजनक समापन की शर्त के रूप में ऐसी परीक्षाओं या परीक्षणों को उत्तीर्ण करने की, जैसा भी उचित समझा जाए, आवश्यकता हो सकती है।[PART III DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MAY 26, 2022/JAISTHA 5, 1944 19 (5) परिवीक्षा से संबंधित अन्य विषयों के संबंध में, संवर्ग के सदस्य भारत सरकार द्वारा समय-समय पर इस संबंध में जारी किए गए आदेशों या अनुदेशों द्वारा शासित होंगे।

9. वरिष्ठता- (1) संबंधित उप-संवर्ग में अधिकारियों की सापेक्ष ज्येष्ठता इन विनियमों के लागू होने पर विनियम 5 के उप- विनियम (1) के अंतर्गत आरंभिक संविधान के अनुसार अवधारित की जाएगी:

परंतु यह कि यदि किसी ऐसे अधिकारी की ज्येष्ठता उक्त तिथि को विशेष तौर पर अवधारित नहीं की गई थी, इसका अवधारण ज्येष्ठता तय करने वाले नियमों के आधार पर किया जाएगा जैसा कि यह इन विनियमों के लागू होने से पूर्व लागू है।

(2) विनियम 5 के उप-विनियम (1) के अधीन नियुक्त अधिकारियों से भिन्न अधिकारियों की ज्येष्ठता कें द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी सामान्य अनुदेशों के अनुसार अवधारित की जाएगी।

(3) विनियम 4 के उप-विनियम (5) के अनुसार नियुक्त अधिकारियों की ज्येष्ठता उक्त उप-विनियम में यथा उपबंधित रीति में तय की जाएगी।

(4) उन मामलों में, जो उप-विनियम (1) (2) और (3) के अधीन नहीं आते हैं, आयोग के परामर्श से परिषद द्वारा ज्येष्ठता अवधारित की जाएगी।

(5) आरंभिक संविधान के अनुसार नियुक्ति से पहले संविदा या तदर्थ आधार पर काम करने वाले अधिकारियों द्वारा आहरित वेतन वृद्धि के लिए दी गई सुरक्षा, यदि कोई हो, पर उक्त प्रारंभिक संविधान के अनुसार उनकी नियुक्ति के उपरांत टाइम स्के ल आधार पर पदोन्नति पर विचार करने हेतु सेवा की अवधि या ज्येष्ठता के अवधारण के लिए ध्यान में नहीं लिया जाएगा।

10. संवर्ग में नियुक्ति- दन्त संवर्ग में सभी नियुक्तियां नियंत्रक प्राधिकारी द्वारा की जाएंगी।

11. सेवा का दायित्व- इन विनियमों के अधीन किसी भी पद पर नियुक्त कोई भी व्यक्ति परिषद् क्षेत्रों की अधिकारिता में कहीं भी सेवा करने के लिए उत्तरदायी होगा।

12. निजी व्यवसाय का प्रतिषेध- (1) इन विनियमों के अधीन किसी पद पर नियुक्त किसी व्यक्ति को परामर्श और प्रयोगशाला कार्य सहित निजी व्यवसाय की अनुमति नहीं दी जाएगी:

परंतु यह कि ऐसे व्यक्ति भारत सरकार द्वारा समय-समय पर विनिर्दिष्ट दरों पर गैर-व्यवसाय भत्ते के हकदार होंगे।

13. निरर्हता- (1) कोई व्यक्ति,

(क) जिसने ऐसे व्यक्ति के साथ विवाह किया है या विवाह का अनुबंध किया है जिसका पति या पत्नी जीवित है;

या

(ख) जिसने अपने पति या पत्नी के जीवित रहते हुए, किसी व्यक्ति के साथ विवाह किया है या विवाह का अनुबंध किया है, दंत संवर्ग में नियुक्ति के लिए पात्र नहीं होगा:

परंतु यह कि परिषद, का यदि समाधान हो कि इस तरह के विवाह को ऐसे व्यक्ति और विवाह कर रहे दूसरे पक्ष को लागू व्यक्तिगत कानून के अंतर्गत अनुमति है तथा ऐसा करने के अन्य आधार हैं, तो किसी भी व्यक्ति को इस विनियम के प्रचालन से छू ट दी जा सकती है।

14. सेवा की अन्य शर्तें- इन विनियमों में स्पष्ट रूप से विनिर्दिष्ट नहीं किए गए मामलों के संबंध में दंत संवर्ग के सदस्यों की सेवा की शर्तें, यथोचित परिवर्तनों-सहित और संवर्ग के संबंध में कें द्रीय सरकार द्वारा जारी किए गए किसी विशेष आदेश के अधीन होंगी, जैसा कि सामान्य रूप से परिषद के अधिकारियों पर लागू होता है।20 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MAY 26, 2022/JYAISTHA 5, 1944 PART III] 15. शिथिल करने की शक्ति- जहां परिषद की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वह किसी भी वर्ग या श्रेणी के व्यक्तियों के संबंध में आदेश द्वारा, लिखित रूप में दर्ज किए जाने वाले कारणों के लिए और आयोग के परामर्श से, इन विनियमों के किसी भी उपबंधों को शामिल कर सकती है।

16. व्यावृत्ति- इस संबंध में भारत सरकार द्वारा समय-समय पर जारी आदेश के अनुसार, इन विनियमों में की कोई भी बात आरक्षण, आयु-सीमा में छू ट और अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, आर्थिक रूप से कमजोर वर्ग, भूतपूर्व सैनिकों और अन्य विशेष श्रेणियों के व्यक्तियों के लिए प्रदान की जाने वाली आवश्यक रियायतों को प्रभावित नहीं करेगी।

17. निर्वचन- यदि इन विनियमों के निर्वचन से संबंधित कोई प्रश्न उठता है, तो आयोग के परामर्श से कें द्र सरकार द्वारा इसका निर्णय किया जाएगा।

Delhi, the 20th May, 2022

No. A-42015/4/2017-H (Estt.)-II/D-216.—In exercise of the powers conferred by clause (c) of sub- section (1) of section 43 of the New Delhi Municipal Council Act, 1994 (44 of 1994) and after consultation with the Union Public Service Commission as required under sub-section (2) of the said section 43 and with the approval of the Central Government in terms of sub-section (2) of section 387 of the said Act, the New Delhi Municipal Council hereby makes the following regulations regulating the method of recruitment to category 'A' posts of Dental Cadre in the New Delhi Municipal Council, namely :-

1. Short title and commencement.– (1) These regulations may be called the New Delhi Municipal Council, Dental Cadre, Category 'A' Posts, Recruitment Regulations, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- In these regulations, unless the context otherwise requires.-

(a) "Commission" means the Union Public Service Commission;

(b) "Council" means the New Delhi Municipal Council (NDMC);

(c) "Controlling Authority" means the Chairperson of the Council;

(d) "Departmental Promotion Committee" means a Committee as specified in Schedule-III for considering cases of promotion;

(e) "Duty Post" means any post, whether permanent or temporary, as specified in Schedule-I;

(f) "Dynamic Assured Career Progression (DACP) Scheme" means the DACP scheme for medical and Dental doctors as conceptualized, vide Ministry of Health and Family Welfare, Government of India, Order No. A.45024/2/2008-CHS.V, dated the 29th October, 2008.

(g) "grade" means any of the grades as specified in Schedule-I;

(h) "Sub-cadre" means any of the sub-cadres, namely, Specialist Grade (Dental) and Medical Officer (Dental), as the case may be;

(i) the expressions 'Schedule Castes', 'Schedule Tribes', 'Other Backward Classes', 'Economically Weaker Section' and 'Persons with Disabilities' shall have the same meaning as assigned to them in the Constitution and applicable Acts of Parliament;

(j) "Schedule" means a Schedule to these regulations;

(k) "Departmental Confirmation Committee" means a Committee as specified in Schedule-III for considering cases of confirmation.

3. Constitution of the Cadre.- (1) With effect from the date of commencement of these regulations, a Dental Cadre in the New Delhi Municipal Council shall stands constituted, consisting of the categories of posts as specified in Schedule-I to these regulations.

(2) The category, level in the pay matrix and the number of posts in the said cadre shall be as specified in the Schedule-I.

(3) All Duty Posts included in the said cadre shall be classified as Category 'A' posts.

4. Authorized Strength.– (1) The authorized strength of the Duty Post included in various grades of the cadre on the date of commencement of these regulations shall be as specified in Schedule-I.

(2) The authorized permanent strength of the Duty Posts in various grades shall be such as may, from time to time, be determined by the Council.

(3) The Council may make temporary additions to, or reductions in, the strength of the Duty Posts in the various grades as deemed, necessary from time to time.

(4) The Council may, in consultation with the Commission, include any posts other than those included in these regulations or exclude a post included in these regulations.

(5) The Council may, in consultation with the Commission, appoint an officer whose post is included under sub-regulation (4) of these regulations, to the appropriate grade in a temporary capacity or in a substantive capacity as may be deemed fit, and fix his seniority in the grade after taking into account continuous regular service in the analogous grade.

5. Initial Constitution.- (1) All the existing officers holding category 'A' posts of Dental Cadre in the Council on regular basis on or before the commencement of these regulations shall be deemed to have been appointed under these regulations in respective grades provided that they possess the requisite qualifications.

(2) The regular continuous service of officers referred to in sub- regulation (1) before the commencement of these regulations shall be counted for the purpose of probation, qualifying service for promotion, confirmation and pension or National Pension Scheme.

(3) All the Officers appointed on contract basis or ad-hoc basis on or before the 31st January, 2017, who continue to render service in the Council on the date of commencement of these regulations, on the basis of their suitability to be assessed by the Commission and possessing requisite educational qualifications and experience prescribed for the post and being found fit, shall be deemed to have been appointed under these regulations in the respective grades, and they shall be members of the cadre from the date of commencement of these regulations.

6. Future Maintenance of the Cadre.- (1) The vacancies in any of the grades referred to in Schedule-I shall be filled in the manner as hereinafter provided under these regulations.

(2) The method of recruitment, the field of selection for promotion, including the minimum qualifying service in the immediate lower grade or lower grades, as the case may be, for appointment or promotion to the posts included in the cadre shall be as specified in Schedule-II.

(3) The departmental promotions to higher posts in the cadre shall be made from among the officers of the cadre in the immediate lower grade or lower grades, as the case may be, on the recommendations of the Departmental Promotion Committee referred to in Schedule-III.

(4) The vacancies in the grades of Specialist Grade-II (Junior Scale) and Medical Officer (Dental) shall be filled by direct recruitment as provided in the Schedule-II, in consultation with the Commission.

(5) The minimum educational and other qualifications, along with the age-limit for appointment to Duty Posts in the cadre by direct recruitment shall be as specified in Schedule-IV.

(6) The posts of Specialist Grade-II (Junior Scale), Specialist Grade-II (Senior Scale), Specialist Grade-I (Non-Functional Selection Grade) and Specialist Grade-I (Senior Administrative Grade) shall be interchangeable within the sub-cadre for the purpose of promotion.

(7) The post of Medical Officer, Senior Medical Officer, Chief Medical Officer, Chief Medical Officer (Non-Functional Selection Grade) and Chief Medical Officer (Senior Administrative Grade) shall be interchangeable within the sub-cadre for the purpose of promotion.

(8) Promotion to the grades 'other than entry grade' referred to in sub-regulation (4) shall be without linkage to vacancies in accordance with Dynamic Assured Career Progression Scheme.

7. Filling of Duty Posts by Deputation including short term contract.- (1) Notwithstanding anything contained in regulation 6, where the NDMC is of the opinion that it is necessary or expedient so to do, it may for reasons to be recorded in writing and in consultation with the Commission fill up nor more than five percent of Duty Posts in the grade of Medical Officer and Specialist Grade-II (Junior Scale) in Dental Cadre by deputation of suitable officers holding analogous posts under the Central Government or State Government or Union Territories and by short-term contract of suitable officer holding analogous posts under the Statutory bodies, Autonomous bodies, Public Sector Undertakings, Universities or recognized Research Institutions.

(2) For appointment to Duty Post on deputation basis, the officer shall, among others, fulfill the minimum education and other qualifications prescribed for the posts in Schedule-IV.

(3) The deputation shall be for a period not exceeding three years, which may, in special circumstances and for reasons recorded in writing, be extended upto five years as the NDMC may thinks fit.

8. Probation.- (1) A person appointed to the cadre in the level of Medical Officer (Dental) and Specialist Grade-II (Junior Scale), as the case maybe, by direct recruitment, shall be on probation for a period of two years:

Provided that the NDMC may extend the period of probation in accordance with the instructions issued by the Government of India form time to time in this behalf:

Provided further, any decision for extension of the period of probation of an officer shall be taken immediately after the expiry of initial period of probation and ordinarily within eight weeks and communicated in writing to the concerned officer together with the reasons for so doing within the said period.

(2) On completion of the period of probation or any extension thereof, the officer shall, if considered fit for permanent appointment, be confirmed in terms of the extant orders of the Government of India.

(3) Where, during the period of probation or any extension thereof as the case may be, NDMC is of the opinion that an officer is not fit for permanent appointment, it may discharge such officer or revert him to the post held by him prior to his appointment in the cadre, as the case may be.

(4) During the period of probation or any extension thereof, officer may be required by the NDMC to undergo such courses of training or to pass such examinations or tests as may be deemed fit, as a condition of satisfactory completion of the probation.

(5) As regard other matters relating to probation, the members of the cadre shall be governed by the orders or instructions issued by the Government of India in this regard from time to time.

9. Seniority.- (1) The relative seniority of officers in the respective sub-cadre shall be determined in terms of the initial constitution under sub-regulation(1) of regulation 5 on the commencement of these regulation:

Provided that if the seniority of any such officer had not been specifically determined on the said date, the same shall be determined on the basis of the rules governing the fixation of seniority as where applicable prior to the commencement of these regulations.

(2) The seniority of officers other than those appointed under sub-regulation (1) of regulation 5 shall be determined in accordance with the general instructions issued by the Central Government in this regard from time to time.

(3) The seniority of officers appointed in accordance with sub-regulation (5) of regulation 4 shall be fixed in the manner as provided in the said sub-regulation.

(4) In the cases which are not covered under sub-regulations (1) (2) and (3), the seniority shall be determined by the Council in consultation with the Commission.

(5) The protection, if any, accorded towards increments drawn by the officers who worked on Contract or Ad-hoc basis, prior to placement in terms of the initial constitution, shall not be taken into account for determining the length of service or seniority for consideration for promotion on time scale basis subsequent to their placement in terms of the said initial constitution.

10. Appointment to the Cadre.- All appointments to the Dental Cadre shall be made by the Controlling Authority.

11. Liability for Service.- Any person appointed to any post under these regulations shall be liable to serve anywhere in the jurisdiction of Council areas.

12. Prohibition of private practice.- (1) No person appointed to any post under these regulations shall be permitted private practice including consultancy and laboratory practice:

Provided that such persons shall, however, be entitled to a non-practicing allowance at the rates specified by Government of India from time to time.

13. Disqualification.- (1) No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the Dental Cadre:

Provided that the Council may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulation.

14. Other conditions of Service.- The conditions of service of the members of the Dental Cadre in respect of matters not expressly provided for in these regulations, shall, mutatis mutandis and subject to any special orders issued by the Central Government in respect of the Cadre, be the same as those applicable to officers of the Council in general.

15. Power to relax.- Where Council is of the opinion that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing and in consultation with the Commission, relax any of the provisions of these regulations with respect to any class or category of persons.

16. Saving.- Nothing in these regulations shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, Other Backward Classes, Economically Weaker28 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MAY 26, 2022/JYAISTHA 5, 1944 PART III] Section, Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Government of India from time to time in this regard.

17. Interpretation.- If any question relating to the interpretation of these regulations arises, it shall be decided by the Central Government in consultation with the Commission.

The Category posts, level in the pay matrix and number of posts included in the Dental Cadre in New Delhi Municipal Council:

Note 1:- The posts in sub-cadre of Specialist Grade are to be operated in the categories of Specialist Grade-I (Senior Administrative Grade), Specialist Grade-I (Non-Functional Selection Grade), Specialist Grade-II (Senior Scale) and Specialist Grade-II (Junior Scale) within the total combined sanctioned strength of the said three posts.

Note 2:- The posts in sub-cadre of Medical Officer (Dental) are to be operated in the categories of Chief Medical Officer (Senior Administrative Grade), Chief Medical Officer (Non-Functional Selection Grade), Chief Medical Officer, Senior Medical Officer and Medical Officer within the total combined sanctioned strength of the said seven posts.

Note: (1) The crucial date for determining the age limit shall be as advertised by the Commission.

2. The qualifications are relaxable at the discretion of the Commission in case of candidates otherwise well qualified. 3. The qualification regarding experience are to be relaxable at the discretion of the Commission in case of candidates belonging to Scheduled Caste or Scheduled Tribes, if any stage of selection, the Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.

4. The qualifications referred to in section 10 of Dentists Act, 1948 (16 of 1948) as amended time to time shall be the recognized dental qualifications.

"आरंभिक संविधान.- यथास्थिति, होम्योपेथी चिकित्सक, वरिष्ठ होम्योपेथी चिकित्सक या मुख्य होम्योपेथी चिकित्सक के पदों पर 31 जनवरी, 2017 को या उससे पहले अनुबंध के आधार पर या तदर्थ आधार पर नियुक्त किए गए सभी अधिकारी, आयोग द्वारा उनकी उपयुक्तता के मूल्यांकन के आधार पर और पद के लिए निर्धारित अपेक्षित शैक्षिक योग्यता और अनुभव रखने और उपयुक्त पाए जाने पर, संबंधित ग्रेड में इन विनियमों के अधीन नियुक्त किया गया माना जाएगा, और वे दिनांक 20 मई 2022 की अधिसूचना सं. फा.ए-42015/4/2017-एच (स्था.)-II/D-215 में संशोधन के प्रारंभ की तारीख से सेवा के सदस्य होंगे।

(2) यह अधिसूचना राजपत्र मे इसके प्रकाशन की तारीख से प्रवृत्त होगी।

NOTIFICATION

Delhi, the 20th May, 2022

F. No. A-42015/4/2017-H(Estt.)-II/D-215.—In exercise of the powers conferred by clause (c) of sub-section (1) of section 43 of the New Delhi Municipal Council Act, 1994 (44 of 1994) and after consultation with the Union Public Service Commission, as required under sub-section (2) of the said section 43, and with the approval of the Central Government in terms of sub-section (2) of section 387 of the said Act, the New Delhi Municipal Council hereby makes the following amendment in the notification No. F.4(22)/2001/UD/11528, dated the 6th August, 2002, namely:-

1. In the said notification, after the opening paragraph and before the Schedule-I, the following shall be inserted, namely:-

"Initial Constitution.- All the officers appointed on contract basis or ad-hoc basis to the posts of Homoeopathic Physician, Senior Homoeopathic Physician or Chief Homoeopathic Physician, as the case maybe, on or before the 31st January, 2017, on the basis of their suitability to be assessed by the Commission and possessing requisite educational qualifications and experience prescribed for the post and being found fit, shall be deemed to have been appointed under these regulations in the respective grades, and they shall be members of the Service from the date of commencement of the amendment notifications number F.A-42015/4/2017-H(Estt.)-II/D-215 dated the 20th May, 2022".

(2) This notification shall come into force on the date of their publication in the Official Gazette.
