(43)44 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: OCTOBER 13, 2022/ASVINA 21, 1944 PART II - Sec. 1] साधारण निर्वाचन आयोजित करने की घोषणा की थी और श्री विपिन कु मार तिवारी ,ने राष्ट्रीय राष्ट्रवादी पार्टी के उम्मीद्वार के रूप में पूर्वोक्त निर्वाचन लड़ा था;
और यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 77 (1) के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, वह तिथि जब उसे नाम-निर्देशित किया गया है और उसके परिणाम की घोषणा की तिथि, दोनों तारीखें सम्मिलित, के बीच अपने द्वारा या अपने निर्वाचन एजेंट द्वारा उपगत या अधिकृ त निर्वाचन संबंधी सभी खर्चों का, या तो स्वयं या अपने निर्वाचन एजेंट द्वारा, एक पृथक और सही लेखा रखेगा और लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, निर्वाचन लड़ने वाले प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से तीस दिनों के भीतर अपने निर्वाचन व्यय का लेखा जिला निर्वाचन अधिकारी को दर्ज करेगा जो धारा 77 के अंतर्गत उसके द्वारा अथवा उसके निर्वाचन एजेंट द्वारा रखे गए लेखे की सत्य प्रतिलिपि होगी;
और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89(2) के अधीन मुख्य निर्वाचन अधिकारी, राष्ट्रीय राजधानी राज्य क्षेत्र. दिल्ली के पत्र सं .CEO/COE/102(86)/DLA-20/Scr.Rep/2020/38125, दिनांक 03.06.2020 के जरिए जिला निर्वाचन अधिकारी, जिला उत्तर-पूर्व दिल्ली की प्रस्तुत रिपोर्ट के अनुसार, राष्ट्रीय राजधानी राज्य क्षेत्र. दिल्ली के 70-करावल नगर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, श्री विपिन कु मार तिवारी विधि द्वारा यथापेक्षित रीति से अपने निर्वाचन व्यय का कोई लेखा दाखिल करने में असफल रहे हैं;
और यतः, जिला निर्वाचन अधिकारी, जिला-उत्तर-पूर्व दिल्ली और मुख्य निर्वाचन अधिकारी, राष्ट्रीय राजधानी राज्य क्षेत्र. दिल्ली की रिपोर्टों के आधार पर भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (5) के तहत निर्वाचन व्यय का लेखा दाखिल न करने पर, श्री विपिन कु मार तिवारी को कारण बताओ नोटिस दिनांक 22.09.2020 को जारी किया गया था;
और यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप नियम (6) के अनुसार, दिनांक 22.09.2020 के उपयु र्क्त कारण बताओ नोटिस के माध्यम से, श्री विपिन कु मार तिवारी को निदेश दिया गया था कि वे इस नोटिस के प्राप्त होने के 20 दिनों के भीतर लेखे प्रस्तुत न कर पाने का कारण स्पष्ट करते हुए आयोग को लिखित में अपना अभ्यावेदन प्रस्तुत करें और साथ ही, निर्वाचन व्यय का अपना लेखा दाखिल करें/अपने लेखे में त्रुटियों को सही करें और उसे संबंधित जिला निर्वाचन अधिकारी को प्रस्तुत करें;
और यतः, अभ्यर्थी श्री विपिन कु मार तिवारी द्वारा उक्त नोटिस दिनांक 13.10.2020 को स्वयं उनके द्वारा प्राप्त किया गया था। अभ्यर्थी से प्राप्त पावती जिला निर्वाचन अधिकारी, जिला उत्तर-पूर्व दिल्ली द्वारा दिनांक 18.12.2020 के अपने पत्र सं .F.6(456)/DEO/(NC)SDM(EL)/2020/6357-63 के द्वारा आयोग को प्रस्तुत कर दी गई थी;
और यत: , जिला निर्वाचन अधिकारी, जिला उत्तर-पूर्व दिल्ली ने दिनांक 07.12.2021 के अपने पत्र सं .
F.6(265)/DEO(NE)/SDM(EL)2020/2040-42 द्वारा सूचित किया कि श्री विपिन कु मार तिवारी ने अनेक विसंगतियों के साथ दिनांक 13 .10.2020 को अपने निर्वाचन व्ययों का लेखा प्रस्तुत किया है। आयोग ने अपने नोटिस सं. 76/भा0नि0आ0/क्षे0/दिल्ली-वि0.स0./70/2020 दिनांक 18.07 .2022 के माध्यम से श्री विपिन कु मार तिवारी को विलंब के लिए कारण/औचित्य देने और उक्त त्रुटियों को सुधारने का अवसर प्रदान किया
और यतः, जिला निर्वाचन अधिकारी, जिला उत्तर-पूर्व दिल्ली ने अपने पत्र संख्या F.6(456)/DEO(NE)/SDM(EL)2020/1583, दिनांक 12.09.2022 के माध्यम से सूचित किया है कि सहायक निर्वाचक रजिस्ट्रीकरण अधिकारी, 70-करावल नगर विधानसभा क्षेत्र के कार्यालय के एक अधिकारी ने श्री विपिन कु मार तिवारी को नोटिस देने के लिए उक्त पते का दौरा किया, लेकिन वह उल्लिखित पते पर नहीं पाए गए। अतः, आयोग द्वारा जारी नोटिस दिनांक 18.07.2022 को उक्त पते पर 'चस्पा' दिया गया। एसडीएम (ईएल), उत्तर पूर्व जिला ने आगे यह सूचित किया है कि श्री विपिन कु मार तिवारी ने आज तक अपने चुनावी खर्च का लेखा-जोखा समय पर जमा करने में विफल रहने का न तो कोई उचित कारण बताया है और न ही खाते में सुधार किया है।[PART II - Sec. 1 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: OCTOBER 13, 2022/ASVINA 21, 1944 45 और यत:, भारत निर्वाचन आयोग को यह समाधान हो गया है कि श्री विपिन कु मार तिवारी चुनाव खर्च का लेखा-जोखा दर्ज करने में विफल रहे हैं और विफलता के लिए उनके पास कोई उचित कारण या औचित्य नहीं है और खाते में नोट की गई विसंगति को दूर नहीं किया है।
और यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह अनुबंधित किया गया है कि:-
"यदि निर्वाचन आयोग का यह समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या कानून के अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उसके पास उस असफलता के लिए कोई समुचित कारण या न्यायोचित्य नहीं है, तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरर्हित घोषित करेगा और ऐसा कोई भी व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित रहेगा;
अब इसीलिए, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में भारत निर्वाचन आयोग एतद्द्वारा राष्ट्रीय राजधानी राज्य क्षेत्र. दिल्ली राज्य के 70-करावल नगर विधान सभा निर्वाचन क्षेत्र से विधानसभा के साधारण निर्वाचन-2020 में निर्वाचन लड़ने वाले अभ्यर्थी, श्री विपिन कु मार तिवारी, निवासी- के -103, गली नं-52, के - ब्लॉक, सादतपुर, एक्स्., दिल्ली-110094 को संसद के किसी भी सदन या राज्य या संघ राज्य-क्षेत्र की विधानसभा अथवा विधान परिषद के लिए सदस्य चुने जाने या होने के लिए इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित करता है।

NOTIFICATION

No.CEO/COE/102 (104 )/2019/27395.—The following is published for general information:—
''SECRETARIATE OF THE ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 28th September, 2022
No.76/ECI/ORD/DEL-LA/70/2020/NS-II.—WHEREAS, the Commission had declared to hold the General Election to the Legislative Assemblyof NCT of Delhi from70-Karawal Nagar Assembly Constituency vide its Notification, dated 14.01.2020 and Sh. Vipin Kumar Tiwari had contested the aforesaid election as a Rashtriya Rashtrawadi Party's candidate;
AND WHEREAS, as per Section 77 (1) of the Representation of the People Act, 1951, every candidate at election shall, either by himself or by his election agent, keep a separate and correct account of all expenditure in connection with the election incurred or authorized by him or by his election agent between (the date on which he has been nominated) and the date of declaration of the result thereof, both dates inclusive & as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within thirty days from the date of election of the returned candidate lodge with the District Election Officer (DEO) account of his election expenses which shall be in a true copy of the account kept by him or by his election agent under Section 77;
AND WHEREAS, as per the report under rule 89(2) of the Conduct of Election Rules, 1961, received from the District Election Officer, North East District, NCT of Delhi through the Chief Electoral Officer's letter No. CEO/COE/102(86)/DLA-20/Scr.Rep/2020/38125, dated 03.06.2020, Sh. Vipin Kumar Tiwari, the contesting46 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: OCTOBER 13, 2022/ASVINA 21, 1944 PART II - Sec. 1] candidate from 70-Karawal Nagar Assembly Constituency of NCT of Delhi, failed to lodge any account of his election expenses as required by law;
AND WHEREAS, on the basis of the above reports of the District Election Officer, North East District, NCT of Delhi and the Chief Electoral Officer, NCT of Delhi, a Show Cause Notice dated 22.09.2020 was issued by the Election Commission of India under Sub Rule (5) of Rule 89 of the Conduct of Election Rules, 1961 to Sh. Vipin Kumar Tiwari for non-submission of account of Election expenses;
AND WHEREAS, as per Sub Rule (6) of Rule 89 of the Conduct of Election Rules, 1961, through the above said Show Cause Notice dated 22.09.2020, Sh. Vipin Kumar Tiwari was directed to submit his representation in writing in the Commission explaining the reason for non-submission of accounts and also to lodge his accounts of election expenses/rectify the defects in his accounts before the District Election Officer concerned within 20 days from the date of receipt of the notice;
AND WHEREAS, the said notice was received by Sh. Vipin Kumar Tiwari on 13.10.2020. Acknowledgement receipt obtained from the candidate has been submitted to the Commission by District Election officer, North East District, NCT of Delhi vide letter No. F.6(456)/DEO(NE)/SDM(EL)2020/6357-63, dated 18.12.2020.
AND WHEREAS, the District Election Officer, North East District, NCT of Delhi vide letter No. F.6(456)/DEO(NE)/SDM(EL)2020/2040-42, dated 07.12.2021 informed that Sh. Vipin Kumar Tiwari has submitted his account of election expenses on 13.10.2020 with a number of discrepancies. The Commission vide its letter No. 76/ भा.नि.आ./क्षे./दिल्ली-वि.स../70 /20 20, dated 18.07.2022 provided an opportunity to Sh. Vipin Kumar Tiwari to give reasons/justification for the delay and to rectify the said defects.
AND WHEREAS, District Election Officer, North East District (NCT of Delhi) vide letter No.F.6(265)/DEO(NE)/SDM(EL)2020/1583, dated 12.09.2022 has informed that an official from the O/o Assistant Electoral Registration Officer, 70-Karawal Nagar Assembly Constituency visited the said address to serve the notice to Sh. Vipin Kumar Tiwari but he was not found residing at the mentioned address. Hence, ECI's notice dated 18.07.2022 was pasted on the said address. The SDM (EL), North East District, has further informed that till date Sh. Vipin Kumar Tiwari has neither provided good reason or justification for his failure in submission of his accounts of election expenditure in time nor rectified the account.
AND WHEREAS, the Commission is satisfied that Sh. Vipin Kumar Tiwari has failed to lodge an account of election expenses and has no good reason or justification for the delay and has not rectified the discrepancies noted in the account.
AND WHEREAS, Section 10 A of the Representation of the People Act, 1951 stipulates that:-
"If the Election Commission is satisfied that a person-
(a) Has failed to lodge an account of election expenses within the time and in the manner required by law or under this Act; and
(b) Has no good reason or justification for the failure the Election Commission shall by order published in the official Gazette, declare him to be disqualified and any such person shall be disqualified for a period of three years from date of the order;
NOW THEREFORE, in pursuance of Section 10 A of the Representation of the People Act, 1951, the Election Commission of India hereby declares Sh. Vipin Kumar Tiwari, resident of K-103, Gali No. 52, K-Block, Sadat Pur Extn., Delhi-110094 the contesting candidate for the General Election to the Legislative Assembly of NCT of Delhi- 2020 from 70-Karawal Nagar Assembly Constituency, to be disqualified for being chosen as and for being a member of either House of Parliament or the Legislative Assembly or Legislative Council of a State or Union Territory for a period of three years from the date of this order.
