याचिका का विज्ञापन
एतदद्वारा सूचना प्रदान की जाती है कि कं पनीज़ अधिनियम 1956 की धारा 433 (ई) और धारा 434 के साथ पढ़े माननीय उच्च न्यायालय नई दिल्ली द्वारा तिथि 19.09.2012 में उपरोक्त प्रतिवादी कं पनी को समाप्ति (वाइंडिंग अप) हेतु एक याचिका कोटक महिंद्रा बैंक लिमिटेड, Ist फ़्लोर, 6 वैशाली एन्क्लेव, पीतमपुरा, नई दिल्ली, तथा UGF- 1-11, ऊपरी भूमि तल, अम्बा दीप भवन, 14, कस्तूरबा गाँधी मार्ग, नई दिल्ली- 110001, जो की प्रतिवादी का लेनदार है, द्वारा माननीय उच्च न्यायालय में प्रस्तुत की गयी थी।
माननीय उच्च न्यायालय, नई दिल्ली के पारित आदेश दिनांक 12.09.2018तथा 03.09.2019 सी. पी.संख्या 449/2012 में शासकीय समापक को कं पनी के अन्तरिम परिसमापक नियुक्त किया है और याचिका का विज्ञापन प्रकाशित करने का निर्देश दिया गया है। याचिका में सुनवाई की अगली तारीख 5.3.2024 के लिए तय की गई है।
कोई लेनदार, अंशदायी अथवा अन्य व्यक्ति कथित याचिका में समर्थन या आपत्ति का इच्छु क कोई अन्य व्यक्ति स्वयं की इच्छा की सूचना कार्यालय अधोहस्ताक्षरी को प्रेषित करनी चाहिए तथा इस प्रकार सूचना कार्यालय अधोहस्ताक्षरी को याचिका की सुनवाई हेतु निर्धारित तिथि अर्थात 05.03.2024 से पूर्व 5 दिनों से अधिक विलम्ब नहीं पहुचना चाहिए तथा उक्त प्रयोजन हेतु स्वयं व्यक्ति रूप में अथवा स्वयं के अधिवक्ता दवारा सुनवाई में उपस्थित होना चाहिए। याचिका की एक प्रति कार्यालय अधोहस्ताक्षरी दवारा उक्त लेनदार तथा अंशदायी को निर्धारित शुल्क के भुगतान पर उपलब्ध की जाएगी। कोई शपथ पत्र याचिका हेतु प्रतिवाद में उपयोग हेतु इच्छु क न्यायालय में निर्धारित सुनवाई तिथि से पूर्व 5 दिनों से अधिक विलम्ब नहीं प्रस्तुत करना चाहिए। इसकी एक प्रति अधोहस्ताक्षरी को भी देना चाहिए।

Notice is hereby given that a petition under Section 433(e) and 434 of the Companies Act, 1956 for the winding up of the above Respondent Company was presented on 19.09.2012 before the Hon'ble High Court of Delhi by M/s Kotak Mahindra Bank Ltd., having office at Ist Floor, 6 Vaishali Enclave, Pitampura, New Delhi, Also at: UGF- 1-11, Upper Ground Floor, Amba Deep Building, 14, Kasturba Gandhi Marg, New Delhi-110001, creditor of the Respondent Company.
The Hon'ble High Court of Delhi vide order dated 12.09.2018 and 03.09.2019 passed in C. P. No. 449/2012 appointed the Official Liquidator as the Provisional Liquidator of the company and directed the Official Liquidator to[PART II -II DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MARCH 7 , 2024/PHALGUNA 17, 1945 7 publish the advertisement of petition. The next date of hearing in the said petition is fixed for 5.3.2024 at 10:30 A.M.
Any creditor, contributory or other person desirous of supporting or opposing the making of an order on the said petition should send to the under signed notice of his intention signed by him or his advocate with his name and address so as to reach the under signed not later than 5 days before the date fixed for the hearing of the petition i.e. 05.03.2024 and appear at the hearing for the purpose in person or by his advocate. A copy of the petition will be furnished by the under signed to any creditor or contributory on payment of the prescribed charges for the same.
Any affidavit intended to be used in opposition to the petition should be filed in Court and a copy served on the under signed not less than 5 days before the date fixed for the hearing.
