(सिविल) सं. 22722/2016 शीर्षक "प्रतिमा रानी गुप्ता व अन्य बनाम दिल्ली उच्च न्यायालय एवं अन्य" तथा इस शर्त के भी अध्यधीन हैं कि उपरोक्त निर्णयों के क्रियान्वयन के परिणामस्वरूप यदि उनका वरिष्ठता स्तर अवनत होता है तो वे अपना स्थान अपने से ऊपर आसीन अधिकारी(गण) हेतु छोड़ने के लिए बाध्य होंगे एवं यदि कोई रिक्ति उपलब्ध नहीं होती है तो वे प्रत्यार्वर्तत हो जायेंगे|
2. सहायक निबंधक संवर्ग में श्री सुनील (क्र.सं. 9) की वरिष्ठता, श्री कौशल कु मार सचदेवा, निजी सचिव (निलंबित) के विरुद्ध लंबित जांच कार्यवाही के परिणाम तथा उनकी उपयुक्तता के आकलन के अध्यधीन होगी।

(सिविल) सं 20313/2019 शीर्षक "मनमीत सिंह एवं अन्य बनाम दिल्ली उच्च न्यायालय, द्वारा महानिबंधक एवं अन्य" के परिणाम के भी अध्यधीन है।
4. स्थानापन्न सहायक निबंधक के रूप में श्री कमलेश कु मार (क्र.सं.11) की नियुक्ति और वरिष्ठता श्री कौशल कु मार सचदेवा (निलंबित) के खिलाफ लंबित जांच कार्यवाही के परिणाम के अध्यधीन है और उनके दोषमुक्त होने व पदोन्नति के लिए उपयुक्त पाए जाने की स्थिति में, यदि सहायक निबंधक का कोई पद उपलब्ध नहीं होता है, तो श्री कमलेश कु मार अपने पिछले पद अर्थात निजी सचिव के पद पर प्रत्यार्वर्तत किये जाने हेतु बाध्य होंगे। सहायक निबंधक के संवर्ग में उनकी वरिष्ठता एस.एल.पी. (सिविल) सं. 20313/2019 शीर्षक "मनमीत सिंह एवं अन्य बनाम दिल्ली उच्च न्यायालय, द्वारा महानिबंधक एवं अन्य" के परिणाम के भी अध्यधीन है।46 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MAY 29, 2025/JYAISHTHA 8, 1947 PART II - Sec. 1] 5. क्रम संख्या 12 व 13 पर र्वर्णत अधिकारीगण, अर्थात् श्री राजेश कु मार मल्होत्रा और सुश्री सफलता भाटी की स्थानापन्न सहायक निबंधक के रूप में नियुक्ति इस शर्त के अध्यधीन है कि श्री जोगिंदर कु मार बत्रा, निबंधक के इस न्यायालय में प्रत्यावर्तन पर या माननीय भारतीय सवोच्च न्यायालय द्वारा विशेष अनुमति याचिका (सिविल) सं. 20313/2019 शीर्षक "मनमीत सिंह एवं अन्य बनाम दिल्ली उच्च न्यायालय, द्वारा महानिबंधक एवं अन्य" में पारित किसी न्यायिक आदेश के अनुपालन के परिणामस्वरूप, यदि सहायक निबंधक की कोई रिक्ति उपलब्ध नहीं होती है, तो वे अपने पिछले पद पर प्रत्यार्वर्तत किये जाने हेतु बाध्य होंगे। ऐसी किसी स्थिति में, क्रम संख्या 13 पर र्वर्णत अधिकारी (सुश्री सफलता भाटी) को कनिष्ठतम होने के कारण सबसे पहले प्रत्यार्वर्तत किया जाएगा। यदि दूसरी स्थिति भी उत्पन्न होती है, और यदि सहायक निबंधक की कोई रिक्ति उपलब्ध नहीं है, तो क्रम संख्या 12 पर र्वर्णत अधिकारी (श्री राजेश कु मार मल्होत्रा) प्रत्यार्वर्तत होंगे |

NOTES: 1. The above appointments are subject to outcome of (i) SLP (Civil) No. 20362/2016 titled"Ravinder Pahuja & Ors. Vs. High Court of Delhi & Ors.", (ii) SLP (Civil) No. 19374/2016 titled "K.K.Sharma & Ors. Vs. High Court of Delhi & Ors.", (iii) SLP (Civil) No. 27418/2016 titled "Dinesh Manchanda & Ors. Vs. High Court of Delhi & Ors.", and (iv) SLP (Civil) No. 22722/2016 titled "Pratima Rani Gupta & Others Vs High Court of Delhi and Ors." and also subject to the condition that in case as a result of implementation of above decisions their seniority position is depressed, they will be liable to yield their position to the officer(s) placed senior to them and in case no vacancy is available, they will stand reverted.
2. The seniority of Mr. Sunil (S.No.9) in the cadre of Assistant Registrar shall be subject to outcome of the inquiry proceedings pending against Mr. Kaushal Kumar Sachdeva, Private Secretary (under suspension) and assessment of his suitability.
3. The seniority of Mr. Nandan Singh (S.No.10) in the cadre of Assistant Registrar is subject to outcome of the inquiry proceedings pending against Mr. Kaushal Kumar Sachdeva, Private Secretary (under suspension) & assessment of his suitability and also subject to outcome of the SLP (Civil) No. 20313/2019 titled "Manmeet Singh & Anr. Vs. The Delhi High Court through Registrar General & Ors ".
4. The appointment & seniority of Mr. Kamlesh Kumar (S.No.11) as Officiating Assistant Registrar is subject to outcome of the inquiry proceedings pending against Mr. Kaushal Kumar Sachdeva (under suspension) and in case of his exoneration and he being found fit for promotion, if no vacancy of Assistant Registrar is available, Mr. Kamlesh Kumar shall be liable to be reverted to his previous post i.e. Private Secretary. His seniority in the cadre of Assistant Registrar is also subject to outcome of SLP (Civil) No. 20313/2019 titled "Manmeet Singh & Anr. Vs. The Delhi High Court through Registrar General & Ors.
5. The appointment of officers at S.No. 12 and 13, namely Mr. Rajesh Kumar Malhotra and Ms. Saphalta Bhati as Officiating is subject to the condition that in either case of repatriation of Mr. Joginder Kumar Batra, Registrar to this Court or in case as a result of compliance of any judicial order passed by Hon'ble Supreme Court of India in the Special Leave Petition (Civil) No. 20313/2019 titled "Manmeet Singh & Anr. Vs. The Delhi High Court through Registrar General & Ors, if no vacancy of Assistant Registrar is available, they shall be liable to be reverted to their previous post. In either eventuality, the officer at S.No. 13 (Ms. Saphalta Bhati) will be reverted first, being the juniormost. In the event the second eventuality also materialises, and if no vacancy of Assistant Registrar is available, the officer at S.No.12 (Mr. Rajesh Kumar Malhotra) will be reverted.
