(सिविल) सं. 22722/2016 शीर्षक "प्रतिमा रानी गुप्ता व अन्य बनाम दिल्ली उच्च न्यायालय व अन्य" तथा इस शर्त के भी अध्यधीन हैं कि उपरोक्त निर्णयों के क्रियान्वयन के परिणामस्वरूप यदि उनका वरिष्ठता स्तर अवनत होता है तो वे अपना स्थान अपने से ऊपर आसीन अधिकारी(गण) हेतु छोड़ने के लिए बाध्य होंगे एवं यदि कोई रिक्ति उपलब्ध नहीं होती है तो वे प्रत्यार्वर्तत हो जायेंगे|
2. इस न्यायालय की अधिसूचना सं. 54/स्था.I/ईI-2/डीएचसी दिनांकित 01.08.2025 के आंशिक आशोधन में, श्री जोगिन्दर कु मार बत्रा के इस न्यायालय में प्रत्यावर्तन के संदर्भ में श्री विनीत असवाल की नियुक्ति पर अधिरोपित यह शर्त कि यदि सहायक निबंधक की कोई रिक्ति उपलब्ध नहीं होती है तो वे अपने पूर्व पद पर प्रत्यार्वर्तत किए जाने हेतु बाध्य होंगे, हटाई जाती है| स्थानापन्न सहायक निबंधक के रूप में उनकी नियुक्ति इस शर्त के अध्यधीन रहेगी कि भारत के माननीय सवोच्च न्यायालय द्वारा विशेष अनुमति याचिका (सिविल) सं. 20313/2019 शीर्षक "मनमीत सिंह व अन्य बनाम महानिबंधक के माध्यम से दिल्ली उच्च न्यायालय व अन्य" में पारित किसी न्यायिक आदेश के अनुपालन के परिणामस्वरूप, यदि सहायक निबंधक की कोई रिक्ति उपलब्ध नहीं होती है, तो वे अपने पूर्व पद पर प्रत्यार्वर्तत किए जाने हेतु बाध्य होंगे।
3. श्री दिनेश चंर (निजी सचिव संवर्ग से पदस्थ) एवं सुश्री सुमन चावला (प्र.अ.न्या. / को.मा. संवर्ग से पदस्थ) की स्थानापन्न सहायक निबंधक के रूप में नियुक्ति इस शर्त के भी अध्यधीन है कि विशेष अनुमति याचिका (सिविल) संख्या 20313/2019 शीर्षक "मनमीत सिंह व अन्य बनाम महानिबंधक के माध्यम से दिल्ली उच्च न्यायालय व अन्य" में पारित किसी न्यायिक आदेश के अनुपालन की स्थिति में, यदि सहायक निबंधक की कोई रिक्ति उपलब्ध नहीं है, तो सुश्री सुमन चावला (प्र.अ.न्या. / को.मा. संवर्ग से पदस्थ) को उनके पूर्व पद पर प्रत्यार्वर्तत कर दिया जाएगा तथा तत्पश्चात, श्री जोगिंदर कु मार बत्रा, निबंधक के इस न्यायालय में प्रत्यावर्तन की स्थिति में तथा यदि सहायक निबंधक की कोई रिक्ति उपलब्ध नहीं है, तो दूसरे सबसे कनिष्ठ अधिकारी अर्थात् श्री दिनेश चंर, जो निजी सचिव संवर्ग से हैं, को उनके पूर्व पद पर प्रत्यार्वर्तत कर दिया जाएगा। इसके अतिरिक्त, जांच कार्यवाही के परिणामस्वरूप श्री कौशल कु मार सचदेवा की दोषमुक्ति एवं उन्हें पदोन्नति हेतु उपयुक्त पाए जाने की स्थिति में, यदि सहायक निबंधक की कोई रिक्ति उपलब्ध नहीं है, तो श्री दिनेश चंर अपने पूर्व पद अर्थात् निजी सचिव पर प्रत्यार्वर्तत किए जाने हेतु बाध्य होंगे।
4. यदि उपरोक्त घटनाएँ (अर्थात् (i) श्री जोगिंदर कु मार बत्रा, निबंधक का इस न्यायालय में प्रत्यावर्तन (ii) श्री कौशल कु मार सचदेवा की दोषमुक्ति एवं उन्हें पदोन्नति हेतु उपयुक्त पाया जाना और (iii) विशेष अनुमति याचिका (सिविल) सं. 20313/2019 शीर्षक "मनमीत सिंह व अन्य बनाम महानिबंधक के माध्यम से दिल्ली उच्च न्यायालय व अन्य") में किसी न्यायिक आदेश का अनुपालन, एक ही समय में या86 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: SEPTEMBER 18, 2025/BHADRA 27, 1947 PART II - Sec. 1] एक के बाद एक घटित होती हैं, तो सबसे कनिष्ठ (सुश्री सुमन चावला), दूसरे सबसे कनिष्ठ (श्री दिनेश चंर) और तीसरे सबसे कनिष्ठ (श्री विनीत असवाल) प्रोन्नत व्यक्ति अपने-अपने पूर्व पदों पर प्रत्यार्वर्तत किए जाने हेतु बाध्य होंगे।
5. समस्त प्रोन्नत व्यक्तियों की वरिष्ठता, श्री कौशल कु मार सचदेवा (निलंबनाधीन) के विरुद्ध लंबित जांच कार्यवाहियों तथा एस.एल.पी. (सिविल) सं 20313/2019 शीर्षक "मनमीत सिंह व अन्य बनाम महानिबंधक के माध्यम से दिल्ली उच्च न्यायालय व अन्य" के परिणाम के अध्यधीन है।
6. इसके अतिरिक्त, ये नियुक्तियां सहायक निबंधक के पद पर नियुक्ति हेतु भर्ती नियमों में दिए गए अनुपात में संशोधन/परिवर्तन से संबंधित लंबित अभ्यावेदनों के परिणाम के भी अध्यधीन हैं |

In partial modification of this Court's Notification No. 54/Estt.I/EI-2/DHC dated 01.08.2025, the condition imposed on the appointment of Mr. Vineet Aswal regarding repatriation of Mr. Joginder Kumar Batra, Registrar to this Court, if no vacancy of Assistant Registrar is available he shall be liable to be reverted to his previous post stands removed. His appointment as officiating Assistant Registrar shall continue to be subject to the condition that in case as a result of compliance of any judicial order passed by Hon'ble Supreme Court of India in the Special Leave Petition (Civil) No.20313/2019 titled "Manmeet Singh & Anr. Vs. The Delhi High Court through Registrar General & Ors," if no vacancy of Assistant Registrar is available, he shall be liable to be reverted to his previous post.
3. The appointment of Mr. Dinesh Chandra (incumbent from Private Secretary cadre) & Ms. Suman Chawla (incumbent from AOJ/CM cadre) as Officiating Assistant Registrar is also subject to the condition that in case of compliance of any judicial order passed in the Special Leave Petition (Civil) No. 20313/2019 titled "Manmeet Singh & Anr.Vs. The Delhi High Court through Registrar General & Ors.," if no vacancy of Assistant Registrar is available, Ms. Suman Chawla (incumbent from AOJ/CM cadre) shall stand reverted to her previous post and subsequently, in the event of repatriation of Mr. Joginder Kumar Batra, Registrar, to this Court and if no vacancy of Assistant Registrar is available, then the second junior most officer namely Mr. Dinesh Chandra, who is from the cadre of Private Secretary shall stand reverted to his previous post. Further, in case of exoneration of Mr. Kaushal Kumar Sachdeva upon the outcome of the inquiry proceedings and he being found fit for promotion, if no vacancy of Assistant Registrar is available, Mr. Dinesh Chandra shall be liable to be reverted to his[PART II - Sec. 1 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: SEPTEMBER 18, 2025/BHADRA 27, 1947 87 previous post i.e. Private Secretary.
4. In case the aforesaid events materiailses (i.e. (i) repatriation of Mr. Joginder Kumar Batra, Registrar to this Court (ii) exoneration of Mr. Kaushal Kumar Sachdeva and he being found fit for promotion and (iii) compliance of any judicial order in the Special Leave Petition (Civil) No. 20313/2019 titled "Manmeet Singh & Anr.Vs. The Delhi High Court through Registrar General & Ors.,") at same time or one after another, then, the junior most (Ms. Suman Chawla), second junior most (Mr. Dinesh Chandra) & third juniormost (Mr. Vineet Aswal) promotees shall be liable to reverted to their respective previous posts.
5. The seniority of all the promotees shall be subject to outcome of the inquiry proceedings pending against Mr. Kaushal Kumar Sachdeva (under suspension) and subject to outcome of SLP (Civil) No.20313/2019 titled"Manmeet Singh & Anr.Vs. The Delhi High Court through Registrar General & Ors.
6. Further, the appointments are also subject to outcome of the pending representations with regard to amendment/ change in the ratio in the recruitment rules for appointment to the post of Assistant Registrar.
