यतः, भारत निर्वाचन आयोग की अधिसूचना सं. 464/भा0नि0आ0/दिल्ली-वि0स0/2025 दिनांक 10 जनवरी, 2025 के अनुसरण में 24-पटेल नगर विधान सभा निर्वाचन क्षेत्र के लिए दिल्ली राष्ट्रीय राजधानी राज्य क्षेत्र विधान सभा 1963 DG/2026
(13)14 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MARCH 19, 2026/PHALGUNA 28, 1947 PART II - Sec. 1] का साधारण निर्वाचन, 2025 आयोजित किया गया था; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और
यतः, दिल्ली राष्ट्रीय राजधानी राज्य क्षेत्र के 24-पटेल नगर विधानसभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2025 का परिणाम, रिटनिग अधिकारी द्वारा 08 फरवरी, 2025 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 10 मार्च, 2025 थी; और
यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, दिल्ली से उनके दिनांक 26.03.2025 के पत्र सं. CEO/COE/102(121)/2024/1637, के तहत प्राप्त जिला निर्वाचन अधिकारी, नई दिल्ली की दिनांक 11.03.2025 की रिपोर्ट के अनुसार, श्री अशोक कु मार, जो दिल्ली राष्ट्रीय राजधानी राज्य क्षेत्र के 24-पटेल नगर विधान सभा निर्वाचन क्षेत्र,2025 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं; और
यतः, जिला निर्वाचन अधिकारी, नई दिल्ली की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री अशोक कु मार को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/दिल्ली वि0स0/व्यय लेखा/2025/सी0ई0एम0एस0-I, दिनांक 29.04.2025 को जारी किया गया था; और
यत:, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, श्री अशोक कु मार को लेखा दाखिल न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, नई दिल्ली जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और
यत:, मुख्य निर्वाचन अधिकारी, दिल्ली ने अपने पत्र द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस श्री अशोक कु मार को दिनांक 07.05.2025 को तामील किया गया था; और
यत:, जिला निर्वाचन अधिकारी, नई दिल्ली ने अपनी अनुपूरक रिपोर्ट दिनांक 16.07.2025, के द्वारा सूचित किया है कि श्री अशोक कु मार ने निर्वाचन व्यय के लेखे का कोई विवरण प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, श्री अशोक कु मार द्वारा विधि के अंतर्गत यथा-विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-
" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व् यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है ,दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,
तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व् यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा।";
यत:, तथ्यों और उपलब्ध रिकार्डों के आधार पर, आयोग का यह समाधान हो गया है कि श्री अशोक कु मार अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और[PART II - Sec. 1 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MARCH 19, 2026/PHALGUNA 28, 1947 15 अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि दिल्ली राष्ट्रीय राजधानी राज्य क्षेत्र के 24-पटेल नगर विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, श्री अशोक कु मार, निवासी- मकान संख्या टी-516/2, बुद्ध मंदिर के पास, बलजीत नगर, दिल्ली, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे ।

ELECTION COMMISSION OF INDIA
ORDER
New Delhi, the 11th March, 2026
WHEREAS, the General Election to Legislative Assembly of National Capital Territory of Delhi, 2025 for 24-Patel Nagar Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/ECI/DL-LA/2025, dated 10th January, 2025; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and
WHEREAS, the result of the election for 24-Patel Nagar Assembly Constituency of National Capital Territory of Delhi, 2025 was declared by the Returning Officer on 8th February, 2025 and hence the last date for lodging the account of Election Expenses was 10th March, 2025; and
WHEREAS, as per the report dated 11.03.2025 of DEO, New Delhi under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the Chief Electoral Officer, Delhi vide his letter No. CEO/COE/102(121)/2024/1637 dated 26.03.2025, Sh. Ashok Kumar, a contesting candidate from 24-Patel Nagar Assembly Constituency of National Capital Territory of Delhi, 2025 has failed to lodge account of election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer, a 'Show-Cause Notice' No. 76/दल्लिी वि0स0/व्यय लेखा/2025/सी0ई0एम0एस0-I, dated 29th April, 2025 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Ashok Kumar, for not lodging of account of Election Expenses; and
WHEREAS, through the above said 'Show Cause Notice' and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Ashok Kumar, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of election expenses with the District Election Officer, New Delhi, District within 20 days from the date of receipt of the notice; and
WHEREAS, the Chief Electoral Officer, Delhi, has reported that the said 'Show Cause Notice' was served to Sh. Ashok Kumar, on dated 07.05.2025; and
WHEREAS, the District Election Officer, New Delhi in his Supplementary Report dated 16.07.2025 has16 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MARCH 19, 2026/PHALGUNA 28, 1947 PART II - Sec. 1] reported that Sh. Ashok Kumar, has not submitted any statement of account of election expenses. Further, after receipt of the said notice, Sh. Ashok Kumar has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under
this Act, and
(b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such
person shall be disqualified for a period of three years from the date of the order.";
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Ashok Kumar, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act,1951, the Election Commission of India hereby declares Sh. Ashok Kumar, R/o House No. T-516/2, Near Budh Mandir, Baljit Nagar, Delhi and a contesting candidate from 24-Patel Nagar Assembly Constituency in General Election to the Legislative Assembly of National Capital Territory of Delhi, 2025, to be disqualified for being chosen as and for being a member of either House of the Parliament or the Legislative Assembly or the Legislative Council of a State or Union Territory for a period of three years from the date of this order.

यतः, भारत निर्वाचन आयोग की अधिसूचना सं 464/भा0नि0आ0/दिल्ली-वि0स0/2025 दिनांक 10 जनवरी, 2025 के अनुसरण में 40-नई दिल्ली विधान सभा निर्वाचन क्षेत्र के लिए दिल्ली राष्ट्रीय राजधानी राज्य क्षेत्र विधान सभा का साधारण निर्वाचन, 2025 आयोजित किया गया था; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 78 के अनुसार, किसी भी निर्वाचन में निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, निर्वाचित अभ्यर्थी के निर्वाचन की तारीख से 30 दिनों के भीतर अपने निर्वाचन व्यय के लेखे जिला निर्वाचन अधिकारी के पास दाखिल करेगा जो उक्त अधिनियम की धारा 77 के अन्तर्गत उसके द्वारा या उसके निर्वाचन अभिकर्ता द्वारा रखे गए लेखे की एक सत्य प्रति होगी; और
यतः, दिल्ली राष्ट्रीय राजधानी राज्य क्षेत्र के 40-नई दिल्ली विधानसभा निर्वाचन क्षेत्र के लिए निर्वाचन, 2025 का परिणाम, रिटनिग अधिकारी द्वारा 08 फरवरी, 2025 को घोषित किया गया था और इस प्रकार निर्वाचन व्यय के लेखे दाखिल करने की अन्तिम तारीख 10 मार्च, 2025 थी; और
यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (1) के अंतर्गत, मुख्य निर्वाचन अधिकारी, दिल्ली से उनके दिनांक 26.03.2025 के पत्र सं. CEO/COE/102(121)/2024/1637, के तहत प्राप्त जिला निर्वाचन अधिकारी, नई दिल्ली की दिनांक 11.03.2025 की रिपोर्ट के अनुसार, श्री विरेन्द्र, जो दिल्ली राष्ट्रीय राजधानी राज्य क्षेत्र के 40-नई दिल्ली विधान सभा निर्वाचन क्षेत्र,2025 से निर्वाचन लड़ने वाले अभ्यर्थी हैं, विधि के अंतर्गत यथा अपेक्षित निर्वाचन व्यय का लेखा दाखिल करने में असफल रहे हैं; और
यतः, जिला निर्वाचन अधिकारी, नई दिल्ली की उक्त रिपोर्ट के आधार पर, भारत निर्वाचन आयोग द्वारा निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (5) के अंतर्गत श्री विरेन्द्र को अपने निर्वाचन व्यय के लेखे प्रस्तुत नहीं करने के लिए कारण बताओ नोटिस सं. 76/दिल्ली वि0स0/व्यय लेखा/2025/सी0ई0एम0एस0-I, दिनांक 29.04.2025 को जारी किया गया था; और
यत:, उपयु र्क्त उक्त कारण बताओ नोटिस के जरिए और निर्वाचनों का संचालन नियम, 1961 के नियम 89 के उप-नियम (6) के अंतर्गत, श्री विरेन्द्र को लेखा दाखिल न किए जाने संबंधी कारणों को स्पष्ट करते हुए आयोग को अपना20 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MARCH 19, 2026/PHALGUNA 28, 1947 PART II - Sec. 1] अभ्यावेदन लिखित रूप में प्रस्तुत करने और नोटिस के प्राप्त होने की तारीख से 20 दिनों के भीतर जिला निर्वाचन अधिकारी, नई दिल्ली जिला को अपने निर्वाचन व्यय के लेखे प्रस्तुत करने का निदेश दिया गया था; और
यत:, मुख्य निर्वाचन अधिकारी, दिल्ली ने अपने पत्र द्वारा सूचित किया है कि उक्त कारण बताओ नोटिस श्री विरेन्द्र को दिनांक 07.05.2025 को तामील किया गया था; और
यत:, जिला निर्वाचन अधिकारी, नई दिल्ली ने अपनी अनुपूरक रिपोर्ट दिनांक 16.07.2025, के द्वारा सूचित किया है कि श्री विरेन्द्र ने निर्वाचन व्यय के लेखे का कोई विवरण प्रस्तुत नहीं किया है। इसके अतिरिक्त, उक्त नोटिस मिलने के उपरांत, श्री विरेन्द्र द्वारा विधि के अंतर्गत यथा-विहित लेखे दाखिल करने में अपनी असफलता के लिए भारत निर्वाचन आयोग को न तो कोई कारण बताया है और न ही कोई स्पष्टीकरण दिया है; और
यत:, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क में यह उपबंधित किया गया है कि:-
" यदि निर्वाचन आयोग का समाधान हो जाता है कि कोई व्यक्ति-
(क) निर्वाचन व्ययों का लेखा उस समय के भीतर और उस रीति में जैसी इस अधिनियम के द्वारा या अधीन अपेक्षित है, दाखिल करने में असफल रहा है; तथा
(ख) उस असफलता के लिए कोई अच्छा कारण या न्यायोचित्य नहीं रखता है,
तो निर्वाचन आयोग शासकीय राजपत्र में प्रकाशित आदेश द्वारा उसको निरहित घोषित करेगा और ऐसा व्यक्ति उस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरहित होगा।";
यत:, तथ्यों और उपलब्ध रिकार्डों के आधार पर, आयोग का यह समाधान हो गया है कि श्री विरेन्द्र अपने निर्वाचन व्यय के लेखे दाखिल करने में असफल रहे हैं और उनके पास ऐसा करने में असफल रहने के लिए कोई भी उचित कारण अथवा औचित्य नहीं है; और
अत:, अब, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10क के अनुसरण में, भारत निर्वाचन आयोग एतद्द्वारा घोषणा करता है कि दिल्ली राष्ट्रीय राजधानी राज्य क्षेत्र के 40-नई दिल्ली विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी, श्री विरेन्द्र, निवासी- ए-302, भूतल, ए-ब्लॉक, खानपुर, जे जे कॉलोनी, डॉ अंबेडकर नगर, नई दिल्ली- 110062, इस आदेश की तारीख से तीन वर्ष की अवधि के लिए संसद के किसी भी सदन अथवा राज्य अथवा संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्य चुने जाने अथवा होने के लिए निरहित होंगे ।

WHEREAS, the General Election to Legislative Assembly of National Capital Territory of Delhi, 2025 for 40-New Delhi Assembly Constituency was held in pursuance of the Election Commission of India Notification No. 464/ECI/DL-LA/2025, dated 10th January, 2025; and
WHEREAS, as per Section 78 of the Representation of the People Act, 1951, every contesting candidate at an election shall, within 30 days from the date of election of the returned candidate, lodge with the District Election[PART II - Sec. 1 DELHI GAZETTE, NATIONAL CAPITAL TERRITORY GOVT.: MARCH 19, 2026/PHALGUNA 28, 1947 21 Officer an account of his election expenses which shall be a true copy of the account kept by him or his election agent under Section 77 of the said act; and
WHEREAS, the result of the election for 40-New Delhi Assembly Constituency of National Capital Territory of Delhi, 2025 was declared by the Returning Officer on 8th February, 2025 and hence the last date for lodging the account of Election Expenses was 10th March, 2025; and
WHEREAS, as per the report dated 11.03.2025 of DEO, New Delhi under sub-rule (1) of Rule 89 of the Conduct of Elections Rules, 1961 received through the Chief Electoral Officer, Delhi vide his letter No. CEO/COE/102(121)/2024/1637 dated 26.03.2025, Sh. Virender, a contesting candidate from 40-New Delhi Assembly Constituency of National Capital Territory of Delhi, 2025 has failed to lodge account of election expenses, as required under law; and
WHEREAS, on the basis of the said report of the District Election Officer, a 'Show-Cause Notice' No. 76/दल्लिी वि0स0/व्यय लेखा/2025/सी0ई0एम0एस0-I, dated 29th April, 2025 was issued under sub rule (5) of Rule 89 of the Conduct of Elections Rules, 1961 by the Election Commission of India to Sh. Virender, for not lodging of account of Election Expenses; and
WHEREAS, through the above said 'Show Cause Notice' and under sub rule (6) of Rule 89 of the Conduct of Elections Rules, 1961, Sh. Virender, was directed to submit representation in writing to the Commission explaining the reasons for not lodging the account and also to lodge the account of election expenses with the District Election Officer, New Delhi, District within 20 days from the date of receipt of the notice; and
WHEREAS, the Chief Electoral Officer, Delhi, has reported that the said 'Show Cause Notice' was served to Sh. Virender, on dated 07.05.2025; and
WHEREAS, the District Election Officer, New Delhi in his Supplementary Report dated 16.07.2025 has reported that Sh. Virender, has not submitted any statement of account of election expenses. Further, after receipt of the said notice, Sh. Virender has neither furnished any reason nor explanation to the Election Commission of India for failure to lodge the account of his election expenses as prescribed under law; and
WHEREAS, Section 10 A of the Representation of the People Act, 1951 provides that :-
"If the Election Commission is satisfied that a person-
(a) has failed to lodge an account of election expenses, within the time and in the manner required by or under this
Act, and
(b) has no good reason or justification for the failure,
the Election Commission shall, by order published in the Official Gazette, declare him to be disqualified and any such
person shall be disqualified for a period of three years from the date of the order.";
WHEREAS, on the basis of facts and available records, the Commission is satisfied that Sh. Virender, has failed to lodge account of election expenses and has no good reason or justification for the failure to do so; and NOW, THEREFORE, in pursuance of Section 10A of the Representation of the People Act,1951, the Election Commission of India hereby declares Sh.
