ક્રમાંક :કેપી/૧૯૯૪ નો ૨૪૪/જી. એફ.સી-૧૨૯૪/૨૨૧૭/ જે – ભારતના સંવિધાનની કલમો ૨૪૩૮ અને ૨૪૩–લ ની જોગવાઈઓ અનુસાર અને ગુજરાત પંચાયત અધિનિયમ , ૧૯૯૩ (સન ૧૯૯૩ નો ગુજરાત અધિનિયમ ક્રમાંક : ૧૮ ) ની જોગવાઈ મુજબ ગુજરાત હુંસરકારે, પંચાયત અને ગ્રામ ગૃહનિર્માણ વિભાગના તા . ૧૫મી સપ્ટેમ્બર, ૧૯૯૪ ના સરકારી જાહેરનામા ક્રમાંક: કેપી/સન ૧૯૯૪ નો ૨૧૭/ઈએલસી/૧૦૯૪/૧૫૮૯/જે મુજબ પંચાયતો અને નગરપાલિકાઓની નાણાંકીય પરિસ્થિતિની પુનવિચારણા કરવાઅને આ સંબંધમાં ભલામણો કરવા ગુજરાત નાણાપંચની રચના કરી છે ;
અને નાણાપંચે કામગીરી ચાલુ કરી દીધેલ છે.
અને નાણાંપંચે પિતાનો અહેવાલ સરકારને તા. ૩૧ મી ઓકટોબર, ૧૯૯૫ સુધીમાં રજૂ કરવાનો છે ;
અને ગુજરાત નાણાંપંચના અધ્યક્ષશ્રીએ , પંચની વિસ્તુત કામગીરીનેઅનુલક્ષીને પંચમાં વધુ બે સભ્યોની નિમણૂંક કરવાની દરખાસ્ત રજૂ કરેલ છે ?
અને હવે ગુજરાતના રાજયપાલને એવી ખાતરી થઈ છેકે ગુજરાત નાણાં પંચમાં તેનું કામકાજ સમયમર્યાદાની અંદર કરવા માટે વધુ બે સભ્યની નિમણૂંક કરવાનું જરૂરી છે ;

૧) ગુજરાત નાણાંપંચમાં નીચેના બે અંશકાલીક સભ્યને તાત્કાલિક અસરથી નીમે છે :– ?
તેથી, હવે ભારતના સંવિધાનની કલમો ૨૪૩-૮ અને ૨૪૩-લની જોગવાઈઓ અનુસાર અને ગુજરાત પંચાયત અધિનિયમ , ૧૯૯૩ ની કલમ- ૨૨૬ ની પેટા –કલમ (૨) થી મળેલી સત્તાની રુએ ગુજરાતના રાજ્યપાલ આથી– (

No. KP/ 35 of 1995/PRN/ 1094/ 415 / J.-In exercise of the powers confereed by sub - section ( 1 ) of section 274, read with section 135 and section 159 of the Gujarat Panchayats Act , 1993 ( Guj . 18 of 1993 ) , the Government of Gujarat hereby makes the following rulos namely: --
1. Short title. These rules may be called the Gujarat Taluka and District Par.chayats (Custody of Taluka and District Funds ) Rules , 1995.

2.. Definition. In these rules, unless the context otherwise requires :-
(i)" "the Act" means the Gujarat Panchayats Act , 1993 ;
( ii) "section" means a section of the Act ;
(iii) "Panchayat" means a Taluka Panchayat or a district Panchayat as the case may be;
(iv) "Secretary" means a Taluka Development Officer of a Taluka Panchayat ; or a District Deve- lopment Officer of a District Panchayat as the case may be;
(v) "fund" means a Taluka Fund or a District Fund as the case may be , constituted under sec- tions 134 and 158 of the Gujarat Panchayats Act, 1993.
3. The Taluka Fund and the District Fund shall consists of Land Revenue grants paid in persuance of the provisions of section 219 and other grants paid in pursuance of the provisions of section 175 or section 176 as the case may be.
4. (1) The Taluka Panchayat or the District Panchyat as the case may be , may allow its secretary to keep a permanent advance not exeeding . ... an amount to be decided by such panchayat from time to time for meeting the current expenditure.
(2) Subject to the provisions of sub -rule (1 ), all the remaining sums of Taluka and District Panchayat Fund shall be deposited by the Taluka Panchayat and the District Panchayat in the Government Trea- sury to the credit of the Personal Ledger Account of the Taluka Development Officer or the District Development Officer, as the case may be, Out of the sums so deposited , the actual amount required for the payment for the various purposes shall be kept in the Porsonal Ledger Account and the remaining amount shall be Invested in the Government as terms depossits of the Taluka Panchayats and District Panchayats.
(3). Taluka or District Panchayat may invest with the previous sanction of the State Government or by any special order which the State Government may make for the purpose, such part of the fund in Public Securities in the name of the Panchayat any from time to time disposed of such securities as may be necessary.
Explanation. For the purpose of this rule, public securities means :-
(a) securities of the Central Government or any State Government ; or
(b) securities, stocks debentures or shares the interest whereupon has been guaranted by the Central Government; or the State Government ; or
(c) debentuets or other securities for money issued by or on behalf of any local athority in the State of Gujarat in exercise of the powers conferred by any enactment for the time being in force ; or
( d) securities expressly authorised by any order which the State Government may make in this behalf
5. The Gujarat Taluka and District Panchayats ( Custody of Taluka and District Fund) Rules 1963 are hereby repealed .

(iii ) " income" means income of the panchayats from all sources as Provided for in the Gujarat Panchayats Act , 1993 , including Government grants ;
(iv) "loan" means the loan made , taken or raised under these rules ;
(v) "non-Government Loan" means a la caised otherwise than from the funds of the State Government ;
(vi) "panchayat" meaus a village panchayat, a taluka panahayat or a district panchayat , as the case may be ;
(vii) " term of a loan" means the period elapsing between the date on which loan is completely made, taken or raised and the date on which it is compeletely repaid.
3. The purpose for which the loan may be raised. The panchayat may raise loan on the security of its fund for any of the folliwing purpose , namely:-
(1) carrying out of any functions which it is legally authorised to carry out under the Act ;
(2) giving of relief and the establishment and maintenance of relief works in times of famine or scarcity.
4. Limitation or boorowing power . The total amount of loans raised by a panchayat shall not exceed at any time five times , the average annual income of the panchayat for the last three years ;
Provided that a village panchayat may raise a loan upto Rs . 50,000/--(Rupees Fifty Tihousnads ) , for electrification of the area falling within its jurisdiction under the village electrification programme .
5. Application for loan.-( 1 ) Where a panchayat desire to obtain a loan from the State Govern- ment orraise it from the public , it shall pass a risolution to that effect and shall submit an application to the State Government .
(2) Where the panchayat making such application is a village panchayat , it shall submit the appli- cation through the taluka panchayat and the district panchayat and where it is a taluka panchayat , it shall submit the application through the district panchayat .
(3) The application shall contain the following particulars, namely:-
(i) the purpose for which the loan is required ;
(ii) the amount which it is proposed to raise ;
( iii) the fund on the security of which it is proposed to raise the loan ;
( iv) the law under which the said fund is levied, received or held ;
(v) the dates within which the money is to be raised and , when it is proposed to raised a loan in instalments , the amount of each instalment , the dates within which the first instalment is to be taken or raised , and the years in which it is intended to take or raise the other instalments ;
(vi) the rate of interest at which it is proposed to raise the loan ;
i) the term of years for which the money is to be raised and the method by which it is to be paid. If it is proposed to repay the loan by means of a sinking fund , the rate of interest at which The investment of such sinking fund is to be calculated , shall also be stated ;
(viii) account of the financial position of the panchayat, including a statement of all existing prior charges on its fund-
(a) the receipt side of the account shall show only ordinary revenue receipts . Receipts from loans or deposits or thoinvestments of sinking fund shall be excluded as well as items of abnormal character which should be indicated separately when required ;
(b) on the expenditure side interest or debt and payments to a sinking fund shall be included , and all expenditure from loan funds and repayment of advances er deposits shall be excluded: 心
(c) explanations shall be given of important variation in the accounts of revenue and expenditure ;

(ix) the extraordinary items of receipt and expenditure with full descriptions of the nature of receipt or expenditure for the past three years in a separate statement ;
(x) the balance of each loan taken either from the State Government or open matket together with the amount of instalment , if any, to be set aside annually for the sinking fund shallbe dis- tinctly shown in a a separate statement .
6. Transmission of a duplicate copy of the application to the Examiner, Local Fund Accounts . Where an application for loans is made by a panchayat under the rule 5, a duplicate copy of the applicationto- gether with the statement giving the full particulars required by the said rule shll be sent direct to the Examiner , Local Fund Accounts, Ahmedabad at the same time when the application is submitted .
7. Scrutiny of loan applications . Where the application for loan made under rule 5 has been for- warded through any panchayat , the panchayat shall offer its remarks thereon .
8. Rajection of Loan applications . On receipt of the application made under rule 5 ifit appears to the State Government that the money ought not to be raised, it shall reject the applicatiion .
9. Urgent Loans . The State Government if it is satisfied that the loan is urgently needed for any such purpose , may, notwithstanding anything contained in these rules , after such inquiry, if any, as it thinks fit, make , grant or sanction the raising of such loan at any time on the receipt of the appli- cation .
10. Government Loans . When a panchayat submits an application for a Government loan, the State Government may grant the loan, subject to the following conditions , namely:-
(a) the term of the loan does not ordinarily exceed the maximum period of 30 years . Every loan shall usually run for as short a period as possible , This rule may, however, be relaxed in very special cases ;
(b) funds are availabe from the grants voted by the Legislative Assembly for the purpose ;
(c) the rate of interest payable on the loan to be such as the State Government may determine ; and
(d) panchayat shall not be competent to raise loans under these rules unless they show to the satisfaction of Government , the loans which it could receive under section 131, 155 or 223 of the Act , would be inadequate for the purpose for which a loan is being raised .
11. Non-Government Loans .-( 1) When a panchayat submits an appplication for a non-Government loan, the State Government may sanction the application provided the term of the loan does not or- dinarily exceed the maximum period of 30 years . Every loan should usually rua for as short a period as possible . This rule may, however be relaxed in very special cases .
(2) Notwithstanding anything contained in sub -rule (1 ) , no permission for raising any non-Government loans would be given to any panchayat so long as Government loan could be had for the purpoзе .
12. Prescribed conditions . ( 1 ) In granting or sanctioning a loan, the State Government may impose any further conditions , not inconsistant with the Ast , and with these rules , as it may thinks fit .
(2) In particular and without prejudice to the generality of sub -rule ( 1 ) , the following conditions shall be imposed , namely:-
(i) In the case of every loan , the panchayat shall furnish to the Accountant General, Gujarat , and to the State Government any information which they may require regarding its funds and regarding the expenditure made out of the loan .
(ii ) In the case of a Government loan, the State Government , if it considers that the panchayat has failed to comply with any of the conditions prescribed in respect of the loan or with any of the requirements of these rules , may at any time order that no further payments shall be made on account of such loan and that any amount advanced shall with interest thereon , shall be repaid immediately.

(iii) In the case of non-Government loan , the panchayat shall not without the previous approval of the State Government , very the dates within which the raising of the loan or of the first instal- ment of it has been sanctioned and that if the loan is raised by instalments , the panchayat shall report , for the previous approval of the State Government, the date within which each further in- stalment is to be raised .
13. Remedy by attachment if loan not repaid .--If any money raised in accordance with these rules, or any interest is not repaid according to the conditions of loan , the State Government , if itself the lender, may, and if the State Government is not the lender , shall on the application of the lender, attach the funds on the security of which the loan was made . After such attachment , no persons , except an officer appointed in this behalf by the State Government , shall in any way deal with the attached funds; but such officer may do all acts in respect thereof which the borrowers might have done if such attachmenet had not taken place , and may apply the proceeds in satisfication of the loan and of all interests and of all expenses caused by the attachment and subsequent proceedings :
Provided that no such atachment shall defeat or prejudice any debt for which the funds attached were previously pledged in accordance with law; but all such prior charges shall be paid out of the pro- ceeds of the funds before any part of the proceeds is applied to the satisfaction of the liability in re- spect of which such attachment is made .
14. Procedura on attachment . When the State Government decided to attach any funds under rule 13, the following procedure, shall be observed, namely:--
(a) The State Government shall issue a notice to the Panchayat prohibiting the collection or management of such funds by the panchayat , and vesting the administration thereof in such officer as the State Government may appoint . The State Government shall cause such notice to be published in the Official Gazette and in such manner as it may deem fit within the local limits of the area subject to the control of the panchayat .
(b) The Officer appointed by the State Government under rule 13 shall pay the moneys collected or received under such attachment to the lender , or in the case of a Government loan, into the Government Treasury.
(c) The said Officer shall prepare the accounts of moneys so collected and the cost of collection, in such form as the State Government may, from time to time , direct . He shall deliver a copy of the accounts to the panchayat , and shall cause a copy to be published in the Official Gazette .
15. Unexpended balances. If, on the completion of the work of the closing of the account of the transaction for whih a panchayat has raised money, the State Government is satisfied that the whole of the money has not been spent on the purpose for which it was raised, it'shall proreed as follows , namely:--
(a) In the case of a Government Loan . The State Government shall direct that the unexpended balance shall be forthwith repaid to the State Government and the principal of the reduced by an equivalent amount . The State Government may direct such variations as it may consider necessary on this account in theinstalments fixed for the liquidation of the loans .
(b) In the case of a non- Government Loan. The State Government may direct that the un- expended balance shall be utilised in the reduction in any way of the debt of the panchayat or in carrying out any works which the panchayat is legally authorised to carry out .
16. Interest on Government Loans . The following provisions shall apply to interest on ment loans, namely:- Govern-
(1) Interest shall be charged at the rate agreed upon, yearly or half yearly, as the State Government may determined and shall be reckoned and paid on each instalment from the date on which such instalment is received by the panchayat .
(2) The State Government may if it thinks fit direct that a penal rate of compound interest not exseeding 10 percent per annum shallbe paid upon all over due instalments of interest , or of pri- naipal and interest.

17. Interest on non -Government Loans. Interest on non-Government loan shall be charged at the rate specified at the time of raising the loan , yearly or half yearly (half year shall be reckoned as ending on 30th September , or 31st March) and shall be reckoned and paid from the date on which the amount has been received by the panchayat i
Provided that where the loan is obtained by the panchayat from any person , bank, authority or institution for electrification of the areas within its jurisdiction under the village electrification program- me, such person , bank , authority or institution shall have the option to require the panchayat to pay interest at the end of every three months from the date on which the whole amount of loan or the first instalment of the loan is received by the panchayat .
18. Repayment of Governmedt Loan. With the previous consent of the State Government , the pan- chayat may, at any time , repay the whole or any part of a Government loan in advance of the period fixed by the conditions of the loan.
19. Sinking Fund for Government and Non -Government Loans .-- If a loan is not repayable by annui- . ties annual drawings, the panchayat shall establish a sinking fund in the following manner , namely:-
(1) It shall pay out of its income , yearly or half yearly into such fund, a sum which accumulating at such rate of compound interest as the State Government may fix will be sufficient to secure the liqui- dation of the loan within the term fixed for its repayment .
(2) It shall make the first of such payments within one year from the date of taking or raising the loan unless the State Government otherwise directs .
(3) It shall invest its sinking fund in Government sccurities as defined by the Indian Securities Act , 1920, or securities specifiedin clause (c) or ( d) of section 20 of the Indian Trusts Act , 1882 :-
on Provided that when a loan or an instalment of a loan is nature within twelve months from the date which sum is payable into the sinking furd under clause ( 1) , the panchayat may deposit with the State Bank of India such sum or such portion thereof as may be necessary for repayment of such loan or interest .
20. The Gujarat Panchayats Loans Rules , 1964 are hereby repealed .

No. KP/29 of 1995/PRN- 1094/1833 -J. In exercise of the powers conferred by sub - section (1 ) of section 274 read with . sub - section (5) of section 243 of the Gujarat Panchayats Act , 1993 (Guj . 18 of 1993 ) , the Government of Gujarat hereby makes the following rules , namely:-
1. Short title. These rules may be called the Gujarat District Panchayats Appeal Committee (Pro- cedure) Rules, 1994 .
2. Definition. In these rules , unless the context otherwise requires :
(i ) " the Act " means the Gujarat Panchayats Act, 1993 ;
(ii ):"Chairman" means the chairman of the Committee ;
(iii ) "Committes" means the Apeal Committee of the District Panchayat constituted in pursuance of the provisions of section 243;
:
(iv) "Form" means a Form appended to these rules ;
(v) "Secretary " means the Secretary of the Committee appointed under rule 3 ;
(vi) " Section" means a section of the Act .
3. Secretary of the Committee. The District Panchayat shall designate an officer of the Panchayat to act as Secretary of the Committee..."
4. Sittings of the Committee . The Appeal Committee shall meet at such times and places as the Chairman may decide ;
:
Provided that not less than two day's notice shall be given to every member of any meeting of the Committee .
5. Registration of appeal . ( 1 ) As soon as an appeal is received the District Development Officer shall endorse thereon the date of its receipt and pass on the appeal to the Secretary. The Secretary shall , as soon as possible satisfy himself that :-
(i) the person presenting has authority to do so ;
(ii) it conforms to the provisions of section 244, and section 104, 200 or as the case may be, 242 and these rules .

(2) if the appeal conforms to the provisions of clauses (i) and ( ii ) of sub - rule (1) or if there are any defects in the appeal and if the Secretary is satisfied that such defects are of a minor nature he shall cause it to be registered in a register to be maintained for the purpose in Form A:
Provided that the Secretary may, with the approval of the Committee register an appeal prefcrred under section 242 eventhough the period of limitation for preferring such appeal specified in sub -section (2) of section 242 has elapsed , if he is satisfied that on account of non- communication of the order or decision of the panchayat to the appellant , the appellant was not aware of such order or decision and hence could not prefer the appeal within the said limitation period but has proferred the appeal within a period of thirty days from the date he became aware of such order or decision.
(3) If the Secretary finds that the appeal so presented does not conform to any of the provisions of clauses ( i) and (ii ) of sub -rule (1) , he shall :--
(i) where the defects to be remedied are not of a minor nature , with the approval of the Chairman , return the appeal with an endoresement specifically pointing out such defect ; and
(ii) Where the appeal contains defoats of minor nature , with the approval of the Chairman, by a separate letter, specifically point out such defects and shall call upon the appellant or his agont to re- medy or explain such defects within a period of fifteen days from the date of receipt of such letter . If the appellant or his agent fails to remedy or explain satisfactorilythe defeats within the said period , the Secretary shall place the appeal before the committce for decision on merits and the defeats rema- ining so unremedied shall be taken into consideration by the committee at the time of hearing of the appeal .
(4) The Secretary may with the approval of the Chairman also call upon the appellant to furnish within the specified period as many additional copies of the memorandum of appeal together with its accompaniments as he may consider Locosstay for supply to the hospondents and other persons , if any , or if required otherwise . If the appellant does not furnish the additional copies , the committee may reject the appeal .
6. Appeal to be heard when all the five mombers are present: An appeal shall be heard when all the five members of the Committee are present .
7. Procedure to be followed by the Committee in the exercise of its appellate powers under section 104, 200 or 242:-( a) After an appeal is admitted , the Secretary with the approval of the Chairman shall cause a written notice to be delivered personally or sent by registered postto the appellant in Form B specifying the date on which and the time and place at which the appeal shall be heard. A like notice shall also be given to the village or as the case may be , taluka panchayat against whose decision the appeal is preferred and to other respondents , if any , in like manner and such potice shall be accompanied by a copy of the memorandum of appeal .
(b) The chairman may also directits Secretary to call for all material records any papers which may be necessary for deciding the appeal .
(c) If the appellant on whom the notice is served under clause (a) does not appear, cither by him- self or through his duly authorised agent or any person authorised by him for the purpose on the day fixed for hearing or on any other day to which the hearing may be adjourned, the Committee may de- cide the appeal ex-parte or in such manner as it may think fit . In other cases, if the evidence on re- cord is sufficient to enable the Committee to decide the appeal, the Committee may, after hearing the parties, present record its decision in writing together with awith a full statement of the grounds the thereof. If however,, the Committee considers it to be necessary to examine any witnessor require any document to be produced in order to enable it to decide the appeal , it may examine such witness or require such documents to be produced and then, after hearing the parties , record its decision in the manner specified above .
(d) The order to be passed by the Committee in pursuance of clause ( c) shall be passed in the name of the District Panchayat and shall be signed by the Secretary. A copy of the order so passed shall be supplied to the appellant so far as may be , in person or if this cannot be done for any reason whatsoever, shall be sent to him by registered post . A copy of such order shall also be sent in the like manner to the respondent village or as the case may be, taluka panchayat and other respondents , if any, and in a case where the appeal was against the decision or order of a village panchayat a copy of such order shall also be sent to the taluka panchayat to which such village panchayat is subordinate .
3. Procedure to be followed by the Committee in respect of Matters not provided for in these rules: - The Committee may, in any matter not provided for in these rules, follow the procedure, as far as it

may be applicable, laid down in the Code of Civil Procedure , 1908, or may regulate its procedure in such manner as it thinks fit .
9. The Gujarat District Panchayat Appeal Committee (Procedure ) Rules , 1968, are hereby repealed .

BOMBAY PRIMARY EDUCATION ACT , 1947 .
No. KH/ SH/ 30 /KHPS - 1091-3388 - CH. WHEREAS , the draft rules further to amend the Bombay Primary Education Rules , 1949 , were published as required by sub - section (3 ) of section 63 of the Bombay Primary Education Act , 1947 (Bom . LXI of 1947) at pages 253-1 to 253-7 of the Gujarat Government Gazette; Extra ordinary Part --I A. dated the 24th June , 1994, under the Government Notification, Education Department No. KH /SH/ 20 /KHPS - 1091-3388 - CH, dated the 10th June , 1994 inviting ob- jections or suggestions from all persons likely to be affected thereby till thirty days from the date of publication of the said notification in the Gujarat Government Gazette .
AND , WHEREAS, no objection and suggestions received from the public on the said draft notification;
NOW, THEREFORE , in excroise of the powers conferred by section 63 of the Bombay Priman Education Act , 1947 (Bom. LXI of 1947) , the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules , 1949, namely:-
1. These rules may be called the Bombay Primary Education ( Gujarat Amendment ) Rules , 1994.
2. In the Bombay Primary Education Rulos , 1949 (hereinafter referred to as "the said rules ",) in. rule 106 para ( 1) in sub -rule (A) -
(i) in clause ( 1) , the following proviso shall be inserted , namely: -
"Provided that the Dircotor may if he thinks fit , arrept application which is received after expiry date but before the commencemert of the next academic year. "
(ii) for clause (5 ), the following shall be substitutd , namely:-

"(5) No change either in the management or the place of the private primary school or both shall be made without the prior written approval of the Director . An application for such per- mission shall be made to the authorised officer alongwith a nonrefundable fee of Rs . 1000/-- on or be- fore the last date of October of the previous academic year from which it is proposed to make such chauge . The Director, while deciding such application , shall follow as far as may be possible the procedure similar to the procedure for recognition of a private primary school . "
(2) for sub -rule (B ) , following shall be substituted, namely:---
"(B) ( 1) Application for opening of higher standards or additional divisions: A management of a private primary school , who desires to open higher standards or additional divisions in the exis- ting reangaised private primary school from the commencement of new academic year, shall apply on or before the last date of October of the previous academic year to the "Authorised Officer " in Form 'D' in Appendix 'C' appended to these rules Provided that the Director may if he thinks fit , accept such application in cases where the applications are received after the expiry of date but before the commencement of next academic year .
1 (2) Every application made under alause (1 ) of the sub -rule be sent to the authorised officer by registered post with acknowledgement due together with an undertaking in writing that the condi- tions of employinent of the staff in the private primary school shall be those as specified in schedule 'F' apponded to these rules , and to gether with a fee of Rs . 500/ -- (which is non- refundable ) for each stan- dards or divisions applied for .
(3) No such application shall be entertained unless it is duly made in Form 'D ' in Appendix 'C' appended to this rules and the same is accompanied by an undertaking and requisite fees duly paid .
(4) No provate primary school shall be geauted permissin to open higher standards or additional divisions unless it fulfills the requirements prescribed under clauses (4) to ( 11 ) of sub -rule (A) of rule 106 .
(5) The procedure for granting permission to open higher standards and additional divisions shall be the same as prescribed under rule 107 .
3. In the said rules , in Appendix ' C' after Form ' C' the following Form 'D' shall be added .
