No.GHM/98/17/M/NPJ/2788 - VIP- 36 - A.1 .--1 . Whereas sub- section (2) of Section 80 of the Gujarat Municipalities Act , 1963 , (Gujarat Act No. 34 of 1964 ) ( hereinafter referred to as the said Act ) provides for vesting of Government lands in Municipality by way of gift or otherwise.

2. And whereas Government of Gujarat has decided to vest in the Municipalities , now forming part of the former Gujarat Area of the earstwhile Bombay State , all open plots within the Municipal limits existing as on 31st December , 1980 except those which are specifically reserved by Government for its own purpose.

3. NOW, THEREFORE , in pursuance of clause (e) of sub- section ( 2) of Section 80 of the said Act , the Government hereby vests in the Municipality all vacant plots and la ds situated within the limits (existing as on 31st December, 1980) of the said Municipality and belongingto the Government mentinoned in Schedule No. I for local Public purposes except plots and lands described in Schedule No. II appendeed hereto which are reserved by Government .

4. The said vacant plots and lands mentioned in Schedule No. I:-

(a) shall be under the direction, management and control of the said Municipality and hold and app- lied by it as trustee subject to the provi ions and for the purpose of the said Act .

(b) shall belong to said Municipality and be used by it for local public purpose or could be disposed off by it and the proceeds derived from the sale of such plots and lands be utilised by the said Muni- cipality for the purposes of the said Act .

(c) shall be vested subject to the terms and conditions laid down in Governemnt G.R. , R.D. No. NPJ/1082/51343/G-1, dated 22nd April , 1982.

5. In pursuance of sub - section (3) of Section 80 of the said Act , the said plots and lands vested in the seid Municipality shall be resumable by Gover ment if required by it , for any Government or public purpose, without any notice to the said Municipality.

For resuming the land accordingly the Collector will issue order and it will be sufficient and final .

૨. જે પરીક્ષાર્થીઓ પરીક્ષામાં ગેરહાજર રહેલા છે. તેમણે પરીક્ષા આપવાની એક તક ભેગવી લીધી છે તેમ ગણવામાં આવે છે.

૪. ગુણ ચકાસણી માટેદરેક પ્રશ્ન પત્રદીઠરૂ.૩૦/-નીફિ સરકારી તિજોરીમાંઅથવા સબસિડિયરી બેન્કની શાખામાં આવુક સર "૦૦૭૦ અન્ય વહીવટી સેવાઓ ૮૦૦-અન્ય પ્રપ્તિ (૪) ભાષા અને પરીક્ષાફી" હેઠળ જમા કરાવીને અસલ ચલન અરજી સાથે સામેલ કરવાનું હેશે.

BOMBAY PRIMARY EDUCATION ACT, 1947.

No. KH/ SH/23 /NSM- 1298-58 -CH. The following draft of a notification which it is proposed to be issued under section 63 of the Bombay Primary Education Act, 1947 (Bom . LXI of 1947), is published as required by sub-section (3) of the said section 63 for the information offall persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration by the Government of Gujarat on or after the expiry of thirty days from the date of publication of this notification in the Official Gazette.

2. Any objection or suggestion which may be received by the Secretary to the Government of Gujarat, Education Department , Sachivalaya, Gandhinagar from any person with respect to the said draft before the expiry of the aforsaid period will be considered by the Government .

Draft Notification

In exercise of the powers conferred by section 63 of the Bombay Primary Education Act, 1947 (Bom. LXI of 1947 ) , the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules, 1949, namely:-

1. These rules may be called the Bombay Primary Education (Gujarat Amendment ) Rules, 1998.

2. In the Bombay Primary Education Rules, 1949, in schedule F', for condition 5, the following shall be substituted:-

"Closure of school or Reduction in the total number of classes: No management of recognised private primary school shall effect any reduction in the total number of classes in its school or close down the sohool without the prior permission in writing of the Director of Education . For this purpose the managment shall make an application to the Authorised Officer atleast six months before the date from which it intends to reduced the number of classes or close down the school . On receipt of such application, Authorised Offlicer shall hear the management and forward such application with his remarks to the Director of Primary Education . The Director of Primary Education may in such manner as he may deem necessary and shall decide whether the application should be granted or refused either in whole or in part . "
