: મુવાડી જુથ ગ્રામ પંચાયતના ૧બાઈનીમુવાડી ( ૨)માવાની મુવાડી અને (૩) ધાંધવાસણા મહેસુલી ગામે પૈકી ધાંધવાસણા મહેસુલી ગામે સમાવેશ નવીન રચાયેલ તલેદ તાલુકામાંકરવામાં આવતા , આ પ્રાદેશિક ફેરફારના કારણે ધાંધવાસણા ગામને અલગ ગ્રામ પંચાયત આપવાની જરૂરીયાત ઉપસ્થિત થયેલ ધાંધવાસણા ગામને અલગ ગ્રામ પંચાયત આપવા માટે બાઈની મુવાડી જુથ ગ્રામ પંચાયતના વહીવટદારે તારીખ ૨૧મી અક્ટોબર , ૨૦૦૦નારેજઠરાવ કરેલ તાલુકા પંચાયત પ્રાંતિજની તા . ૨૯મી ડિસેમ્બર , ૨૦૦૦ ના રેજ ઠરાવ નં .-૧૦ થી બાઈની મુવાડી જુથ ગ્રામ પંચાયતનું વિભાજન કરીને ધાંધવાસણા ગામને અલગ પંચાયત આપવા ભલાસણદર્શક ઠરાવ કરેલ .
સાબરકાંઠાજિલ્લા પંચાયતની કારેબારી સભાએ તેના તારીખ ૨૮મી સપ્ટેમ્બર , ૨૦૦૧ના ઠરાવ નં . ૧૨૪થી બાઈની મુવાડી જુથ ગામ પંચાયતનું વિભાજન કરવાને ભલામણદર્શક ઠરાવ કરેલ .
બાઈની મુવાડી જુથ ગામ પંચાયતના વિભાજનની દરખાસ્ત જી. વિ. આ . શ્રીની કચેરીમાં પ્રક્રિયા હેઠળ હતી તે દરમ્યાન જે ગામ પંચાયતની મુદત પુરી થઈ ગયેલ હોય તેવી ગ્રામ પંચાયતોની ચૂંટણી યોજવાની પ્રક્રિયા હાથ ધરવામાં આવતાં અને બાઈની મુવાડી જુથ ગ્રામ પંચાયતનું વિભાજન ન થતા આ ગ્રામ પંચાયતનું વિભાજન ન થાય ત્યાં સુધી તેની ચૂંટણી ન કરવા માટે તારીખ ૨૦મી નવૈમ્બર , ૨૦૦૧નારેજ બાઈની મુવાડી ગામના ગામજને એ ચૂંટણી પંચને લેખિત રજૂઆત કરેલ હતી . પરંતુ આ રજુઆત અંગે કેઈ પ્રત્યુત્તર ન મળતાં બાઈની મુવાડી ગામના શ્રી ભુતસિંહ ઉમેદસિંહ_ઝાલા દ્વાર નામ ગુ . હા. માં ખાસ દિવાની અરજી ક્રમાંક ૧૧૦૪૫/૨૦૮૧ દાખલ કરીને બાઈની મુવાડી જુથ ગ્રામ પંચાયતનું વિભાજન કરીને ધાંધવાસણા ગામને અલગ પંચાયત આપવા અને બંને ગ્રામ પંચાયતની ચુંટણી યેજવા માટેની દાદ માંગેલ હતી.
ખાસ દિવાની અરજી ક્રમાંક ૧૧૦૪૫/૨૦૦૧નાસંબંધમાં ના . ગુ. હા . કોર્ટ ચૂંટણી પંચને અને વિ. ક. શ્રીને અરજદારની તારીખ ૨૦મી નવેમ્બર , ૨૦૦૧નીરજુઆત સંબંધમાં હુકમનીકેખી મળ્યાની તારીખથી ૧૫ દિવસમાં વિચારણા કરીને નિયમેનુસારને હુકમ કરવા આદેશ કરેલ હતો .
નામ. ગુજરાત હાઈકોર્ટને ઉકત હુકમ વિકાસ કમિશનરશ્રીને મળતા તેઓએ તેમના તારીખ ૨૪મી નવેમ્બર , ૨૦૦૧ના પત્રથી સદરહુ હુકમ અનેબાઈની મુવાડી જુથ ગ્રામ પંચાયતના વિભાજનની દરખાસ્ત મેકલી આપેલ હતી, પરંતુ તારીખ ૨૩મી ડિસેમ્બર , ૨૦૦૧ છેરેજજાર ગ્રામ પંચાયતની ચુંટણીઓમાં બાઈની મુવાડી જુથ ગ્રામ પંચાયતને સમાવેશ થઈ ગયેલ હતો અને આ સંદર્ભમાં તારીખ ૨૬મી નવેમ્બર , ૨૦૦૧નેત્રેજ સંબંધિત કલેક્ટર દ્વારા જાહેરનામું બહારપાડવામાં આવેલ બાઈની મુવાડી જુથ ગ્રામ પંચાયતની ચુંટણી થઈગઈછેત્યારેસરકારનાતા. ૧૬મી મે, ૨૦૦૧ના પરિપત્રથી નક્કી થયેલ પિલીસી મુજબ નવી ચૂંટાયેલ પંચાયત અસ્તિત્વમાં એવ્યેથી એક વર્ષબાદ વિભાજન થઈ શકે. આ વિભાગના તારીખ ૧૬મી મે, ૨૦૦૧ના પરિપત્રથી નવી ચૂંટણયેલ ગ્રામ પંચાયતનું વિભાજન એક વર્ષબાદ કરવાની નીતિ નામ . ગુ . હા. કેર્ટમાં થયેલ ખાસ દિવાની અરજી ક્રમાંક : ૮૪૬૩/૧૯૯૫માં નામ. કેર્ટ દ્રારા ઓરલ ઓર્ડરમાં કરવામાં આવેલ નિરીક્ષણને ધ્યાને લઈને નક્કી કરવામાં આવેલા જેથી આ સંજોગેમાં બાઈની મુવાડી જુથ ગ્રામ પંચાયતનીચુંટણી તારીખ ૨૬મીડીસેમ્બર , ૨૦૦૧ નેયેજાઈ ગયેલ હેવાથી સરકારના તારીખ ૧૬મી મે, ૨૦૦૧ના પરિપત્રની સૂચના મુજબ બાઈની મુવાડી જુથ ગ્રામ પંચાયતનું વિભાજન એક વર્ષ બાદ કરી શકાય તેમ છે. બાઈની મુવાડી જુથ ગ્રામ પંચાયતનું વિભાજન આ જ પંચાયતની પ્રથમ સભાના એક વર્ષ બાદ કરવાને આથી નિર્ણય કરવામાં આવે છે. એ અંગેની નિયત નમૂનામાં ધારાધોરણ મુજબની અધિસૂચનાક્રમાંક : કેપી- ૨૪-એફ-૨૦૦૨-વભન-૨૦૦૧-૨૮૯૯-આઈસી- ૧૧-ચ તારીખ ૧૬મી ફેબ્રુઆરી ૨૦૦૨થી બહાર પાડેલ છે જે આ હુકમના પરિશિષ્ટ ૧ , તરીકે આ સાથે સામેલ છે. આ અધિસૂચનાને અમલ તેમાં જણાવ્યા પ્રમાણે બાઈની મુવાડી જુથ ગ્રામ પંચાયતની પ્રથમ સભા મળેથી એક વર્ષ પછી તરત જઅમલમાં આવશે.

BOMBAY PRIMARY EDUCATION ACT, 1947 .
No.KSH- 31 - KHPS - 1099 /143 - CH. - WHEREAS , the draft rules further to amend the Bombay Primary Education Rules , 1949 were published as required by sub - section (3 ) ofsection 63 of the Bombay Primary Education Act, 1947 (Bom . LXI of 1947) at pages 32-33 of the Gujarat Government Gazette , Part- I-ACentral Section , dated the 13th Sept.2001 under the Government Notification ,Education DepartmentNo.K/ SH/ 16/KHPSH/ 1099/ 1340 - CH, dated the 1st Sept. 2001 for inviting objections and suggestions from all persons likely to be affected thereby within thirty days from the date of Publication in the Official Gazette;
"AND WHEREAS , on objections or suggestions have been received from the public on the said draft notification by the Government ;
"NOW, THEREFORE , in exercise of the powers conferred by section 63 of the Bombay Primary Education Act , 1947 (Bom . LXI of 1947) , the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules , 1949 , namely : -
1. These rules may be called the Bombay Primary Education (Gujarat Amendment ) Rules , 2002 .
In the Bombay Primary Education Rules , 1949 , in SCHEDULE -F, for the condition 5, the following shall be substituted , namely :- 2.
" 5 Closure of school or reduction in the total number of classes: - No management ofrecognised private primary school shall reduce the total number of classes in its school or close down the school without the prior permission in writing of the Director ofPrimary Education , State of Gujarat. For this purpose the management shall have to make an application to the authorised Officer atleast six months before the date from which it intends to reduce the number of classes or close down the school . On receipt of such application , the authorised Officer shall hear the management and forward such application with his remarks to the Director

No. K/SH/34/PRE - 1101 / 2660/K :-The following draft notification which is proposed to be issued under sub- section ( 1 ) of section 63 of the Bombay Primary Education Act, 1947 ( Bom . LXI of 1947 ) , is published as required by sub - section (3 ) of the said section 63 for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration by the Government of Gujarat on or after the expiry of thirty days from the date of publication of this notification in the official Gazette.
2. Any objection or suggestion which may be recieved by the Secretary to Government , Education Department, Sachivalaya , Gandhinagar from any person with respect to the said draft notification before the expiry of the aforesaid period will be considered by the Government .
Draft-Notification
No. K/SH/ 34/PRE - 1101 / 2660/K:-In exercise of the powers conferred by sub - section ( 1 ) of section 63 ofthe Bombay Primary Education Act , 1947 ( Bom. LXI of 1947 ) , the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules , 1949, namely:-
1. These rules may be called the Bombay Primary Education (Gujarat Amendment ) Rules , 2002 .
2.In the Bombay Primary Education Rules , 1949 , (hereinafter referred to as "the said rules ") rule 41 shall be deleted .

ક્રમાંકઃ ક/એસએચ/૩૪-પીઆરઈ/૧૧૦૧-૨૬૬૦-કમુંબઈ પ્રાથમિક શિક્ષણ અધિનિયમ , ૧૯૪૭ (સને ૧૯૪૭ના 'મુંબઈના ૬૧માં) ની કલમ ૬૩નીપેટા-કલમ (૧) હેઠળ કાઢવા ધારેલો જાહેરનામાનો નીચેનો મુસદો સદરહુ કલમ ૬૩ની પેટા કલમ ( ૩)થી ઠરાવ્યા પ્રમાણે તેનાથી અસર થવાનો સંભવ હોય તેવી તમામ વ્યક્તિઓની જાણ સારૂ પ્રસિદ્ધ કરવામાં આવે છે અને આથી નોટીસ આપવામાં આવે છે કે આ જાહેરનામું રાજ્ય પત્રમાં પ્રસિદ્ધ થયાની તારીખથી ત્રીસ દિવસ પુરા થયે અથવા તે પછી , ગુજરાત સરકાર, સદરહુ મુસદો વિચારણામાં લેશે .
૨. ઉપર્યુક્ત મુદત પૂરી થાય તે પહેલા,સદરહુ જાહેરનામાના મુસદાના સંબંધમાં કોઈપણ વ્યકિત તરફથી સરકારના સચિવ, શિક્ષણ વિભાગ, સચિવાલય, ગાંધીનગર-ને જે કોઈ વાંધા અથવા સૂચનો મળશે તે સરકાર વિચારણામાં લેશે .

ક્રમાંક : ક/એસએચ/૩૪ -પીઆરઈ-૧૧૦૧-૨૬૬૦ -કઃમુંબઈ પ્રાથમિક શિક્ષણ અધિનિયમ , ૧૯૪૭ (સને ૧૯૪૭ ના મુંબઈના ૬૧માં)ની કલમ ૬૩ની પેટા-કલમ (૧ )થી મળેલી સત્તાની રૂએ , ગુજરાત સરકાર, આથી , મુંબઈ પ્રાથમિક શિક્ષણ નિત્ય , ૧૯૪૯ વધુ સુધારવા નીચેના નિયમો કરે છે?-
૧. આ નિયમો મુંબઈ પ્રાથમિક શિક્ષણ નિયમો (ગુજરાત સુધારો ) નિયમો -૨૦૦૨ કહેવાશે. -
૨. મુંબઈ પ્રાથમિક શિક્ષણ નિયમો, ૧૯૪૯ (જેનો આમાં હવે પછી "સદરહુ નિયમો " તરીકે ઉલ્લેખ કર્યો છે તે) માં નિયમ-૪૧ કમી કરવો .
૩. સદરહુ નિયમોમાં, નિયમ-૬૩માં, પેટા-નિયમ (૨ )માં,ખંડ (ધ ) કમી કરવો .
ગુજરાતના રાજ્યપાલશ્રીના હુકમથી અને તેમના નામે ,

ક્રમાંકઃકેએસએચ-૩૧-કેએચપીએસ -૧૦૯૯-૧૪૩–ચ –મુંબઈ પ્રાથમિક શિક્ષણ અધિનિયમ, ૧૯૪૭ (સને.૧૯૪૭ના મુંબઈના ૬૧ મા)ની કલમ ૬૩નીપેટા-કલમ ( ૩)થી ફરમાવ્યા પ્રમાણે મુંબઈ પ્રાથમિક શિક્ષણ નિયમો, ૧૯૪૯ વધુ સુધારતા નિયમોનો મુસદો શિક્ષણ વિભાગના તારીખ ૧લી સપ્ટેમ્બર ,૨૦૦૧ના સરકારી જાહેરનામા ક્રમાંક/ક-એસએચ-૧૬-કેએચપીએસએચ-૧૦૯૯-૧૩૪૦- ચ હેઠળ તારીખ ૧૩મી સપ્ટેમ્બર , ૨૦૦૧ના ગુજરાત સરકારી રાજપત્ર ભાગ-૧ એ, સેન્ટ્રલ સેકશનના પાના નંબર ૩૨-૩૩ ઉપર પ્રસિદ્ધ કર્યો હતો અને તેનાથી અસર થવાનો સંભવ હોય તે તમામ વ્યક્તિઓ તરફથી, તેની રાજપત્રમાં પ્રસિદ્ધની તારીખથી ત્રીસ "દિવસ અંદરવિશ્વઅનેસૂચનમંગાવવામાંઆવ્યાહતા;
અને સદરહુ જાહેરનામાના મુસદા અંગે , સરકારને લોકો તરફથી કોઈ વાંધા અથવા સૂચનો મળ્યા નથી;
તેથી, હવે મુંબઈ પ્રાથમિક શિક્ષણ અધિનિયમ, ૧૯૪૭ (સને ૧૯૪૭ના મુંબઈના ૬૧ મા)ની કલમ ૬૩થી મળેલી સત્તાની રૂએ, ગુજરાત સરકાર, આથી મુંબઈપ્રાથમિક શિક્ષણ નિયમો, ૧૯૪૯ વધુસુધારવા નીચેના નિયમો કરે છે — .
૧. આ નિયમો, મુંબઈ પ્રાથમિક શિક્ષણ (ગુજરાત સુધારા) નિયમો, ૨૦૦૨ કહેવાશે.
૨. મુંબઈ પ્રાથમિક શિક્ષણ નિયમો, ૧૯૪૯માં, અનુસૂચિ-છમાં શરત નં. પને બદલે નીચેનો મજકૂર મૂકવો –
"પ.શાળા બંધકરવા અથવા વર્ગોની કુલ સંખ્યા ઘટાડવા બાબત-
કોઈપણ માન્ય ખાનગીપ્રાથમિક શાળાનુંસંચાલક મંડળ, પ્રાથમિક શિક્ષણ નિયામક, ગુજરાત રાજ્યની લેખિત પૂર્વ પરવાનગી સિવાય, તેની શાળાના વર્ગોનીકુલ સંખ્યા ઘટાડી શકશે નહિ અથવા શાળા બંધ કરી શકશે નહિ. આ હેતુ માટે, સંચાલક મંડળે જે તારીખથી વર્ગોની સંખ્યા ઘટાડવાનો અથવા શાળા બંધ કરવાનો ઈરાદો ધરાવ્યો હોય તે તારીખથી ઓછામાં ઓછા છ મહિના I-A- 16

પહેલાં અધિકૃત અધિકારીને અરજી કરવી જોઈશે. એવી અરજી મળ્યે, અધિકૃત અધિકારી સંચાલક મંડળને સાંભળશે અને એવી અરજી પોતાની ટીકાટિપ્પણ સાથે પ્રાથમિક શિક્ષણ નિયામક, ગુજરાત રાજ્યને મોકલી આપશે. પ્રાથમિક શિક્ષણ નિયામક, ગુજરાત રાજ્ય તેમને જરૂરી લાગે તેવી રીતે, જરૂરી જણાય તેવી વધુ તપાસ કરીને અરજી પૂર્ણતઃ અથવા અંશતઃ મંજૂર કરવી અથવા નકારવી તેનો નિર્ણય કરશે."
