BOMBAY PRIMARY EDUCATION ACT, 1947.
No.K/ SH/5 /PRE - 1101 / 2660/K : - WHEREAS certain draft rules further to amend the Bombay. Primary Education Rules , 1949 were published as required by sub section (3 ) of section 63 of the Bombay Primary Education Act, 1947 (Bom . LXI of 1947) , at pages 21 to 22 ofthe Gujarat Government Gazette, Part - I -A Central Section , dated the 26th September 2002 under the Government Notification, Education Department , No.K/SH/34/PRE - 1101 / 2660K, dated the 16th September, 2002, inviting objections and suggestions from all persons likely to be affected thereby within thirty days from the date ofpublication of the said notification in the Official Gazette.
AND WHEREAS , no objections or suggestions have been received from the public on the aforesaid draft notification;
NOW, THEREFORE in exercise of the powers conferred by sub - section ( 1 ) of section 63 of the Bombay Primary Education Act, 1947 (Bom.LXI of 1947) , the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules, 1949, namely :-
1. These rules may be called the Bombay Primary Education (Gujarat Amendment) Rules, 2003.

No.KP/21 OF 2003/GNP- 2003-394- B : - In pursuance of the provisions of the Article 243 ( I ) , 243 (Y) read with Section 226 ofthe Gujarat Panchayats Act 1993 , the Governor is pleased to constitute Second State Finance Commission consisting of Shri Dhirubhai Shah as the Chairman . He will hold office for a period of two years as the Chairman .
2 . Other members of the Second State Finance Commision will be appointed hereafter.
3. The detailed Terms and Conditions of the Chairman of the Commission shall be issued separately.
4. The Commission shall review the financial position of the Panchayats (including District Panchayats , Taluka Panchayats and Village Panchayats) and the Municipalities (including Municipal Corporations and Municipal Boroughs ) and shall make recommendations as to the following :
(a) The principles which should govern-
(i) the distribution between the State and the Panchayats and Municipalities of net proceeds of the taxes , duties , tolls and fees leviable by the State , which may be divided between them under the Part IX and IX (A) of the Constitution and the allocation between the Panchayats and Municipalities at all levels of their respective shares of such proceeds;
(ii) the determination of taxes , duties , tolls and fees which may be assigned to , or appropriated by, the Panchayats or the Municipalities , as the case may be;

[PART I - A (iii) the grants - in - aidto the Panchayats and Municipalities from the Consolidated Fund of the State;
(b) The measures needed to improve the financial position of the Panchayats and the Municipalities.
5. The Commission shall review the State of finances of the State Government , the Panchayats and the Municipalities and suggest the plan by which the state Government and the Panchayats and Municipalities collectively and severally may bring about speedy and equitable growth along with high quality of public services .
6. to- In making its recommendations , the Commission shall have regard , among other considerations
(i) the resources, of the State Government for five years commencing on 1st ofApril 2005, on the basis of levels of taxation and non - tax revenues likely to be reached at the end of 2003- 04;
(ii) the demands on the resources of the State Government , in particular, on account of expenditure on Civil Administration, Police and Security, Public works, General , Social and Economic services , debt servicing and other committed expenditure and liabilities;
(iii) the resources of the Panchayats and Municipalities , for the five years commencing on 1st April 2005, on the basis of levels of taxation and non -tax revenues likely to be reached at end of2003-04;
(iv) the objective of not only balancing the receipts and expenditures of the Panchayats and Municipalities , but also generating surpluses for capital investment ;
(v) taxation and non and non tax efforts of the Panchayats and Municipalities as against targets, if any, and the potential for additional resources mobilization in order to improve the per capita own tax and non - tax revenue ;
(vi) the need for ensuring the commercial viability of the drinking water supply system , drainage system , sanitation, street lighting as well as other commercial operations like public transport etc. through various means including adjustment of user charges , reduction ofcost of public services through privatization and relinquishing of non - priority unviable areas ;
7. Inmaking its recommendations , the Commission shall-
(i) adopt a normative approach in assessing the receipt and expenditure of the Panchayats andMunicipalities and, in doing so, keep in view the special problems of a few Panchayats and Municipalities with regard too their geographical location;
(ii) have due regard to the need for providing adequate incentives for better resource mobilization , financial discipline and cost effective provision of high quality public services;
(iii) take into the account the need for speed, efficiency and effectiveness of the delivery system for Government programmes ;

(iv) after making an assessment of the debt position of the Panchayats and Municipalities , as on 31st March 2004 , suggest such corrective measures as are deemed necessary, consistent with the debt sustainability;
(v) review the reforms facility introduced by the State Government on the basis of the First State Finance Commission and suggest measures for effective achievements of its objectives ;
(vi) suggest such measures as will enhance the absorption capacity and credit worthiness of Panchayats and Municipalities.
(vii) suggest such measures so as to fully utilize the process of Information Technology to augment the resources of Panchayat .
(viii) take the base of population figures as of 2001 , if available , or else 1991 , in all such cases where population is a factor for determination of devolution of taxes , duties , tolls and fees and grants - in-aid.
8. The Commission shall indicate the basis on which it has arrived at its findings and make available the Panchayat and Municipality wise estimates of receipts and expenditure.
9. The Commission shall make its report available by the 15th October , 2005 , covering a period of five years commencing on the 1st April 2005.
