No.K/SH/ 1 /PRE - 112000/632 - K : - In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Gujarat hereby makes the following rules further to amend the Assistant Educational Inspector Class - III in the Subordinate service of the Directorate of Primary Education, recruitment Rules , 2004 namely : -
1. These rules maybe called the Assistant Educational Inspector Class - III Recruitment ( Amendment) Rules , 2004 .
2. In theAssistant Educational Inspector Class - III Recruitment Rules - 2004 ( hereinafter referred to as "the said rules " ) in rule 2( a) after the words " primary teachers " the following words shall be inserted, namely: -
" and who has passed the qualifying examination for computer knowledge as may be prescribed by the Government from time to time . "

3. The said rules , after rule 3 (b) ( ii) , the following clause shall be inserted, namely :-
"( iii ) possess the basic knowledge of computer application equivalent to Courses on Computer Concepts (CCC) of Department of Electronic (DOEACC) society or of the level as may be prescribed by the Government from time to time . "
4. The said requirement shall come into force from 1st July, 2005 .

નં.પી-૨૦૦૩નો ૨૧મો- જીએનપી-૨૦૦૦-૩૯૪ -બ .- ગુજરાત પંચાયત અધિનિયમ, ૧૯૯૩ની કલમ-૨૨૬ તથા બંધારણની કલમ-૨૪૩ (આઈ, ૨૪૩ (વાય) અન્વયે મળેલી સત્તાની રૂએ નામદાર રાજ્યપાલશ્રી, આથી શ્રી ધીરૂભાઈ શાહના અધ્યક્ષપદે દ્વિતીય રાજ્ય નાણા પંચની રચના કરે છે . અધ્યક્ષના હોદાની મુદત બે વર્ષની રહેશે.
२ . દ્વિતીય રાજ્ય નાણા પંચના અન્ય સભ્યોની નિમણૂંક હવે પછી કરવામાં આવશે.
3 . પંચના અધ્યક્ષ સંબંધી વિગતવાર શરતો અલગથી બહાર પાડવામાં આવશે.
४ . પંચ, પંચાયતો (જિલ્લા પંચાયતો , તાલુકા પંચાયતો અને ગ્રામ પંચાયતો સહિત) તથા નગરપાલિકાઓ (મહાનગર પાલિકાઓ અને નગરપાલિકા બરો સહિત ) ની આર્થિક સ્થિતિની સમીક્ષા કરશે અને નીચેની બાબતો અંગે ભલામણો કરશે :-
(ક) નીચેની બાબતો અંગેના સિધ્ધાંતો
(৭ ) રાજ્ય દ્વારા વસૂલાતપાત્ર કરવેરા, શુલ્ક , માર્ગ-કર અને ફીની ચોખ્ખી આવકની, સંવિધાનના ભાગ-૯ અને ૯ (ક) હેઠળ રાજ્ય અને પંચાયતો તથા નગરપાલિકાઓ વચ્ચે વહેંચણી તથા આવી આવકમાં પંચાયતો અને નગરપાલિકાઓને મળવાપાત્ર હિસ્સાની, તમામ સ્તરે ફાળવણી;
(२) યથા પ્રસંગ , પંચાયતો કે નગરપાલિકાઓને નિર્ધારિત અથવા તેમના હસ્તક રાખવાપાત્ર કરવેરા, શુલ્ક, માર્ગકર અને ફી નિયત કરવા ;

(3) રાજ્યના એકત્રિત નિધિમાંથી પંચાયતો અને નગરપાલિકાઓને સહાયક અનુદાન ;
(ખ) પંચાયતો અને નગરપાલિકાઓની નાણાકીય સ્થિતિ સુધારવા અંગેના જરૂરી પગલાં,
५. પંચ, રાજ્ય સરકાર, પંચાયતો અને નગરપાલિકાઓની નાણાંકીય સ્થિતિની સમીક્ષા કરશે અને રાજ્ય સરકાર પંચાયતો નગરપાલિકાઓની અલગ-અલગ અને સંયુક્ત રીતે ઉચ્ચ ગુણવત્તાસભર જાહેર સેવાઓ પુરી પાડવા સહિત ઝડપી અને સમાન વિકાસ કેવી રીતે હાંસલ કરી શકે તે અંગેના સૂચનો કરશે .
ξ. ભલામણો કરતી વખતે પંચ અન્ય બાબતો ઉપરાંત નીચે દર્શાવેલી બાબતોને પણ ધ્યાનમાં લેશે ઃ '
(૧) વર્ષ ૨૦૦૩-૦૪ ના અંતે થનાર કરવેરા અને કર સિવાયની સંભવિત આવકના આધારે, ૧ લી એપ્રિલ, ૨૦૦૫ ના રોજથી શરૂ થતા પાંચ વર્ષના સમયગાળા માટેના રાજ્ય સરકારના નાણાંકીય સાધનો,
(२ ) ખાસ કરીને મુલ્કી વહીવટ, પોલીસ અને સલામતી, જાહેર બાંધકામ તથા સામાન્ય, સામાજિક અને આર્થિક સેવાઓ, દેવા-સેવા અને અન્ય સ્વીકૃત ખર્ચ અને જવાબદારીઓ અંગેના ખર્ચને કારણે રાજ્ય સરકારનાં નાણાકીય સાધનો પર પડનારો બોજો;
( ૩) વર્ષ ૨૦૦૩-૦૪ના અંતે થનાર કરવેરા અને કર સિવાયની સંભવિત આવકના આધારે ૧લી એપ્રિલ , ૨૦૦૫ના રોજથી શરૂ થતા પાંચ વર્ષના સમયગાળા માટે પંચાયતો અને નગરપાલિકાઓના નાણાકીય સાધનો ;
(૪) પંચાયતો અને નગરપાલિકાઓના આવક અને ખર્ચનું કેવળ સંતુલન જાળવવાનો જ નહીં, પરંતુ મૂડીરોકાણ માટે વધારાનાં નાણા ઉભાં કરવાનો પણ ઉદેશ :
( ૫) કરવેરા અને કરવેરા સિવાયની આવક ઉભી કરવા માટે પંચાયતો અને નગરપાલિકાઓ માટે કોઈ લક્ષ્યાંકો નિર્ધારિત કર્યા હોય તો તે હાંસલ કરવા માટે થયેલ પ્રયત્નો અને કરવેરા તથા કર સિવાયની માથાદીઠ આવકમાં વધારો થઈ શકે તે માટે વધારાનાં નાણાંકીય સાધનો ઉભા કરવાની સંભાવના;
(5) વપરાશ ખર્ચનું સમાયોજન , ખાનગીકરણ મારફત જાહેર સેવાઓ પરના ખર્ચમાં ઘટાડો અને અગ્રતા ન ધરાવતા બિન નભાઉક્ષમ ક્ષેત્રોને તિલાંજલી આપવા સહિતનાં વિવિધ ઉપાયો દ્વારા પીવાનું પાણી પુરું પાડવાની પધ્ધતિ, ગટર વ્યવસ્થા પધ્ધતિ, સ્વચ્છતા, શેરીની દિવાબત્તી વ્યવસ્થા તેમજ જાહેર પરિવહન વગેરે જેવી અન્ય વાણિજિયક કામગીરીઓની વાણિજિયક નભાઉક્ષમતા સુનિશ્ચિત કરવાની જરૂરિયાત ;
৩. ભલામણો કરતી વખતે પંચ :
(૧) " પંચાયતો અને નગરપાલિકાઓના આવક અને ખર્ચની આકારણી કરવામાંધોરણસરનો અભિગમ અપનાવશે અને આમ કરતી વખતે પંચ, ચોક્કસ પંચાયતો અને નગરપાલિકાઓના ભૌગોલિક સ્થાનના સંદર્ભમાં તેમની ખાસ સમસ્યાઓને લક્ષમાં રાખશે;
(૨) વધુ સંસાધનો ઉભાં કરવાં, નાણાકીય-શિસ્ત જાળવવા તથા ઉચ્ચ કક્ષાની સેવાઓ કિફાયતી કિંમતે પૂરી પાડવાને પ્રોસ્તાહિત કરવાના હેતુસર પૂરતાં પ્રોત્સાહન પૂરાં પાડવા બાબતે યોગ્ય લક્ષ આપશે ;

( ૩) સરકારી કાર્યક્રમો ઝડપી, કાર્યક્ષમ અને અસરકારક રીતે લાગુ પાડવા માટેની જરૂરિયાતને ધ્યાનમાં રાખશે;
(૪) ૩૧ મી માર્ચ, ૨૦૦૪ના રોજ પંચાયતો અને નગરપાલિકાઓના દેવા-સંબંધી સ્થિતિની આકારણી કર્યા બાદ, દેવાં- વહનક્ષમતાને સુસંગત અને જરૂરી ભરવાપાત્ર સુધારાત્મક પગલાં સૂચવશે;
(५ ) પ્રથમ રાજ્ય નાણા પંચની ભલામણ મુજબ સુધારાઓ અંગે રાજ્ય સરકારે દાખલકરેલી સવલતનીસમીક્ષા કરશે અને તેના ઉદેશો અસરકારક રીતે હાંસલ કરવા માટેના ઉપાયો સૂચવશે ;
(૬ ) પંચાયતો અને નગરપાલિકાઓનીસમાવેશ-ક્ષમતા અને ધિરાણપાત્રતામાં વૃધ્ધિ થાય એવા ઉપાયો સૂચવશે;
(૭) પંચાયતોનાં સંસાધનોમાં વધારો કરવા માટે માહિતી પ્રૌધોગિકીનો સંપૂર્ણપણે ઉપયોગ કરી શકાય, એવા ઉપાયો સૂચવશે;
(૮) કરવેરા , શુલ્ક , માર્ગ -કર અને ફી તથા સહાયક અનુદાનની સોંપણી નિયત કરવા , એક પરિબળ વસતિ હોય, તેવા તમામ કિસ્સામાં વર્ષ ૨૦૦૧ના વસતિ આંકડા પ્રાપ્ત હોય તો તેનો અન્યથા વર્ષ ૧૯૯૧ના વસતિ આંકડાનો આધાર લેશે ;
८ . પંચ જેના આધારે નિષ્કર્ષ પર આવ્યું હોય તે આધાર દર્શાવશે અને પંચાયત અને નગરપાલિકાવાર આવક તેમજ ખર્ચના અંદાજ ઉપલભ્ય બનાવશે;
: ८ . પંચ, ૧ લી એપ્રિલ , ૨૦૦૫ના રોજથી શરૂ કરીને પાંચ વર્ષના સમયગાળા માટેનો અહેવાલ ૧૫મી ઓકટોબર , ૨૦૦૫ સુધીમાં રજૂ કરશે;
ગુજરાતના રાજ્યપાલશ્રીના હુકમથી અને તેમના નામે;
પી.કે. લહેરી , સરકારના મુખ્ય સચિવ .

LXI of 1947) is published as required by sub -section (3) ofthe said section 63 for the information ofall persons likely to bettin affected thereby and notice is hereby given that the said draft will be taken into consideration by the Governmentneri ofGujarat on or after the expiry of thirty days from the date ofpublication of this notification in the Official Gazette.

"5. Closure of school or reduction in the total number of classes : - No Management of recognised private primary school shall reduce the total number of classes in its school or close down the school without the prior permission in writing ofthe Authorised Officer. for this purpose the management shall have to make anapplicationto theAuthorised Officer at least six months before the date from which it intends to reduce the number ofclasses or close down the school . On receipt of such application, the Authorised Officer may in such manner as may be deemed necessary, make such inquiry as it may appear to be necessary and shall decide whether the application shall be granted or refused either in whole or in part . "

ક્રમાંકઃ કેએસએચ/૨/કેએચપીએસએચ/૧૦૦૪/ ૧૪૨૧-ચઃ- મુંબઈપ્રાથમિક શિક્ષણ અધિનિયમ, ૧૯૪૭ (સન ૧૯૪૭ ના મુંબઈના ૬૧ મા)ની કલમ ૬૩ની પેટાકલમ (૧ ) હેઠળ કાઢવા ધારેલા જાહેરનામાનૌ નીચેનો મુસદો , સદરહું કલમ ૬૩ની પેટા-કલમ ( ૩)થી વ્યિ પ્રમાણે તેનાથીઅસર થવાનો સંભવ હોય તેવી તમામ વ્યક્તિઓની જાણ સારૂ પ્રસિધ્ધ કરવામાં આવે છે અને આથી નોટિસ આપવામાં આવે છે કે આ જાહેરનામું રાજપત્રમાં પ્રસિધ્ધ થયાની તારીખથી ત્રીસ દિવસ પૂરા થયે અથવા તે પછી, ગુજરાત સરકાર , સદરહું મુસદો વિચારણામાંલેશે.
૨. ઉપર્યુકત મુદત પૂરી થયે અથવા તે પહેલા જાહેરનામાના સદરહું મુસદ્દાના સંબંધમાં , સરકારના અગ્ર સચિવ , શિક્ષણ વિભાગ, "સચિવાલય, ગાંધીનગરને કોઈ પૈણ વ્યકિત તરફથી જે કોઈ વાંધા અથવા સૂચન મળશે તેને સરકાર વિચારણામાં લેશે.

ક્રમાંકઃકેએસએચ/૨/કેએચપીએસએચ/૧૦૦૪/ ૧૪૨૧- ચઃ- મુંબઈપ્રાથમિક શિક્ષણ અધિનિયમ , ૧૯૪૭ (સન ૧૯૪૭ના મુંબઈના ૬૧ મા)ની કલમ ૬૩થી મળેલી સત્તાની રૂએ , ગુજરાત સરકાર આથી, મુંબઈ પ્રાથમિક શિક્ષણ નિયમો, ૧૯૪૯ વધુ સુધારવા નીચેના નિયમો કરે છે?:-
૧. આ નિયમો "મુંબઈ પ્રાથમિક શિક્ષણ (ગુજરાત સુધારા) નિયમો , ૨૦૦૫ " કહેવાશે .
૨. મુંબઈ પ્રાથમિક શિક્ષણ નિયમો, ૧૯૪૯માં, અનુસૂચિ -છમાં, શરત ૫ ને બદલે , નીચેનો મજકૂર મૂકવો-
પેશાળા બંધ કરવા અથવા વર્ગોની કુલ સંખ્યા ઘટાડવા બાબુત- કોઈપણ માન્ય ખાનગી પ્રાથમિક શાળાનુંસંચાલકકમંડળ અધિકૃતઆ અધિકારીની લેખિતમાં પૂર્વમંજૂરી મેળવ્યા સિવાય પોતાની શાળાના વર્ગોની કુલ સંખ્યામાં ઘટાડો કરી શકશે નહિ અથવા શાળા બંધ કરી શકશે નહિ. આ હેતુ માટે, સંચાલક મંડળે , પોતે જે તારીખથી વર્ગોનુંસંખ્યા ઘટાડવા અથવા શાળા બંધ કરવા ધારતું હોય તે તારીખથી ઓછામાં ઓછા છ મહિના પહેલા અધિકૃત અધિકારીને અરજી કરવાની રહેશે. આવી અરજી મળ્યે , અધિકૃત અધિકારી, પોતે જરૂરી ગણે તે રીતે, પોતાને જરૂરી લાગે તેવી તપાસ કરી શકશે અને અરજીને પૂર્ણતઃ અથવા અંશતઃ મંજૂર કરવાનો અથવા નામંજૂર કરવાનો નિર્ણય કરશે .

No. KSH/8 /KHPSH/ 102002 / 88 /CH :-The following draft of a notification which it is proposed to be issued under section 63 of the Bombay Primary Education Act, 1947 (Bom. LXI . of 1947) , is published as required by sub - section (3) of the said section 63 for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration by the Government of Gujarat on or after the expiry of thirty days from the date of publication of this notification in the Official Gazette .
2. Any objection or suggestion which may be received by the Principal Secretary to the Government of Gujarat , Education Department , Sachivalaya. Gandhinagar from any person with respect to the said draft on or before expiry of the aforesaid period will be considered by the Government .

No. KSH/ 8 / KHPSH / 102002 /88 /CH : In exercise of the powers coferred by section 63 of the Bombay Primary Education Act , 1947 ( Bom . LXI. of 1947) , the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules , 1949, namely:

No. KP/20 of 2005/PRN /2001 / 3169/J. - WHEREAS the certain draft rules further amending the Gujarat Village Panchayats Social Justice Committee ( Constitution and Functions) Rules , 1995 were published as required by sub - section (5) of section 274 , read with sub - section (3 ) of section 92 of the Gujarat Panchayats Act , 1993 ( Guj . 18 of 1993 ) , at pages 51-52 of Gujarat Government Gazette , Part I- A dated 14th December, 2004, under the Government Notification , Panchayats , Rural Housing and Rural Development Department No. KP/ 27 of 2004 -PRN - 2001-3169 -J, dated the 14th December , 2004, inviting objections and suggestions from all persons likely to be effected thereby of within thirty days from the date of publication of the aforesaid notification in the Official Gazette .
AND WHEREAS no objections and suggestions were received with respect to the said draft rules on or before the expiry of the aforesaid period by the Government.
NOW, THEREFORE , in exercise of the powers conferred by sub - section ( 1 ) of Section 274 , read with sub -section (3) of section 92 of the Gujarat Panchayat Act, 1993 (Guj . 18 of 1993) , the Government of Gujarat hereby makes the following rules further to amend the Gujarat Village Panchayats Social Justice Committee(Constitution and Functions) Rules , 1995 , namely: -
1. These rules may be called the Gujarat Village Panchayats Social Justice Committee ( Constitution and Functions) (Amendment) Rules, 2005,

No. KP/ 24 of 2005 / GNP/2000 / 394/B : - WHEREAS in pursuance of the Provisions of Articles 243 - I and 243 - Y of the Constitution of India and as per the provision of Section 226 of the Gujarat Panchayats Act , 1993 (Gujarat Act No. 18 of 1993), the Government of Gujarat constituted the Gujarat Finance Commission videGovernment Notification , Panchayats, Rural Housing and Rural Development Department No. KP/21 of2003/GNP - 2000-394- B , dated the 19th November, 2003 to review the financial position of the Panchayats andMunicipalities and to make recommendations in this regards ;
AND WHEREAS , the term of the Finance Commission is for a period of 2 Years .
AND WHEREAS . the functions of the Finance Commission are yet to be finished and the Finance Commission has to submit its report to Government ;
AND WHEREAS . the Gujarat Finance Commission has submitted the proposal to extend the terms ofthe Finance Commission for a further period upto the 18th November, 2006 .
AND WHEREAS . the Governor of Gujarat is satisfied that it is necessary to extend the period of the Gujarat Finance Commission upto the 18th November , 2006 .
NOW, THEREFORE, in pursuance of the provisions of Articles 243-1 and 243 -Y of the Constitution of India and in exercise of the powers conferred by Section 226 of the Gujarat Panchayats Act , 1993 ; the Governor ofGujarat hereby -

BOMBAY PRIMARY EDUCATION ACT, 1947 .
NO.K/ SH/ 14 / KHPS - 1004-117 -CH : - The following draft of a notification which is proposed to be issued under section 63 of the Bombay Primary Education Act , 1947 (Bom.LXI of 1947) , is published as required by sub -section (3 ) of the said section 63 for the information of all persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration by the Government of Gujarat on or after the expiry of thirty days from the date of publication of this notification in the Official Gazette.
2. Any objection or suggestion which may be received by the Secretary to the Government of Gujarat (Primary Education) Education Department , Sachivalaya , Gandhinagar from any person with respect to the said draft on or before expiry of the aforesaid period will be considered by the Government .
DRAFT NOTIFICATION
NO.K/ SH - 14/ KHPS - 1004-117 - CH : - In exercise of the powers conferred by sub-section 63 oftheBombay Primary Education Act, 1947 (Bom.LXI of 1947 ) , the Government of Gujarat hereby makes the following rules further to amend the Bombay Primary Education Rules , 1949 namely: --
1. These rules may be called the Bombay Primary Education (Gujarat Amendment) Rules , 2005.
2. Inthe Bombay Primary Education Rules , 1949 in rule 106, in sub- rule (A) , in clause (4) , after sub - clause (XV) , the following shall be inserted , namely : -
"(XVI ) A person, who is discharging his duties on academic or non - academic post in any Private Primary School recognized under section 40A of the Act, shall not remain as trustee in his own trust or any other trust registered under the Bombay Public Trust Act , 1950 or under the Societies Registration Act, 1860, for the purpose of imparting Primary Education .
